  1. Hello, For the past nine years we have had trouble with different baliffs collecting on behalf of train and tram companies. It started with a baliff collecting for many unpaid tram fines in my husbands name in 2007. My husband did NOT accumulate these fines and had no idea where they came from. We had no correspondence of the orginal paperwork. Just what the baliff had in his hand. He suggested my husband do a stat dec on them and was very understanding. A few were actually referred back to court. My husband attended court and once the description of the person fined was read out it was quickly dismissed. The description however was the exact match to his brother His brother admitted using my husbands name and address on many occasions. We thought it was all over. We moved address and didnt think anymore of it. But Its been years and these baliffs kept coming. Some we paid as they didnt give enough time to complete a stat dec others gave us time to complete it. Its been nine long years of just wondering when the next door knock will come. This morning a baliff arrived stating he wanted £825 for avoidance of fares relating to 2005 and 2007. He has given us 24hours and if we do not pay hell be back with the police and a locksmith. We are at our wits end. Again its another day off for my husband and another day of ringing around courts. Is there anything we can do to stop this baliff and the locksmiths as we really do not have the money this time to stop them and not enough time to complete a stat dec. (Although my husband is trying) thank you
  2. Hello all. I'm hoping you may be able to offer advice. I have had a letter posted at my home; a 'notice of seizure ' by a HCEO acting for Marstons Bailiffs. The debt is for a historic utility bill. The debt is in my name only. The seizure has been levied upon my girlfriends car. Her car is registered in her name, and insured in her name. I have never owned the vehicle. My girlfriend is getting worried and upset as she is reliant on her vehicle for her work. Can the officer remove this vehicle? He has stated that the registration documents etc mean nothing, and that as we live together and have done so long term it is a shared asset which I have access to. It has been some time since I last had to come here for help, but found you all very helpful and informative before at a time when I was in need of advice and support. Many thanks.
  3. I am hoping that someone can help me, long story cut short, I got made redundant a while ago and TV licence direct debit bounced and I got a fine, I am now working. I ran the courts who said £50 a month is the least I can pay, they would not accept any less, I managed to pay a couple of months but then could n't pay ( I am also catching up on rent/council tax) I have had a letter from Marstons saying that they will visit to levy distress and remove my goods by auction. As I have a heart condition I have written to Marstons re vulnerable debtor etc, however is there any template letter or legislation that I can quote to the court, all I want to do is come to an arrangement that I can afford but I know that the court will refer me back to the baliff who will add additional charges on, its making me ill and the insomnia ! hence I am writing this at 1 in the morning, any advice would be appreciated,
  4. This morning I was awoken by a very rude man man from Marstons and if I said nearly banging the door off its hinges it wouldn't be an understatement. The account relates to my wife. after having a fine fore non payment of a tv licence. I tried to speak with him but that was no good as he asically refused as it named my wife and not me. His also opening line was Im from Marstons do you know why I am here?? Gotta love it havnt you. He claimed to have a warrant to which I replied may I see it please answer was a flat no. Now he has left a letter and claimed to be coming back tomorrow same time to carry out this distress warrant. The balance of the fine is £142 and I know that from court papers etc. However the amount Marstons are trying to claim is £442 is this legal to claim nearly 3 times the original debt?? Any help and advice would be greatly appreciated.
  5. Hi. New to the forum - discovered while searching for clampers. Leaving the house this morning i discovered my car was clamped with a sticker on drivers window, attached below [ATTACH=CONFIG]47466[/ATTACH] It relates to a supposed unpaid parking ticket from westminster council. I believe I may have already paid this months ago but I am still looking for the paperwork and online receipt. The ticket is £202 and the bailiff fee is £240, total £442 being demanded in cash. I have not received any paperwork through the letterbox nor did the bailiff make attempt to knock on my door. Advice gratefully received!
  6. i had a letter pushed through my door when i got home late yesterday saying about a final notice for 373 and he would be returning later this week i think its for the remainder oof a court fine for tv license which i thought had been paid 2 years ago i have had no thing from court before and no final steps notice etc or any letters from marstons can i get a stat dec from court how do i go about getting one of these am worried sick i have a mentally sick husband 2 children under 5 and a pregnant daughter as well helppppp
  7. Hi All I have joined today for some help on my current situation, I have heard wonderful things about this fourm and any help would be really appreciated. I have a speeding fine that has been unpaid, I stupidly buried my head in the sand and as I simple do not have the means to pay the fine, jut pushed it to one side and prayed it would disappear. Obviously it hasn't I received a letter from Marstone two weeks demanding payment of the £300 fine + £85 fees that were now due, I contacted marstons to advise even with help from friends I would not have the funds to pay until next month, the response I got was it was now with the bailiff and I would have to deal with him directly. Last week I came to front door to find a hand delivered letter stating a bailiff had tried to attend but was unable too and now the balance of £600 is to be paid or I can expect another visit and more fees. I spoke to the bailiff via telephone and advised I would not have the money but would try my best to get it by tomorrow, Unfortunately despite all avenues I have only managed to raise the £300 that was originally due on the fine. I have seen a few conflicting reports stating if I pay the original fine amount then I am not obliged to pay the fees that are now being demanded however I was hoping someone would be able to state for sure if this is the case or not? Waiting in hope kind regards Robbie
  8. 2 debt collectors called asking for over £400 for an unpaid fine from 2005 at the magistrates court. I knew nothing about any unpaid fine so no way were they getting a penny. They showed me some paperwork the unpaid fine was £165 the rest were their fees from a visit 10 ten days ago and today. No way did anybody visit 10 days ago, he reckons they would have left a note, I have nevre had a note. Obviously I was not letting them in and told them i was not paying. So they said they would wait outside for "the bailiffs and the POLICE and they would execute the warrant and take goods to the value of the £400 and odd quid." I said ok and shut the door, they sat in their car, i went on the internet. A quick frantic search revealed they were lying to me and as far as I could see they could not claim their fees and unlikely they would force entry. I went back out to them and asked when the police were arriving? "as it is a grade 2 in about 10 to 60 minutes" So I went back in, 20 minutes later a card popped through the letterbox and they drove off. The card had the Marstons logo date ref etc, but said that they had attended to execute a Distress Warrant issued against me and that I was wilfully trying to evade payment..........and that I should be aware that there exists a power under Schedule 4A of the Domestic Violence Crime and Victims Act to enable us to enter your property, BY FORCE, using locksmiths where required to execute this warrant.............I will be re-attending your premises with a locksmith if necessary, to conclude this matter. I may if appropriate request authority to use the above powers of entry. I am not happy and need to do do some more reading up about bailiffs and their tricks but i thought i would share this story.
  9. i was caught speeding 2 yrs ago, pleaded guilty & was fined. unsure how much original fines were, but i have a bill from marstons for £400. in the past i have spoken to them over the phone, they demanded £25pw which i cannot afford. i have tried to contact the doncaster court, but it's always press this , press that and always cuts off. the latest letter states they have the right to enter my home using a locksmith in my absence, is this true? also, if they do turn up with a locksmith do i have to let them in? i'm determined to defend my property , but don't wish to end up in a police cell or have them remove my belongings. any help would be appreciated, but these people are very unpleasant & very unhelpful, i'd rather arrange some sort of payment plan through the court, is this possible?
  10. Hi, I am new to all this and desperate for some advice, any help would be greatly appreciated. My husband had an account with Howdens last year, he used it to buy materials for a job he was doing which totaled around £450. Following this he had no work and could not afford to pay the balance off, he contacted Howdens and explained the situation. Then 2 weeks ago a man knocked the door and when i opened it he asked for my husband, he wasnt here so he handed me a letter to give to him. The letter had Marstons on it and a Writ from the high court with all sorts of fees on and total balance £1,140. I phoned my husband at work and gave him the mobile of the officer to call....he phoned the man and explained that he would clear the debt off over the next 3 months, Mr Andrews said he could not talk about it unless he had a reference number (we now know he didnt need one) anyway my husband got the ref off me and then attempted several times to contact Mr Andrews back, left messages and had no reply. 4 days ago I am at home when someone starts pounding on my door, shouting. I was terrified!! The door was locked and I did not move from the livingroom, I had a good idea who it was!! He kicked my door (there is a dent in the door to prove this) and was trying the handle. After several minutes they put a letter through and left. The letter was the same as before but costs were now £1,287 and the bailiff was now Mr Wright. I telephoned the office and said my husband had been waiting for a reply from mr Andrews so why has another visit occurred? they explained that we would have to contact the new officer and that they could not do anything. I telephoned Mr Wright and very politely explained the situation to which he said "its not my problem I want full payment" after repeatedly telling him we have 3 small children and cannot afford it he said if we did not get £500 to him by Friday he would be back with equipment to break into our home and take our things. We offered £300 and installments of £100 a week (not that we can really afford it) he wasnt having any of it so we tried to sort it out with the office!! in the meantime I checked out Mr Wright, who is not on the certified register....when questioned he got very defensive and put the phone down. We asked the office, who said he was a certified high court enforcement officer and they did confirm that he had no right to threaten to break into our home. The office accepted our payment arrangement and everything was fine, or so we thought!! My husband phoned the office Friday to pay and was told it was not accepted by Mr Wright, the gentlemen he spoke to also said that he wont be on the register because he is a sheriff and does in fact have the right to break into out home??? Sorry about the essay just wanted to get as much in as possible.....any advice on the matter would be greatly received Thankyou in advance Kind regards Emma x

Hi there, my husband received a speeding fine last September, he had just lost his job so the whole thing escalated out of hand, & his fine increased for failing to provide his information, whilst he was out of work the court took so much out of his JSA, he went back to work in July due to him not earning an amazing wage we wrote to the court asking for an I&e form, and offered to set up a standing order for £15 per week. The courts wrote back informing us it has been passed onto Marston's who have wrote to us demanding full payment of £745.00 + £85.00 fees which we are not in a position to pay such an amount in full, i fully appreciate my husband was in the wrong by burying his head in the sand, but I would like some info on how best to sort this out, Many thanks
  12. Hello my partner is having some problems with Marstons. He was fined by the Magistrates court back in may and had a payment plan of £20.00 a fortnight put in place, My partner has been paying his fine but 2 payments were paid but paid late and because of this the fine was passed to Marstons. Then my partner received a letter from Marstons asking for full payment but he was unaware that the fine had been passed on so we wrote a letter to the court and to Marstons asking them to take back the fine as it was being paid its just 2 payments were late. Marstons replied saying that there complaints department would look into it and he would be contacted when a decision was made this letter was dated the 1st August 2013. However today my mother in law had a visit from a Marstons bailiff asking for my partner who also lives there, wanting a payment of over £800.00 or goods will be removed. Now the actual fine is only £600.00 and over £120.00 has already been paid to the courts some of which was paid after the fine had been passed to Marstons. So we have again written to Marstons to ask why the bailiff had attended the property as in our previous letter we asked for no bailiffs to come to the house as my mother and father in law both are pensioners with severe medical conditions my Father in law has alzheimer's and my mother in law is partially blind and is in remission from breast cancer and visits like this are to stressful for them both. We of course sent evidence of the previous correspondence we have had with Marstons along with a complaints letter. I was wanting to ask if what we have already done is right and if there is anything else we can do and does my partner continue to pay the court even though the fine is with Marstons. If anyone could help that would be great as my partner is extremely angry with Marstons as they frightened the life out of my Mother In law saying that they are coming back later to remove goods and the conversation is also being recorded thankfully my mother in law didn't open the door and spoke to him through a closed window. Please help thank you
  13. Hello and thank you in advance for any advice you can give me. Last year my son recieved a driving ban with a fine of £475. He was ask to wait to make a statement of means. This never happend and after asking several different people was told to go home, Which he did. Because of personal problems ie splitting from partner and spending time on different cousins sofa's the paper work never got to him. On Thursday 1st August a letter for my son came to my address, He has always told me to open his letters incase they are urgent. It was a Further Steps Notice dated 16th July giving him 10 days to reply. As you can see from the date that time ran out on the 26th so the letter did not reach us in time to act. I rang the number on the letter and was told it was to late to pay as it was already sent to a bailiff. I would have to deal with the bailiff, Whose number she gave me. I should put here it was Marstons. I rang Marston's who said it was not yet in their system and to ring back on Monday. They said when it did show they would want the money in full. It has now occured to me that because the letter came here the bailiffs will come to my home to get the money. I own the house and all it's contents, My son has no belongings here because it was all left at his former partners house when he left there, All he had was his clothes. I have two questions , 1st What can I do if they come to my house? apart from not letting them in. 2nd Can my son still apply to the courts to have a means hearing or make a statment of means so he can clear this debt. We do not have the money to pay this in full, So I can't pay it either otherwise I would and he could pay me back Hope you can advise me Lilly.

But Marstons have chased a Mother 8 years after a council had apparently obtained some court order re a fine for truancy, when the Son concerned had a brain tumour.
  15. Please can someone help! Had a visit today from a bailiff stating i owe £450 for TV license debt from 2008 from a previous address in another area. I called the majestrates court and told them it was the first i had heard about the debt. They advised that i did actually aknowledge the debt back in 2008 and made a £30 payment so a stat dec is not an option. The court advised me to call their fine department which i did and they say because i had a baby 7 months ago, self employed on maternity allowance am classes as vunerable and should be allowed to have the debt passed back to themselves and just pay the original £150 and have baliff taken out the eqasion. So i called marstons, spoke to someone who clearly could not be bothered to be there said i was told a crock of lies (his words) and it was up to the majestrates to claim the debt back. Another call to majestrates, they confirmed they could NOT take the debt back and its up to marstons or the other option they told me - IGNORE IT?!!! they say just dont answer the door or let them in......i don't want a default of CCJ though been working hard to sort out my finances. Called marstens again spoke to someone who was incredibly rude and told me to call the baliff as it was HIS decision NOT the companys to send back the dbt?!! Am confused and have spent the past 2 hours on the phone back and forth whilst trying to look after a 7 month baby. Its seriously stressing me out and inder loads of pressure from baliff HELP please xx

Hi All Just wondering if any one can help with a problem here goes: Apparently in 2009 i committed a traffic offence ( i was probably at work and the offence was probably made by my x husband) I apparently replied by post pleading guilty ( dont remember doing this either) in may 2010 i apparently called the courts and said i would pay in 2 weeks) during this time i was going through serious domestic issues( evidence from police etc), which required me to move house in Dec 2010 i changed licence etc over to my new address A couple of months ago i received a letter from police to pay this outstanding fine, so i phoned them due to the fact i was unaware of any of this (my mail was being taken) they told me it was for not filling in information on a named driver. explained situation they told me to go to courts and make a declaration. The bailiffs have turned up last week and the fine is now £500 originally £200, been to court today to make deceleration and they told me about the phone call i made and about reply to a guilty plea i explained the situation (fell on deaf ears) I asked if i pleaded guilty why was i being fined for not declaring information (deaf ears again) and why had it took them so long to find me . asked if they could remove the bailiffs and reply was no i have to sort it out. To top it all i have to pay fine £500 (not got that sort of money divorced 2 children,but i am working and on tax credits) Phoned marstons group gave ref etc asked to be put through to welfare officer wont allow it i have to speak to bailiff let message with them. Also on top of all that i am in bankruptcy at present phoned the official receiver and they say i have to pay fine,but i thought the OF owned all my belongings,. In a muddle can anyone help i am willing to pay fine but on monthly basis or in full at original amount. Long winded sorry:|
  17. Got a letter yesterday from marstons stating seven days to pay before the bailiff arrives. The only information on it was it related to a court fine for a criminal charge of harassment, causing distress and abusive behaviour in September 2006. don't know anything about this and I certainly haven't been arrested, charged and appeared in court to get the so called fine. I called the 0845 number today and after holding for 20mins managed to speak to what sounded like a spotty adolescent straight out of school, I was told there was no other information he could tell me. Very helpful of course you can have your money...not. now this being the 4th such unknown debt letter in a month, 3 for my husband and one for me, I had already spoken to the police and reported the letters as identity theft. 2 of the said letters where in connection with cars we have never owned, again in 2006, and another similar to the marstons, for a court fine to do with an arrest for abusive behaviour and using foul language. After I told the child at marstons I had a crime number for identity theft and explained it wasn't me he just simply said 'prove it'. On police advice (which I told him), I calmly explained what the police told me to do - write to marstons explaining about all the other letters and I had reported this as identity theft theft and could they issue us with more details of the said Crum, ie where it happened, who had I harassed and caused distress, what time, court I mysteriously appeared at and on what date. He then got quite aggressive and told me I would have to fine that out myself, my reply was again on police advice, innocent until proven guilty and as the letter was from them, the onus is on them to prove it. Anyway if he wouldn't give me anymore information, how did he expect me to do his job for him? Again I got a temper tantrum response that the bailiff would come anyway and 'sort me out' and he quite firmly slammed the phone down. Three times I called back and every time got cut off. I am now going to take all the letters and 2 statutory declarations I have to the police station with my crime number and have my own tantrum, because I took young Paul's at marstons little 'sort me out' comment as a threat and I now feel quote intimidated and fearful of the big scary bailiff turning up. Any advice on what to do when he gets here would be greatly appreciated.
  18. Hi I had a letter from Marstons a few months ago stating I owed an outstanding amount from a fine and marstons fees 82.00. I sent them a ltter asking why the fees are so high,and they just advised thats what the fees are,as from some time last year.I paid the fine immediatly but held back from the fees,as I beleived one letter from them does not cost 82.00. About 8 weeks on,i have just had a doorstop visit by the creeps and they have told me that in no uncertain terms that I now owe them 300.00.Pay up or they will take my car.. It was a saturday morn,I was a little intimidated and I paid....I am very uncomfortable and feel very angry that this has happened...arent I suppose to get a warning or letter etc.. any help will be greatly appreciated.   19. Hi Again Guys well another day, another issue that bites from my previous life.... I have today received a letter, diverted from my old personal address, from Marston Group Limited. The letter is in reference to a "high court writ" against a company i used to own. I had no knowledge of any court action against this company. The letter was threatnig to gain access to my property (my previous property) to collect goods. The letter is addressed to the company name, but at a personal residential address. The company is currently non trading and hasnt traded since june 2012, and there is an application into companies house to have the company struck off. The creditor who has issued the court action against the company was aware of this 12 months ago and has received a letter stating such. Anyway, I have called Marstons on receipt of the letter to inform them that I dont live there any more and the person who does had nothing to do with the company. I also informed them that that address was a personal residential address and that it never was associated with any business or traded from there. I also explained the status of the company. The lady, awfully rude, then asked me for my new address, which I refused to give. SHe said she would trace me, find me and attempt to remove goods from my new home. I explained that this was unacceptable and that the business had no assets and everything in the house was either mine, my childrens or my new partners. She said they would still send the baliff anyway and attempt to collect and that I had to prove, with receipts, that the goods in the house were not that of the business and would have to provide receipts. Any advice on where I stand with this? I havent seen any court paperwork or dont know who to speak to to stop this harassment.

Are marstons just a DCA or do they also enforce court orders, im in debt with many creditors red,lowell,mkhall you name it and i know most are just DCA so when i get a letter i laugh and throw away knowing most of the debts are approaching SB status. But a couple years ago (im still trying to find it) i got a letter from Marstons and it said i had 5 working days to pay £540 i think it was or they would send baliffs round, i think the refrance to original debt was HMC whoever that it. It was different to all the usual DCA letters i get, i panicked and thankfully my mum was able to pay it, and i paid my mum back over a few months, Then i came across this site and see marstons mentioned quite a bit and im starting to wonder should i have paid them, it never went near a court i dont think. Is it to late to start questioning this unknown debt which was paid some 2 years ago.
  21. Hi, I could do with some advice as I have conflicting opinions. My wife received a judgement against her and she then applied to have it set aside and for execution to be stayed. The debt is owed but by our Limited Company and not by her. The supplier has mistakenly sued her. In the meantime Marston Bailiff arrived today and was quite threatening with regards to taking possession of our shops goods. We explained that we had made the application but he had no interest. He asked her to sign a walking possession which she refused. She informed him that the goods in the shop were owned by the Limited Company and not by her. He said he could just take the lot and argue about it later. I rang the court who have escalated our application to urgent and that they will get it listed for an urgent hearing. The court said that once it was listed that would stop the Bailiff from actually taking anything Is that correct???? If it is then that's fine but when we rang Marstons, head office they said that it would not stop enforcement. Who is right?? Kind Regards, Lee
  22. Ok bear with me on this as I have been trying to help my cousin out with her problem. Today Marston came round to her house and took possession of her car. When she contacted them, they explained it was for a Parking Ticket issued by Essex County Council last year. This was the first that either my cousin or her husband had heard about it. Marston said they had written to them and hand delivered a letter, yet my cousin has nothing of the sort from them. My problem is in understanding the process by which this debt should be claimed. Would a warrent of distress been issued or not. She has paid the fine and fees they applied which totaled to just over £600. If needed I have the only piece of paperwork that Marston gave them which is the Notice of seizure of Goods and inventory. Many thanks in advance. Bavo
  23. Hi everyone, I hope I'm posting this in the correct place as I wasn't sure if it should go here or on the Motoring Group forum. I woke up this morning to find my van had been clamped for non payment of a council parking charge. I'm not too worried about the parking charge as I am in dispute with the council and am currently going through their formal complaints procedure - I realise now I should have just paid the fine and tried to claim everything back afterwards - you live and learn! However, I am concerned with how I was forced to make a payment to the bailiffs in order to get my van back. Whilst my van is personally owned its signed up with the company name, logo and contact details and I use it for deliveries. When I explained to the bailiff I use it for my sole use in my business doing deliveries and am unable to carry out any deliveries without it I believed it was covered under Section 89, 1 of The County Courts Act as the vehicle was essential for my business and I needed it this afternoon for my deliveries. The bailiff said the Act doesn't count and he should know as he's been doing this job long enough - Is this correct ? Also, when I asked why hadn't I need notified he said a letter was sent out 10 days ago giving me 7 days to pay or the would take this action - I didn't receive the letter but have no proof and similarly they cant prove it was sent but said the fact their computer says the letter was issued that's good enough for the courts. In order to get my can back so I could do my deliveries I paid the following: Original fine and fees - £93.20 Bailiffs attendance costs - £61.94 Attendance to remove/removal - £175.00 VAT - £49.63 Total - £379.77 plus £1.00 debit card fee Is there any way I can find out if they are allowed to charge these amounts ? Plus, and this just gets better, I've just realised I've paid too much VAT as 20% of £236.94 (£61.94 + £175) is actually £47.39 - is this fraud or a HMRC matter ? (would love to start a VAT investigation!) Is there anything I can do about the over charge ? When I made the payment I explained I paying under duress as I had no alternative and was looking to mitigate my losses, in that they were phoning to a tow truck to remove the vehicle. I have since faxed a copy of this statement to Marstons as the bailiff refused to sign my statement to confirm I had made him aware. (I also wrote this on the receipt just in case) I've tried speaking to Marstons and requested their complaints procedure only to be told there isn't one, you simply fax or email a complaint and they will deal with it when they get round to it - I though anyone working on behalf of a local council had to have a written complaints procedure ? I've also telephoned my local council's corporate compliance complaints team and they have taken details and said they will look into the matter but it's normally something I would have to take up with the bailiffs firm first. Any advice anyone could give me would be appreciated - I don't mind dragging these guys through the courts or causing as much fuss as possible as I'm happy the original fine will be cancelled by the council once they have dealt with my original appeal.   24. Hi everyone i had a parking fine from manchester city council(my car was a touch over the white line when i parked). I am a blue badge holder in recepit of dla and esa which totals £120 pw. I contacted manchester city council who were unhelpful from the start and told me it was not there problem and to contact northampton cc. Northampton cc told me the same and passed me back to Manchester cc. Now i have 5 days left to find £93...marstons told me in no uncertain terms they will take my car,i live with my mother and have no valuable goods of my own(all have been long sold since my illness). I asked could any amount be taken out of my benefit weekly and i was told "yes,the full amount of £93 and given to our balliff). Is there any other alternative to the one solution i have left which is to borrow off a door step lender which obviously i do not want to do as we all know how that could end up.   25. next door just came round. marstons had visited while she was out. her son had used the car last year and had a parking ticket and failed to tell he. she thinks he hid all the letters. total bill is £495. it is a council parking ticket we called marstons and an aggressive bailiff said its not his problem and he just wants the total amount paid. asked if she could go into a payment plan he said no. because he will just take the car. asked for a break down of his costs. he said the warrant is £161. and three visits totalling £166. asked how it adds upto £495. he said the rest is going to be for the tow truck when he comes to remove the car. she told him she sold the car last week at which point he threatened her with contempt of court. i said how can it be contempt if the levy notice is today and she sold it last week. at which point he become more aggressive. saying i,ll sort this out today. tell her i am coming round i,ve advised her to not open the doors. call me i will video him. and go and get this set aside on the grounds she never received the original PCN any other advice
