Ok back to some sensible debate.

The suggestion made about getting a policy statement from Chief Constables is a good one.The aim of CAG as with other sites that draw people together as one to fight injustices,is to have a level playing field that acts within the rules.Where the rules are unclear or not being observed then its people power to try and get some determination.Instead of talking about it and doing nothing.....lets write to all the Chief Constables.In fact I suggest writing to their trade association too ACPO.

A temp letter is no problem I am sure ...........

So who is interested ?

I am prepared to give some time to it,because there has been some intersting and valid points made.

Good.I am in the North West so dont mind doing Greater Manchester Lancashire Merseyside Cheshire and Cumbria.

I had a quick look on ACPO website but did not see anything specific although theres lots of stuff about everything else.

This should be a collective thing so has anyone thoughts on specifics that should be included in the temp letter ?

Also maybe I should start a new thread for this so that progress can be followed without getting lost with other discussion ?

I could do a few more ... but feel we should have as many people as possible involved, after all, a Chief Constable from (say) Essex will take far more notice of someone from Essex that he will from someone at the other end of the Country !

We should start by asking if they have any specific bailiff policy (to see where they initially stand) and point to the Devon & Cornwall police policy document, to show that some forces are taking the matter seriously.

 

We should try and find out how their current policies differ, as when the information is collated it could make a very good press release (for the media) to show the vastly different attitudes in different areas (and any publicity will be good for the cause generally).

hi martin would this be in reference to DCAs acting in an unapropiate manner and not observing the laws laid down before them,or would it first involve asking the cheif constables for their qualified advice regarding the unlawful activities concerning DCAs then we could have a format for the CHEIF CONSTABLES opinions and for them to come up with a collective and reliable letter to pass to any DCA who thought they were above the law

hi Patrick-Dcas are different to Baliffs in that they have no real powers in the same ways that Baliffs have.

There is already a lot of protection for victims and apart from using The Administration of Justice Act for harrassment cases its very rare that Police are involved with issues between DCAs and Debtors.Oft guidelines on debt collection provide a magnitude of protective steps that are favourable to use against DCAs who flout the rules.There is already a stickie in one of the debt forums which is being worked on to issue a mass complaint...have a look at this.

 

Also I should point out that our communications to the Police will be specifically to try and get clarification as to their policies in dealing with Baliff/Client issues as opposed to Baliff codes of practice many of which are regulated by their own trade bodies/trade associations.

The temp letter can be sorted once we have enough interest from people to take on the remaining force areas.Good response so far.We will only have one shot at this so the temp letter will need to be drafted to cover the points that we want answers to and that we will be able to move forward on.

Maybe a good idea to do an update showing the force areas covered and those we need people to help out with.Will try and do this tonight.

Don't bite my head off for going off topic for a minute and please feel free to move my post Martin

 

After seeing this thread I was talking ( unofficially ) to a police seargent tonight and I asked him what happens if a Baliff phoned asking for assistance . as in what checks the police make to make sure he is certified .. if the debt is in dispute etc etc ... I was not suprised to be told no checks are made .. if the police get a call to assist they will just go and assist .I explained about the powers baliffs have and about debts being indispute etc and was told that the police would not be interested in any of that .

 

So I can't wait to see what official replies you get
