  1. Hello Please advise! I have recieved a letter stating I travelled/attempted to travel with being in possession of a ticket from first great Western. There's a cost of £86 if I pay by 30/01 and I'm livid that I have been criminalised by this company. I am a commuter and regularly purchase tickets on this service which can be proved from bank statements. This is the first time I have been sent a letter of this nature. On the day of travel it happened to be the first time I forgot my wallet fortunately I had cash, however the machine at the station does not accept cash (only method of getting ticket). I had my bike with me on the train and had to stand with it due to how busy it was. I was unable to purchase a ticket from the guard either because his machine was not working or there wasn't enough time before the final stop. I cannot remember. I arrived at the station and requested to purchase a ticket as I have done so before and they decided to take my details. Trying to explain the situation and the guard being a stubborn [edited] he got the police involved At which point I caved in. Was sick that a company I have used for so long would treat me with such disrespect criminalise me and He asked me some questions which he wrote down as evidence - none of which were related to my payment method - I refused to sign as he misquoted at least one of my answers. 1. Do I have a case? 2. How do I fight my case? 3. Who do I contact? Please help!!
  2. I have recently send the CCA letter to NEW DAY and had a reply from them saying Unfortunately we are unable to send you a copy of Agreement I owe them £665 and i would like to settle with them by offering £200 Please any advise or sugestion

Hi all, I sent a CCA request to Welcome Finance on a secured loan from 2008 for over £18085. they have now replied stating that they are no longer in possession of the document but we are still liable for the debt under case law and the Consumer Credit Act. The figures they have returned look to have been completely made up, what should my next step be?
  6. Hi, I am wondering if someone could help me with a current problem I am stuck on and not sure how to respond to the debt company. I will try and keep this short. I am currently in a situation where I am out of work and now unable to pay my debts. I work for an agency and am on one of these silly zero hour contracts so my employer has no obligation to offer me work. Over the last 12 month period I have had to take quite a lot of time off work due to sickness with a lifelong medical condition I have and my employer hasn’t been to impressed with this. Becuase my employer is no longer offering me work I cannot pay my debt at the moment until I find alternative employment, I am also in the process of applying for job seekers allowance in order to help me through this difficult time. I have written to my creditor (Wescot) and explained in short my current situation. They have now responded asking for proof of my medical condition. My question really is are they allowed to ask for this and if they aren’t how should I respond the letter. I should also mention that I have been paying this debt off up to this month. Hi, In March I took out 2 addition mobile phone contracts with Vodafone and as part of the agreement I would be able to share the data from my existing contract onto these new contracts, and this data share would just continue even after the upgrade on my existing contract that was due in May. (As written on the T&C's I signed) I therefore, arrange the upgrade on my original contract earlier this week and was assured again during the upgrade process the on the 42 per month iphone contract (1gb data) that I would be able to continue to share the data. Then after recieving the upgrade I was unable to access the internet on ANY contract, after numerous calls to vodafone I was then told that I had previously been given incorrect information and the as the 42 per month contract is not a RED contract I would not be able to share the data.. I was then told I would have to upgrade to the 47 per month contract (3gb data). So I went ahead with the upgrade and was assured that I would have the data sharer on the account. HOWEVER, I am still not able to access the internet on ANY phone. I have spoken to vodafone everyday since and after being passed from department to department each time I was told that there has been no data assigned to the account and that due to this the internet access has been barred. I was then told this had been resolved and I would be able to access the internet on all handset again. This works until midnight that night, at which point I receive a test message on all phones saying I have used all my data allocation and that I wont be able to access the internet until I buy more data - I have actully only used 88.60mbs of my 3gb allowance!!! This has happened everyday since my upgrade and everytime I call vodafone I get told the same thing.. Its fixed and you will be able to access the internet... That works until midnight everytime. I called vodafone again today and was told that they dont know what is causing the problem or how to fix this. Its apparent that vodafone can't honour the terms of the contract that was purchased but when I try to cancel the contracts I am told they will charge me the termination fee. How can I resolve this because I am not prepared to pay to cancel the contracts when this is a vodafone error that they cannot permanently fix... and I am not prepared to phone vodafone every day like I have done for the passed week. I am beyond annoyed now!! Update: I have now emailed vodafone using the link in the forum and received an auto reply with ref: 6880383
  8. Dramatic changes in our financial income over the past 3 months have severely affected our ability to keep up with mortgage payments with GE Money. My wife and I have sadly taken the decision to sell our home of 28 years in order to clear the mortgage, pay off debts and move into rental accommodation. GE Money have offered no help whatsoever and we have been plagued with up to 4 calls a day. Each time they call we speak to a new "puppy" and have to go through our life history again and again and again. The house is no on the market and we have virtually no income. It is an exceptionally stressful situation and beginning to affect our health and well being, we are at a loss as to what we should do next. We would welcome any advice as we have found ourselves in a position which is completely alien to us in our later years of life.

Hello I was supposed to sign on yesterday however I was laid out with a full blown migraine I got my mum to ring up for me however she could not get through to the actual jobcentre after many attempts of ringing the 0845 number If I was to go in and ask for the JSA28 form tomorrow would that prevent me from being sanctioned? Will it be okay that I did not make contact on the day? Cheers, Mike
  10. I've received an email from one of the site team, but it won't let me reply saying I don't have the necessary permissions. In the end I've responded using the "contact us" option. Not heard back yet though. Also, i'm struggling to find where to update my home email, the profile page doesn't appear to give the option. Any advice, am I doing something wrong? Thanks in advance

  12. Hi, I have spent a fair while searching the forums for this, but cannot find a similar problem, so here goes.. I am being chased by Lowells for a cc debt with HBOS unpaid from 2009, it seems to have just been taken over. I recently sent a SAR to HBOS with my signiature on the anti tamper signature image I found on here. I have finally have[ATTACH=CONFIG]45409[/ATTACH] a reply acknowledging my request and the fee, but within the letter it states 'Unfortunately we are unable to verify your signature' and that I need to call them, which of course I have no intention of doing so. My SAR and the reply are attached, with all the personal information removed. How can I reply to this, and does this then constitute being in dispute? Many thanks in advance.
  13. In May, I took my family to Derbyshire for the day. During the day my wife and I both took turns driving. At some point we allegedly, drove 58mph in a 50mph zone passed a mobile speed camera. I have received a NIP and sent it back requesting photographs of the vehicle in order to identify who was driving at the time. I received the photographs which are of the rear of the car, and do not dhow the driver. I have written to the derbyshire police, and explained that I can not absolutely confirm who was driving the vehicle at the time of the alleged offence. (as we took turns driving and neither of us remember seeing a mobile speed camera, otherwise as would have checked our speed!). I have offered to take the blame for the offence, as I do not think it necessary to waste the courts time. I will accept the fixed penalty (and points if necessary) however if I state emphatically that I was driving I may be committing fraud as I am not certain. I have now received a letter "AS you are still unable to identify the driver at the time of the alleged speeding offence, the case papers will be passed to the Criminal Justice department for the consideration of instigating proceedings. As a result you may receive a summons to attend court". Now going to court will mean time off work, which will cost me more than £60, I want to avoid court. Do I simply write back to them and accept full responsibility even though I don't know if I was driving? Cheers
  14. Morning, I am due to sign on just after lunch. However, I began to feel ill about an hour ago. I am hoping this will pass. I had to near collapses last week, in a matter of 1 hour, if it wasn't for my little son, I would have collapsed on concrete. I am exhibiting the same symptoms as I had last week. My Vegus nerve is irritated and slows my heart down, it's making me feel like rubbish. If I ring in at lunch would they hold on to releasing payment till I am well enough to sign on?
  15. I am currently paying £200.00 a month on a CCJ which I am currently in arrears by £400.00. There is a suspended attachment of earnings order and I have been told by the company (Lightfoots) who are acting on behalf of Southern Pacific Mortgages that their client will not consider reducing the monthly payment. I have sent an income and expenditure form and have yet to recieve a reply to this. I am looking to submit a N245 to the county court to have the amount for the CCJ redetermined, I am being very reasonable and offering the sum of £100.00 per month which is more affordable. Once I submit the N245, will that prevent them from enforcing the Attachment of Earnings Order? Also, once a new amount has been set, will this just continue at the new rate without having to pay the outstanding arrears as I cannot afford the arrears at present. Desperately need some advice on this. Also is the fee for the N245 £40.00?
  16. I have worked for an employer for 6 months. They appear unable to meet there obligations. They appear unable to pay a contractor who did some work for us, and other organisations are phoning about unpaid invoices. there are 3 permanent staff. If an employer is unable to pay wages (due to be received by employees mon/tues next week) when should they notify the employees? What legal rights would i have if my employee is unable to pay my salary next tuesday. I believe the situation is as follows - we are working on a project which is supposed to go live at the start of next month. The client receiving this will then be due to pay a significant sum putting the companies finances on a level playing field. But I need to understand my legal rights if they delay or don't pay on the 25th of the month. I am looking for another job - but I need employment and a wage until that happens.
  17. My partner and I split up and she moved out of the house we rented together. I have had the assessment from the CSA and I have been moved onto the New Rules (having previously been on the old rules with a child from a previous relationship). So I now have to pay 20% of my net earnings. Due to now paying the full rent, bills etc. the figure they have quoted me will push me into a position very quickly where I am unable to afford to live i.e. a lot more going out than coming each month. I do not have a high paid job and I want to support my child financially as best I can. If I sublet a room in the house, with the land ladies consent, would this effect my payments to the CSA? Would it be better to have the tenancy agreement re-drafted to show both names or better to keep it just in mine. My understanding is that under the new rules you are adjudged on your net earnings so would this change in circumstance constitute "income"? i don't really want to share my home with a stranger as I help raise my children and I'm not trying to get out of payment, just be able to pay maintenance without loosing my home and then not be able to provide anything! I have discussed it with the CSA but so far their responses have been underwhelming! I was quite up together with the old rules but am new to the "New Rules"

  19. Does anyone know what happens if I am unable to make car lease payments? I have about 16 months left of a 3 year lease. Husband has left, financially struggling (to put it mildly). I cannot transfer the lease and the cost for early redemtion is about 3.5k. Any advice on any options much appreciated.
  20. Hello Like many others I am having trouble cancelling my Membership with Harlands. In February 2012 they were running a campaign via my local gym. I went along and was told to join quickly as there were only 100 memberships up for sale and they were going very quickly. Stupidly I didn't take the cancellation rules before signing. Shortly after this my situation changed through no fault of my own. My relationship had broken up and I was asked to leave the house we both shared. I when to stay with my Mum (who lives in Spain) for sometime. I wrote to Harlands explaining the situation and that I would be cancelling my membership. They wrote back to say I needed proof of my address, ie utility bill, bank statement. I replied saying that because my move was temporary, I had not changed my address and my post was being redirected. In June I came back and I am currently living with friends until I find a permanent home. I have moved 13 miles out of the area - cancellation states 15 miles. I wrote to them again stating that I would not be visiting the gym again, given my situation - finances are very tight, and rising petrol costs it was not viable for me to go there. Also the area brings back painfully memories. I also stateed in my email about OFT case against Ashbourne amongest other things. They replied stating that given I don't live 15 miles out of the area they will not cancell my membership and that my membership is in arrears of £98.00 or I can pay £461.00 to pay off the membership. They are not listening and only interested in getting their money regardless of the situation. I have emailed BBC Watchdog with my story. Like many of us I'm not happy, yes I take responsibility that this was my own fault for not taking in the cancellation rules etc., but I don't feel I have a choice other than pay up and draw a line under this situaiton. Hi everyone, A few months a go I received a letter from Lowell regarding an old Barclays Loan which I defaulted on in 2006 and paid for a few years before having severe financial hardship and was unable to pay. They sold the debt on to a dca and I sent a CCA request which they could not resolve. That was a few years ago. Then a few months ago I received a new letter from lowell asking for payment. Again I sent the initial cca request and followed up with the 2nd letter. They have now come back to me and said that after liasing with Barclays Bank an effort to obtain the document they have been advised that they are no longer available due to the length of time sinse the account was opened. They say they are untertaking an investigation into the account which will remain on hold until an outcome is reached and during this time I will not receive any further correspondence. my question is what does this mean. Last time I requested a CCA the DCA just responded saying that the document could not be found and the debt had been passed back to Barclays. Why this time have they placed it on hold? Or will they just pass back in a few months? What do you think will be there next move? I'm pretty certain that no CCA will ever be found..will they take action without one? Any help would be appreciated. Thanks Mark
  22. Hi, so i will try to summarize my issue. I had to move back to italy suddenly for some major family problems, with the big hope of coming back to london as soon as everything is sorted out. I was checking online my bank account every now and then to see if everything was ok when i discovered some transaction i never done. i called Barclays asking to have my card blocked and i explained the whole situation. i've been told there was no way i could get my money back because i was overseas so i had to come to a local branch. i spent over £250 just to come over and have everything sorted out and transfer some money from my barclays account to my italian bank account. So i went to the king's cross branch and i spoke with the manager, who, very kindly, took care of my situation: i asked for a refund and compiled few forms with my details (i have copies with me now). i asked for a new debit card to be issued to my italian address or ANY ohter way to access my online banking to manage my money. i asked to transfer some money from my account to my italian account (got a copy of the transfer aswell). After few days i received an email from the branch manager saying that the transfer was cancelled because the money was on my savings account and i had to transfer the money from that account to my current account first so they could transfer them oversea. Of course, in order to do that, i needed to login online... . and of course, in order to login online, i need a debit card. So he told me to call 00441604614812 because they needed to speak with me. I called that number and after more than 30 minutes talking on the phone dealing with someone with no clue about his job, i got nowhere: No way for me to access my account online, No new debit card can be issued to an oversea address, I can't transfer my money on the phone (of course), I already spent more than 250 pounds coming over to London just to sort everything out and around 20 more pounds on the international call. I tried to submit a complain on their website but I keep getting an error. Ii've absolutely no clue on what to do next. I simply need to transfer some money from my deposit account and from my current account to my italian bank account. What should I do? THank You
  23. We purchased some furniture 4 years ago from a large furniture retailer and it has developed a fault that they are unable to repair due to that line being discontinued. It has a 5 year structural guarantee but I am not sure whether we can also claim under the sales of goods act? They have offered us store credit of approx 50% of the original purchase price or a cash settlement of approx 12.5% of the original purchase price. Our preferred option would have been repair or replace as we do not have enough money available to spend the additional 50% required to buy new goods from the same store but as the supplier is not able to do this can we ask for the 50% store credit offer they have made us to be given in cash as this would increase our options considerably?
