Hi All :)

 

Inspired by the recent press coverage of bank overcharging I've just made the first step towards reclaiming the huge amounts Barclays have charged me in the last ten years for being overdrawn.

 

I've attached the letter I sent to Barclays here.

 

Their response includes the following statements:

 

1) The bank is not under obligation to present information according to any particular format. Therefore your request to assemble a schedule of charges is turned aside. (They did however, return my £10 payment and stated that they would send the requested statements free of charge).

 

2) As regards your mention of "manual intervention", the DPA does not oblige the bank to comment about internal policies and procedures. Furthermore, in the context of managing day to day transactions arising from out of order accounts, the bank does not hold the information you have requested in a form that would be covered by the DPA. Whilst aggregated information is retained for statistical purposes, this would not constitute "personal data" under the DPA and therefore would not be covered by s.7 DPA subject access request. For the avoidance of doubt, the fact that we do not generally record information in a way that is caught by the provisions of the DPA, is in no way an admission that there was no such manual intervention.

 

As you can see, I sent the standard letter from the forum here, but Barclays refused to release data relating to any manual intervention. They have, however agreed to send me copies of all of my statements free of charge. It looks like they are trying to make it as difficult as possible to go through the process. So is the letter from here out of date or incorrect? :?

Please can people tell me of their experiences with Barclays and trying to reclaim charges? Has anyone been successful? What should be my next step here?
