  1. Hi, I wonder if anyone could offer me some advice. I am not sure if my question fits into this sub-forum and I am sure it will be moved if I am wrong. Anyway, I had a judgement made against me for a store card a few years ago for around £1,100. I agreed a monthly payment of £15 a month which I only managed to keep up for 6 months and never hearly from them until today threatening an oral examination unless the balance is paid in full or a payment plan can be agreed. I had hoped to be receiving a pension but I only have nine qualifying years, and there is a delay in getting some qualifying years transferred from many years working in Ireland, but doubt I will have that sorted before Christmas. So my earnings are £0. My husband has offered to try and help, but we are struggling to keep on top of everything. Any suggestions on how I should approach this?
  2. I've posted several times on the forum regarding different issues, but this is something I strongly suspect is false paperwork. Had to order the Judgement Debtor to attend for questioning for the fact we have a CCJ and they're not paying. So, she brings all the evidence (and I was there to witness all this, and have their partner stare me out silently) and I receive a copy in the post. Now I'm not sure this is where I have any case whatsoever. They submit their partner's wageslip as "any other income to the household" and the wageslip stinks. Tax code is a very old one (it's 10000 now, this is less than half that), a date showing next year's date, a tax office reference that the HM Customs & Revenue website doesn't recognise, the amount earned to date divided by the date (back to 4th April) shows they earn more than stated on this wageslip and finally, no one seems to have heard of the job title shown on the wageslip. All adds up to something fishy methinks. But can I go back to the Court to point these irregularities out? If I can get evidence of false paperwork (ie non existent tax office) would this be classed as contempt of court for submitting falsified paperwork?
  3. To cut a long story short (this is in an old thread I started around 18 months ago), we have a judgement for just over £6000, which we are currently attempting to enforce. We had an Examination done which gives all income/expenditure details, looking like we won't get much per month (£150 offered), but it we accept the £150 in a varied order, can it be changed afterwards (as declared in the Record of Examination is a large loan due to be paid off in around 2 months which frees up just over an extra £200)? Therefore after 2 months could we request £350 per month as this will be the amount surplus after this time. Other than that are there any other items I could discount (ie non-essential items/bills) which I could refuse to take into account? Many thanks.
  4. Hi My letter transferring me from IB to ESA arrived on Friday, sending me, as usual when I get such letters, into a paroxysm of anxiety and an epileptic fit. However, this was followed by a phone call today. My husband, recently made redundant, was fortunately home to take the call and tell them that I was not in a state to answer the call, having had several anxious and sleepless nights followed by daytime exhaustion and fits. My question is - why are they calling and not sending me the form? Do they want me to answer the questions on the form by phone? If so, what should I do? I can, with the benefit of the answers on some threads on this site write out some of the answers and my husband could be nominated to answer the questions for me? Would that be a good idea. Please advise - also, what to do about the mental health section of the form if and when it arrives?
  5. hi all i have recieved a letter from hmrc saying they are doin a examination of our claim under the 2002 act section 16(3) a well i phoned the number on the letter yesturday to update them on my childcare amo0unt change on 13th september and i had never informed them. the problem we have is that they require all origional documents as evidence such as bank statement, rent agreement, council tax bill, childcare invoices/receipts payslips p60 p45. the problem is that my husband applied for his indefinate leave to remaine in the uk visa on september 19th and can take up to 6 months, and we had to send all original documents to them i have check and if i request the documents to be returned they will cancel his application refund the fee and we will have to apply again so that in NOT an option for us, when i sopke to the lady she said i would have to put that in a letter when i send in the documents that i do have and they will look at it. i know its a bit of an odd situation so i guess there isnt many people who have experiance of this but any advice would be great as im stressin out here
