Was awarded the cost of a days wages on appearing at hearing, which amounted to £62 including mileage allowance and parking.

 

Citi had not conducted themselves well in my claim, and think the judge was annoyed that they had turned up to the disposal hearing once there defence had been struck out instead of settling.

Advice offered by ENRON is without prejudice and is for your judgement as to whether to take it. You should seek the assistance or hire of a solicitor or other paid professional if in doubt.

Yep, Citi settled after the court orderred it.

 

The case management notes were a bit stinging from Citi's point of view - if you fancy a read here they are:

If you need the money badly then sign he order. However, you might consider striking out the bit on confidentiality - and also add "save for an application for wasted costs" to the bit about costs.

 

Then Citi will have to agree this of course and they may not wish to in which case the whole issue may have to go on. I am at a loss to understand why they have had their judgment setaside when it is clear from this that there is no intention to defend. I would want to write to the judge pointing this out and saying that clearly their setaside application was abusive. It all depends on how badly you need the money.

Their judgment was initially set aside as they claimed they weren't aware of the claim in the first place and weren't given the opportunity to file a defence!:o......liars!

 

I'm not desperate for the money but more interested in seeing justice carried out. These coporates just try to intimidate the average Joe Blog:mad:......and I won't be intimidated. They either settle with Wasted Costs or we take it back to the court!

Interesting! Which solicitor was representing Citi in your claim?
