  1. Hi there! I know this thread is old https://www.consumeractiongroup.co.uk/forum/showthread.php?468641-Gemini-Parking-Solutions-PCN-Queen-Elizabeth-Olympic-Park-On-a-motorbike&p=5153731#post5153731 but yesterday I got a parking ticket by Gemini on my motorbike for parking exactly at the same spot than you did. I am curious to know what happened and what I should do. Thanks!
  2. Hi. This has become a talking point between me and my biker mates. Why are we asked to pay pillion insurance? My full bike licence entitles me to carry a pillion, and I do not need an insurance company's further permission. Car drivers are not asked to pay for passenger insurance. Several of us have asked our insurance companies, normally at renewal, what this is for. Answers range from "It's illegal to carry a pillion if they aren't insured seperately" to "It's so we can represent the pillion if they are injured." The first is obviously wrong, the second raises so many further questions that it is untenable. Would they really represent the pillion against their own insured if the insured were at fault? I know that drivers/riders can be liable if an injury is caused by their actions. We just haven't been able to find a definitive answer and I know that several people believe that it's just another way to get a few extra pounds from us. Thank you in advance for any interest.
  3. Hi folks. Much the same as many people here I suspect, my first post is about a Parking Charge Notice I received. I'm aware this isn't a penalty charge notice. I have read many different stories about Gemini but I believe mine is a little unique. I and my motorbike (yes, my motorbike) received a Parking Charge Notice, stuck onto my petrol tank at the Queen Elizabeth Olympic Park. Date/Time - 11/08/16 16:50 The Issue reason is "Parking in a No Parking area". I have not appealed yet. All excuses aside - those being that I was attending a job interview and could find NO parking facilities at all. Eventually I locked my motorbike up to a bicycle railing completely missing the road signs as you can see in the photo attachment. I got back to my bike to find the parking charge notice on it. I have till Thursday (the 14th day) to appeal to keep within the £60 reduced fee (from £100). So much advice says ignore the Parking Charge Notice, but I feel my situation is quite unique. What advice do any of you sages have? Cheers in advance.

Hi I know there are lots of articles on here and other sites about this with conflicting information, and the laws have changed a bit in the last year but I was hoping for some help for where I stand. Just moved into new flat and parked my Motorbike on some empty ground opposite so as not to use up any of the residents minimal street parking spaces. This morning I came out to find a Contractural Breach Charge on my seat (not stuck on). I looked around and EPM have put some signs up on the back wall but with no lighting and I couldn't see them when I got there last night. There are no bays marked out and no entrance or exit, it is just some empty land next to the side street and I was tucked up against a tree. The side street is council permit parking only between 9-6 Mon-Sat. It appears the advice is no longer to ignore them but if it had been windy this morning, I wouldn't have even found the ticket. It states it was observed for only 10 minutes and 9 seconds, colour not recorded, and the location is noted as a Solicitor's 2 streets away. Doesn't have my street name on it anywhere. I know this is an invoice etc but I clearly did not accept entry to any contract by parking there as the sign proclaims. What is the best course now, appeal to EPM then POPLA? Thanks Dom
  5. I sold a motorbike on Ebay yesterday, the buyer messaged me and asked for the Reg Number and Chassis Number which is fair enough as he wanted to do a HPI check before arranging collection. He messaged me earlier to say thanks for those details and the search has requested the following: V5 registration document serial no and V5 registration document issue date. I wanted to check that he actually needs this information and why that information is requested before giving it out to him. Just making sure it's genuine info that's required as when I've done them in the past I've only needed the Reg Number. Thank you.
  6. Won a motorbike off Ebay on 30th May, paid via bank transfer the next day as Paypal doesn't offer protection on motor vehicles. Was described as fully working, just had an MOT. Got a courier to pick it up and deliver it, received it yesterday, wouldn't start, had to buy a battery charger, discovered battery is knackered so will need to be replace, there may be other issues but hopefully not. Where do I stand on this with it not being as described? Can I make the seller reinburse any repairs I have to pay for? Or if I really wanted to could I return it? Thank you.
  7. Hello everybody, I'm writing to ask you what you think I could do in this situation. I apologise in advance for the long post, but it's a very long story with many details so I thank you for your patience in reading this. 1 months ago I bought a motorbike from an official Peugeot dealer, that was the beginning of the nightmare. 1) the bike arrived several weeks later, there were always delays and I had to chase them because they did not inform me 2) once the bike arrived, the wrong number plate was put on - I was asked by the dealer 2-3 days later to take it back for number place replacement as he swapped it with another one by mistake. Later on this year when my road tax renewal has arrived I have then found out I was registered as the owner for 2 vehicles: mine and another one (first number plate I was put on) 3) On the day I picked up the bike for the first time in the shop, the bike kept turning itself off at every traffic light - took it back and dealer said he didn't adjust the idle before selling it, he then did and it was ok 4) I had a crack on the front mudguard, which I only noticed 2-3 days after the purchase, I asked it to be replaced and they never did, they conveniently forgot about it - eventually I gave up Later on a mechanic points out the back mudguard is practically rubbing against the wheel because the hook was broken, he repairs it with wire but doesn't keep it and asks for the replacement part as it came out like that from the factory - no part received 5) 11 days after the purchase the motorbike starts leaking petrol, I call AA, they take it to the garage and replace a cracked fuel pipe and a leaking fuel filter - leaving the bike parked outside at the end of the reserve with barely any petrol in for me to ride it to the next petrol station 7) Despite me not being instructed about oil checks etc (I was told I didn't need to check oil levels and that would be checked only by a mechanic during the routine service), after about a month I decide to check the oil level - stick comes out dry. I think I must have got it wrong so I take it back and ask to have a oil check. One of the mechanics just fills it with oil, doesn't say a word and says here you go. I ask what happened, he said nothing it's safe to ride away, there's oil. 6) the bike doesn't start in the morning, regardless of hot/cold weather, once it's been parked for 2-3 hours it doesn't start I take it back, they first say there's nothing wrong with it and return it to me. I take it back again, they adjust the idle again. I take it back again, they change the spark plug and say the battery is fine so they can't see a problem. Still the problem isn't fixed, I take it back again and they change the automatic choke and ask me to come back if it still doesn't work - by then I just had lost hope. The problem persisted but I didn't go back, I just lived with it and said to myself I was going to take it another dealer. 7) I had been there at the garage at least twice a month for the first 6 months. I have asked when's the next check due and they say 5000 miles (my meter is in km though) 8) The bike gets stolen, no big damage just the ignition had ripped cables, the bike was pushed along the street then they couldn't start it so they just left it there (I guess that not being able to start the bike in the morning saved my bike on this particular occasion) 9) I ring the dealer asking if he could fix my ignition by soldering the cables back, as he asked for £120 for the new part and it was gonna take time to order it (other dealers I contacted were selling it from 60 to 80 pound) He said the soldering can get complicated and I might end up having to pay 120 for the labour anyway (5 cables? really?) and started mumbling away something along the line that he wasn't sure if it was possible because the back of it is plastic and it melts, etc. etc. he wasn't really convinced he could do it but he ended up saying he could at least try. I was happy with try and I need the bike for work I ask him if he had time that afternoon, he said yes but not too late - I said to him I could take 2 hours off work and head there around 4pm, should take me an hour so should be there at 5pm. He said it's fine. I asked him 2-3 times because my employer back then wasn't really happy about giving me 2 hours off if he was gonna at least try to solder it back I would have come otherwise I couldn't afford to go there, not have it done and then having to take more time off which wouldn't have been possible for me at the time. He said he was going to at least look at it and try so I went. Got there around 5,15-5,20pm (shop closes at 6pm but sometimes I see them opened for a bit longer), he said I could leave the ignition there and he would have taken a look at some point another day. I pointed out I couldn't take any more time off to pick it up and that I asked him several times if he could do it on the day but he was adamant that no, I was 15 mins late, the shop closes in 40 minutes so he couldn't possibly solder 5 cables. I then ask for the wiring scheme so I can solder it myself and he said he didn't have it, but I could google it - that's what I had been trying to do but I couldn't find it online either. I asked him to just tell me how the cables had to be soldered back (in what order) and he said he didn't know he would have googled it himself but if it's not on google he would have waited until another bike of the same model came in so he could check the wiring and solder it back, so he didn't exactly know when it was going to happen. I start freaking out, I said that he was wasting my time and I was in huge distress and that by the way the bike still didn't start in the morning after and he said I could take the bike there and they can have another look. Happens that I had talked to another dealer who said he knew exactly what the problem was, and given the past experience with this dealer I decided to trust the other one. I have said to this guy that no, I wouldn't have left the bike there anymore because they don't know what they're doing, they messed everything up from day 1 and instead of showing a little bit of respect and appreciation for my patience by fixing the ignition they were bold enough to say that no, 15 mins late I'm not even gonna look at it. I said I would never come back. 10) I end up buying the part on ebay and fixing the ignition myself 11) I take it to the other dealer because it still didn't start in the morning, they notice the spark plug was the wrong one for that bike, they replaced and it got a bit better but still would struggle to start 12) The other dealer also notices a weird noise in the piston, says the piston was worn and was getting too small for the cylinder - I ask him if he could be a damage that was caused by riding it without oil for a month, he said yes and he also added he wasn't going to do anything about it because he didn't want to get involved with Peugeot for a human error that somebody else did, as it would be difficult to claim it under warranty. He says the engine will die all of a sudden sooner or later. But it was still working I used it as it is. Yesterday evening the bike turns itself off in the middle of the street on the way home and doesn't start anymore. Looks like flat battery, I charge the battery put it back in but same thing. This morning I try again, same thing - I call AA and take it to the original dealer where I bought it so I can also explain what the other dealer said. The guy I had spoken to before as he sees me leaves the shop (found out today that he is the owner) I speak to one of the mechanics said he was going to look at it, I go to work prepared to come back there at 6pm when I finish. 20 minutes later I receive a phone call from the owner saying I just left the bike there and legged it, I explained I spoke to his mechanic and he said he was gonna look at it. He said that since I said I wasn't going to come back then he doesn't want to fix my bike so I must go and collect it now because he's pushing it out on the street and once it's out of his shop that's entirely my problem - plus the warranty is not valid anymore because I didn't service it, so he wouldn't have done any work on it anyway. I say.. what service? I asked you and you told me next one 5000 miles, I'm 3000km behind. . well, apparently there were 2-3 services in between that I wasn't made aware of. I was actually told 5000miles was the first service I had to do, now.. I never owed a NEW bike so I didn't really know when you're suppose to service it. Then the guys starts shouting at me I ask him to please don't shout, he's adamant it's out of warranty and also that he doesn't want to see my bike in his shop he's pushing it out. I said I was gonna make a complaint with peugeot. I do.. I call customer service at Peugeot, explain the whole situation to them and they say that unfortunately since the service is explained in the manual and service book (that I was NEVER given by the shop but the shop is denying it) the warranty is not valid. As for the guy's manners he can't do anything because Peugeot don't impose any standards for the level of service of their dealers so they can conduct the business like they want, and if he wants to be rude then he can be rude and Peugeot is not responsible. As for the lack of oil from the start, he said that no written proof is there, he will deny it and it is just my word against his so they can't do anything to help me. I picked up the bike called AA and had to transported back to my home. The mechanic from AA reckons the piston got thin and bent, so when the bike runs for 3 mins, the piston gets bigger, jams in the cylinder and the bike turns itself off. When the piston cools 10 mins later the bike starts again but as soon as it gets hot it jams again. Only his opinion anyway he didn't look in the engine. Now, at this stage what can I do? I was thinking of claiming under the sell of goods act, trying to prove the bike was not fit for purpose from day 1 and the services received was insufficient, but can I prove it? When I went back to the shop today I set my phone on recording, so I have a conversation with me and the mechanic where he apologises saying it wasn't up to him to fix it or not and I asked him if he remembers I was always there and the bike was broken from day 1 one I bought it, he said yes I know. I wonder if I could use it as a proof (I feel guilty for the poor mechanic though), but I doubt that I can because I didn't warn them I was recording. Any thought?

Back in September 2013 i recieved keys to a new flat 1 month before i actually moved in. 2 Days after getting the key (17.09.13) the contractors working for my landlord managed to knock my motorbike over off its side stand, whilst trying to access the bins. I didn't know for sure at the time that it was them that knocked it over. I was getting the bike ready that day for long ride to visit family for a weeks holiday. So i had to ride the bike damaged. The landlord sent me a text the following week confirming it was his contractors that did cause the damage. i suspected the damage to be more than £200, so asked if the contractors would pay up to the value of £200. They begrudgingly agreed, only in £50 a week payments. However after 6 weeks of not receiving any money, i sent them texts asking when they were going to pay. These went ignored for another week, until i sent one saying i would get the police involved. I immediately got a text back, saying the landlord was going to take care of it. I took my bike back to the dealer for an official evaluation, which should have cost £80, which they did free of charge because my bike was due its service soon. And the damage was closer to £400 The landlord agreed to meet me a couple of weeks later, and told me point blank: "If you want your money, you are going to have to take it to a civil court. And as its private land, i don't fancy your chances. That said i am prepared to knock £100 off your rent, and that's it" I tried showing him the piece of paper from the dealer, showing that £100 wouldn't even cover the cost of replacing my windscreen. He wouldn't even look at it. Since i've hinted to the contractors that i am serious about taking this to small claims court, they said that them & the landlord will deny any knowledge of any involvement as far as damaging the bike is concerned. Now don't forget i have the landlord admitting the contractors damaged the bike in text message. Its an iphone, so these can be screen captured & printed What can i legally do here? I mean i am planning on moving closer to work as soon as my 6 months is up in april, so i can see me having to fight him again to get my bond back.
  9. Hi all New to the forums here. Back in march this year I parked my motorbike in the Cardiff NCP car park overnight without purchasing a ticket, and came back the next day with a penalty charge notice on my wind shield. Now when I got to the car park originally, I hopped off my bike, read through every sign that they had up, looked around for an attendant and there was none - even at the office. I was looking for any sort of information on parking motorbikes (they had no designated bike area) but there was none. Being anal about it I called them on the 0845 customer services number, spoke to a guy who spoke with his manager whilst putting me on hold and then confirmed I do not need to pay as it's a motorcycle. I told him which car park I was located at, and also confirmed with him that I should park my bike in a car bay. So I thought this would be bullet proof, certainly now I won't come back to a ticket. But I did. £30 within 14 days or £60 thereafter. Of course I refused to pay it - now this is where I imagine the facepalms and headshakes will happen. I sent an appeal to NCP as per the notice said, detailing how I spoke with a gentlemen on this number, at this time and this was discussed. The calls were recorded according to the 0845 greeting. They declined my appeal on the basis that I parked in a pay and display car park without clearly displaying a ticket. I felt like exploding. I didn't appeal to POPLA as by that point I didn't want NCP getting hold of my information ( I gave false contact details to NCP). But as it was on CCTV the DVLA were more than happy to hand over my details, I later found. So I received a series of letters which I ignored, telling me how debt recovery would be given the case and eventually Debt Recovery Plus Ltd have taken over and are sending me notice's for now in excess of £100. Again I ignored these, the last one I ignored was a letter saying a reduced amount of £110 is payable if I pay before 12/11/2013. I didn't. And since then I have moved address and not told the DVLA. Not sure if I've received any more letters. I want to get this burden off my back now, it's starting to stress me out as I'm worrying over the thought of having debt and a CCJ, now that I've moved into a place I can hardly afford. Is there anybody who can advise me on this situation? There's absolutely no advise I can find on motorcycle parking and what my rights are. Thank you so much for reading. Dale
  10. My son, rather stupidly, allowed his friend to ride his motorbike and he was involved in an accident with a car. My son was devastated, the bike was his pride and joy. The police were called and his friend is likely to be prosecuted. The bike, which was in my husbands name, has been repaired and sold to a colleague who is fully aware of what happened. Today my husband has received a letter from Privilege Motor Claims saying their customer has reported the incident to them and given them my husband's details. They have been in contact with his insurance company and understand that he has not reported the incident to them and asking him to do so as soon as possible, reminding him of his duty under the Road Traffic Act to report any incident he is involved in. Now, obviously he hasn't reported it because he hasn't been involved in any accident. I would really appreciate any advice you can give as to what we do now. Should my husband just reply saying he hasn't been involved in an incident, should he ignore it or should he give them my son and his friends details?
  11. Hi guys, First post here. I found the forum while on google. I don't have any paperwork infront of me so I will just give you the basic outline of my story minus all the road traffic act BS etc. My motorbike was up for sale, so I put a full MOT and 12 months TAX on to help sell it. It didn't sell and it just sat in my shed. A few months went by and I got a demand from the DVLA as my bike was no longer insured. I had to insure it or sorn it. I could return the tax disc for a refund. Failure to do so would end up with penalty or court. Being disorganized, I had lost the new tax disc and admittedly didn't get my butt into action. A couple of weeks later, I got an automatic fine. I complained because the first letter had not given me a deadline to act by. I think this is poor practice as any government service should work to clearly defined deadlines and procedures. Naturally my complaint got ignored and I paid the fine to avoid further penalty. I requested a V33 lost tax disc form via the DVLA but they didn't send one. I therefore sent back the tax refund/SORN decleration form as requested, only minus the tax disc. I did this to at least declare sorn and avoid any more grief. The form was returned to me saying that I cannot claim for a refund on my tax disc without the tax disc (fair enough) and enclosed a missing tax disc form. This form makes you sign an agreement whereby the DVLA may keep £12 of the refund. A 2 month refund on a £60 tax disc is less than that! I really wasn't fussed about the refund (I'd already been stung) and didn't return the form. About a month passed by and I got a court summons for a repeat offense. I complained and wrote to my local MP. The response I got was late (according to their own response guidelines) and they notified me for the first time, that my SORN was rejected for not returning the tax disc. This had NEVER been mentioned to me before. The letter I received only ever mentioned monetary interests for returning the disc. They gave me a 9.45am court date in SWANSEA - I live in Luton. They instructed me to return my non guilty plea to them. I contacted the court a couple of days before and they said I should have contacted the court directly and could have the hearing at my local court. Why did they not make me aware of this? The DVLA have basically made the process as difficult as possible. They refused to give me any vehicle information over the phone because of the court date. A written request could be made with a cost attached, but they would not guarantee the information's arrival until AFTER the court date. They haven't been clear about rejecting my SORN declaration an gave me incorrect information about the SORN declaration process. I should be shocked that this is a GOVERNMENT organisation, but I'm not. I also don't believe that I will win or receive a fair trial, but I am going to stand up in court and have my say. I have been compiling as much evidence as possible to illustrate their incompetence and resistance to helping me resolve the issues. There is a hearing next week in Swansea to discuss having the summons in Luton. What an expensive and ridiculous process! TYPICAL!!!! I shall keep you all posted!
  12. Hey. I recently crashed into a car as it pulled out from a side street without seeing me. Long story short, my insurance company have requested a copy of my CBT certificate which i have provided, however the date on my insurance says i passed 10 days before i actually did on my certificate. My insurance was purchased in March and the CBT dates refer to January, so i had a CBT cert when i applied for insurance and i was wondering if this could affect my claim. Also on my documentation i state i have a provisional license, (which is true) however right next to that box on the documentation it states "Date you passed full UK motorcycle license" and then the date of purchase of my insurance was put in that box. I don't understand this, how can you have a provisional license and a full UK drivers license for a motorcycle?. ( this question was not asked online and i did NOT enter the date stated on my docs) Lastly, it states on my insurance do you hold or have you held previously another motorcycle insurance policy, this says yes on my docs however this question was never asked when i did my purchase online, and the answer is NO i have not had a previous policy. Any advice on how to proceed with this would be a big help. Thanks.
  13. A few weeks back i needed a mot and rear pad change. Whilst doing the pads the guy said the head race bearings needed replacing and there was no steering stop so that needed to be done to pass. he recommended a local garage to do the work. Took in on a Thursday and was told 2-3 hours for front and rear brakes, steering race and stop. Off i went to sit in catford and wait. 3 hours later i call and am told there is a delay for the steering stop and will be another 2 hours. I wait 3 hours and then getting wound up i walk back to the garage. I ask if its finished and am told they are just finishing the front but still have the back to do (45 minute job max) I ask why its not done after 6 hours they say they were doing other work on other bikes? I said how long to do the rear and despite it being 2 hours till closing he says it wont be ready till tomorrow. I tell him not to bother and to finish what he is doing. I get charged £210 for 3.5 hours but was annoyed it took 7. Im then back at work for 7 days so book it to a different garage who also do MOT,s for my next days off to have the rear pads done and a mot. Whilst driving to work i hit a bump and suddenly the bearings are loose with lots of play in the steering. Later when i goto get the pads and mot i ask him to sort the bearings he tries but cant and calls the first garage who say they will fix what they did. so he does the rear brake instead. the next day i goto the first garage who say they are busy so cant do it today so i say i will be back after another 7 days at work. Whilst driving for 7 days the rear will starts weaving around on inspection the rear will is rocking around? when i get it to the 1st garage to fix the head race i warn them about the rear wheel. 5 hours sitting in catford no phone call so again im not happy and walk back up there to find the bike outside probably fixed. They say the head race bearings are tight but will slacken off? and say tell the MOT garage to call to confirm if need be. They said the bad real wheel shake was because the guy that done the pads did not tighten the wheel up properly? Next day i goto the MOT place who say straight off no way it would pass i need to go back to get the bearings loosened off. I go back to the 1st garage and say wth? they say they had problems when they installed. if they loosened the steering there was play if they tightened it there was no play but too tight? they say they don't have time today so i need to take it in tomorrow so tomorrow is my 3rd day off wasted of just this week. Punchline is when they finally sort the steering the MoT will probably find other stuff i was not even aware of. Looks like when it comes to bikes people take their good old time and do a awful job. If i find a new garage thats good i dont care where they are i will stick to them
  14. Hi all, First time poster here. Looks like a great site, so hoping I can get some advice on here. Here goes..(!) I've been a driver for a few years and just bought myself a scooter for commuting to work. Got loads of quotes online and chose Bennetts motorbike insurance, which was expensive at £185 Third Party fire and theft, because of a previous claim on my car insurance, but just about the cheapest I could find online. Everything went through fine and I received all the documents. A few days later, I get a letter from Bennetts saying they'd been notified by their underwriters of an undisclosed "claim". Below are my 2 incident details (both my fault), the first one is the one I didn't disclose when getting the quote, because I didn't see that as a "Claim" Incident details: 2010 - Reversed into car in road whist reversing from my drive. Told insurance company, but didn’t claim against insurance. 2011 - Hit driver in rear in slow moving traffic. Claim made. Phoned them up last night when I got home and the chap added the first incident to my details, but needed to speak to the underwriter to process the paperwork in the morning (this morning). Got a call back from the guy at Bennetts saying the underwriter has now refused me insurance, but another broker (Aviva) will do it for £15 more. I couldn’t be bothered with all the hassle of sorting out another insurer, so I said OK. He put it through and then noticed the first incident wasn’t added "for some reason", so would have to add it in. Did so and said it would be another £55 (ish)on top of the £15 I’d just paid. I told him I wanted the policy cancelled out of principle. He charged me £30 to cancel the policy. I was a tad annoyed obviously, but guess it was in the small print, so sucked it up. He now tells me I have to declare the refusal of insurance for any future quotes from any insurance company. This will obviously affect my car insurance premiums as well and is something I will have to do for the rest of my life unlike accidents/claims, which last 5 years and then are wiped off. I went away and did some more quotes at comparison sites just now and the cost has now doubled (£400 TPFT), by adding the first incident. Worse still, as I declared I’ve been refused insurance (which I’m told I have to do by law), I’m only insurable by a small number of companies, the kind of companies, who will only insure “problem” drivers. What are your thoughts on this? Do you guys think I have any hope, or am I stuck with this millstone for life? Was I right to not mention the first incident that wasn't actually a "Claim".   15. Hi, I received a parking ticket from UKPC Ltd in High Wycombe Retail Park for parking out of the marked bays on my motorbike. I ignored them at first because I've heard that the private parking tickets are a con. I then received another letter saying that it had gone up to £90. I work away from home sometimes so when i get back to check my mail the 14 days they'd given me would have been up by the time i come back between jobs. On returning home this week I have received another letter this time from Debt Recovery Plus Ltd, saying outstanding amount is £150 and i have to pay it within 14 days of the date of the letter. From what i can see there is no date on the letter so how would i know when to pay by? I need some advice on what to do or what action to take. There are no motorbike bays in the retail park and i dont like parking my bike in the car bays as my bike may get damaged by other cars, and i think its a waste of a space if i park my bike in the bay when it can be parked out of the way on the pavement next to the car park. There was plenty of room to walk by it as it was tucked in the corner where nobody walks. Please write back to me if you know what to do!   16. I received a conditional offer of fixed penalty notice in May 2012 - 76mph in a 60 limit. The registration was for my motorbike (which has a private plate). I completed the Section 172 decleration as the owner, but pointed out that I didnt believe I was on the road that day (13th May) and asked for copy of the photographic evidence. I then received two photographs showing a BMW motorbike, but no picture of the registration plate. I responded reiterating that after reviewing the information that I cannot recall being on the road that day (Sunday) but that I did however travel on the road the previous day (Saturday) travelling over to Lincolnshire with friends. I carried out my own checks (my diary but have nothingn in it for the Sunday and I have no fuel tickets on my visa or bank card for the Sunday). In addition, the photographs do not show the number plate and the riders jacket is different to mine (picture shows white patches on the arms and mine is all black) I therefore completed the Section 172 information again, but pointed out that I therefore could not tell from the information provided and my own chekcs that this was me hence cannot confirm it is me or my bike! in July I received a letter stating that 'no completed and signed responce had been received' or the the 'responce received does not meet the legal requirement to provide full driver details.' The letter then threatened court proceedings under section 172. I again responded refering to my previous letters and that I had completed the information under section 172 but (as I could not rememeber travelling on that road on the date in question) that I was unsure what else I could do (referencing no number plate, jacket was not like mine, personnal checks with friends etc did not tie into the date). I then received a telephone call from a policeman stating that he had been asked to investigate - He stated that the picture came from a camera inside a roadside van and the operator then wrote down the number plate - hence why they had the number plate but no picture of it. He then stated the operator had also made the point that it was an unusual plate ('like a car number plate' rather then a bike-style) - I pointed out that this was not correct and the number plate is a standard 'square' bike plate! Throughout the discusssion I was given the impression that they would prosecute and I had little choice - i.e. it was easier to take the 3 points and fine! After discusion with a solicitor, he advised me not to simply accept this but I have now received a court summons, charged with 'failing to give information re: drivers identity as required' 15/6/12 and speeding exceeding 60MPH - automatic camera device 13/05/12. My initial assumption was that they had the wrong day - they are oviously adamant the date is correct, but I am sure I was not there on the Sunday (I was definately there on the Saturday) Sorry for the long winded post but any advice would be appreciated.
  17. Hi Hoping I am in the right forum here. My motorbike was stolen and then due to fingerprints and blood being found on the parts left behind when they dropped it, 3 youths were taken to court. Unfortunately on the day, the prosecutor told me that police had not correctly marked up the fingerprint evidence and no statement had been put in with the blood evidence, the judge would not allow a delay and threw the case out of court - which leaves me well out of pocket even with insurance! Is there anything at all I can do to try and claim some money back - I know even if it hadn't been thrown out of court I would have probably got the '50p a week is all I can afford' brush off, but its so annoying that these 3 scumbags walk away due to police incompetence!
  18. Hi, I've got a notice for £80, which is the second notice. I wasn't aware of the ticket - possibly someone took it off the bike. Is it possible to anything with it? Send them a letter, that I've never received the first one and ask them for opportunity to pay the first notice? It was a bike parking in West End, I was about 10 minutes outside the hours for free parking. Thank you in advance, JJ
  19. My husband bought a motorbike from a website. It's a Chinese import and is brand new. He paid the deposit and it was imported and built for him. It was delivered today and he checked it over and paid the remaining balance. But once he'd signed for it he was given some paperwork and then told he'd have to register it himself, and pay duty to the DVLA - which he was not told about. We're looked all over the website and it says nothing about this anywhere. At no point did the guy he was dealing with mention that he would have to register the bike himself in order to get a reg plate and insure and tax it. Where do we stand? Should the company refund this money?
