Same experience as above. Where does he (the car owner) stand? It is annoying that someone takes the money for your ticket physically but then you get told you haven't paid. I also have the ticket as evidence. Again, parking attendant said to put on dashboard but no reference to terms and conditions. Interestingly I parked around 7:30am. It was dark so even if the signs were up at the time, they weren't illuminated so would that add weight to the argument? Do I reply or just wait?

  3. Good afternoon all! I just wanted a bit of advice on a situation i'm currently in. i'd just like to state that i have no real legal expertise and knowledge lol at the start of June 2017 i got myself a BMW 530d on finance through the company i used to work for. they kindly offered to insure the car through the company due to the mileage and business use i was doing with the car. on the 28/06/2017 i sold the vehicle on finance to a customer. he has then ran up dart charges and 2 PCN's which i have had to pay (£513 Each, so total of £1026). I had actually sent a copy of the finance agreement to all parties as part of my representation when the fines originally came through. waltham forest council have stated that its on the file but newham council and dart charge claim they never received it so all 3 then still continued to chase me for payment. I paid the fine for the two council PCN's as it had got to bailiff stage and a bailiff was at my house. however, i have got a HPI report on the vehicle which states there was a change of ownership on the V5 on the 28/06/2017 which is the new owner. I'm now thinking can i get any form of compensation for all the trouble and hassle this has caused. The one bailiff entered my parents house and was asked to remove his shoes as we have cream carpet but he failed to do so and continued to walk around the property so i now have to pay to have the carpets cleaned which is annoying as well as now putting me in a situation whereby I've been paid from my employer but not left with anything for my bills due to having to pay the fines. on these grounds do i have any basis to challenge the enforcement companies and take them to small claims court to get my original £513 back for what i paid, I've incurred late payment charged on 2 bills as a direct result of having to pay for a fine as well as the cost of cleaning the carpets? Any help is appreciated
  4. Received a yellow PCN whilst in retail park 3/1/18. Yellow one from VCS. I was parked in the Disabled bay and in a rush. Placed my badge, not right down at the window, because I can't reach it to put it away. Saw the PCN, opened the car door and the badge was on the floor. Unfortunately I did say I was driving and sent copy blue badge. I have sent two letters to VCS and the one I got last week said I still had to pay and I could still pay the original amount of £60. This is stressing me out, sleepless nights, worrying and causing my asthma to flare up. Not good at writing letters. Help!!!!
  5. I received a PCN for spending 21 minutes in a car park in a town I don't know well. I had pulled into the car park to answer a phone call on my mobile - I was in my daughters car so didn't have hands free. As I was then pulled over I rang home to check on the kids, and then rang my husband to see where he was _ I was suppose to be picking him up from town. He didn't know where he was so said he would find a road sign and ring me back. I drove round the car park a few times - tried to get my bearings - find the exit, work out what road I was on. He finally rang me back, gave me instructions about where he was, I explained where I was - we arranged where I would pick him up - 21 mins in total as it turned out. As I didn't actually park up ( what is the definition of parking?). I didn't buy a ticket, and also only meant to pull in whilst taking/making a calls which was the safe thing to do. Didn't think to buy a ticket ...stupid I know. Now I have a PCN. I wrote back , enclosed a cheque for a pound to cover parking. Fine was £90!!!!! Didn't lodge an appeal with POPLA. Now gone to a debt recovery and have 28 days to reply. Do I let this run-on to county court?? Do I put a late appeal in? Help. I was ignoring it and judging by the other posts it was better to try and resolve it again. What do you think please?
  6. Good afternoon everyone, Yes, it's my first post at the forum because I haven't had any problems like that and my knowledge of UK's law is very poor on this field. Let's start from begining. I've bought a car in August 2017 and got few PCN's that I didn't pay at the begining. After few weeks I got 2 letters from Medway Council to pay two different PCN's that I've paid (last one was on 27th September). Two days after I've moved to another flat in gorgeous Chatham. I've informed DVLA about moving and have VC5 with new address and a date 08/11/2017. Since then I didn't get any letters informing me to pay PCN's at my new address. And here the story begins... Last Friday morning (27/5/2018) I went out to my car and I saw it's going away on a service car . I've had no idea what's going on but I thought it might had some connection with those last years' PCN's I called Medway Council to find out what's going on. A lady I was speaking with told me that it's being taken by Jacobs because of unpaid PCN's and gave me their number. I've managed to contact with a man who was in charge of my case and he told me I had to pay £950 if I wanted to get my car back (while my car is worth £1500) and every next day I'll be charged £15 for parking. I needed this car next day to get me and my girlfriend to work so I'd met that man and paid him all the money he asked for just not to lose next day without the car. Do you think this kind of acting is legal? In my opinion I was robbed and I regret I didn't called the police that my car was stolen. Can you please tell me if there is something I can do to get any money back? Thank you in advance for any help.
  7. Parked in a slip road that's in foreground of pic, one way running right to left. Left slip road and turned right onto main road. Only signs are left and right of slip road exit. CCTV shows me turning right with long shot, then close-up showing vehicle reg. On reflection, I can only say I was watching out for other cars in this very busy area and honestly did not see the No Right Turn signs. There was no signage on the road surface, opposite in the form of signs or any physical obstruction. Can anyone say if the road signs give good cause to appeal due to height, etc. Also, is it right that my Appeal of the challenge already turned down will mean I HAVE to pay the FULL fine of £130, as opposed to the £65 "discounted charge" paid already. If it's just not worth the trouble, or paying the extra £65 if I lose the Appeal, just give it to me straight, thanks. LBH PCN pic small.pdf
  8. Hello, I would really appreciate if someone could give me some feedback as to whether to appeal the PCN. Yesterday I parked down a road with a school on, outside housing which is very busy with cars. I parked on a high kerb between two driveways which my car did not over hang onto either of the driveways and i was not obstructing pedestrians or either houses. My car is slightly over onto the dropped kerb, we are talking cm. I have attached photo's for reference, if someone could please let me know what they thi, I would be very grateful.   9. I just received a Local authority PCN, which correctly lists the make of my vehicle but incorrectly lists the model of my vehicle. Is the PCN therefore invalid? Thanks
  10. Hello hope you are well? I just received a PCN from Brent council for violating a no right turn, unfortunately I followed my satnav and turned right but I never saw the sign on the pavement. My question is that the spelling of the road is wrong on the PCN notice, does this mean I have grounds to appeal? Thanks. Kind regards Ummi
  11. Hi, I've read a few threads today and found the advice very useful. Just wanted to share my specific case to see what advice can be given. I noticed a CCJ on my credit file through clear score registered at Northampton County Court. Today I rang the court and was advised that it was in relation to a PCN from SIP and Gladstones have taken me to court. The case is regarding 2xPCNs at the start of January 2017 outside of my address in privately rented apartments. On at least 1 of the days in question the ticket machine was out of use (I have a photo showing this - although it probably isn't the greatest as it doesn't clearly show where the machine is just the "NOT IN USE" message). A couple of weeks after these dates I moved from my apartment and didn't receive anything from the claimant regarding the claim or subsequently anything from the court. The first time I realised there was an issue was looking at my credit file and finding the CCJ. The CCJ amount is in excess of £400 (inc court fees etc) which is quite frankly extortionate for 2 days parking. I don't have allocated parking in my tenancy agreement. I would like to remove the CCJ from my credit file and have received the N244 application notice from the county court. Any help and advice would be greatly appreciated before I pay the £255.
  12. Hi, My other half received a PCN from Civil Enforcement Ltd following her picking up a prescription at the local doctor's surgery. She has a letter from the surgery confirming that this was the case on the same date on which the PCN says. My wife decided to inform Civil Enforcement Ltd directly that this was the case, along with the letter, and surprisingly enough these cowboys rejected her appeal. She then informed me of this and I am now trying to sort it out. In their letter to her they said their internal appeals process has been exhausted and if she wishes to continue her appeal she needs to go directly to POPLA. Could you please let me know whether I can write to them again, along the lines of the thread below or whether I will need to go to POPLA?   13. My wife and I work for the same company. She broke her foot in November tripping over one of the many spent firework rockets left lying around the work car park by the landlord. After a while she decided to go back to work with a surgical boot and crutches and I agreed with our building manager that if our car park was full I would park in the disabled spaces as our overspill car park is quarter of a mile away. Four spaces are marked up for my company and the other five aren't marked up for anybody. On the morning in question, our four were taken up so I parked in one of the others. I got a ticket from CPP who didn't even query with our reception desk (I've got a company sticker on my windscreen). My company contacted the landlord (who knew my wife had a broken foot) to ask what was going on just got a curt reply saying we shouldn't have been parked in disabled bays that are not ours. We thought it had been dealt with however. Then a PCN arrived so help appreciated folks.   14. I got a ticket today. A Sunday at 11.58am. It was a single yellow line in Greenwich, London. Any advice on what the sign is all about please? Since, it didnt mention a weekend, I parked there and this is how i find myself here.
  15. This very recent Local Government Ombudsman's decision (released 10 days ago) is another one of importance. In this particular case, a motorist had incurred a penalty charge notice from London Borough of Haringey for wrongful parking. As the contravention was for parking as opposed to a CCTV contravention, she received a Penalty Charge Notice on her car advising that the charge was £130 but if she made payment within 14 days, she would be entitled to a 50% discount bringing the penalty down to £65. She told the council that she could not pay and offered to clear the debt over a 15 month period at £5 per month; the Council refused but offered here a further 14 days to pay at the reduced rate. She refused to pay. A warrant of control has been issued and passed to bailiffs to enforce and the debt has risen from £65 to £513 (to include bailiff fees of £310). Please be advised that our signage located throughout the area clearly state "No Stopping at Any Time". It is the motorist's responsibility to ensure that he/she is fully aware and compliant with the Terms and Conditions of this area. We must advise that there are over 70 high profile signs advising drivers of the consequences of not complying with the highway restrictions located throughout the 'Red Route' areas.   17. I have received a letter from B W Legal, stating that it is a `Discount Offer` to settle a PCN which they state has not been resolved. Their letter is in the usual format. Interestingly, they state that the contravention was dated 23rd June 2012, which I understand pre-dates the official inception date of POFA. I do not have any memory of this alleged event as the car was only in my name for insurance purposes and belonged to my son. As this pre-dates POFA, am I right to assume that if I state that I have no knowledge of the driver, especially after 6 years, they cannot enforce this?

Hello folks, Infringement date: 11/01/2018 NTK date: 22/01/2018 Received: 25/01/2018 Schedule 4 of The Protections of Freedoms Act 2012 is mentioned Number plate photos were included I have not yet appealed Euro Car Parks are the company (BPA member) Vehicle was located in Bishops Centre, Taplow Was in Frankie & Benny's too long. Entered the car park at 18:50:40 and time on my receipt is 20:53:26, but we stayed chatting until close to F&B's closing time (11pm). Exit time was 22:59:16. Therefore I should have left at 21:50 and overstayed my welcome by 1hr 9mins. Most other outlets on site close at 10pm - the car park was practically empty. I do not think £75 for 1hr 9mins parking from 9:50pm is justifiable, expecially since 3 hours is free and you can park in Maidenhead town centre for £1.50 for that entire duration at night. I know the steps are: appeal, reject, request popla, appeal, win (hopefully). Given the above, which template should I use for my first appeal to ECP?   19. Aplogies as an absolute newbie here, however I was asked to create a new thread. There is another recent thread (I can't post links, maybe someone else could as seems daft to recreate a whole heap of stuff). I am in the identical situation at the same location I have just received an identical letter from UKCPS, all details completely as the above mentioned thread (same paperwork). My wife was driving my car that day, obviously she didn't spot any signage etc. 28 minutes over a 4hr limit..... Disgusted that companies can request such 'fees', she is disabled (was parked in disabled bay, with badge on show) which has left me even more disgraced at these cowboys operate, with no extra time for disabled people.... Question is approach them & ask for 'understanding'? Dismiss? etc etc
  20. Hi I'm hoping that you can help me... A few days ago, I received a PCN from Smart Parking as the registered keeper of our vehicle, relating to an "unauthorised parking" of our vehicle on 24/01/2018. There are photos of the car entering the car park and leaving the car park. It seems to be fairly standard to come on here and ask about not paying the fine etc. but I have a slightly different enquiry - we actually have the ticket from Havens Bank car park on that day which shows that my husband paid to park in the car park. The ironic thing is that it's known to be notorious for this and I'd only said it to my husband the previous day, "keep that ticket just in case they send a funny letter!" Do I just appeal it online, sending photographic evidence of the ticket and then it will be sorted? Or is there a better way to sort this? You've all given such helpful advice to others regarding their issues at this car park, I'm hoping that you can help me! Thank you! Sam
  21. Hi, my post is relevant as its another MET PARKING CHARGE NOTICE debacle. This time at Mcdonalds, Gatwick As per the previous poster, my first correspondence from MET was a 'reminder' document. Please see the 2 files attached. I have two questions before I lodge my complaint / appeal with MET. First - I received this notification 25 working days after the alleged infraction - yes the car was there on that date however "the driver" was not aware of any parking restrictions, nor did "the driver" notice any signage - which seems a regular theme. Secondly - the notice wording suggests the drivers details have been provided by the registered keeper?????? There must be some telepathy going on here Would appreciate peoples views on whether I should respond to MET using the many templates provided OR just ignore the letter given the 2 points raised above..   22. I recently found a PCN attached to my windscreen from UKPC even though I was displaying a permit. The PCN stated that I was not displaying a valid permit, although the out of focus pictures taken by them, and displayed on their site, show the permit on my dashboard. I have appealed the PCN and asked that they stop harassing me, as this is the second time I have had a ticket whilst displaying a permit. What I find frustrating is that rather than cancel the first PCN, they simply waited 2 months for it to expire, and my guess is this one will probably go the same way. As this means I have to not only waste my time appealing these PCN's but also have to wait 2 months for a resolution, is there any way I can force them to issue a cancellation in a timely manner and to stop this happening repeatedly? As it stands,this series of events could go on infinitely and I have far better things to do with my time.
  23. Hi On 27/1/18 I parked in this car park operated by Smart Parking. The closest machine was out of order so I walked across the car park to obtain a ticket, which I am sure more than covered the period that I was parked - BUT, I no longer have the ticket. I received the attached notification on 2/2/18. I have no intention of paying this but I'd be grateful if you could advise of next steps. Should I raise an appeal or leave to run its course ?   24. Hi My friend who lives over road went to local esso and got a pcn in the post for parking at the garage for 3Hrs 27 mins 37 secs to buy a newspaper!!! I have proof on my cctv (reg not readable) of him leaving at 06:37am and returning at 06:54am Is it best to just ignore it or send them a letter telling them where to go or see them in court as I would be willing to witness that fact that I know it was him that came home and parked opposite. I could save 2 weeks of footage of his 2 cars parked at home and photo evidence of me walking over and taking a picture on my cctv? Many thanks, Andy

She did her shopping there, however, she paid cash and didn't keep any receipts from her shop. What would be the best course of action? Appeal to the parking company? Contact Lidl?
