hi, im new to this forum and i would be grateful for some help and advice.

 

I have recently received a letter from Lowell financial. They say they have tried to contact me on numerous occassions, and that i owe xxx amount to them. They also say my account is with the pre-litigation department and have asked me to make an offer of settlement to them or arrange a monthly payment plan, otherwise they will pass onto Hamptons legal.

Im not realy sure what the money owed is for.

 

I would be grateful for some advice

I am unable to advise you, someone will be along who knows more than

i know.

 

Whatever you do DO NOT call these people or talk to them on phone.

 

Do you recall any debt you have with anyone?

Hi these letters are all attempts to get you to ring them where they will try to browbeat you into making a payment with threats of the earth will fall on you we will take your house and car even your kids. Before they can do anything against you they will have to give you full detail of who the debt is for etc.

 

As for Lowell, Hamptons Legal they are the same thing and most of the time a load of hot air.

You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

 

I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

 

I am/we are familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

 

I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

 

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

For your information Hampton Legal are just Lowell by another name. They send out the same nonsense on different notepaper. Its just another desk in the Leeds Threat Centre. I think its the one beside the fire exit. They use the amusing Legal title to make you think they are solicitors and that Lowells have escalated things when in actual fact they are not solicitors
