  1. I have a joint mortgage with my sister or rather a remortgage, of 87000, We have kept our payments up to date, until I took sick, and have been off work with PTSD, stress/depression, and am currently waiting for treatment. My sister rang them, and she had to phone the CCCS and get a number or something, so that Santander knew that we had spoken to someone about our situation. The woman suggested we paid £50 off a month, we usually pay £591. So we actually paid £200 off for the last two months. Now we both have received letters today, saying that unless we pay the arrears within the next seven days, we will get a visit from a field person. As far as we were concerned we thought this arrangement was for 3 months, and we had paid over the amount they suggested, and the interest was frozen, with no charges. But they say we owe them over £758.00 This has us very confused and frightened, as money is very tight, and we have our essentials to pay for. Does one dept not talk to the other..
  2. Hi all , I was the victim of mortgage fraud by an ex partner , I thought I was buying a house together, having contributed half of the deposit ( 85 k of a 170k deposit ) in 2010 . It transpired that she used a false address , false declaration of funds , falsely claimed that it was a buy to let property and mortgage and that she would not live there or never had . She used that false address for another three years , and had been living in the house before the mortgage as a tennent and has lived there ever since . I told natwest of the fraud in 2013 , but they have refused to take action . i have recorded calls , and natwest have said that they accept people make false decorations in their applications and as long as the mortgage is paid on time , they don't mind . I now have a charge on the property with the land registry , but , What action can I take against natwest , seeing as they accept that I told them about the mortgage fraud in 2013 and they have knowingly facilitated that mortgage ?
  3. I'm looking for some advice please . I recently applied for a mortgage, and was asked initially over the phone "have you ever had any CCJS or IVAS". The answer was and is no. I was given an agreement in principle. This has now progressed to full application stage , after passing a full credit check. I have received a check list to sign and return to the lender. One of the first questions asks "Have you ever been subject to county court judgements (CCJs) , defaults or a repossession"? Is this asking if I have had a CCJ, county court default judgement or county court repossession order?, or is it asking if I have ever had credit defaults? The answer to that is yes, all unsecured, all now off my file and statute barred. After an initial panic I believe it is all County Court order related but I would like your opinions please.

Hello, We want to re-mortgage our house finding better deal with diffident lender and on the same time increase amount taking Money to do some improvements like change windows, doors, rendering etc... My Questions are: Can we increase mortgage with different lender? (Our house price increased over 30% from the time when we bought it) Will the Lender ask to provide estimates for work to be done from Contractors? Doing re-mortgage how much Broker's fees are?   5. After discovering that I had PPI attached to an old Halifax mortgage, I put in a claim for miss selling. Today I had a telephone call from the Halifax in connection with another PPI with them that I knew nothing about. I ventured to enquired about my Mortgage PPI claim and they said that a letter was sent out to me on the 12th July 2016 explaining everything. Today is the 25th July 2016 and I have NOT received any such letter. The lady on the phone then read me the contents of the said letter outlining the reasons for the decline of the PPI. The ones that stood out were :- You had NO savings to support your mortgage payments in the event of sickness or redundancy. You needed PPI to cover sickness, redundancy etc. When the aforesaid "sale" took place I had been in my present employment with Royal Mail for 9 years and continued to work for them for a further 10 years until my retirement. (19 years in total). It doesn't take a genius to work out that a letter sent on the 12th of the month does not take 13 days to arrive at its destination even if it was 2nd class. This letter is still to arrive. At the time of the sale I had cover for sickness (6 months full pay, 6 months half pay) redundancy (12 months pay) and also death in service through my Royal Mail Pension. As far as I was concerned I DIDNT need PPI, being covered through my employment. I have the original paperwork in connection with this PPI and in my Personal financial Report it states :- No recommendations nee4ded From the information you gave me it seems you already have plans in place to meet the following or no need in the particular area * Protecting your financial security * Protecting for critical illness over and above the mortgage debt * Saving for the future * Investing your capital I had a secure job with Royal Mail and a statutory pension plan in place for my retirement which included a payment for death in service. Sick pay and redundancy pay. Why did I "NEED" PPI Was the Halifax right to decline my PPI claim. I understand that it was underwritten by Lloyds. Any information greatly accepted. Thank you
  6. Re: GE MONEY. Hello, I an new here and am in the same situation as many of you with GE Money mortgage charges etc. I didn't know how to post my query, so I am sorry to do it on this post. Hello. I am new to this site, but have spent many days reading through the threads, looking for answers. I have been with GE Money with a mortgage for 9 years. I have 28 months remaining. Some while ago I fell into mortgage arrears (£704 - which equates to 1& 1/2 months mortgage) Subsequently they have been adding monthly Admin charges of £40 per month for 40 months and the last 7 months £50 per month. direct debit recall charges of 18 x £25. field Agents fees - 4 visits charged, only 1 executed. Total of these visits fees £274. Grand total of all of theses fees and charges £2,674. (Plus interest - although I do not know how to work that out - sorry. Back in May of this year 2016 I received a letter from GE informing me that they have transferred my mortgage to Kensington. These money grabbers have written to me stating that I am in mortgage arrears of £705.68 PLUS Fees and Security Charges of £1598.07. And that my mortgage account has an overdue amount of £2303.75. They also say "You are breaking the terms and conditions of your mortgage and it is important you make a payment to clear the total amount shown above. I understand that Charges and Fees cannot be treated as arrears. Arrears are missed contractual payments. I pay £493 per calendar month and have done so for as long as I can remember. I offered GE a paltry £10 a month extra payment back in February (mainly because I am on a pension and at that time had NO work) They refused and continued to add charges etc every month and then they transferred me to Kensington. I have my SAR from GE and that is where I calculated the fees and charges they have imposed on me. Do I go to GE for a refund of these charges or is it now Kensingtons responsibility. Thank you
  7. Hi, I've had a read through previous posts and was hoping for some advice on our current situation. We entered debt management plan in Jan 2013 (70k credit cards & bank loans). Never missed on mortgage payments (1 residential & 2 buy to let) and these are currently up to date. We have a couple of properties which have finally increased in value and are hoping to sell this summer and get back on track. Our DMP has always been up to date. We were wondering what our chances were of obtaining a mortgage in future once we come out of the plan. Both of us have good jobs and stable employment. Also - if we went for part/full settlement of our debts does this pose an increased risk? We were hoping that if we went for part/full settlement we would be able to save and get another residential mortgage in a year or two - not sure if mortgage company would look at us - any thoughts? Really appreciate any help and advice as this DMP is a weight round our necks that we really want to get rid of as soon as feasible (never paid a bill late until we entered into this but was unavoidable due to significant change in circumstances). Please be gentle as I am not overly familiar with protocol on forums. Thank you for reading

No contact ffom loan company about deceased parents secured load. --------- Hi, I'm hoping someone can offer some for of advice. My mother passed away in 2012, she had a secured loan on the house, not huge, it ws 7k and at the time she passed there was 3.6k remaining. Being disabled she didn't have a massive income and her insurance policy covered her funeral and that was it, she has £70 in her bank account and no other money or assets besides the house. The loan company (Santander) were great, said we needed to take the details of probate in and everything would be on hold until then. Her will was written when I was a child so I was the benificiary but not the executor. Everything had to be done through her sister. It took a while to get probate sorted as the solicitors who had the 'official' copy of her will had closed and neglected to send their documents to wherever they're supposed to have sent them when they closed (Sorry, can't remember exact terms), we had to try and track down her will and when we couldn't we had to apply for a signed letter from some place (again, sorry I cant remember exact terms) that allowed us to go and sort probate, that took a while and it was fnally sorted around a year ago. myself and my aunty took all the needed documents to santander who took copies of everything and said they'd be in touch shortly, I distinctly remember the woman saying it is usually a quick process. They kept calling the secured loan a mortgage, are these two the same thing? It's now been a year and I've heard absolutely nothing from them. Neither has my aunty (We aren't sure if they'll contact me now probate has gone through because I'm the benificiary or contact her because she is the executor). Nothing besides the monthly ststements which has in big bold writing at the top 'This is for information only'. I know it sounds stupid and anyone reading will think why have you not called them, a few reasons really, I'm terrified for one, I've lived in this house my entire life, I have nowhere else to go, the house is in a terrible area and needs a lot of work, it's not worth enough for me to sell and buy elsewhere. And secondly my own health hasn't been great, mental health that is, I've suffered from severe depression and extreme anxiety includig time spent in hospital due to attempted suicide. I'm currently unemployed and am terrified if I call they'll say they want all the money or they want massive monthly payments that I can't afford and i'll basically end up losing the house. I've no idea what to do, do I call and see whats taking so long and why? Or just leave it and wait for them to contact me however long that takes?
  9. Borrowers whose monthly payments doubled when their lender increased the rate on their tracker mortgages are hoping a Court of Appeal ruling might allow them to claim back thousands of pounds. About 6,000 West Bromwich Building Society customers are expecting refunds after last week’s ruling that the lender was not justified in changing the rates for buy-to-let landlords on tracker mortgages. In December 2013 the lender increased the rates, despite the fact that the Bank of England’s leading Bank Rate, which tracker mortgages are typically expected to follow, had not changed at all. These borrowers will now receive a refund and be returned to the lower rate. The lender is expected to pay out £27.5m.   12. Please could anyone advise me on what to do next regarding this, as I seem to have run up against a brick wall. I bought my previous property in 2000 with a mortgage from Southern Pacific. The mortgage was redeemed in February 2004 when I sold the property to my son, who also took out a mortgage with the same company to purchase it. My son failed to make the mortgage payments and the property was repossessed about 2 years later. I no longer have anything to do with my son. Recently, I decided to try to claim back PPI from my earlier mortgage. I no longer have any paperwork relating to that mortgage, as it remained with my ex - wife when we sold the property. All I have is bank statements showing monthly payments being made to Southern Pacific, with a reference number which I quoted to Acenden when I made my claim. Acenden stated that they had no record of me ever owning the property or having a mortgage. The only details they kept coming up with were my son's. Despite explaining that I owned the property prior to selling it to my son, and that my initials are different, they could find nothing. Until a further phone call about 2 weeks ago when - at last - they stated they had found my details and gave me an account number, and promised to send my paperwork to the company dealing with my PPI claim. Then a few days ago, I received a phone call from the claims company. Acenden had sent them all the paperwork relating to my son's mortgage. I then phoned Acenden again, who stated that they have no record of me and my son's details are all they have. So back to square one. What can I do next to prove my mortgage existed, and have they committed a breach of the Data Protection Act in sending out paperwork relating to my son to a third party? Any help greatly appreciated. Thank you.
  13. Hello All, This is my first post on here although I have done a tremendous amount of reading on the site trying to work out the best course of action for my wife and our family. I will try to keep it short and succinct: We bought a house in 2007, with a GMAC mortgage, I lost my job in 2009 and we ended up in arrears, the mortgage changed to Mortgage Express, the house was sold with a shortfall of £30k. We have been paying £50/month ever since up to last month (April 2016). I received a letter from a solicitors mid March saying they were acting for their client Bradford and Bingley regading the arrears remaining following the sale of the property, now £28k plus. Enclosed was an income and expenditure form, also request for details of vehicles we own, bank accounts, savings, shares, finally a statement to sign acknowledging liability for the outstanding debt and our offer of repayment either monthly or a lump sum. A called them as they were calling me 4 times a day continuously. The info given to me on the phone was that they now owned the debt and they wanted the information to setup a plan for us to repay it. I have filled in the form but not sent it off or had any other contact with them yet. I would just like to point out at this point that they have the wrong address for us as we have moved into rented property due to an impending permanent move abroad, I still have access to the old address and any post ariving there. It maybe wrong but I do not feel obligated to give this company our new address. Or should I setup and carry on paying the £50 ish/month and/or give them new address and setup new plan? Many morale questions but the immeadiate action is most important which will lead to the future plan. We are departing the Uk next year. Thanks in advance for any advice and experience..

  15. Hi everyone, Ok, i really need some advice and direction. My dad is 66 years old and i am the only family left that he has here in the UK, rest are in his home country. I own a property with my wife and 3 year old baby and have been looking to move out of there and purchase our own house. My dad has offered to sell the house to us at us under market value and at the exact mortgage which he has to pay to the lender, i do not earn enough money (£30k per year) to be able to buy it so a friend of his said why doesn't he 'gift' the house to me and i get the money under a bridging loan then later on get a good deal from a high street bank. There is a lot of sentimental aspects of this house which is why he just wouldn't want to sell it anyone and why he wants to gift it to us so then my son can grow up in it. I was really just after some advice on this. His friend said we would have to wait 1 year or perhaps longer on an 8% rate before the banks would then see the gift as completed so i can get a better rate, finishing off the bridge. He wants to retire and live in his home country. Is this the best way to proceed? Thank you
  16. I have a couple of questions I'm hoping someone can offer some advice with. I have a secured loan with Southern Pacific (Acenden) for £5500 taken out in 2006 and is due to finish at the end of April. In 2007 I was made redundant, got in to approximately £400 of arrears and was taken to court and ordered to pay the full monthly payment plus £20 per month towards the arrears. T his I did but Acenden added a £30 arrears fee each month to the arrears, hence I had no chance of ever repaying these arrears. The situation is that I now owe £12k which is due to repaid at the end of April and is made up entirely of fees, charges and interest. My questions are, 1. Does anyone thing there is any point going to court to challenge Acenden on the basis that they have frustrated the order of a court (or whatever the legal terminology maybe) as by them adding charges to the arrears I could never repay the arrears as directed by the court. 2. Does anyone know of any company that would be able to offer legal help (rather than just the generic advice you get from National Debtline etc.)? I have approached a local solicitors (in Bolton) but they want my to pay £500 up fron t just to look at the papers before deciding if they could help which I'm not in a position to pay. Any advice appreciated.
  17. Hi All, I have spent the last few days reading thousands of posts and trying to get a grasp on things but i can't find anything similar to my dilemma. Will try and keep it brief as poss. We have a decision in principle with our BS. We went directly to them as the OH banks with them, they have the best rates and they are are by far the best fit for our needs. The DIP went through fine with the credit check as both of our credit files are spotless. The problem is i still have old debts totaling approx £30K from between 8 and 18 years ago. Yes, the large percentage of this debt goes back to 1998! I have somehow got away with minuscule payments for several years which i negotiated myself, approx £20/month in total. There are a total of 7 debts (mostly now with Cabot) with 2 of the early ones having CCJ's and the rest defaults. We now need to make an appointment to process the full application and i know one of the questions will be regarding Outstanding Debt'. Although the aforementioned old debts are no longer showing on my credit report they are of course technically still outstanding. I will have to mention them and this will obviously go against us!! I can of course not mention them but this will be dishonest and could lead to the mortgage being withdrawn after exchange (if they found out) which will mean the possible loss of a large deposit. Although no longer showing on my credit report the payments to the DCA's will show up on my bank statement. They only require to see 1 months statements so i could of course stop paying by SO/DD so i have a 'clean' month but again this is dishonest and i wouldn't chance it. Maybe they wont care about the old debts or maybe they won't notice (clutching at straws here!). The only solution i can see is to try and get low F&F settlements but i only have approximately £2-3,000 spare at the moment. If they accept i cant see any problems but the chances of all of them accepting 10% seems remote. Would welcome any thoughts from the experienced members. Many thanks. PS - I know i have been 'cashcowed' for several years and have never asked for CCA's. Unfortunately finding a way not to pay the debt wouldn't stop it being outstanding so wouldn't help my problem.

Halifax mortgage. never missed payments until last year. my deal allowed for a repayment holiday. went into branch explained in difficulties, was given 3 months 'off'. may, june, july. my situation hadnt improved so then missed August. Saw their field agent [charged for] who took full statement of particulars etc; and i asked for help via interest only option. i made the payment for September. Eventually got letter confirming a reduced payment for oct, nov, dec. i took this for an interest only due to the figure offered. however struggled so hence the reason for Court possession hearing. based on their Court papers and then Witness statement, i have communicated via email with the solicitor stating i dispute the amount claimed [they have included the 3 months holiday and also the full amount rather than interest only amount for the oct-dec]. plus they state they dont know my circumstances etc, yet they have the field agents report, so they were inaccurate in their claim. i also stated that i felt their 3 month interest only offer was short sighted and not dealing with my request for long term help; as discussed with the field agent. additionally i was getting arrears letters and new payment amount letters during the oct-dec [harassment?]. i asked for the arrears to be added onto the mortgage [plenty of equity] and an interest only option for 2 years to allow me time to get back on my feet. they said no. they now say the 3 months holiday was just an 'arrangement' and not a formal payment holiday and the reduced payment was not an interest only option, just a reduced payment arrangement. hence how they have arrived at an arrears figure of c£6k based on the full monthly amounts, where I calculate it at approx £3k based on the holiday and reduced agreed amounts. their own criteria as i have now found out is that they can offer such a facility, interest only, but only if 6 months of full regular payments have been received., and only after another income/expediture provided. i have stated they have one from end august, paid for, and nothing has changed !! hence why i am in this financial position and asking for help. i then asked if i was to make 6 months payment at the full amount, knowing that financially it will be a burden, would i then be allowed to drop to interest only for 2 years and the arrears added onto the term. the response from the solicitors was that they would accept that proposal, but ask for a suspended possession order and also want a full inc/exp before confirming acceptance. BUT for any interest only and arrears consolidation i would have to discuss direct with Halifax.!! [they are on a direct computer link with halifax/BoS]. Additionally in their witness statement they state they have followed protocol to assist blah blah blah, including offering reduced payments and consolidation of arrears. I have replied stating that i am unhappy as there is no guarantee after financially struggling for the 6 months to comply with their own criteria for qualification for an interest only mortgage, they will be any more helpful than at present [words of that effect] due to their lack of flexibility. Also they have NOT offered consolidation of arrears, as they claim, even after my requesting it through my own proposal. Therefore i have advised them that the more sensible proposal is that which i originally asked for, 2yrs interest only with arrears consolidated/added to term., as that is a more financially viable, sensible and sound option and I will be attending Court to reiterate that offer. So.......... if you got this far !!! i have no faith in the court system [even longer story] to the point they make me physically sick but obviously have to go on friday. all my emails were marked without prejudice and i also referred to my right to produce/use as evidence in Court. Tomorrow i will print out [x2] copies of all my emails etc and create my own witness bundle and hand deliver to the Court so that the judge has it on file - i will email copy the solicitors also. If any thoughts or advices as to any case law i can refer to etc etc, i would be grateful for....... sorry so long winded but just decided to share this worry.......... THANKS !!
  19. Hi all, I took out a loan with welcome finance in January 2007 which is secured on my house for £13k. I split up with my partner (whos name is also on the loan) in 2008 and since this have been stuggling financially with debt. I am currently working full time plus a part time job at nights and the weekends, however i am only just managing to survive financially. I have succeeded in getting my mortgage up to date with no arrears, and the smaller debt my ex left i have dealt with using a debt management program but i just cant afford the payments on the WF loan (£270 per month). I have missed a lot of payments on this loan and they have now passed it onto a debt collection agency (although i have yet to hear from the agency). The balance on the loan is now £15000 including charges. I started reading about unfair credit agreements and wrote to them to request a copy of my agreement, which i received although it was quite illegible as it had been printed from a computer. Should this be a route i could take and if so what am i looking for in the agreement? If not what other options are available? can you get trust deeds to include secured debt? i could probably afford to make small payments each month but i would be over 100 by the time it go paid off!!! I cant see any changes in my financial situation for the forseeable future, im already working all i can and its taking its toll!! I cant see any way out of this at the moment, there is no equity in the house, as its sitting at a loss. On top of this Ive had health problems and my doctor wants me to give up my second job. Any advice would be greatly appreciated!
  20. Hello, I hope someone is kind enough to help. I won't go into names or numbers as I know many banks and their Lawyers/ Debt collectors are avid readers of such forums. I have a mortgage shortfall debt after a repo. The banks Solicitors wrote to me and requested a repayment of the shortfall. This has been going on now for a approx 2 years. I made a few offers of a full and final which they declined. They then countered my offer on a Without Prejuduce basis but I could not afford to pay the sum requested at the time. I am now in a position to borrow the countered sum but as the date has lapsed they are now declining my offer. I know this is just a game they are playing and I am sure they will be willing to play this forever. What I would like to know is can I apply to the Court regarding this matter for a Judge to decide that this should be settled or do I just have to play games for the rest of my life with them. I am doing everything I can and offering to pay this sum is a big commitment for me but will be worth it to get rid of this . I am hoping a Judge would see how I am trying to work with them and maybe help end this matter once and for all. The Solicitor has told me they won't take me to Court as it would cost to much money as there is no guarantee they they will be able to get the money, also they won't bankrupt me as I have no assets. I guess they are worried I go on and win the lottery Any advice will be appreciated. Thank you
  21. Hi My mum has a mortgage on a small apt in Spain. The repayments were affordable but two years ago rose to an almost unbeareable level. The banks will not remortgage due to her age and are not prepared to enter into negotiations about the repayment level. Has anyone had dealings with companies that advertise they can help you out of similar situations? From what I gather they negotiate with the banks on your behalf, you pay a fee but you get out from under a huge mortage with no liability. Id be interested to hear of any such stories. Thanks
  22. Re: The Mortgage Corporation - Woking Hi, I had a mortgage with the mortgage corporation from 1990-1998. I have traced them to the present day in the guise of :- Mortgage Trust Ltd. 51 Homer Road, Solihull, West Midlands, B91 3QJ. I had PPI arranged through the mortgage corporation and am trying to claim this back. I have gone thru' the claims process myself with Mortgage trust and they say that because cases prior to Jan 2005 fell within a non-regulated sale environment they do not have any liability. When I took my complaint to the Financial Ombudsmanicon service (FOS), they confirmed that this was the case. They did however state that I could take the complaint to the insurance underwriter (the insurance company who actually provided the cover) and the FOS would be happy to help if I had problems with them. Here lies my problem. I do not have any details of the insurance underwriters who the mortgage corporation dealt with in the 1990's as I was never sent any documentation. If any body out there has their ppi policy details, I would be very grateful if you could provide me with the name and possibly the address of the insurers used by the Mortgage corporation in the 1990's Many Thanks, jxgrgs
  23. Hi Bakatcha, The reason why I am contacting you is connected with my own dilemma with INGEUS!! I have been out of work for sometime & it's tough. The job centre has placed me on a mandatory work program with INGEUS & sadly it's lasted longer than expected. My advisor is using unorthodox ways to find work for me and somewhat intrusive. My advisor thinks it's a good idea if he watches me use the computer when I search/apply for jobs and he also wants me to possibly visit INGEUS on a daily basis. He also thinks it's a good idea if he applies for vacancies without me performing this task and I strongly disagree with that! He even suggested that I sit down with him & log onto my email account so he can check all the jobs I apply for each week, unacceptable in my opinion and I wondered what you make of this.

I'm having similar problems, could you please let me know how i would get a summary of the charges added to my account, i've tried logging into their website but they will not activate my account. I've received a letter stating i'm in arrears but when i ring up they say my account is in credit and they will get someone to ring me back, but never do!!!
  25. Hello I really need some advice. I have been given an eviction date from my mortgage lender as we are in arrears and have failed to keep to an agreement. This eviction is set for the 10th of March, we only received the notice a week and a bit ago. I have filed an N244 application to try and delay the eviction. I just don't know if it will be successful and as this hearing is set for the 8th it would be cutting it very fine. I have written in the N244 that due to my wife's medical condition we desperately need more time to find accommodation. She has an chronic back/spine condition and struggles to do normal day to day things and mobility can be an issue at times. She is also being treated for a heart issue and has to have her liver scanned at the end of March for a separate issue. We have approached the council and have been put on the list for "suitable housing" closer to our grown up Children.They need to help her when I am at work or working away. This all takes time! I have also asked if we can have time to sell the house ourselves but not sure if this will be allowed. Does anyone have experience of these hearing and if this could buy more time? I am totally lost............
