  1. Hoping for some advice..... Had my car clamped this morning for an unpaid parking ticket. The car itself is on finance, so when I told the bailiff this he said he was immobilising the car instead. He's acknowledging that they can't remove or sell the car, but says immobilising it is fine. His paperwork states he has taken control of it, though he says that telling me he's changed that to just immobilising it is enough. Surely he shouldn't have immobilised it in the first place, it's not my property, though it is the car mentioned in the paperwork for the PCN. He's adamant I have to pay the clamping fees to get my car released - is he correct? I'm of the opinion he should never have taken control of it in the first place, as it's on finance. He hadn't checked before he clamped it, he's admitted that - though he says he's still entitled to clamp it. Any ideas?
  2. Hi guys I wonder if you could offer advice please Jbw enforcement agent appeared at my home this morning looking for my 21 year old son. I did not open the door no will i. Son is not here at the moment but i do have a bed wardrobe ect in my dinning room for him to use if he was to be here - no belonging other then some clothes and odd toiletries and no car in his name. Notice just says enforcement for warrant £616 And a ref number . phoned son who told me to open his mail and discovered letters about non payment of dart charge from march this year. 2x £115 one of the numbers matches the number on the enforcement notice the other does not Whats the best way to proceed from here please ? Are they likely to try and take goods from my home ? Should son contact the bailiff with a offer ?
  3. Hi guys. I need some advice on a tricky one. I have bailiffs in enforcement stage, however managed to come to an agreement. Two PCNs, one from a local council, and other one from Dartford Crossing. I have recently filled bankruptcy application and waiting for a decision. Question is: if my application is approved and court order is made can bailiffs still take any further action, or am I ok to stop paying before an interview with OR? I included those pcns in my bankruptcy application. Any help would be really appreciated.
  4. I am being chased for an old council tax bill. The council has set up an attachment of earnings arrangement with my employer (NHS). Now I have had a visit from an agent of JBW who is being very insistent, but not physically threatening. I was about to leave home for a funeral when he called so didn't wish to talk to him in any detail at that time. I have now found the paperwork for the AOE and my plan was to email a copy of this to JBW. Surely they cannot come at me from all directions like this? I work on the NHS bank, usually 20 hours pw but sometimes less, so I don't earn very much and couldn't possibly pay any more out monthly. But I have also heard that one shouldn't enter into any arrangement with them, so my question is: if I email them with the copy of the AOE, saying that is already in place, would that constitute an arrangement?   5. Hello, I had a payment plan set up with JBW to pay monthly, I all payments had been met except my February payment was made 2 days late due to me not being paid myself (self employed). Today i had a visit from a bailiff stating that because the payment was late that it has now incurred a £235 fee on top of what was outstanding. The thing that really stings is that i only had 1 payment left to make for a sum of £138 (due end of March) so now the total has sprung back up to £373!! I have spoke with somebody from JBW and said that i had no correspondence from them saying that the matter would be passed to the bailiffs because of the late payment. They said they had text me and emailed me (i received neither!) and that i had to deal direct with the bailiff (who just so happened to be sat in his car outside) about 5mins after my call with JBW the bailiff knocked on saying that he was in the process of getting a van round to remove goods making the debt spiral higher! I haven't let him into the property (and wont be) but just wondered what other fee's he can concoct to make my bill spiral even higher? I can't believe that it has risen so sharply just because one of my payments was 2 days late out of all the others ive made Any help appreciated
  6. Hi all really need some advice am so worried. We have c/tax arrears for 2015/16 which up to today we had left 596.20 the last payment we we're due to make was late by 7 days due to my partner being self employed and the way payments fell due to Christmas. Anyway we have always made payments as agreed with jbw never have we not paid(over a £1000 has already been paid to them) well today I received a not so lovely visit from two bailiffs who to say the least we're not the most pleasant of people I have ever meet. They issued us with a enforcement notice for full payment which now stands at 831.20 due to 235 in fees. I said to the bailiff could we not continue with the current payment plan of £250 a month to which he replied well how much can you pay today I said £20 as I paid you £250 less than 7 days ago and that's all I have, then the next payment of £250 would be made as normal on 18th Feb. But refused this offer. Now I don't know where we stand there is no date on the letter as to when they will be back either. I never let them into my home and never offered them in either. What worries me the most is if they turn up again when my daughter who has a disability is here lucky enough today she was at school but what about next time she would not react well to these thugs in suits turning up and behaving in the manner in which they did today. I'm really at my wits end I don't know what else to do. Any advice would be grateful. Thank you
  7. Good afternoon, Hopefully someone can give me some guidance at what i can do to resolve a matter i have with JBW group. On the 25/03/14 i received a letter to my address that stated I owed £354 to the London Borough of Bromley for council tax. I contacted JBW via email and asked what and when this was related to, They responded giving me the address of the property and the time period which dates back to 2003. I advised JBW that i don't know anything about this debt and was not at the property at the time the outstanding amount it for.They replied with the following "Dear Mr James, It is down to yourself to provide evidence of this to the issuing authority if you claim that you are not liable as a liability order has been issued against you. Best regards, JBW Group." I do not have any information going back nearly 11 that shows i didn't live at that address at the time so I sent them the following "Dear Sir/Madam Ref: 2171642 You have contacted me regarding the account with the above reference number, which you claim is owed by myself. I would point out that I have no knowledge of any such debt being owed to London Borough of Bromley. I am familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question. I would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods. Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment. I would ask that no further contact be made concerning the above accounts unless you can provide evidence as to our liability for the debt in question. I await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions. We look forward to your reply. Yours faithfully Mr James" They have responded with "Dear Mr James, JBW have a liability order that has issued you as the liable party. If you wish to obtain a copy of this, please request this from London Borough of Bromley. JBW will not be ceasing enforcement as we have been instructed by London Borough of Bromley and work under the authority of a liability order. We again reiterate, if you claim you are not liable please provide evidence of this as the onus is on you to provide this. Best regards, JBW Group." If I cannot prove that I was not at the address at the time what do I do? I have no paperwork going back 11 years for anything. Any advice would be welcomed. Thank you David

Hi, we have an old council tax debt that was near on £2000, we had a payment arrangement with our local council and we were late making 2 payments and it was handed to a bailiff who we contacted right away by email and phone to make offer to pay and set up a payment arrangement. They would only accept amounts we couldnt afford or stick to,we made a clear repeated offer of £50 monthly and did income forms.despite this and our contact with them they then sent enforcement letters citing lack of contact and would not retract them unless we paid the amounts they wanted or the full amount. They were not willing to any payment plan other than one that was a minimum £150 a month and we couldnt afford that.from the start we offered regular payments of £50 monthly. Despite contacting our local council we had no luck in them retracting the bailiffs and the council were quite rude and blunt about it.Regardless we have made regular online payments direct to the council since July,but the bailiff still visits,i think they've done their 3 visits now,we had an enforcement visit this morning with 2 agents and a van. I know the rules about not being able to just enter etc but was wondering is there anything more we can do to stop this little short of being bullied into payments we cant afford because they'd be too high.The pressure and stress is awful.I'd appreciate and help you can offer,thanks,Julie
  9. Looking for some advice please.... We are in arrears with this years council tax, we set up a payment plan with the council but due to circumstances with work we didn't stick to the agreement, we knew it would go to court and be passed to an enforcement agency..... We have had dealings with the same issue over the last few years.... On the 12th sept we received a letter from jbw advising that the amount of £1140 was now payable to them, the same day we received an attachment of earnings order from the council for unpaid council tax arrears, we assumed this was for the amount advised by jbw and never completely read the order. My husband contacted the council to advise he had changed employer and gave new details, he questioned the letter from jbw to be told that the team who deal with it all will get it sorted..... After receiving another letter from jbw advising they were taking it to enforcement stage I rechecked the attachment order which i have realised is on,y for £53, possibly for a previous years council tax. So now we are unsure of what to do next, my husband will ring the council tomorrow to try and organise a payment plan directly for weekly payments until 31st March then the account will be clear, I have a feeling they won't agree and will advise to speak to jbw, checked online with jbw they want £290 upfront then payments of £88, we don't have the initial payment so at a loss of what we can do.... Any advice on dealing with this would be great, we have had bad dealings with previous bailiffs being threatening so very reluctant to deal with these.... We will not let them into our home and will keep our property secure..... I have a car on hp with another 4yrs of payments left, can they levy on this or not? My name isn't on the bill just my husbands.

I am hoping someone can help me please, today I had a visit from a JBW Bayliff,, who was pursuing me for a council tax debt from 2011 from a previous property, In all honesty I thought this had been dealt with, he told me the LO order was put in place on the 24/10/2012 and that he was here today to take my goods, I explained that i thought it had been dealt with and I explained that I was going to phone the local council to get clarification as I already had a earnings attachment order on my wages, and had a previous attachment that had now been cleared, he said he would give me 5 minutes to sort it out, i locked my door and phoned the council, the council explained that the money was still outstanding, and that they couldnt find the attachment of earnings that i had already paid off, then the bayliff came back banging on the doors and windows, i was still on the phone at that point to the council, i opened the door and told him i was still on the phone, he went back to his car, he never provided me with any paperwork etc. turns out the debt was still owed despite me thinking it was paid, he wouldnt leave and kept on returning to my door, now normally i wouldnt of ever opened the door, and with me just recovering from an operation i was highly emotional, he wouldnt except a payment plan or give me 14 days to sort it because, he said 3 letters had already been left and that he had no choice but to take goods from the house, i told him he wasnt setting foot in my property and he said he would take the campervan parked on my driveway which wasnt mine, i went into full panic mode and phoned my mum in a distressed state, who just paid the amount via her card to him over the phone, now the debt is cleared, however now that i have calmed down and thought about it, i am still unsure of the charges. Are these charges correct?
  13. Morning, Had a letter from JBW "Notice of Enforcement" Bromley Council. Left the address (repossessed) mid 2008. Spoke to Bromley and they informed me that I was responsible for the CT until the property was sold. That's fine not a major issue but they won't take payment from me and told me to speak with JBW. Problem is I have emailed them 3 times now (don't want to speak on the phone) and still no response? I don't want them turning up and adding charges etc. Not sure if I should ring them? Also I heard somewhere that a warrant is only valid for 12 months? The Warrant Issue Date: 03/07/09. Does this have any bearing on their right to collect? I am fine paying the debt although it will have to be in instalments just heard so many bad things about JBW. Thanks in advance
  14. :sad:Hi - I have council tax arrears and spoke to my council yesterday to organise a repayment plan, but was told that this has gone to the baliff - JBW Group. I called them (I have not recieved a letter yet) to organise a payment plan and was told that they cannot organise repayment plans, they have to have someone visit and take notes of all my goods and discuss repayment plans then. This sounds very odd to me, and was also told that if I don't do it this week then the charges next week will be nearer £300! I've organised a time on Friday for them to visit but I really don't want to let them in - I just want to spread the payments over 3-4 months - do I have to let them in? Many Thanks
  15. Hi there, This morning I had a visit from a bailiff from JBW Group who had clamped my car parked on private property. I had not had any previous visits from them and they had not previously levied the goods (car) via a signed walking possession order. As he clamped the car without this would this be classed as illegal as it is an abandoned levy? What he did provide me with was a notice of seizure of goods & inventory. I explained to him that my circumstances were classed as vulnerable and that I could put a payment plan in place. He informed me that he would have to speak to his manager. Meanwhile I went inside and printed out some documents to prove my vulnerability. I went outside to give him these documents and discussed a payment plan. I was prepared to offer £50 per month (given that I am currently not working). He laughed and stated he would be able to accept £50 per week, and there is no way I can afford that. Amazingly however, he did agree to remove the clamp!?!?!? However, he did stated that the case would still be live and he wouldn't be sure when the next visit would be, could be later today, tomorrow, but I got the impression maybe not him (would he be passing it over to another bailiff?) - perhaps he was concerned about the whole vulnerability aspect? Immediately after he went I phoned their office at 8am and explained the situation and emailed a letter over to them explaining my circumstances of the vulnerability (suffering from stress and depression for 2 years and now being classed as disabled due to this having had to have my employment terminated in Dec 2013 as a direct result). I also sent letters to TfL (Head of Contracted Services & also their Director for Congestion Charging & Traffic Enforcement Directorate for whom I managed to get the name of the Director). I sent these by secure recorded & signed deliver and guaranteed next day delivery. I also copied the letter I sent to JBW to TfL as well as sending the letter to JBW in hard copy. Within both letters I included all my evidence as proof of situation. The fees listed on the Notice of Siezure of Goods& Inventory are listed as: PCN & Court Costs £202 Sending a letter £11.20 Levy/attendance to levy £57 (I have had no previous visit from them, so I am confused about this) Other £175 (what does this mean?) VAT £48.64 TOTAL £493.84 Later today at 3pm and 8.30pm I received 2 further knocks, this time I had parked the car away from the house and did not answer. Is it possible that they would revisit my property another 2 times today? Any general advice on the situation gratefully received and advice on fees would be good. Also, the continued visit are making me very stressed and adding to my general state of ill-health. Thanks for you help in advance!
  16. Hello This is my first time here and I have done some research and THINK I am heading in the right direction but just checking! We have a LO for council tax. It's gone to bailiffs. I have asked council to accept a payment plan and they say no, talk to bailiffs. They have visited. LO is for £1300. I have contacted them in writing asking them to accept a payment plan. to which they said they couldn't without a Levy in place. As far as I have read, this is untrue and grounds for formal complaint. I replied to this effect and they "note the content" but still say they need a Levy in place. I've told them they won't be coming into my house and that I will pay them their £47.50 but that I will pay the rest directly to the council in instalments since JBW have refused payment. I have now had a text message saying that they will add further charges (which, as far as I can see, they can't). Checked the name of the Bailiff on the register and its not there. I've done it all right so far, haven't I? (other than not being able to pay my CT in the first place) (all correspondence, including them saying they can only accept a payment plan once they have a Levy is in writing and stored). What next? TIA
  17. Guys/Gals Had a final notice posted to me fromJBW last week with charges for an alleged PCN, amounting to nearly £600. I wrote to them for a full cost breakdown. They replied that the original was put through the door on a certain date, the strange thing is, my door was off the hinges due to a new door being fixed so i know they did not attend. The one charge I have been hit with over and over is for 15 telephone calls to my aleged answerphone on a landline number I used to have over 2 years ago. They state this was given to them by a service provider. I have checked the bailiff fee scales and no where can I see a scale for telephopne calls etc, can anyone advise on this.Thanks

HI, i received a letter through my door on 13/08/13 from JBW with reference to an outstanding PCN, fee's as below: Balance before visit £101.44 Attendance to levy fee £33.60 attendance to remove fee £210 TOTAL £345.04 I sent them a letter on the same day stating that i had no problem paying the original fee together with a £28 first visit fee (as this was all i was aware they could charge) i also said i was un-willing to pay the £210 removal fee as they had nothing to levy on. I enclosed 2 cheques for £64.71 each, amounting to £129.44 which i believed to be what i realistically had to pay. they cashed one of the cheques and sent the other back to me as it was postdated and they said they weren't allowed to keep these, nothing else in the letter so i assumed evrything was sorted. I woke up this morning to another letter with more fee's added whcih now amounts to £523.92 and they have clamped my car!! I have spoken to their advisors on the phone who have informed my that all the fees are correct and they have been authorised by by their client (my local council) to charge these fees. I have spoken to the council who say this is not the case and they dont authorise any fees of any kind. I have asked for the fees to be removed and i will pay what is owed and they have refused. I am going on holiday to france tomorrow and need my car, i cant see any option as this time but to pay the full amount and try and reclaim the charges back at a later date. I have also been to citizens advice this morning who told me they cant help in any way. I would be grateful of any advice. Thanks

They have written to them explaining they have the wrong address but have ignored. The name on the letter is asian and they are white british. Would upload letter but not enough memory.   20. Hi, Not sure anyone can help here. Just had (today) a rep from JBW Group knocking on my door requesting that I pay £398.33 for a council tax. Pretended to be a court bailiff to start with, followed by a rep for Hounslow council then an employee for JBW Group. No identification shown at all even though requested. Threats of taking stuff and court were made. After some questioning as I thought it was a load of tosh, I apparently owe council tax or £355.83 + £47.50 in costs dating back to 16/10/2003 which was the "offense date". The sum was issued in 16/9/2004. Now I lived as a private renter in the place in question for 2 months, paid council tax for that period and notified the council when I left. I cannot prove this as it was a decade ago unfortunately. Anyway, the whole thing sounds fishy. How should I be dealing with this, bearing in mind an arbitrary sum has been pulled out of the air and no papers from the council, JBW or any court have been issued. AFAIK this is stature barred after 6 years. Any help appreciated!
  21. Hi All I wondered if someone could give me some urgent advice. Myself and a friend have a joint Motor Trade Insurance policy and we buy and sell cars. My friend was driving his car on Tuesday when he got pulled up at the side of the road by a Police/DSS/Bailiff road block. The JBW bailiff told him that there was outstanding parking fines in the name of the company (would not tell him what vehicles they were for) and said he was seizing his car. My friend disputed this even consulting with the police who said yes its unfair but you have no choice but to pay. Needless to say my friend paid £3100 (for FOUR tickets) and drove away. He has since reported this to his bank and disputed the payment, has anyone any advice on which grounds he can dispute this transaction (under duress etc) and the fact that the fines do not apply to his car. After all the Logbook clearly states that a registered keeper is not necessarily the legal owner. My thanks in advance
  22. Hi all, I'm hoping that the kind people here can advise me. This afternoon I found a letter pushed through my door in an envelope marked Delivered by hand with a space to write the time and date but none was written. Inside was a Notice of attendance from JBW. The box with details of client and balance etc are typed not written. Myself or my husband have been in the house all day and no one knocked on the door apart from a man about our bins so obviously nothing to do with this letter as he showed me his ID. . Anyway this letter states Balance Before Todays Visit £191.44 Attendance to Levy Fee £62.40 Attendance to Remove Fee £210.00 Total Balance Now Due £463.84 The enforcement agent visited with the intention of seizing and removing your goods. The cost of this has been added to what you already owe and the total amount now due is shown above It then goes on to say I mus pay the total immediately to avoid further enforcement action which may increase the amount you owe substantially. Enforcement action can continue at any time and without warning. Theses are the main points of this notice. It has a squiggle at the bottom but no name of anyone. However no one actually knocked on the door and they must have done it very very quietly as I have 2 dogs and they bark as soon as anyone is near the door. This is for a Parking fine. I don't actually remember getting anything about a parking fine although I may have due to stress of my son having to go into foster care lots of things have slipped past me the last 7 months as it's an ongoing battle at the moment to get him the help that he needs. Back to this notice of attendance I do not have £463.84 we are on ESA WRG due to my husbands cronic illness we are currently having his DLA claim re-looked at. Are the Fee's correct? £270 for posting a letter through the door? This is also the 1st contact we have had with JBW re this PNC we did have another one about a year ago and we paid them nearly £500 for that one, well my father in law did which we are still paying him back for. I guess what I am posting for is what can I do about this? As far as I know nothing has been levied although our car is on the drive I've seen lots of advice to move it well away but that really isn't an option as my husband cannot walk far and I don't drive. The car is not on finance nor is it a mobility car, it's worth at a guess £2000 and is vital for my husband to be able to get to his hospital appointments etc as he cannot travel on public transport due to his condition.   23. Hi all, I have no idea how to deal with my situation and I hope someone could be able to give me some advice. My boyfriend got a parking ticket by Newham London/TFL which he failed to pay on time (December 2011). Marston Group was after him. When he got letter from Marston he paid penalty same day (July). Few days ago he was clamped on the street by JBW. When he asked for what they said that for ticket from December last year. He informed JBW that he already paid this ticket but JBW said that he needs to pay £500 and if he really paid he will get money back. He tried to contact council and both companies but they sending him from one place to another. Just to be 100% sure he contacted Marston to find out exactly for which ticket he was charged in July. Marston respond that they are not able to provide the details. We have all the receipts and letters but we are trying to link both companies to the same offense to make sure that we actually paid twice for same ticket. Can someone advice if there is any chance we can get information from Marston regarding our payment. For me it pretty clear that if I am charged for something I should be informed exactly for what. Is there any act I could refer to to get the information. Please help!!!! Thank you in advance

After having a run in with JBW a while back and i submitted an out of time application I thought all was fine until now someone for JBW has just put a clamp on the car I use, but don't own JBW have been told that I don't own this car so it is quite clear that they are doing this to harass. Aparently my appeal was turned down but this is the first i have heard of it. Were do we go from here as the car cant be towed as it is not mine. This has been done by a Mr steptow/e who is not a registered Bailiff at least not for JBW.
  25. on Monday this week I received hand delivered letter from JBW relating to a tfl congestion charge. There was no tfl reference on the letter. I contacted tfl as i had not had a congestion charge and they told me it was in February which is odd as i haven't been into London by car this year. anyway i went to do a PE2 and PE3 from the TEC as the bailiff had come late on Monday i would not be able to get to the County Court for a witness signature until Wednesday. On Wednesday morning they clamped the car that was supposedly involved. I am the registered keeper of this vehicle but not its owner. I got the forms signed, witnessed and sent on the Wednesday. I then turn my attention the bailiff himself on the first letter the signature was just two upside down Vs the second letter was had a name that looked like Mr. ***** or *****. I sent the following e-mail to JBW as I couldn't identify the bailiffs name and to inform them that they have clamped a car I don't own. Also thee balance has gone from £268 in the first letter to £550 in the second. This is to inform you that despite your not allowing reasonable time between visits letter was hand delivered on Monday and a car was clamped on Wednesday i have submitted an out of time application PE3 and PE2 forms to TEC as your bailiffs visit on Monday was the first contact made about this alleged charge. In addition the supposed fee of 550.84 for a unknown fine off £200 is wholly disproportionate to the original charge and according to law the maximum i could be for the two visits is £296 i request a complete breakdown of costs as to what exactly you believe you are charging for, i have included the relevant law below and the calculation of costs as worked out to the letter of the law. 1For preparing and sending a letter advising the debtor that a warrant is with the bailiff and requesting the total sum due£10.00 Note:The fee under paragraph 1 can only be recovered if the letter is sent before a first visit is made to the debtor’s premises. 2For levying distress— (i) Where the sum demanded and due does not exceed £100 £20.00 (ii) Where the sum demanded and exceeds £100 20% on the first £200; due 5% on any additional sum over £200 For attending to levy distress but where the levy is not made, the reasonable costs and charges for attending to levy.The costs and charges are not to exceed the fees and charges which would have been due under paragraph 2 above if the distress had been levied.The costs and charges are subject to taxation under rule 11. 20% of £200 is £40 x2 visits = £280 20% VAT is £16 Grand total of £296 Why have you £254 more than the law says you can. I am also informing you that Whilst i am the registered keeper and main user the Ford Mondeo registration ****** i am not its owner therefore any attempt to tow it would not be legal. Finally the names of the bailiffs on both letters are unreadable please supply the name of the Bailiff/s dealing with this as i wish to check they are registered. This morning he left a message that confirmed it was ******. I have checked online and there is nobody with this surname certificated. Unfortunately the MOJ must be at the Olympics as their telephone keeps going through to answer machine. I sent a text to the mobile number asking him to supply what court he was certificated at and when. they only reply i got is who is this. I'm dubious about revealing who has asked this I don't want him to harass me via my mobile. Anyway that is where I am at the moment any advice as to what to do next would be much appreciated. I have stared out the names as i though it might contravene forum rules to reveal them if it doesnt i will hapily put them back in.
