  1. hi folks thanks for any advice in advance, i am on here due to an insurance claim for my vehicle, where they are saying the value to repair is £2800 and that they are going to write off my vehicle and off me only £2200 i have looked online at cars on a like for like basis and they are nearly £1500 more than what i am being offered for mine. the accident was not my fault, was a young driver aged 18 who has had 4 other accidents since passing his test, he was driving on the wrong side of the road, windscreen covered in frost, unable to see a thing, have taken pictures of this, we were nearly stopped as it was just outside our driveway when he drove in to the front of us whats annoying is we are going to be out of pocket by nearly 2k because of his actions we have a private plate on the car, so will have to pay for that to be removed, we had just filled the car full of diesel, and to get something the same its going to cost us a lot more than the insurance company is offering, can anyone offer us some advice where we can go with this, if we have any rights many many thanks
  2. Due to him losing his job my husband is 2 months behind with the payments for the car to welcome finance. First they bombard us with phone calls-and are still doing so despite us sending 2 letters telling them not to phone. The today a girl from welcome phoned and said unless the payment was made immediately then they will come and get the car and if necessary get the police involved. Can they take the car without a court order?
  3. Hi, I have been working for a contract company since Sept-13, I was employed on a fixed term, 12 month, term time contract. When the contract expired we were waiting to find out if the company had won the tender for another year but it was dragging on and on so the manager said our contracts would roll on. Apparently all staff are only ever offered 12 month contracts which I understand, and this is fine. However me and the girl who started with me and on the same terms, have been "let go" because apparently we are "the only temporary staff". I can't understand how this can be the case, surely all staff are the same? Also, I work a set amount of weeks per year and they restarted the count after my 12 month expiry and so IMO it was implied I would continue to work there for another year. We were told even if current company did not win the contract we would transfer to the new one over TUPE. Turns out they didn't win the contract and our details were in the TUPE paperwork but we've now been told we were temporary (news to me) and no longer required. There is an element of nepotism here as the boss' son who worked PT has now been given FT hours (he wanted this) so basically, how can they say I was not required when they've given him my hours? Conveniently this is just in time for the new company taking over. He has worked there for 3 years and he changed his job role/hours a few months ago which boss denies (?!) Can anyone give their thoughts on this? I think this is very dodgy and I'm not sure it is legal?
  4. i went in to the shop Game, and decided to purchase a game for the nintendo wii, it was marked up as 99p, it was a used game, took to the till and the cashier said thats £7.99 please, obviously i pulled him up and said erm...nope, it clearly says 99p on it, he asked his manager who said the 99p was a offer price, but the offer had ended, and the sticker should not be on there, so they have every right to refuse sale, is that right.
  5. My friend has been trying to register on the forum to ask this but he is having some problem with his registeration? Anyway, he has asked me to put this up as he id desperate for some advice. Thanks 'I had my first day off last week after a year with my company. For the first 7 months I was actually a temp and for last 6.5 months a full time employee. I was told I would taken on after a 3 month period but had to wait, reducing my Christmas bonus by £80 for those extra four months I was a temp. Although two members actually left the company to go somewhere else to work. However it did not work out for either and returned and received a full years bonus. After my only day off, the company ask me to complete an in-house self-certified sick note. Which I did. I did this with my team leader, we completed the first page and started the second, he then said just sign it as its the a repeated form the first page. I did, had no reason to mistrust him and then I just returned to my post assuming I could be able to get a photocopy. The next day when I went to the office and ask if I could have a copy of my sick note, I was denied bluntly; spoken down to (patronised) . I would like to know if is this legal, can an employer do this? Furthermore, do I have actually have to complete the part about why I was off or can I keep my reason to myself under my confidential clause?

Hi all, I recently made a claim for ESA on Monday 17th November 2014 and I received a letter yesterday saying that my claim has been accepted and I will get £72.40 per week, however when looking in my bank today they have only given me £51.72. I know that I lose the first 7 days, but why is it only £51.72? Is this right? My sick note from the doctor was for two weeks. Also they say my sick note runs on 30th November, and to get a sick note to them by the 1st December, however I could only get in to see my doctor on the 1st December, will this be ok as long as I send the sick note the same day i get it? I am really worried now.
  7. Getting married soon and ordered a personalised cake topper. When it came it was not really the same style as the photo example. Specifically, the "Mr" and "Mrs" are not at different levels and the first letter of our surname is not overly large as in the example (see below) The example pictured is as so: The one we got looks like this (click for bigger): [ATTACH=CONFIG]54567[/ATTACH] Emailed the seller the asking if she could make one with the above features, reply was: Thank you for getting in touch, I apologise for the long delay in getting back to you. We are sorry to hear you are unhappy with your order. I have had a look at the photograph you have sent to us, and can see that the way the & has been placed is due to the letters included in your name. Because of the L we are unable to have the exact same design as Mr and Mrs Smith. We are always happy to send a proof before processing an order if this is requested. Unfortunately we are unable to send a replacement free of charge as this item is not faulty or damaged. However we would be happy to include 25% discount on a new order. I replied with: I understand that each design will be different due to the different letters in various surnames and it is unfortunate that ours didn't allow for the usual style to be applied. What really attracted us to your design was that it had multiple levels of words (The "Mr" high up, stylish large "&" followed by a lower level "Mrs". The surname also had a large Capital which balances out/matches the large "&" sign). I'm sure you can understand why we are slightly disappointed with the end result, as it has very few of the advertised example's features. If it is not possible, as you have said, to create a topper with a similar concept to the example using our surname; then can I regretfully request a refund. I don't like to ask, and I am more than happy to cover the original postage costs. She said: Thank you for getting back to me, unfortunately as this item is a personalised item we are unable to offer a refund or exchange. However as a gesture of goodwill I can either refund you 25% of the order or we can offer a 25% discount on a new order with another design. So, It is a personalised item, but it doesn't really match the example. Am I entitled to my money back? or is the 25% off actually more than generous? I'm just interested more than anything, as to whether she's right or not.

  9. If an item is purchased and paid for online but collected from the store, what are my rights when it comes to returning goods. That is to say do I have the statutory 7 days to return and request a full refund as it was an online transaction or does the fact I collected goods from the store have an impact? Grateful for any advice

Hi I defaulted on my LloydsTSB Mastercard back in late 2008 (I lost my job of 15 years a few months before), I paid the minimum £1.00 a month until summer 2010 when my debt was passed on to Robinson Way and i've continued to pay them £1.00 a month and still do. During this time I was diagnosed with Parkinsons and Type1 Diabetes and a few other things (Leg amputated) and am surviving on only sickness benefit. My local LloydsTSB which is literally about 50 feet from my front door has recently been converted to a TSB branch I decided to take the plunge and apply for their basic account because i'm tiring of travelling into town to the nearest NatWest atm where i've banked since I left LloydsTSB or the nearest Post Office to draw my money out. This is a question about the right to set off between accounts. Can Lloyds raid my TSB account to pay towards my old credit card debt? Do they even care about the debt anymore since they passed it on to someone else? According to page 5 of these recent Lloyds/TSB transfer terms and conditions they have waived the right to set-off between the two 'new' banks even while they both remain within the same banking group - and next summer TSB should be entirely out of Lloyds Banking Group altogether when it is floated off. Am I reading this correctly or should I still use NatWest for my benefit payments at least until TSB is totally independent. Thanks for reading.
  11. Hi, I recently hired a car through Right Cars (right-cars . com) through a broker (Argus Car Hire) for a few days in Glasgow. When I payed for my car hire, there was a £350 deposit added. Now, normally when I've hired a car, they do not add the deposit to the hire bill but treat it as a separate 'holding deposit' transaction (i.e. hold the balance on the card but do not immediately claim the funds). I have returned the car, at which point I was informed that everything was fine and that my deposit refund will be credited to my account the next working day (which was also what I was told when I hired the car initially). However, a week has passed and there is no sign of the money. I contacted Right Cars (whilst recording the conversation) and they assured me that I have had the full deposit refunded the next working day after the car was returned, and provided me with a 10-digit reference number (which is not recognised by the bank). They also confirmed that I should receive the full amount. The staff member said it can take up to 14 working days! for the deposit to reach my account. She verbally confirmed the credit card number with me, so there are no mistakes there. I also asked for the authorisation code, so I could trace the transaction with my card company but I was informed that there was none as the refund transactions were processed in bulk. Now, at this point I contacted my card company. They said that they had no records for any pending refunds, and normally they would know about pending transactions almost immediately after they were processed. It is normal for refunds to take a few days to appear on an account, but 14 working days (3 weeks) is ridiculous! I really hope I do get my money as I really need it. They also advised me on the chargeback process if it were to come to that. Worryingly, a few people have had threats of being sued for libel by right cars for posting bad reviews of them online. I know that these claims shouldn't amount to anything, but it is worrying all the same. There's also an online portal which acknowledges the credit card refund delay and provides a not-so-helpful wikihow entry on why credit card delays can take a while.   12. Hi there, My partner and I moved into a privately rented flat 2 months ago. We really get on with our landlady and are good tenants. The property is always spotless, bills are always paid on time and we really do look after our home. When we moved, we were asked by the letting agent if we had a pet. (At the time) the answer was a no. They confirmed that their 'standard' clause was 'no pets', however there is a clause that states we could have a pet with the landlord's written consent (and this can be broken at any time). I called the letting agent as my partner and I have decided that we would really like a kitten. We have both had experience in owning a pet and my other half is at home everyday (he works a couple mins away from our flat). I e-mailed our landlady to ask if it would be possible to have a kitten. Initially, she said no due to the above standard clause. I then pointed out that in black and white on the tenancy agreement, (directly underneath the 'no pets' clause, ironically), it states that if the landlord gave written consent, we could keep an animal. She then responded by saying she will speak to the Management company as this is a separate contract and will come back to me So I'm a bit annoyed, and very upset. This is HER contract and we signed the agreement which stated that we could have an animal with written consent. Landlords/Tenants, I would really appreciate your advice as to where we stand! Extra bit of info - She is coming over early next week to do an inspection, which we are not worried about in the slightest and we have agreed that we will advise her if the answer is a 'no', we will be moving as this would have affected our initial decision.
  13. we had our house repossessed around 2 1/2 years ago and it was subsequently sold for below the market value leaving a shortfall in the region of 25k. We have heard relatively nothing since apart from a few letters. They are now chasing heavily for this including people coming round to the house from a company called Field Call. We took the mortgage out with Future Mortgages who i believe sold out to the company that repossessed (can't remember the name but it started with an 'E' trying to remove all thoughts from my head as the repossession was the last thing after being put on Statutory Sick Pay due to a near Fatal experience). I am now being chased through Field Call for a company called Optima, i dont even know who these are. What steps if any can i take as i am now fully fit again i am back working but i am ready for a fight after what they collectively put my family through. All help appreciated. Hornigoldfamily
  14. Hi. Firstly thanks to the Cag team & people involved, you guys/gals do a great job. I am a single father with MS (multiple sclelrosis) on DLA and living at home. My ex, her mum is also on benefit (ESA) & receives child benefit for both my daughter & her stepsister. I have no idea how much the child benefit give her (any idea's on that?) We have both been separated a good long time, time in which I've always tried to provide nice things for my daughter (I'll just say Bec from here out, its easier) whom I see on a fairly regular basis. With her starting high school this year (she's 11) I got a visit from my mum (becs nan) saying that Becs mum had been stressed at the cost of school clothing & that I should step in and do the right thing. Now here, I made a point of stating what seems to me to be wholly logical by explaining to my mum that child benefit is for these things & what, for examples sake, if in same situation I had four kids by her mum, would myself as a single Dad on benefits be expected to cover this cost four times over? Anyway, we had quite an argument about this though I since went and told Becs mum that rather than haranguing my mum for these things that I would simply offer up 100 pounds a month towards my daughters upkeep (anything for a quiet life plus my daughters happiness) I had been actually putting money aside into savings for my daughter for when she reaches certain age, which I will still try to do though I am not certain if I can keep that up so well in the face of this new 'situation'. So what I would like to know please is am I doing the right thing? I ask this because I do not think her mum would use this money wisely and solely for my daughter, in fact I would rather take Bec out (difficult with my health probs) & sort the things personally. Also, am I right in saying that her child benefit money should cover the school clothes costs? Whether child benefit covers it or not, as her father I will do the right thing one way or the other, I am just seeking some much needed intel on the situation. Look forward to some clarification on these things, thank you. Oh, and for the record, Becs mum never put me or anyone on the birth certificate as Becs father though I do not want to start getting into a big legal thing about that, she's my daughter, I'm her Dad, we already know this. I just want to do the right thing with the money.
  15. I was recently asked by a friend to find out if their council garage which is not attached to their propriety but across the street is part of the right to buy. They have rented it for over 30 years at a peppercorn rate of around £3 per month, but recently they shot up to £10 per week. several of the block are already privately owned already but the council are digging their heals in when they asked to but it, "as selling the garage might set a president". I looked around the gov website but can not find out this info.
  16. I ordered a carpet around a month ago from Carpet Right. Today, the fitters turned up to lay it, only for me to realise that they had brought with them, the wrong carpet. One of the fitters then phoned Carpet Right, and he was told that the wrong carpet had been put in packaging that my carpet ought to have gone in. ie. it had been mislabelled. Now, I have been told that the correct carpet cannot be laid for another two weeks. So, I am now in the position of having a hallway, stairs, and landing just covered in underlay. This is obviously a huge inconvenience. My question is this. Am I legally entitled to some form of compensation. Does anyone know what the law says, if anything, regarding cases similar to this. A week ago I back-bumped into a car that was partially blocking my driveway, it's rear half blocking my path and it's front part blocking a fire-hydrant on a red-marked no parking at any time curb. I gave the car's owner my insurance info and today got a phone call from my insurance company on a claim for the accident. So, since nobody was supposed to be parked there 1) should I involve the city's parking enforcement office on this ? 2) Is this claim something that I should contest? If I do, what are my chances of winning ? Thanks for your advice.

  19. Hi. I just have a question regarding ESA. My husband had spinal surgery in October and has been on ESA since the end of September. He has received a letter saying he has to attend a medical on the 13th February but thats the day he is due back to work and all being well he will go back that day. Do I ring and tell them that he is back to work that day and they should cancel the appointment for the medical? Many Thanks

Hi, hoping someone may be able to advise I currently owe Barclaycard credit cards - £22,000 Barclaycard overdraft - £3000 BOS credit card - £600 debt has become difficult to deal with, monthly payments etc. I'm self employed and live in the UK. How receptive are Barclaycard and would I be able to write off some of the debt? I've had the barclaycards for over 10 years. I got PPI back from one of them and used that to pay off some of the debts. I used to earn a lot more money so wasn't really a problem until now. Maybe missed payments only a few times in all that time. thanks in advance
  21. Evening, Is it true that letting agencies cannot do a thorough check like a bank and only see CCJ's and other similar marks on your report? Or Do they only look for those? I read somewhere they cannot access the defaults on an account. Looking to rent but have a few defaults. Hopefully I'll find somewhere.

  23. This is a brilliant video that everyone should see if they can spare the time, especially the wealthy in the country. Im reminded of Nigel Evans the Tory MP who wanted his legal Fees paid after the legal aid cuts politicians should be ordinary people they never feel the pain of there policies nor have the experience of hardship to shape them. A brilliant quote from the video "How would you feel if we voted on making every MP get there electricity and there gas cut off, there fridges emptied, and said to work for 4 months and get there food from a food bank, how would you feel about that? You should realize how your policies effect people" Im recently a victim myself, these last 3 months havent been the best, i guess you could argue other countries have it harder, but we have the resources to make it easy for the majority not the minority. *(Please move it if it is)
  24. Hi, please can someone explain in greater detail the maximum discount for the Right to Buy scheme. I have read all the relevant literature Am I right in thinking that the maximum discount is 70% of the valuation of the property however this would be capped at £100,000 (London borough cap) So a property that is worth 350k in London is not going to be sold to the tenant for less than 250k. Assuming that the maximum discount applies. Much appreciated

Don't exactly know where to post this, so posting it here My local poundworld is terrible for giving the correct change, more or less every day, they don't have 1p pieces, and the operator make their excuses.. .sorry I don't have any 1p coins, even when I asked for my 1p change, he just closed his till This has been going on for the last 2 years, I have even contacted there customer support, and once more today sent a strongly worded email I would like to know from someone who is in the know, would this be classed as theft, if it happened once or twice, then call it an under sight, but to happen all the time, some one must know its going on The xxxxxxxxx bit is something I want to take up with my local police officer, as I recon, Im owed around £3, in change not given to me, over the last 2 years I even consider, if this is happening in other poundworld stores, there something very underhanded going on
