can anyone tell me please,how a judge can order the sale of a house that is owned by another bank.i have a charging order with cak west and although im up to date with payments and have offerd to pay more money per month and also tried to sell the house 3 months or more back,they wont accept my latest proposals.

can a second chargee really be able to force me to sell?and how would they force me to do it,they surely cant reposes it as i don't own it the other bank do until its paid for,or are we now living in russia

 

any help would be great.

by another bank are you refering to a mortgage you have from that bank, if so another company I believe can apply for a charging order, so house does not need to be free of a mortgage for this to take place.

read around the forum there is some usful information there.

I am sure people with experince will advise fully

hi thanks for the reply.

the order is already on there,can they force me to sell my home above the first chargee?

and how can they force me,will the chain m up and pull me down to the estate agents.if the put it at auction they wont get there money anyway.

Are you refering to a 2nd chargee trying to force the sale of a property even though you are up to date with the payments ?

plus what about the 1st Mortgagee, are you upto date with the payments ?

ty for the reply.

the cak west have a charge against my house.all payments that i owe them are up to date.

my first mortgage is with rbs,all payments up to date never ever been behind with them.

what im asking is,how can the cak west get some one to force me to sell my home,ie above the first chargee.

will they come and run me down the estate agents and make me sell it?

or are we living in russia now,lol

The simple answer is they cant!, if you are up to date with your payments, no chargee can force the sale of your property. maybe they are threatning you just to get increased payments from you every month
