got a fight on my hands with AMEX and Newman

Well im having a terrible month here, if it don't rain it poors.

Any way, got an out standing debt with AMEX red, credit card, wont bore you with to much history, but they have give the debt to the DOGS, yes Newman's, who have tried there bully boy tactics, but i have told them to P....s off. so i sent them a CCA, and guess what i got a reply.

 

 

Thats right, they can not supply a true copy of any contract or any thing at all.

So any idea's??????

Even if it was opened online, they should still be able to supply a true copy, including T&C's.

Well, im not sure, but they have not sent a true copy of any agreement to me, all i recieved from newman's was a E-Application and a set of terms and conditions, which are not signed nor addressed to me, they just look like a standard set of terms and conditions.

What should i do? should i write back to them saying that they need to send me a true copy of a signed agreement? and what if i never signed one, i have looked through my files and can not find any agreements with AMEX, im not sure if i ever recieved one from them or if i ever signed one.

I would do just exactly that - post back when they come back with something meaningful.

have you considered that the debt may consist of unlawful charges?

 

if not, I would suggest sending a SAR.

Well they are hiding behind the The Consumer Credit Act 1974 (Electronic Communications) Order 2004 to get out of supplying the signed agreement

 

it would be helpful to know when the agreement started as the order came into effect on the 31st December 2004 so if your agreement started before then they can whistle

 

do you have a copy of the agreement that you can post please so we can have a look and check its got all the required terms etc?
