DCA - Phoenix-Sarl-Marlin-HSBC

Hi everyone. New member in Deep S.... After years of paying regular reduced payments, HSBC has sold my 1997 CC and 2002 Loan agreement to Phoenix-Sarl-Marlin. They have now demanded immediate payment and 1 week later issued N1's. The have claimed the loan as an overdraft. No account numbers mentioned. Loads of Interest has been added, and thank goodness I found CAG. Great posts from PT2537,Bug,Tomterm8, and others have cheered me up. Has anyone won against these b......s. I,m going to need your help as a total of £35K o/s has just been bumped up to 45K.

 

I started new thread with above title if anyone would like to come in PT2537 would be a great start if not too busy.

OK I have folded first and maybe could have taken them a little lower but they started at £1900 being 45% of the debt I started at £80 being their court costs and we have settled at 12x £20 a month or £240 as a full and final.

I have just been reading round a few threads and noticed you have been able to settle out of court . Well done.

 

I am interested in the fact that you were able to negotiate a F&F over a 12 month period. Would most companies accept that method do you think ?

ive subbed to this thread and will read from start to finish, but i noticed the post from edz11 for pwalton v rbos which i am interested in as others are with mbna probs

 

ive glanced quickly at the cca copies and they are very similar to what i and others been sent so as i say will further read later and update you

 

fab result, i will be happy if i got to this stage too well done

 

did you get any adverse info off your credit file too? and if so would it then show as fully satisfied once all payments paid?

Just to update...it was a F&F for £25 x 12 not 12 x £20 for some reason I got it mixed up however I paid my last payment this month.....

Interestingly although the debt was assigned to 1st credit and all my dealings were through them I received a letter from MBNA this week to advice me that I had paid the last amount and the balance was now nil…!

Now that this has gone I am more than happy to post up anything that will help you. they didn't remove the stuff on the credit file but I am working on it..

The bonus for me was I SAR'd MBNA to get additional info and at the same time got the unlawfull charges refunded so with the reduced F&F less the charges I think this £4300 only cost me about £100
