I'm helping a friend with a few debts a year ago sent a CCA request to Robbers way who couldn't comply. Just received a letter from Hoist - "we refer to the query .............As we are unable to resolve in a satisfactory manner, we have taken the decision to write off the account and cease all collection activities....." Although my friend is pretty sure she didn't have PPI, we are now sending an SAR to Captial One and I'm betting her that not only will there be PPI but also charges. Just for interest I'll keep you posted BTW, she's been cash cowed for years!

Hi all In October 2009 I defaulted on an HSBC overdraft, £700 of which was charges, the other £700 ish the actual overdraft. They didn't get in touch until last year (I had previously looked in to a DRO but HSBC wouldnt confirm the details to me as it had been passed to a DCA, my circumstances then changed and I was able to negotiate the other debts I had at the time) The account was originally opened in 2005. I sent MKDP LLP a CCA request, they took a long time to respond and finally responded saying that the account was opened 'interpersonally' (whatever that means) and therefore no agreement was necessary? I've read elsewhere on the forum that pre-April 2007 CCA agreements are required or the debt is unenforcable, can anyone confirm? I now can't afford to pay this debt having exhausted my options previously; I'm begrudged to play ball with them / HSBC when there are so many charges on there and this could have been resolved years ago if they had given me the info I needed for a DRO!

Although, I can't find the original post on here, you people have helped me previously with a problem I had with Robbers Way. They've now written to me and it looks like I've got to start from the beginning again. Despite claiming originally that they were acting on behalf of a client, they wrote to me that they had purchased the credit card debt owed to Capital One. They were asked to provide a copy of the agreement via a library template, which took them over two years to provide. I, in turn sent them an account in dispute letter from the library. I eventually received a mass of damp documents which were incomplete and did not contain all the documents necessary to prove their right to collect. In subsequent months, they wrote to me to say a doorstep collector would call and indeed, he did. I sent him off with a flea in his ear. Two months later, I had a letter stating I had set up a monthly payment agreement via this man and they told me I was late with the payment! I did not contact RW and the parasites seemed to back off. I've now received a letter from Dryden Fairfax stating that I need to contact Robbers Way within 10 days or else! There's no acknowledgement of any previous correspondence with me so it looks like Robbers Way wants to start from the beginning again via their pet in-house solicitors! I'm inclined to play them at their same game by once again asking for the a copy of the original credit agreement. Could you give me any further advice please? Thank you.
