Hi , i worked part time 16 hrs in a care home as a maintenance man for 9 months up until june this year i worked in the dementia unit , the job was quite stressful and upsetting at times and was made worse by a recently promoted carer/manager anyway we didn't get on and we had argument and she tried to give me a written warning about my attitude , so i walked out , the other managers were very understanding and wanted me to return and sort out the problem but i just couldn't deal with it so i resigned went to see my doctor and I've been on the sick with depression/stress since . i have recently got a questionnaire fit for work thingy and my doctor tells me they will probably say i'm fit to work which is ok because i'm ready to start work , my question is will i be able to claim jsa or whatever it is when i get signed off the sick , i will tell the job centre i left the job because it was making me ill . thanks in advance.
  3. Hi I wonder if any of you could advise on the following. My Neighbour started a new job 6 months ago, on December 1, 2013 the company split it self in 2 & formed a new company . She was Tuped over , with out consultation, no meeting or given any new contract. After a lot of thought she decided too hand in her resignation [ one weeks notice] effective from 6/1/2014. Today she was given a letter stating that as from 24/12/2013 her contract was being terminated. Is she being sacked?, having already given notice can the company then terminate her employment ?. She has never seen her new terms & conditions, been consulted on the hand over or been kept informed . As she had already decided to go , she feels it is a point of princeable to honour the notice period she gave & technically if a new employer makes checks , then she was sacked. Is there any action she can take to enforce the notice period she gave them. She is also being asked to train the new person who turned up today to replace her.
  4. I have worked for a local council department for the last 8 years. Recently, I took up a Saturday job with another department of the council and when the manager of the department rang me at the end of May 2012 to say I had the job and would I like to accept it, I said yes but that I had 4 to 5 days planned off in the Summer and would that be ok to take. She said yes and I took her at her word. Anyway I started, took the first two planned Saturdays and that was ok but when I rang her during the week to remind her of the next two Saturdays, she said I couldn't have them and if I took them it would be unauthorised absence. I told her that they were already booked but she spoke to me like a school child and said that I must consider my position as I was still on probation etc. I took the holiday as planned but when I returned home I had a letter telling me that I am due to attend a disciplinary hearing next week. I am sick with worry and I have already written to the council to resign my post as I do not want it effecting my other job. Can they continue to take me to a disciplinary hearing if I have already resigned? I rang ACAS and they said that I should have got her agreement to the holidays in writing but that doesn't help me now!
  5. Has anyone any ideas? I resighned on 13th and collect a letter on 14th sayin g to attand a disciplinary proceedure on 15th Do I have to? should I? What happens if I say no? I dont need a reference Help anyone?
