  1. Hi Caggers, I need some advice on statement of educational needs. Can I change the named school in my child's statement or will I need to ask for him to be re-assessed? It has been 9 months since his last review and 4 years since I actually named a school in his statement.
  2. Hey everyone. My sister needs help. First off she has learning difficulties and doesn't fully understand the situation she's in. She works for a care company where she goes to peoples houses to help the elderly with there daily things. She's on £7ph, the problem I see with this is they will schedule her to work 30 mins at a house and they will only pay her half of her £7 which I can slightly understand but what annoys me is she has to pay for her own travel nothing discounted or anything. She spent 5 days a week leaving the house at 8am getting home around 9pm and in 3 weeks only got paid £171. I do not think this is fair and was wondering if this is allowed.

Dear All Quite a difficult one here and I'm at fault for being stupid but I'm now paranoid over benefit fraud, prosectution etc. story is this Moved into new place Oct/Nov 2011 Initially was Singler person paid as such but then partner moved in gradually over next few months. I never changed council tax and simply sent the form off April 2012 and 2013 and continued the SPD as the relationship was on again-off again etc. I now have an SPD review letter. I've rung the council up and changed it so we are now both on it but I need to send the SPD letter back. I told the man on the phone in a panic she had just been here a few months but obviously they have details of when mail etc was sent here (note her mail sent here initially prior to her moving in fully). I want to fix this and pay back the arrears but I'm paranoid anything else I say will get me in more trouble and get me prosectuated. i did ring the coucil and expalin this - the lady didn't really understand and said that if I just fill int the SPD form that would generate a bill if any monies are owing. I want to go in to the council to speak to them but think I'll ramble and get myself into more trouble! The amount owing would be 2x25% - so about 600quid and I could pay it back there and then! Any advice?
  4. Hi all, About 2 weeks ago, I was getting so stressed about my debt situation that I contacted Gregory Pennington and they took a lot of my mind. Agreeing to take me on if I paid £200 a month, they would talk to creditors and sort it all out for me. I remember being told my first payment would be just £35, to set up, then £200 a month after that. They also told me to stop paying all payday loan companies. Today I got paid my wages and rang Gregory Pennington to pay their set up fee and was told that it wasnt £35, that I needed to pay the £200 first, BEFORE they would even speak to my creditors. ( Even though they said they would contact my creditors as soon as I signed a Client Authority form). Now (due to me paying off arrears in rent today) I cant afford this £200 until NEXT month. BUt during this time my 5 payday loan companies will eat and **** me for interest and charges. Im almost sure that my debt will double if I do nothing. Which is making me really really worried. My debts are Wonga : £570 PTP : £1600 Money In Advance : £220 Lending Stream : £230 Capital One : £330 Last month I set up a repayment plan with Wonga and Lending Stream, agreeing to pay them this month. But from advice given to me by G.P. I foregone the payments. And now im freaking out in case they hit me with an almight rise in debt. Im at breaking point now. As a temporary reprieve of my sanity, I have contacted StepChange and im trying to see if they can help, but I dont think they contact creditors at all and leave that to us. Could anyone give me advice on this situation please? I would be extremely grateful. Martin
  5. can anyone tell me where i stand with this. i bought a fridge freezer from homebase on the 14th of jan and returned it the next day as it wasnt big enough, i was told of three dates for a refund but it never turned up i spoke to the bank (hsbc) they suggested a chargeback as it was a visa debit i could do that, so we did and was told we needed to fill out some forms with proof we had sent it back and was told we may need to pay it back at a later date as they put it into our account straight away but we would get plenty of notice of this. this was on the 1st of feb. we got the forms filled it out and sent it with a copy of the paperwork we had for sending it back. we thought no more of it then on the 18th homebase refunded the money into our account, now we did make a mistake and use the money they refunded without realising that was what is was. Then yesterday we received a letter saying they would be taking the amount back but no date on the form we rang them to find out they were taking it tomorrow. now the letter was dated the 22 of feb and we only know it will be taken tomorrow as we rang up. is this right surely that is not giving us prior knowledge of it going out. where do we stand with this, we will have no money in the bank tomorrow when tax credits go in and we are both unemployed and we have three children one is only one year old. thanks for looking
  6. just been to the work programe ,and my advisor,says i am not doing very well finding work, so she sugested training for something different from warehouse work and packing, which is all ive done most of my life. she said what about construction work,i said i think i am to old and out of shape for that kind of work, so she said think about what you can train for to get a job,so ive been thinking but i cant think of anything,any ideas.?
  7. Hi Guys, Does anyone remember how many demands and needs questionnaires, they filled out when applying for a loan or credit. I received my 2nd refusal today and they included a copy of the demands and needs. My name, signature, date and the advisor's signature and date are different on there copy as to what is on my copy. the signatures are almost correct, but there is big differences to way the dates and my printed name, have been written. I could scan and crop, for you to see Have I caught them in their lies,,,, James

Hi my name is Gerry and Im trying to turn my Welfare Advice Skills into a self supporting business.My idea is simple enough to run a Wefare Rights Advice service that will pay me and anyone who works for me a wage.Its not for profit Im just sick of doing mundane jobs Im not suitable to want to use my skills in the field they were designed for.So my problem is where if anywhere can I approach to help me set up such a business.The plan would be to provide advice on benefits and preparation of benefit appeals giving the client who has no understanding of the system the best chance of sucess at appeal.The next problem is most clients would be unable to afford more than a nominal fee,this would be acceptable as long as it covered my admin costs,but where do I get my salary from?So if anyone can help please email me at [EDIT] and I will be grateful and all constructive criticisms are welcome many thanks

  10. hi im really having problems with csa and tribunal service. there have been so many counts of incompetence that im thinking of taking this further and seeking legel advice but i need advice from others who may have been treated this way. this is whats happened, the csa contacted me at the back end of last year telling me i was entitled to over £8,000 in arrears for my 2 children who are now 27yrs and19yrs so the arrears go back to late 90,s. i told them i wasnt entitled to any money because id been a single parent on benefit and then since 2001 id been disabled of work so i was still in reciept of benefit so any monies owed had to go back to the state, they then told me that due to a change in the law it was my money and they were in the process of securing a payment from my ex. i had been getting £11 per mth for the past couple of years as my daughter was in further education and i was get tax credits so i assumed that it was all to do with that and that was the end of it with the csa until they got in touch about the arrears. in january 2012 i started to recieve payments and they continued until the beginning of march 2012 then stopped without any warning and in total id recieved £2,030 from the csa, when i contacted them to find out whats going on they told me the following, the original weekly calculation had not been done the correct way and that the person dealing with my case came up with the figure off the top of there head and this was what was quoted to me over the phone from the csa officer i was dealing with, she told me that my ex had appealed this and it was her job to put it right. she told me because it was the csa fault they had to by law squash all arrears and that i was to pay back all money id recieved. i straight away appealed this because as far as im concerned im not paying it back and i totally disagree with there decision, they made me feel that both i and my children was worthless and my abusive ex would get off scott free. over several phone conversations with this woman she told me that many mistakes had been made such as- didnt check the work details my ex provided to see he was telling the truth no periodic yearly checks were done, i only ever heard from csa once in a blue moon over the years. tribunal service lost our paper work for over 2yrs which prevented checks etc. now on 31st aug i had to attend a hearing at oxford and me and my ex met with a judge to addresss the situation, the judge did say at the hearing that it was wrong to squash the arrears and that my children was entitled to some money and she sent my ex of to basically fill in the gaps of the time line to do with where he,d workd,lived and how much rent he used to pay etc so they can revise the weekly amount and work out just how much he owes in arreas and as to whether i,ll be getting any money, she adjured our case and im waiting for a new date. since then ive been informed that the judge wasnt even dealing with my case she was working from my ex,s appeal which as you know had been dealt with and id appealed there desicion, the csa said they were going to bring it to the judges attension and i just got to si tback and wait to see what happens next so i think you can see nobody at the csa or the tribunal service seems to know what the hell there doing, the csa did deposit £100 into my bank account as an admission of ther failings towards me and the csa person i spoke to told me that she wasnt happy to do what she did but the laws the law. di really appreciate any advice because i am feeling abit lost and have no one to talk to about what to do next etc thankyou for taking the time to read this.
  11. The Respondent's Solicitor has written to me asking how much I would consider settling for. Hearing's scheduled for Christmas time. I have not yet completed a full schedule of loss and am going to take formal advice on it shortly. But based on a look of case law, I have a feel for what might be reasonable. Am I right in thinking that I don't have to disclose my financial expectations, or the schedule of loss until ordered to do so by the Tribunal? Also, in light of this, is it worth setting up a Special Needs Trust to protect any settlement I might receive? I am disabled and on benefits. But may be able to work again in the future.

Hiya All, I posted this thread post No.2568071 ( Sorry cannot put link in as I have not made enough posts) as you will see it was 2009 but I never got to finish it and apply for judgment to be set aside, I was still unsure of my position following my last post. I would like to know if I have grounds and can proceed with setting it aside Best wishes Zeb
