      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Will they take it back as i have all optional cover and insurance or will they refuse ?

Hi, Sorry to hear about this, knowing Brighthouse they will probably say they cannot do anything about it, there insurance does not seem to do what they say it does, sorry i cannot be more helpful.

Lost? more like stolen lol and even then....I think I have heard they dont really like customers claiming on their insurance any way...if you read around the site you will come across stories where the customer has tried to claim against the insurance and the responce they have had in return.

I'm fighting back and ready to go :D who will be my first victim? LBL, Brighthouse.

Your OSC cover is worthless in this instance (well, it's worthless period to be honest) as this only covers you for failure or breakdown.

Your DLC policy covers your PAYMENTS in the event of the goods being damaged or stolen.

You may think this insurance covers the goods against damage, theft, fire, flood etc, but it doesn't. Unlike “real” home contents insurance it WILL NOT provide you with any replacement should it become necessary (not even like-for-like), and will only ever, at best, release you from your agreement with BrightHouse. You end up with NOTHING. In fact, you may even end up with a policy excess to pay (up to £100 in some cases) particularly on portable items – laptops, phones and game consoles for instance.

 

Furthermore, in the event of a claim, the store manager will have the final say as to whether the policy should apply. He may, for instance, decide the goods where stolen or damaged because you didn’t secure or look after them adequately.

You're going to have to return it if it's been broken, but hopefully you've only had it a short time, that way you won't get too much of a sting!

You are definitely, positively 100% NOT going to get it replaced! ;)

Correct , took it back and they showed it manager and brought it back saying nope youre not covered at all.

 

Nice to know im gonna have to pay over £350 left on it with totally useless insurance cover.

Yeah, it's a real no win situation isn't it...

 

You're just going to have to take it on the chin and treat it the same as if you had purchased it from, say, Dixons or Phones4U and didn't take any insurance cover...

 

Naturally, you'd be very foolish continuing to pay BrightHouse OSC cover on this from now on... No doubt you've already realised this and cancelled it? If not - do it NOW!

 

May be worth running this past the FSA and letting them see a copy of your DLC terms and conditions... ;)

 

By the way, in case you didn't know, the FSA don't have BrightHouse as a supplier of insurance on their database... but they DO have Caversham Insurance (Malta) Ltd... (know wot I mean... wink wink... ) ;)

You would have been better off with your own home insurance, which is what I did the second they suggested DLC I told them I had insurance so they said I had to bring in the paper work...so I went home and organised some contents insurance and have had it ever since...killed two birds with one stone as it prompted me to do something I'd been meaning to do since I moved in and got me out of accepting their DLC

What insurance firm did you go with as Im having trouble finding one that meets Brighthouse requirements

I bought a lap top for my son for school and took out the insurance, always made payments never missed it anyway he accidently dropped the lap top so i went to my local store Woolwich glad that at least i had insurance that could repair it.

 

When i got there they refused to honour the insurance which they supplied so i wrote to the head office to let them know that i have suspended all payments on the lap top and fridge which i have out ( also have insurance on that ) UNTILL they repair the lap top. when the local store saw that there was no payments i told them why that i had notified the head office etc so they said oh dont worry we will deal with it email the head office to let them know . I did and still they have not and said they will not repair the laptop despite there being an insurance for accidental damage etc on the thing!.

 

I am still not making any further payments untill they honour their contract in the insurance taken out. enough is enough.

if you read your agreement you will find that dlc and osc cover you for fire theft and accidents so you are covered tell them that they got tp comply with the law if they state they are covered in the contract they got to comply take contract with u to show them. also do not listen to a word they say they are full of crap they lie all the time if they still won.t repair take them to court for breach of contract and claim all insurane back as its worthless .
