Hi, I am currently going through the ombudsman stage, in demanding repayment of account fees for additions 2000(?) - 2004, additions plus 2004-2012 and no 'downgraded' current account with overdraft of £1, 700 and daily fees of 0.75p and £1.50 depending of if the overdraft is 0-£700 or £700 to £1,700. I have complained regularly over the years to Barclays but only had occassional fees reversed. The package account fees at worst were £192.00 per annum by 2012, whether in credit or not. In 2008 Barclays imposed a £1000 reserve with paid transaction fees on top of a pre-existing overdraft of £700. I complained about this at the time, but was initially told I needed to have it. At this time I had £20,000 in savings with Barclays and had more than £2,000 in credit and there was no reason for them to add this to the account from my point of view. Later when I went into debt on the current account I was charged multiple £22.00 paid transaction fees, when over the £700 limit. In 2014 The resolve loan was automatically converted to an overdraft facility with daily fees, which I didn't agree. I wasn't adequately informed of this change. In financial year 2014-2015, I was charged more than £450 in daily fees over one year and since then the annual cost in fees have been similarly high despite little use of the account. In 2015 I made only 3 withdrawls and have made no withdrawls since 2016. Last year, 2017, Barclays offered a resolve loan with no fees and monthly payments (after turning me down for a hardship loan) on the basis that I showed that I could manage to pay 3 installments of £150.00 per month in May, Jun and July. I did this and Barclays did not charge the daily fees for these 3 months and at the end of July I was sent a letter stating that now I had completed the 3 payments "I still needed to get my account back in order" and I could "pay in [full] at any branch" etc. the outstanding amount of arrears; which I had reduced to £1,413. There was no mention of the original resolve loan and the letter made no sense because the loan had been the purpose of making the regular payments in the first place. I felt let down by this and didn't know what to do, as I felt it was Barclays duty to fulfil their part regarding the resolve loan, which was at their instigation in any case. The grinding daily fees were reapplied in August, in December 2017 I received a letter saying that my balance was £1,596.44DR and that they 'recently' wrote requesting a payment. On 22nd Jan '18 I received another letter stating that my current account was overdrawn by £1,644.44 and that my 'agreed' overdraft limit was £10.00 and thus I was over any 'agreed' overdraft limit, still no mention of the resolve loan. I phoned Barclays on the 9th Feb 2018 to question this and make a complaint, which I did. I also complained about the packaged account fees between 2000 and 2012. I was given a complaint reference number and told that someone 'could' get back to me within 48 hours. Hearing nothing, I phoned again on the 16th and was told that my complaint had been closed I was put on hold for about 20 minutes twice before someone got back to me to say that it hadn't been closed but that it had a new reference number due to a migration of systems. I sent a letter of complaint to Leicester customer services and copied it to the Cheif Exec at HQ London. I phoned later to demand an acknowledgement of the complaint. This took some time I was sent a letter saying that my packaged account claim was being investigated and they split the complaint into two periods (for the same account no.). I later received a phone call from a customer services manager admitting fault re: the resolve loan and repayment of all fees since I used the account in 2016 and £544.25 in refunded daily fees and £140.69 for my inconvenience (over 20 yrs). After everything that has happened with Barclays over the years I refused to accept this but insisted that the manager put this in writing. A week later I received a letter confirming this and saying that their investigation of this (the non-packaged time) was now complete and I had a right to go to the ombudsman. I phoned the ombudsman but was told I couldn't complain yet about the packaged bank account because Barclays had not yet completed their investigation but that I could complain re: the recent period. Now I am not sure what will happen with the ombudsman but it's already taking weeks with 'out of office' replies to my emails and when I phoned Barclays they will not speak to me. Can (and should) I go to small claims for negligence?

  3. Hello! I went to court with my neighbour over a land dispute. I had to withdraw from the trial because I am deaf and the audio loop wasn't working, but the Judge refused to adjourn... This is probably a whole other area, however, the neighbour was awarded costs of £23k and has now placed an Interim Charging Order on our jointly mortgaged house. My husband is not the debtor. I want to know if I can argue that the Award is unfair, not just because of what happened in court, but also because it includes a 100% success fee, which I feel they are not entitled to because I did not receive the Part 36 Offer which the neighbour's lawyers said they sent to me prior to trial. They are unable to prove I received it as they only sent by first class post. The hearing to decide whether the Charging Order is to be made final is in August, and I wonder if anyone can advise what I should do if I wish to object to the award for costs. My husband will object to the Charging Order. What argument should he provide, please? There is little equity in the property, as there is a lot of work which needs doing, including subsidence. The Judge was biased and failed to adjourn when it was discovered that the Audio Loop necessary for me to participate in the Trial, was not working. He instructed the room to shout and speak slowly for my benefit. None did as they were all the opponents witnesses. All of what they said under cross examination was of no consequence. I entered into litigation after much studying, and was confident of success. What went wrong? I am now being taken to court by my opponent for his costs.. £23k.. He is trying for a Charging Order, too.
  4. Hi, Im desperately hoping someone can advise... To cut a really long story short, i took a career break from my bank job to care for my sick husband in 2012. It left us with minimum income other than disability allowance and carers allowance as because i was still classed as employed we were told we couldnt claim any other benefit, not that we wanted to. We never have had any state benefits. My husband passed away in 2013 and i had to pay his funeral costs, half of which i paid upfront. His family were meant to pay the other half but never did. Subsequently the co-op billed me. I had gotten in to a mess financially since still being off work, entitled to no benefits and trying to deal with my own grief aswell as supporting my 9 year old daughter with hers. Falling behind with mortgage payments and council tax i had to agree to pay almost double on them both to avoid reposession of the house and removal of goods for bailiffs. I counted these as my priority debts and put everything else to the bottom of the list including the coop bill. They issued a ccj against me which unfortunately then meant i couldnt go back to my old job (i work for a bank and policy is no ccjs). I have since started up my own business and draw £100 a week wages when there is enough money to take of course. I also now get working tax credits so a tiny bit better off. The solicitors dealing with the case sent me an enforcement notification. I rang straight away to see if i could make some kind of arrangement but they said no. The original outstanding was £2200. The ccj had £2900 and now ive had a letter through the door telling me its £3900!! The bailiff has said in the letter he will come back and take my car. And other goods within 7 days, i have tried to speak to the solicitors but they've said its pay the lot or nothing. Ive submitted for n245 to the court with a copy if my income and expenditure but i really need a bit of advice. Will the bailiff allow me to make payments by instalments or will they just keep coming back and taking my things regardless of the fact i can prove i dont have the means to pay. If they take everything i have and its still not enough what will they do then?? I feel totally helpless Hoping for some/any kind of advice... Shelley
  5. hi I recently finished a full time course at the end of january and started signing on to job seekers allowance while looking for work. At the first meeting at the job centre before anything else was discussed i was told that at the start of all new claims there is a mandatory 12 weeks of daily contact. After questioning this i was told that this is a national policy for all new claims. although im not attending every day i'm getting appointments to attend 2 or 3 times per week and must email my job search activity, jobs applied for, and forward all email responses from applications. i was told this was to help me find work but after almost 2 months all it has involved is keeping them updated on my work search activity with no help whatsoever towards finding work. after searching online i cant find anything about a mandatory 12 weeks of daily contact for all new claims so suspect that it is just some local thing. can anyone let me know if this is a national or local scheme? i expect that things like this are intended for people who who need help or encouragement towards looking for work rather than everybody, and as i was placed on this before anything else was discussed they have no reasons whatsoever to suspect that i might need this extra attention. Is there any national criteria to determine who gets placed on this daily contact which i could use to complain & be placed on the normal fortnightly signing?
  6. Found this on the Mail where people are being hit with default CCJ even for a penny they know nothing about until the bailiff knocks or they are refused credit. It's a shame as the old address issue needs to be out there, had the reporter \ editor done some proper research, this could have really got it out there. Maybe needs moving elsewhere.....
  8. When I got my assessment report through from ATOS, there are vast problems. The lady nurse, for one, said I was smartly dressed and coped well at interview. Firstly, I wore jeans, and said I did not have time to wash my hair as it was a mess. I was not coping at all, I kept stiuttering and had some difficulty in answering some of the questions, my mum stepped in and answered them for me. I was awarded 0 points, considering I showed her my dosset box and medication and said my partner helped me in and out of the bath where needed, even though I have had rails I can use. I then stated I had trouble with pain in my hands due to having fibromyagia and had difficulty in cutting up veg, and felt unsafe to cook without supervision, I got zero points!! She also scored me zero points even for the fact that I cannot budget with money. I did get enhanced rate for mobility, but I am not happy getting 0 for daily care. How do I do a mandatory recon please, Iam so shocked going from middle rate personal care on dla to scoring nothing, potentially loosing £53 per week.
  9. This has been going for years now, what I want to know is why are these haulage companies not doing more to protect their vehicles, and drivers? Thousands of illegal immigrants have come into this country over the years, you can watch them on television, and see how they are managing to break into vehicles, we should have been able to stop this by now, it’s just shame that none of these firms are doing enough to stop it, there must be away. The sooner the better.
  10. I have been bullied at work by a colleague and raised a grievance. The meeting is next week which is making me very anxious and panicky. I signed off for anxiety and stress at work, informing my line manager that I will stay out of work until the meeting, because the stress is affecting my mental health. The absence will be less than five days. My manager's manager insists that I have to call in every day. I checked the Sick Leave Policy and there is only mention of keeping in touch, nothing about a sick employee calling the office every day. Is this allowed?

  12. I have for the last three years worked for a UK based company in Holland doing 2 week on 2 week off 12 hour shifts. We are paid a daily rate and I would have classed my self as an employee as I am PAYE. About a year or so ago 30 mins before a Maritime Labor Convention inspection I was asked to sign a contract as it was required for the inspection. I signed. It states under wages that the amount included holiday pay. no amounts are given and as I understand it this is okay if its negotiated, transparent in the contract ( x amount is wage X amount is holiday pay) and its shown on the pay statement. None of this has happened. My question is can I claim for Unlawful deduction of wages as I have always understood that my daily rate was just wages. Now you may ask what about holidays...we dont take them as we in effect get 26 weeks a year off. To muddy the waters even more the company has been bought by a Dutch company. Does a ET have sway over a European company.

  17. hello hope some one can help me. as of monday just gone was told that i had to attend the jobcentre daily at different times to do a job search now been told this i had to go back to the JC the next day for 1:35 which then i was made to sign and was told since i had been up yesterday which was monday that he was going to do job search next time i come up. so after leaving the JC he forgot to give the new time which was for 1:00 for the following day when i got there he told me that and that it was his fault since he didn't tell me then was made to sign and no job search again. he gave me a new time for 9:35. to me they either can't be bothered to do the job search to help me find work or there just find it funny me turning up just to sign a bit of paper and give excuses. i do my job searching at home since i have my own computer and internet with a job match account and can't really see how making me go each day is making any difference especially when they have done nothing to help. also can someone tell me if the distance from JC is too long that they can't expect you to go each day as i live 3.0 miles away. had some information that if you live within 2 miles then they can make you go each day and if 2-4 miles then they have to make to twice a week. just what i read up on the internet. thanks in advance.

  20. I use Accueview Moist daily disposables. I have seven contact lens holders and starting with one pair of lenses I use them for a day and then store them in a holder using Tesco or equivalent saline solution. I continue to use a pair a day until all seven holders have been used and then use pair one again. It helps if you put numbers on the holders with indelible ink. I then continue to rotate the lenses and in this way one pair will last me approximately seven uses. The number of time may vary, sometime a pair may only be used twice and may then feel 'gritty' and have to be discarded because they've been used in dusty conditions (or whatever) but others may last longer than 7 days. I've been doing this for many years now without problem, and the (obvious) secret is absolute cleanliness and disinfecting the holders once they have finished their cycle. In this way a month's supply will last me six to seven nonths.

  22. There is a retail centre car park beside where I work operated by a well known Parking Enforcement Company. I park in it just about every day. Over the pasty few years I have tried to stick to their 3 hour limit, but have had about a dozen parking tickets from them, all of which I have ignored and they have gone away. You can pay a pound to park in the car park all day, but I never have. Recently, I have decided to try and beat their system. Basically, I'm parking in the car park all day every day and have done for the past 2 weeks. No tickets have arrived yet. My theory is that they will eventually realise that they are wasting their time and money sending me tickets and the tickets will stop altogether. Has anyone else done this? Will they have the sense to stop paying the DVLA for my address? Will the tickets ever stop? Also, if anyone wants to advise me to stop. Tell me why. Thanks

  24. Hello, MotorMile now "own" a debt from WagedayAdvance have been contacting my work every single day 5-10 times a day leaving messages, threatening bailiffs to visit. Doesn't scare/bother me in the slightest but Ive just contacted them and got into a huge argument with one of the staff members asking them to stop calling my work and harassing me while trying to force me to pay a non priority debt. I booked 2 weeks holiday off from work to enjoy with my family and received them while i was away. Now hes basically saying if i can afford a "holiday" i can afford to pay my debts and a doorstep bailiff will be visiting anytime soon. Leading to more arguments, saying i don't allow a bailiff round etc etc and then just told me to grow up and stop being a loser and pay my debts. Then hung up the phone. Is there any reason i should pay the debt if i'm getting continuous harassment and told to grow up? then hung up on. What would you suggest i do? ill be honest Ive ignored the debt as its not priority and i have more worrying matters on my hand but just getting back to work today and being took aside by my manager about all these voice mails being left on the company phone has left me feeling crappy and embarrassed to be honest.
