  1. Hi, I had a previous bank account (but not old enough to be SB) with HSBC which was overdrawn by a large amount. Negotiations to sort things out with HSBC broke down and I've not heard anything from them for 3 years, and have since moved. I came home yesterday to a claim form (dated 29th August) from MKDP LLP who now appear to own the account. I presume they have traced me, but I have had no prior correspondence from them. The amount claimed is a lot higher than the overdraft was, so will doubtless include countless fees. The particulars of claim are 'The Claimant claims the sum of being monies due from the defendant(s) to under a bank account facility regulated by the Consumer Credit Act 1974 and assigned to the claimant on . The defendant(s) account number was . It was a term of the bank account that any debit balance would be repayable in full on demand. The defendant(s) has failed to make payment as required by the demand for payment sent by . The claimant claims the sum of and costs. The claimant has complied, as far as is necessary, with the pre-action conduct practice direction'. No other supporting documents are included, which I suspect is because there aren't any - the overdraft was originally agreed back in 2001 entirely over the phone and I never signed anything or was sent any specific terms before having it. I'm think defend is the way forward as I definitely do not owe the figure claimed, but I don't know what the actual figure should be so I can't really claim partial admission since I don't know how much to admit, which leaves full defence as the only option, and if they don't back down, a full & final settlement offer to try and avoid a CCJ being issued. I understand that section 77 requests are not relevant to an overdraft, but do I have any other rights under the CCA to demand supporting documentation for the claim and would I be able to use failure to supply this as a defence as you can with a failed section 77 request? Some advice on the best way to approach this would be appreciated!
  2. Can anyone please advise on what I can do about a HSBC overdraft. I have recently lost my job and currently unemployed.A few bills, mortgage, credit card and a car loan will very quickly eat up what little savings I have. I have sent a template letter to the loan and credit card asking for 6 months interest free grace and I am hoping that they will agree. My HSBC overdraft is currently at circa £2,200 - the limit agreed is £2,000. I have £1,000 in a savings account. Should I write to HSBC and explain the situation and then use the savings for this months mortgage and food. Or should i stay within my overdraft first and foremost? I know that no one will be happy but there is little else that I can do other than being honest and try to get a job. Any advice gratefully recieved.

Received Court papers yesterday from Northampton bulk for an OD from an HSBC account the missus left in 2008 (moved to Natwest Nov 2008) They're claiming £732, plus interest for 6 years 15/03/11 to 15/03/17 plus fees total 1233 Now, I don't have exact times when HSBC would have stopped the OD and recalled it, but obviously it would have been stat barred by now. But in 2010-2011 the missus, against my advice wanted to 'do the right thing' and and paid one of the previous DCAs (Wescot) some money per month. last payment was around September 2011. Here's hoping their paper trail is seriously faulty.... any advice please. I've a little idea on what to do. I would like to see if I could contest this and make them prove it isn't statute barred (make them come up with the paperwork) I need to do acknowledgement of service, then do I send a letter to the DCA and HSBC for info? thanks for any help I should mention it's Hoist Portfolio that are the claimants, Cohens are just the document address

Hi, Need some help, hopefully it will be better than the replies on MSE I started to go overdrawn with HSBC about 4 years ago, all small amounts which they would charge for, it then got to one month where they wanted to charge more than I could afford, I pleaded with them to not charge me as I would have to move my money as I would have nothing to buy food etc with. They still insisted on charging me. So I moved my wages before they applied the charges and left it around £25 overdrawn from what I remember. Moving on to last week, I received a letter and numerous phone calls (despite asking to be contacted by letter only) from MKRR regarding my HSBC debt which is now £800 with all the charges they have applied. I asked on MSE if I should send a prove it letter. I was advised: 'My first port of call would be a ProveIt letter to the DCA. This should then provide you with an account reference and other information. I would then ignore them completely, and go via the Bank instead. Frankly, asking you to pay what amounts to extortionate phantom charges after such a long period is grounds for a complaint to the OFT on the basis that these charges are unfair. I have the sort code and account number, what do I write to HSBC? Or is there another route I need to take? Regards, DreamEater
  7. I wonder if anyone can please help or advise about this situation. I have a home that I currently rent out and the mortgage is paid up to date etc. I had some financial difficulties when everything crashed in the late 2000's. I missed one or two mortgage payments due to being out of work a long time ago, probably 5-6 years. The arrears were paid up almost immediately and have been on time ever since. I have lived with my girlfriend for 4 yrs and have let the house for that period. Today I received a letter from HSBC for the full balance for the property, a FINAL DEMAND. I dont know why they would send such a letter as, like I said I am all up to date. I am wondering if because I should have let them know I was letting the house I am now in default, and should have been converted to a buy to let mortgage. If anyone could shed any light on this I would appreciate it. Thanks

I wonder if anyone can advise me of a contact number or help regarding a loan taken out pre regulation via Central Trust CT capital with Endeavour personal finance who are now HSBC HSBC blame Central trust as the broker - Central trust say they were not regulated pre 2005 so told me to look at the underwriter who were Hamilton Insurance. I believe they are now Aviva Insurance. I have telephoned many Aviva numbers today - they all tell me that they have never heard of a PPI claim with them as the underwriters?? Am I going mad? I really have no idea who to contact at Aviva
  10. I'm posting on here as my query is related to PPI. Can anyone let me know if they've managed to obtain copies of old Midland Bank/HSBC credit card statements from the mid 1990's? I have the account number but no paperwork. I've read about one other poster on here who took HSBC to a small claims court in 2007, for non compliance over a DSAR and bank charges complaint. Has anyone else had a similar experience and had to take matters this far to get their data. I asked the ICO for an opinion and they accepted the bank's advice that they only hold statements from six years ago

  12. HSBC credit card. Opened 22/10/2012. Defaulted 14/04/2015. Sold to Westcott then to Arrow then to Moorcroft then finally to Capquest!! CCA request sent 28 October with no reply yet. Yes, my partner is in a bit of a pickle with his finances!!
  13. Last year out of nowhere I received a warrant for execution for a CCJ that I had no knowledge of. It transpired that it related to an old overdraft with HSBC that I knew nothing about. The claim was filed by Lowell who had never contacted me regarding the debt at any time. I arranged to have the Judgment set aside and then proceeded to defend the claim. Judgment has now been found against me and I want to know if anyone can advise me as to what to do next. I have no knowledge of an account with HSBC and never used one. Lowell have not provided any application form showing that I opened it or used it. The only evidence they have provided is some copy bank statements from their own database. The account is in a variation of my name - not the name I used. I in fact had a different bank account at the time - have had it and used it for over 10 years. First question therefore - if they do not have an application form or any other form of official evidence - is that enough basis for a claim? I cannot believe that some print-outs from the claimant's own computer is sufficient evidence of anything but is there a legal authority on this point? Second point, the overdraft was "called in" in 2007 but the claim was issued in 2014. I disputed this as being statute barred. In response Lowell suddenly came up with a spreadsheet from their own computer database with payments supposedly made my me and therefore claimed that it was capable of being the subject of a claim. They have not provided any evidence linking me to these payments - they are just dates, amounts and say they were made by "standing order" (but no details of the bank they were made from). I have spoken to my bank and they confirm no standing order payments or payments of any kind were made on the dates they allege. Do they not have to show where the payments came from? I am now in the position where I need to decide whether to apply to have the Judgment set aside again and dispute it further but having already failed once I am a bit concerned about this. I cannot understand how they can have a valid claim when they have no evidence other than that mentioned above. How did the Judge find in their favour? I can't afford to make the application to the Court unless I have some solid evidence behind me to fight my corner.... . which is why I am posting on here. Can anyone point me in the right direction or give me some pointers on how to fight this? I have reported the account to Action Fraud but I don't feel that Lowell will investigate this properly as it is in their interest not too! If they find evidence of identity theft or fraud - then they don't get their money! I have also reported Lowell to the Financial Ombudsman as I think they are wrong to pursue a statute barred claim. Any help here would really be appreciated as I am at a real loss.

  15. Long story short. Returned from holiday in Florence in early July booked thru Booking .com to find an unauthorized debit (around £170) on our HSBC statement in favour of Best Western Hotel. Transaction date was prior to our departure from the UK, and we stayed at a B&B, not a hotel. CrCards cancelled & replaced to forestall further unauthorized debits. Immediately queried debit with bank, who magnanimously credited the charge, and will send us a form to complete. Never arrived. Two further enquiries at our local branch, and we were told we'd get it eventually. Nope, never did. Complained to both BWH and Booking.com - twice. No response from BWH, and Booking.com were next to useless. All they did was query the charge with our B&B (Locanda di Mosconi), who had absolutely nothing to do with the unauthorized debit. Now received a letter from HSBC saying that their investigations turned up zip, and the debit will now be re-imposed, along with charges, interest, etc. 'Phoned to complain, and advised to ignore letter, as it was sent prior to completion of their enquiries! Also assured that form will be sent this time. Hmm....... Sorry, but I just don't believe them. Sod's law stipulates that our a/c will be debited in around 2 weeks regardless of what we have been told, then a right royal battle to get it back again. Now seriously considering closing the a/c to forestall re-imposition of the fraudulent charge, which I thought was their baby. If we do that, can they still legitimately pursue us for the fraud? Any advice appreciated, & apologies for the length of the short version.
  16. Background - about 4 years ago we wrote a cheque but there were insufficient funds in our account. Rather than bouncing it, HSBC paid it and this put us into overdraft for £350. Long story short, they have been chasing this through various debt collectors and the debt was sold to Hoist, who have issued a claim against us. We filed a defence, which was that we don't have enough info to confirm or deny the debt and that we had sent a Subject Access Request to the creditor. They responded with a notice of assignment and copy of the terms and conditions. We decided against mediation so the matter got allocated to a small claims court. We then received a CJR065C from the court saying: "Unless the Defendant files and serves a detailed defence complying with CPR 16.5 by 28/09/16 the Defence shall stand struck out without further order and the Claimant be entitled to enter judgement forthwith". we are trying to put together a defence and also see if we can negotiate with the claimant at this late stage. The terms and conditions we were sent state, under the heading When payments will and will not be made by us that payments will be made if there are funds in the account or if an overdraft is in place (there was no overdraft agreed at the time). It doesn't say anything about making payments when there are insufficient funds or no overdraft in place! We also haven't received an overdraft termination notice because no overdraft existed (until HSBC created one to make this payment). Something doesn't seem right here - any advice appreciated!

Good afternoon I have today received a response from IDEM after sending them a CCA letter regarding a HSBC credit card They have sent me a reconstituted copy and statement and their letter says that this is all they need to provide and that the debt once again becomes enforceable. There is nothing enclosed that shows my signature. is this now enforceable without the signature and if not what should my next move be Many thanks
  18. HSBC have sent me a claim form. I owe £13,500 from a loan taken out several years ago. I intend to respond using the "disagree with the claim" option as I believe I may have been mis sold PPI on the claim. In the event that the judge upholds the claim, how does the process work RE making repayments. Once the judgement has been made, do we have to go back to court another day to agree a repayment schedule. Will HSBC be obliged to offer a repayment schedule or could they start bankruptcy proceedings if I don't make payment in full after the CCJ?

  20. Hi, Making a fairly desperate request for help as now find myself at a loss as the way (best way) to proceed. I have received a claim form for a CCJ out of Northampton County Court by Bryan Carter Solicitors and am now at a complete loss as how to proceed with a defence. The claimant is Lowell Portofolio Date of Issue was 8 July and I acknowledged on the 22 July with intention to defend in full and this was received on 23 July so I believe have until 9 August to submit my defence (33 days after the date of issue)? The Particulars of the claim are: This claim is for 4790. The Amount due under an agreement between the original creditor and the defendant to provide finance &/ or service &/ or goods. This debt was assigned to / purchased by Lowell Portfolio on 06/01/2012 and noticed served pursuant to the law of property act 1925. Particulars: HSBC Bank PLC Acc no ******/88888888 And the claimant claims 4900 The claim also claim interest pursuant to S69 county court act 1984 from 06/01/2012 to date at 8% per annum amounting to 975 (Including court fee and solicitors costs it comes to total of 6400) I believe the claim is for an overdraft/current account Account was assigned and the debt purchaser has issued the claim. I did not receive the notice of assignment as I moved out of my old flat on 31 May 2012 the day before the debt was assigned, then moved to a friends house for 2 weeks before going on to another flat which was to going to be another short term let but ended up staying there for 6 months but did not register that address as it was always going to be a short term stay as landlord was selling the flat (but took them longer than they thought). I have no idea if I received a default notice. But I have not received statuary notice of default sums at least once a year. I ceased payments as I was unemployed and in a lot of financial trouble and was considering declaring bankruptcy but instead opened a safe bank account in 2008 - (I'm not sure of the exact date so do not know exactly when in 2008 I stopped using my HSBC account). I didn't communcate financial problems to the original creditor and didn't make any attempt to enter in a debt management plan instead opened the safe account whilst I found out what my options were re bankruptcy. I sent a CPR31.14 request after acknowledging the claim to Bryan Carter and received what I believe is there standard issue reply stating that it is a simple contractual matter and that in any event the Notices of default and assignment left the control of the claimant when they were dispatched to you - and asking me to refer to my own records and that they are not agreeable to to an extension in filing the defence. But now I am unsure how to proceed with my own defence - I am not sure exactly what the debt is for as my overdraft I think was 1000-1500 and so am uncertain how this has risen to 4900 and whether this includes any other HSBC debt such as credit card? (I had a HSBC credit card I had stopped using by 2008). I'm not sure whether to use what people seem to refer to as an embarrassed defence? Or I'm not sure whether the debt is statute barred as I'm not sure exactly when in 2008 I stopped using the account and from reading the forums it seems to be complex as to when the date starts for a current account to be considered statute barred. Any advice of options of how to proceed would be gratefully received as obviously the time to submit my claim is rapidly approaching, depression is kicking in and I'm very confused as to what the best step to take next is.   21. Hello, I'm hoping someone can advise me if what to do. I have received a claim form from Northampton County Business Centre, claimant - Hoist, address for docs - Cohen solicitors, issue date - 7 oct, amount - £10k ex hsbc I think this debt should be statute barred, how can I find out if it is, what should I do next? this is the only contact I've received, in fact the claim form was sent to an old address. Should I ask Hoist to prove the debt is actually owed since I have never spoken with or heard from anyone connected with their company before? Should I ask HSBC for old statements to find out exactly when a last payment or contact was made? All help would be greatly appreciated, I am obviously extremely troubled by this turn of events and having no clue what to do a friend advised me to turn to this website.
  22. Hi, I was just wondering how best to deal with Moorcroft who have been hounding me. I signed as guarantor for my HSBC Ltd Co. business loan when I started up in 2003/4. Unfortunately due to a breakdown and ill health caused from stress etc the business had to close in 2007, following that I did try to keep making what payments I could afford towards the loan (the outstanding balance is around 20k) but haven't paid anything for about a year/year and a half, however loan doesn't appear on my credit file. Have been burying my head abit as going through a horrible divorce at the moment and not quite able to deal with this as well, have been ignoring all their threat o grams. just need to hold them off for a bit until the divorce is finalised I kinda know where I stand financially. To commit to a financial arrangement with them at the moment whilst everything is still in limbo is going to be hard, and having been pretty much a stay at home Dad since the business closed, I will have to rely on tax credits, CB and maintenance payments to provide stability for my kids until I can get back onto my feet after the divorce is finalised. Should I treat this loan as I would a personal one and send off a CCA request? Or would it be worth just offering Moorcroft/HSBC what little I can afford to get them to go away? As they are threatening me, that if they return the account to HSBC, then HSBC will start legal proceedings?
  23. Hi all. Is there a time limit on attempting to reclaim packaged account fees? I was charged for a packaged account with HSBC between November 2008 and December 2010. They continued to charge the fee even when the account went into an unauthorised overdraft and closed due to default in December 2010. I believe I took the account having been told it would mean I could have an overdraft - which I never actually got. It also provided breakdown cover but I do not drive. I do not know what the other benefits were - I was suffering from mental illness at the time. The delay on me looking into this is due to my illness - I only obtained statements at the end of April this year. Over £350 of packaged fees, but most of them are over 6 years old. Does a time bar apply?
  24. Hello dear friends after another charges added by HSBC to my account ive decided to look around what i can do to reclaim those charges. Lucky enought had acces to online statements for last 72 months (HSBC) so i done my home work. Total charges added to my bank account over last few years : 2009 - 25 2010 - 850 2011 - 995 2012 - 726 2013 - 495 2014 - 434 2015 - 188 so total 3713 pounds in bank charges. I went thrue few topics regarding bank charges and reclaiming them and i decided to go ahead. I had few times conversation with bank asking them if we can do something to stop those charges without any help from bank. What ive done so far : 1. Prepared letter using Your template requesting bank charges to be paid back to my account under hardship 2. prepared schedule of all bank charges from jan 2010 till now both letters will be send out to HSBC. My first question should i adress those letters to branch, head office or any other department of HSBC? will keep you inform about outcome. Thank You
  25. Can someone help me with my question? I need remortgage and on experian I have almost excellent scoring and HSBC has the best deal for us, so i need to know which credit agency they using. Thank you
