  1. Hello I am registered blind, Amex got a default judgment, ccj against me, and a charge against my home, because I could not read their court claim form as my carer was away and now have a new hearing tomorrow. Just discovered this forum. Please help. I have not managed to get access to a scanner yet but will try. But this is the Particulars of Claim they filed in the original claim form. Seems a bit odd to me as no CCA mentioned. Card ending .... was a charge card and card ending ...... was a credit card. Verbatim - Particulars of Claim Money due for Charge card and Credit card services supplied by the Claimant to the Defendant as detailed in monthly statements rendered to the Defendant as follows:- 02 April 2010, .: £731.42 11 June 2010, .: £14848.08 Total Referred Balance: £15579.50 Less credit: £3671.09 Add Statutory Interest in the sum of £2427.88 calculated from each statement due date to today’s date at 8% per annum pursuant to Section 69 of the County Courts Act 1984 AND THE CLAIMANT CLAIMS:- The total sum of £14336.29 Plus continuing Statutory Interest at the rate of 8% per annum pursuant to Section 69 of the County Courts Act 1984 at £2.61 per day until Judgment or sooner payment.
  2. OK guys,a rather unusual one here. I was travelling on a FGW train from Exeter-Cornwall. Just before Plymouth station, the cleaner came through the train asking for any rubbish to be collected. As I hadn't got anything that needed to be taken, I just said No and went back to my book. I turned back in time to see him taking a paper bag out of my holdall which was on the seat next to me and throwing it into the sack. I yelled at him to stop but it was too late-it had been put in there . By then,people were getting up to get up at the station, and he got to the doorway before I could .I managed to get hold of the Train Manager and explained the situation, and was told that there was nothing they could do-once it was in the sack and had been taken off the train,it would be incinerated. 44 Besides some odds and sods, it also had in my wallet with my onward ticket and railcard and about £30 in cash. I've put in a complaint, but I've been told that even though it was their fault, there is nothing they can do unless I can provide proof of purchase for the railcard and proof of what else was in there. It was not just left unguarded, but was actually inside my property sitting next to me when it was taken. What to do next?

My husband had a business which ceased trading as a result of this my husband had a loan, which he had to pay back to the bank, to pay all the debts, which the bank called in the (overdraft) he had been given. He was a sole trader, . He was supposed to be paying £200PCM via direct debit he would transfer money to this account or pay in cheques to cover the payments. The cheques that went into the account were made payable to ***** He was apparently four months behind on payments but was unaware of this. He works for his father’s business now, and is a signatory on the account. His father is the director and this is a limited company. Both accounts for both companys are held with Barclays, obviously separate accounts and account numbers, with no connection between the two companys. In October he went to the bank in order to pay cheques x 3 into his fathers business which is the limited company, the cheques were made out to this company. Somehow my husband who had a paying in book for his old company in his drawer, managed to complete the wrong paying in book and presented the cashier without him knowing three separate cheques which were made out to his fathers business. The cashier did not pick up on this error and they got accepted and paid into his sole trader business account via the banking system. This account is in a completely different name so there could be no confusion. These cheques have cleared. My father noticed that there had not been a deposit into the company bank account and queried this with me, I checked the paying in books and realised I had made an error and rang the bank. I was told that they couldn’t deal with the issue at the branch and I had to contact the Head Office Complaints Department and generate a complaint. I did this and was given a reference number and was told this could take 10 – 12 days. I rang again a week later and was told because I am a signatory on both accounts they can keep the money because my account was in arrears! Its like a cheque being paid out to fred blogs but its paid into a completely different persons account but the bank says well sorry we have taken it now. I understand the right to offset but this isn’t the right to offset rules. the way I see it as my fathers business is a substantial amount of money down which is affecting his business, c ausing bank charges and interest being lost. I should be able to claim all of these costs back. Can someone advice me what to do quickly, I think put it in writing but to who? And to speak to FOS but I also think put in a civil claim now. Advise urgently pls people greatly appreciated.

  5. I have worked for a local council department for the last 8 years. Recently, I took up a Saturday job with another department of the council and when the manager of the department rang me at the end of May 2012 to say I had the job and would I like to accept it, I said yes but that I had 4 to 5 days planned off in the Summer and would that be ok to take. She said yes and I took her at her word. Anyway I started, took the first two planned Saturdays and that was ok but when I rang her during the week to remind her of the next two Saturdays, she said I couldn't have them and if I took them it would be unauthorised absence. I told her that they were already booked but she spoke to me like a school child and said that I must consider my position as I was still on probation etc. I took the holiday as planned but when I returned home I had a letter telling me that I am due to attend a disciplinary hearing next week. I am sick with worry and I have already written to the council to resign my post as I do not want it effecting my other job. Can they continue to take me to a disciplinary hearing if I have already resigned? I rang ACAS and they said that I should have got her agreement to the holidays in writing but that doesn't help me now!
  6. We bought a van off a friend about 6 months ago for £1000, we gave him £700 when we got it & £250 a couple of months ago, so still owe him £50. In the meantime my husband has been working with him & they both got their tools stolen, tools weren't insured, so had to buy new, didn't have the money at the time, so a local merchant said we could pay them monthly, we've paid £500 off a £1600 bil so far, but the merchant has now put them on our friends account, as we don't have one with them. The friend has been baggering us for the money daily, so we've put our car up for sale, so we can pay him. We went away over the weekend & left the van with tools in, in a mutual friends locked yard, went for it this morning & it had gone, called the police, then found out the 1st friend had taken it & its in him lockup on the same yard (we didn't know he had one!). The police have spoken to the friend & they are saying its a civil matter. Spoke to the so called friend & he said he's keeping it all till we've paid him & he's says we also owe him £1500 for the van & £2500 off a job they did together. The van was only £1000, so only owe £50, put neither of us has proof as nothing written down & paid cash, we have got proof we paid the £500 off the tools. The van is registered in our name & we insure it. Please help, we are desperate. Thanks in advance

  8. Hi there, I have found this forum after looking for a solution to my problem through google and I was wondering if someone could advise me. After reading through some threads in this section my problem seems trival but here goes. I have been a member at my gym for about 5 years and I canceled my gym memebership last month inline with thier policy of giving one months notice. I handed my physical letter (which they insisted it had to be) at reception on the 1st of May. I rang the next day to make sure it had all been recieved and the membership canceled which they confirmed it had. I noticed that on the 1st of June they have taken money out for this months memebership fees. I rang to enquire why this had happened and was told that because I had not given 1 months notice they would be charging me an extra month. Now my issue is the 1st to the 1st is a month, but they are failing to recongise this because 'thier direct debit system works on the last day of the month' this was not made clear, I was told 1 months notice, which is what i gave. So basically im asking do I have a grievence here, or above and beyond asking for the money to be refunded and being refused (which I have) I cant really do anything more? I should have cancelled the direct debit straight away, but like a fool I didnt. It isnt a massive amount of money, but I feel they do this to chance their arm and see what extra revenue they can drum up by doing things like this to many customers and it gets on my wick.
