  1. Good Afternoon. I have access to all 3 of the credit reference agency's i notice there is a default registered for £65 by Vodafone. I have never received any notices for this account and as far i was concerned this account was closed. If i knew about the outstanding balance i would of paid it to avoid a default especially as the value is very low. A bit of a long shot but would it be feasible to pay the outstanding balance of £65.00 and have the default removed? Thanks

  3. Hello, I have discovered that there is a CCJ from 2011 for over £7k against me. I think it relates to a credit card with MBNA. The thing is, at the time of the issue of the CCJ I had been living abroad for over two years and had informed MBNA of this fact - never received a reply. The CCJ was taken out by a DCA and not by the original creditor. I doubt my change of address was noted. Instead the CCJ was taken out at my parents' address - which was not my last known UK address, but my last but one. I would have disputed the amount as this seems incorrect. I also would have issued a CCA to ascertain whether the DCA had the necessary paperwork for legal action. I received no information regarding this matter and was totally unaware of it until yesterday. My intention is to apply to have it set aside. However, there is the timescale involved - is it too late to do so? Also, the DCA may argue that they were unaware of my change of address and that they served at my last known address (although they didn't). Is it possible to make a defence that I dispute the amount and that I would have made a CCA request? Is the fact that I was never given the chance to present a defence a defence in itself? That I never heard from MBNA that the debt had been sold or from the DCA that they had purchased the debt?
  4. Hi, This is my first post on here so hopefully i am posting in the right place! I obtained a copy of my credit file last week and noticed that a CCJ has been entered against me from November 2013 from Welcome finance (HFO capital Ltd) this debt relates to a very old debt dating back to approx 2004, which was a loan for £3,000. Some of this i have repaid and the outstanding amount is said to be £1,890.15. I was paying this off each month until i went on maternity leave and my financial circumstances changed. I had several discussions with various people from HFO and their solicitors Turnball and Rutherford, however after these discussions nothing came of anything and to be honest they were the last thing on my mind once i had a new baby in the house. I had never recieved any letters from them and certainly nothing to do with court proceedings/CCJ's being issued etc. I contacted the court and requested a copy of the judgement and claim form.. . the court has sent me the copy of the judgement however they have written to tell me they do not have a copy of the claim form and that this may be with the claimants solicitors Turnbull and Rutherford. The courts passed on their contact details to me and i have tried contacting them and HFO but the number is no longer in use and according to the internet neither are no longer trading???? I am at a loss as to what i do as i have no way of even contacting the company about the so called CCJ they were meant to have sent me. I feel totally sick as the reason i got a copy of my credit file is because i am looking to get a mortgage and something was flagged up.. ... Everything now is such a mess and my future plans are looking very dismal! The annoying thing with it all is i was always happy to pay it off and i don't feel like i have had a chance to sort the problem out as i had no idea the CCJ had been placed on record. Is there anything i can do? Any advice would be greatly appreciated..
  5. Hi all, Sorry new here but hoping you may be able to help. I have just registered with noodle as had started to receive calls from a company called MKRR. They wanted me to confirm who I was but as I had no idea who they were and so wouldn't confirm anything with them until they confirmed who they were. Unfortunately they are now persistant and a web search revealed they were a debt collection agency yet until i can confirm who they are and what they represent and want I am not comfortable passing their identity confirmation checks!!! Once registered with noodle I was surprised to see 3 defaults on my file. One was from Mkdp llp with a default date of 30/11/2010 and the other two are from Marlin financial with a default date of 29/11/2011. Obviously neither of these companies are MKRR and I'm not sure where these defaults have come from as I have never received a default notice and not sure what the debts are for? Anyone have any suggestions of how to tackle this? With many thanks in advance, ZF
  6. I have today been visited by Marstons bailifffs in connection with an unpaid fine. The dilemma I have is that I had a fine which was paid in December 2014 for £70 and upon speaking to the bailiff I was told the original amount was £70. However they say it must be for a different fine. I have proof that I paid £70 in December of last year but I cannot find a matching reference from my online banking that relates to the visit from Marstons. They are now claiming £380 from an original £70 fine which I beleive are one and the same the question I have is how do go about finiding the information I need to stop this. I have 48 hours grace from Marstons before they say they will enter my home with locksmiths if neccessary to remove goods. Can anyone help?
  7. Hi All, I will keep this brief and elaborate later if required. I received a letter from Shoosmiths Solicitors (Northampton office) on 29 April 2014, stating that they were acting on behalf of their client Marlin Europe II Ltd to recover a debt of £8675.25 and that I contact them immediately. I was unaware of any debt due, unaware of Marlin Europe II Ltd and no idea what was going on. Obviously I was shocked by the amount and wrote to them on 30 April 2014, requesting information on the debt, using the standard "prove it" and also requested that all legal process and collection enforcement be suspended until the information was received. The letter was sent recorded delivery. Since then I heard nothing until Saturday when I received a citation from Haddington Sherrif Court. (Scotland). I really need some advice on my next step as they (Shoosmiths) have obviously ignored my information request and ploughed ahead with court action regardless. I have 21 days (18 now) to defend this action, but this is impossible if I have no information on the debt to base a defence upon. I have no idea where to turn now, do I: Write to Shoosmiths, who's address on the citation is now their Edinburgh office and request information again? Write to the court and explain I cannot submit a defence as Shoosmiths have not given the requested information and I cannot build a defence on nothing? Really pushed for time on this one, any suggestions would be appreciated. Thanks
  8. Hi all Can anyone help me? I own a car which I rarely use as I have a company car and my own car is left at home and general used from time to time by my Mum, my brothers and one of my brothers' girlfriends depending on need. I work away and take the company car with me. I received a notice that somebody had parked my own car on private land about 6 weeks ago and everyone is denying it. I only return home every 3 or 4 weeks so didn't get the letter until after the appeal period. I wrote to the company and asked for photographs of the driver but they have responded saying they have no pictures of the driver, only the car as it was parked and that I must tell them who was driving and the fee is now £120! I genuinely don't know who had the car, they are all denying it although I have my suspicions because of where it was parked, but no proof. I've banned them all from using my car without agreeing with me in advance but is there anything I can do about this charge as I think it's unfair to fine me for something I definitely didn't do! I don't want this to create bad credit on my record so would I be taken to court if I don't pay it?
  9. Someone has made a payment of a large amount onto my Capital One Credit Card. I am expecting some refunds due to a cancelled purchase, but not to that amount. I have contacted Capital One but it seems that they are unable to sort it out. In the meantime it is making budgeting very difficult as I have to keep taking into account the payment plus my card is showing that I am "in credit" by about £60 and have the full available credit to spend.
  10. I have recently checked my credit history through equifax. upon getting the report i noticed i have an outstanding debt from 2008. I cannot find who the debt is for and this is going to effect my credit score. it says the default was 11/2008 but updated in 2011, ..will this drop off in 11/2014 or in 2017? ( please see attached picture ) if i cannot find out how to repay it what can i do..any advide is very helpful. Alex
  11. I have been at university for the last 3 years but after calling Marston Bailiffs apparently I owe £575 to HMCTS North East London Magistrates for TV Licence. I dnt even own the property or own my TV?! I have called the debt company who advised me to call the magistrates. But I just need advice on how to possibly over-turn this. I had no knowledge of this debt till today and yet it dates back to November 2011? Thank you for your help. Eman.
  12. Hi I checked my credit file as i got turned down for a mobile phone contract switch over from my partners account. I checked with Equifax and my score was 264 very poor. It was very poor on the basis of 1 debt, everything else is good. The debt in question is a credit card from Lowell Portfolio? Never heard of these people and the balance is for £404.00 and i have no clue what this is for. Would appreciate some advice on what to do? The apparent start date was 05/03/2012 and default date 31/12/2012. Thanks in advance Dani

Ive had 3 letters from Cap quest for a debt with Barclays partner finance for a large sum, at first I thought it was a credit card owed but then realised that it wasn't and that Ive never had a loan with this side of the company especially for nearly 10k!! They have apparently purchased this debt They sent a CCJ threat just before last post date this month so shortening any reply time to about 3 days due to the fact royal mail was mostly closed. Then another immediately after Christmas saying they are still going for legal proceedings and seeing as I seem to have no other ccjs if I dont contact them i might may or possibly have trouble getting a mortgage, mobile phone, loan etc. I have had dealings with these people before, they sent me someone elses payment schedule with their address on it and it ended up in dispute and them never contacting me again as it went over the 45 or so day reply they set themselves. I was going to ignore it but being pregnant I dont really want the hassle of defending a CCJ if it goes that far. Anything I can do? thanks
  14. Hi I have two questions that I hope someone can help me with 1. I was awarded ESA SG in Sept 2013 without any interview/assessment (I did have previous advice from this forum). I have not been told how the decision was made and the time/length of the award. My Benefit Advisor told me to ring and ask for a particular form or something but the DWP Person on the phone was a bit abrupt and just said I would only need that form for appeal and said I can be reviewed at anytime. Im in Glasgow and my turnaround time was within 6 weeks and a total surprise. Just don't know how I was awarded it points wise etc. I didn't want to push it just in case it triggered an unwanted review so let it drop. Since then my sister and brother have both been told in their award letters the award period. So I feel a bit in limbo. Stupid I know but I hate the unknown. Should I be asking for anything in writing? 2. I thought migration from IB/SD to ESA was to be completed by April 2014. A friend of mine is worried senseless just waiting for the letter to drop through the letter box because they have not heard anything. I know there are delays etc but I cannot find anything that states the April deadline is to be extended. Any advice will be appreciared
  15. I got a letter from Lowell's this morning, contacting me about a debt I have no clue about. They've not included an amount owed and the company I'm supposed to have an account with is one I'd never heard of before today (Shop Direct), when I did a bit of googling to find out what was going on. I'm certain I've never taken out an account with these guys. The googling also turned up the forums here and the good advice posters gave. I'm not sure what to do here: what do people advise?   16. Hi there. Sorry for this newbie question. 2 weeks ago I received a letter from Robinson Way asking me to confirm if I lived at my old address. I ignored this letter. Since then they have rung on a number of occassions to which I have never entered into dialogue with them I received a letter from them yesterday stating that I owed £188.67 for a debt relating to CL Finance. I can't say I remember ever using CL Finance in the past however I am thinking it could be an old store card from Comet/Currys. I did get into arrears with the store card about 4 years ago however came to an agreement to pay a full and final settlement. I was just wondering if any of you could tell me which letters I need to send and in which order. Many thanks
  17. I have received a letter from JBW Bailiffs threatening to attend my address with their ANPR vehicle with the view of seizing and removing my vehicle. They are asking for £468.04 with no breakdown and no sign that they even have a warrant on the letter. Their Client is London Borough of Wandsworth and they have provided a ref which looks like a PCN ref. I went onto the Wandsworth council PCN site to try and find details of this PCN as I have not received any notification. I could not find anything on the site so I have written to Wandsworth Council asking for an explanation. Should I use a SAR with the Council and the Bailiff? Should I write to the Bailiff, instinct says no. I will update as I get more information and act on advice given. I would be grateful for advice on how to deal with this.
  18. Hi guys, I have been attempting to deal with this but getting nowhere fast! I'm sure that these DCAs drag their feet deliberately, hoping people will pay up to clean their records up. There are two issues here but I figured they're so similar that I may as well keep them in one thread. Since I got my credit files for the first time ever in May, there has been a default registered in my name by Cabot Financial at a previous address. The account was opened after I left the address and it's for around £250 for a JD Williams group debt. I've sent address history proof back in May and have brought this up with Equifax and Experian more than once (Cabot just come back and say it's correct). I've written several letters, getting nowhere. They've written to me this week asking for my address history so they can complete their investigation (AGAIN). They've also moved the default from my previous address to my current address. I know for a fact that they have no CCA as I never signed one (obvs). - Are they allowed to move the default to my current address? - What are the implications of them doing so? - What next steps would folk advise? - Does anyone have experience of reaching a satisfactory resolution in a similar instance? Secondly, three weeks ago, another default appeared on my credit files for the first time. Its for £300 to Littlewoods and is held by Arrow Global. This is in a slightly different name to mine and has a different date of birth. Weirdly, the address is a uni hall of residence that I lived in in 2005/2006 and the date is 2008! I've sent a copy of my driving licence and proof that I lived elsewhere in 2008 but they're dragging their feet too! - Any advice on this one? - Surely they're breaking some law by reporting this as mine? I've sent off a CCA request to both of these this week, and have demanded the removal of both accounts. I'm not hopeful though. Any thoughts?
  19. This has been variously reported as Capital One and/or Aqua. I looked at the numbers quoted (last 4 digits) and they do not match either, as far as I can see. Aqua has recently changed its office and computer, and have become rather chaotic. They just charged me interest - even though they had collected the previous balance in full by DD. They used to be handled by HBOS in Dunfermline, but no more. No doubt somebody will soon work out who BHAP0042 really is. Cheers Arthur
  20. Hi everybody, I am a new member and need an advice about unknown CCJ. I was living in violent relationship from 2010 to 2013. My partner had control over everything and in July 2011 forced me to leave my property and move in with him. I was very scared of him and did what he told me. I moved in with him, where violence continued until January where I finally was able to separate and move out. I just started to rebuild my life, got my children back ( who was living with the father because of violence between me and pa ex) and going to study at the university this September. I knew that I have outstanding debts to pay but as I sad, I was controlled 24/7 and was not even able to make a single phone call to friend or family, there fore was unable to deal with my debts. Since than I moved twice and he is not longer know where I am. Yesterday I went on trustonline.org.uk and found out that I have two CCJ. One is for 207 pounds made on 03/01/12 and another is for 1041 pounds made on 26/09/11. I would like to get it set aside and repay the debts, but not sure if I would succeed because the CCJ from 2011 and 2012 and I am not sure that above is a good reason a good reason for Judge to set them aside. Another question is: Can I find out who are claimants, contact them, make arrangements to repay debts in installments and ask them to agree for CCJ to be set aside? Could anyone please give me an advice as I am very worried about the matter and would appreciate any reply and help.

  22. Hi, hope someone could help me with this. I was out of the Country for a while, upon return I Emailed my Council to ask if I had any outstanding PCN's. They said I had one, which I paid. I then confirmed that was all outstanding tickets. However, I have just had a "Certificated Bailiff" post something through the door for an outstanding PCN for the same Council and they have charged £232.80 for the visit bringing the total to £477.04. Couple of questions (1) £232.80 for a visit?? Is that Legal?? And (2) The Council said I didn't have any outstanding tickets so what should I do with this bailiff letter? I'm just worried as my car is parked outside and these Bailiffs are a law to themselves and I'm sure saying "the council said I didn't owe anything" won't be listened to. Any advice would be appreciated. Thank you D
  23. Back in July, I moved house (and to a different town and different local authority area at that). I had earlier this year had a large number of PCNs, most of which were succesfully fought and repealed with one outstanding which I paid. As far as I was aware all outstanding matters had been dealt with, and there certainly weren't any new PCNs in the last month or so before leaving, so if there were and the ticket was removed from my car I would have had time for the NTO to arrive before leaving. Today, I've come home to a letter from Equita regarding an unpaid ticket which apparantly has been through the court and a warrant of execution granted. They do not include any PCN number, any reference number for the warrant of execution they apparantly have, the VRN of the car involved, nor are they demanding any specific amount of money, only that I contact them before 'further enforcement proceedings' are started. The usual bailiff threats of a visit from the door and removing goods are not made. In the past I did have some PCNs which ended up with Equita, and this is not like any letter I've seen before, those all demanded a specific amount of money, were properly reference with the PCN and VRN and were much more specific about what would happen if I didn't pay. Also, as I scrapped my car as part of the move I've never had it registered as my new address, nor have I registered on the electoral role so I'm uncertain how they've even found me - my only guess can be they've searched council tax registers for people with the same name (my surname is uncommon) and are fishing to see what response they get. This is also the only letter I've had regarding this alleged ticket at all, so if they or the council knew where I was previously I would have expected correspondance before things got to this stage. A few things I'm wondering Is this likely to be a fishing letter to see if I'll respond or would they actually take action against this address without response from me or something else to confirm that I am the person they are looking for - if they are fishing it's even possible that this has nothing to do with me - my name might be uncommon but there were 2 of us in the phone book at my old town! Can they proceed without some kind of verified proof of where I live? What would be the status of the warrant of execution that already exists? Would that be to levy distress at a specific address (i.e. my old one only) or would it cover anywhere where they know (or believe) me to be? Would 'further enforcement proceedings' mean that they need to go back to court before they can do anything else at a different address? Can I apply to have the court order for the warrant of execution set aside on the grounds that I didn't know I was being taken to court and have had no opportunity to defend myself? If I go down the route of making an out-of-time witness statement on the grounds that I didn't have the opportunity to fight the PCN, accept it and pay a lower fee, or file a witness statement in time is this likely to be succesful (I've never had success with an O-O-T yet, but I've never before had the argument that I didn't live at the address they sent the information to)? Can I find relevant information out without contacting Equita - it's not about avoiding a ticket, it's more that to them all I am is a name with a sum of money attached to it and their greater concern is getting me to pay it, not about whether or not I actually owe it or have grounds to fight it so I don't consider them an impartial body to get information from! How long would Equita wait before taking any further action, to give me an idea of how long I have to sort this out? Any help would be greatfully appreciated!
  24. Hi, I am looking for some advice regarding a disbute between myself and a custormer. Twelve months ago, a customer asked me to purchase some materials in Spain for his property in France, as the materials were cheaper here for his project, (had worked for this client for the past two years with no problems). Customer transfered the money into my company account and I bought the materials. As the customer was not ready for the materials, the materials were held at the local whare house, with customer to arrange for delivery to France, (I said I would help to find transport as well). Six months later, the customer tried to blackmail me by saying if I didnt deliver the material, I would lose the job, so I refused and advised customer to find alternitive contractor. Over the last two months the customer has threatened to send someone to Spain to break my legs and send druggie to my daughters school. last night my wife and I received a "whatsapp" mesasage from a Mr Switch, claiming to have bought the debt for £5500, (which is higher than the cost of the materials) and his fees currently standing at £825 and today we have had another "whatsapp", saying we have twelve hours to contact him and set up a payment plan with him or he will get on a plane and come to our house. my feels threatened and concerned for our daughter and she does not want this person come to our house, I dont wont him confronting me in front of my customers?, I feel that this is wrong and not legal and we should not worry as we have done nothing wrong? . We have no other details other than his name and mobile number, he does not give a company name. The customer has our address and e-mail, so I believe, this guy must just be threatening us or surely he would do things proffessionally and either contact us be e-mail or letter.   25. hi today i received a letter from marston group ordering to pay £640, and client is hmcts south west london 123, i dont know the client and i have never done anything wrong, my name on the letter is half wrong, some of the spellings are missing or some replaced, can someone help me what should i do? HMCTS is proably a court, is the client really is hmcts or marston group are lying? shall i contact the court/hmcts? i have never received any letter on this name or on my name. i am good guy and never done anything wrong please reply asap , thanks
