i hope someone can help my claim is 5120 would it be best to take off the first few charges to come under 5 grand. Also the 8% interest is another 1000 so will this count for over 5 grand claim? getting a bit worried casue i have to file today

HSBC - 11/9/06 - prem letter sent

19/9/06 - lba sent £3391 requested

5/10/06 - MCOL

17/10/06 - offer for £1600 on one account recieved

28/11/06 - Full offer recieved

 

Capital one - 13/9/06 -letter asking for statements sent

17/10/06 - prelim sent for £640

 

Lloyds TSB - 13/9/06 -letter asking for statements sent

17/10/06 - prelim sent fro £732

Lloyds TSB - 26/9/06 - prem letter sent - £391

When you say is it best to reduce it to under 5K, is this so you can go down the small claims track? If it is and you use MCOL chances are your case will get automatically stayed. Your best claiming the full amount and using the N1 form. As regards the interest it is not counted when using the small claims track and with you being just over you would probably be able to go down the small claims if that is what you decideto do.

Hi Jody, my claim is for £5354 and with interest added on plus court fees £6721. I filed at court using N1, it cost me £250. I have since had a stay put on my claim which I have filed a notice for removal (another £35) and I am in court on 31st October for my hearing. I have had no problems with the claim being over £5k it just costs a little more when filing. Don't cut yourself short just to get it under the £5k, its your money at the end of the day. Good luck. Keep your Fingers crossed for 31st as could do with some luck myself :-)

03-06-2007--Prelim sent.

12-06-2007--Reply - Thanks but charges lawful!

19-06-2007--Sent L.B.A. & Schedule of Charges

NOTHING RECEIVED AFTER 14 DAYS

05-07-2007--Phoned Halifax to discuss account. Still standing by charges.

13-07-2007--Filed N1 in Hull Court :wink:

20-07-2007--Halifax deemed served.

25-07-2007--Received offer £280 as Full and Final settlement.

27-07-2007--Sent rejection letter recorded delivery

03-08-2007--Rang Hull Court, nothing received from Halifax

04-08-2007--Sent Pre Judgement letter.

10-08-2007--Defence received from Halifax

13-08-2007--Judgement Request sent

24-08-2007--Claim stayed at Hull Court

31-08-2007--Applied for stay to be lifted

12-10-2007--Hearing for removal of stay on 31/10

31-10-2007--Removal of Stay struck out
