Could someone advise me please. I sent S.A.R - (Subject Access Request) to MBNA on 29.11.06 and data was received on 30.12.06. Before I could send my preliminary request letter MBNA sent a cheque for £159 as settlement and said that if they heard nothing from me within 6 weeks they would assume the matter was closed. I banked the cheque in Feb 2007. I intended to send a letter accepting this as part payment and that I would continue to claim the remainder due (about £800 I think) however at this time my father was taken ill and was in hospital for many weeks and subsequently the letter was never sent.

 

My question is this, is it too late to persue my claim? The card is now paid off by the way and account closed.

I would encourage you to continue your claim. You have absolutely nothing to loose, so go for it.

Start from scratch again with the prelim letter, adapt it slightly to say you first contacted them on so-and-so date regarding the matter of £X that you wish to claim back from them, state that you have already received £159, which you thank them for but you still wish to persue for the remaining balance. Give them a fortnight and then send the LBA.
