  1. Hi, I was wondering if anyone could help me. I have had a look at the posts but i am quite confused about what to do. I recieved a letter from Capquest stating that is was a demand to start bankrcuptcy proceeding and I have 18 days to appear at court. The amount is for approx. £1600 from Orange. I havent been in touch with these people at all, (I am in quite a lot of debt and to be honest have only just started opening my mail!) The problem is that whilst I am currently employed i have had council tax arrears that i am paying off and i have very little disposable income to pay off any unsecured debts. I have no idea what to do and i really dont want to go bankcrupt can anybody give me some advice on how to proceed?
  2. hi there, i am in a nervous wreck all the time about 4 weeks ago i got a letter through the door saying lloyds tsb are taking me to court for an out standing loan on £4000 that i borrowed arond 5years ago, all through this time i was making payments untill lloyds stopped taking them in my foolish ness i never phoned up i just left it, i fell into some home troubles having a squatter in my house and had to spend all my time and money trying to get her out, but lloyds do not care about that, they have summons me to court were they have stated they can put a charge on my house and make me sell it for the littleist amount of money they can get for it, i have to attend court next week, i have been sent a letter from lloyds saying that they have evalluated my ppi claim and that i am owed 2000 i am going to offer that to the cort and see if they will take instalments also my friend in willing to move in with me to help bring in more income into the house to pay it off, i have to children and it is very scary for me one has jst turned 18 the other is 19, i just dont no what to do, any one with advice or if some one has been through this please please comment and help thank you
  3. Today my parents received a letter at their London address (where i dont live since Feb 2011) regarding council tax which i owed of £1003.81 for a Birmingham address. I had a monthly direct debit set-up for some reason ended up failing and being removed, since then this is the first time i have heard from Equita. The letter is under my wife's and my name she is out of work since Feb 2011 til present and i have just started last week. None of us have the funds to pay the amount. The letter posted THROUGH THE DOOR on the 10th Oct 2011 stated: "Payment due in full in 24 hours.....i have attended today with the intention of removing goods and chattels as are necessary to discharge the outstanding council tax liability order and additional enforcement charges cost.....Please note no further arrangements are acceptable and payment is now required in full......i will attend your address to remove goods even in your absence....should you wish to avoid this contact me immediately....no contact will be taken as your refusal to pay" I rang them (before reading that i shouldnt ) to say my parents received this letter but i dont live there anymore. I told him i have been out of work for 2 years and only started working this week. He replied saying it doesn't matter he needs full payment or a court order would be issued, i said it doesnt matter even if i go to court as i cant pay and will still arrange a monthly plan. Obviously more fees would be occurred so i would rather deal with this matter ASAP. The bailiff told me he'll give me til Thursday (4 days) to try and get the money but said i doubt i can. The only method for me will be to get a monthly plan sorted again but im not sure they will....or is there any way i can? Please do help me
  4. Hi all Have received a county court claim form in the post for a debt (Littlewoods cataloge) which im 100% sure is over 6 years old. I have checked through my bank statements and the last time i made a payment or acknowledged the account was the 1st april 2005. However the lovely people at wescott are claiming on the form 24/10/2006? The claim form is dated the 5th Aug and i received it on the 10th Aug. I haven't replied to the court yet or got in contact with wescott im not too sure what my first steps are and any help would be VERY much appreciated.
  5. Well finally have got court papers off HFO services, and do not know what to do now.. Do I acknowledge some of the debt or defend myself.? Quick background... In 1999 I took on a loan with Capital bank, which when divorce reared up I could no longer pay, as my life and head went into a downward spiral. I really cannot remember much, but eventually the debt was past on to 'Intrum Justitia' and from 2005 I paid monthley payments, never mised one as I started to get myself together. This went on to the 22/1/2008 when I received a letter from said company ( I still have it) to state that account had been returned to clients at their request. I rang HSBOS and they said account was closed.. Which I didnt understand as I still owed £5000. The next thong I heard was in Oct 2008 when I had a letter from Turnbull Rutherford who stated I had a principal owing of £6159 plus interest of £4939 !! and tha they confirmed I was an homeowner and were looking to enforce payment by a charging order. Then the phone started. I did speak to them once, but denied owing THEM any money and not to ring me, but to send paperwork . I then got lots of threatng letters for a while then it all stopped. 2010 it started again, Litigation letters, and one ( which I cannot find...which showed a photo of my home etc etc, after finding this site, I sent them a CCA request which was delivered on 23/08/10 . On the 24th I recieved a letter which states in one line " Forward the file for escalation of colection activity, whether by legal action or otherwise" Stating that they will obtain a enforcing judgement by attachment of earning from my workplace...naming the workplace. I do ont know how they found out where I worked!!! I decided after this sod them, nasty S.O.B's, and that I would rather deal with court than them.!! I finally got a photocopy of my credit agreement on 17/9/10 I have about 48 hours to reply to court hearing. Any help and advise is sorely needed!
  6. Hi, please can someone help. I've just received a County Court Claim form - I've never been to court before! I ignored their threats as I figures they didn't have a valid agreement and would never take any action. I've attached what I think are the most important documents I've received over the years on this account. I CCA's the creditor back in 2009 and was given what looks like an application form (which I've just noticed I only received copies of pages 1 & 3, not sure if the other two were on the back f the originals [on the back side of pages 1 & 3]). Can anyone tell me if this is enforcable ? Should I get a solicitor ? I'm very worried that I have very little time to respond and not sure what the best course of action is.   7. A builder did many jobs for me over a 9 month period. All of which I paid him for and I came to trust him. Each time his quotes were verbal and each time I paid him cash. There were no written records. I even recommended him to my neighbours and he did some work for them. Then in June of 2009 he started work on a wardrobe. We are not talking about anything special. The whole thing is made of materials from any high street DIY store. It incorporates a couple of flat pack chest of drawers. There are no expensive materials used. It didn’t take long to put together. Because of the size of the chest of drawers compared to the doors, the drawers cannot be accessed fully, but this was never a problem, because it was agreed to be done for a reasonable amount of money as all other work had been done for. Anyway, two years later, here I am with a massive bill for an average DIY wardorbe (over £6,500) and two invoices for work I don’t recognise that he did and can and will if necessary produce statements for from the people who did it. Ok, I have been very naive and stupid to have trusted someone that much, but I did and here I am. I have written to him asking for receipts, saying that I can produce statements and saying that I don't think it is a fair or reasonable amount for the work. I have explained why it is not reasonable and made an offer to settle the matter. He even says on the website he publicly advertises on that his charges are reasonable. I have offered £1600 in total and £400 of this I have not yet paid. I have said that is what I am offering in full and final settlement and to pursue the matter through the courts if my offer is not acceptable to him. I keep getting emails from him saying I haven't replied to his correspondence. I have replied he just doesn't like or accept the fact that I am not going to pay him what he is demanding. There is never anything from his side offering any kind of compromise to try and settle the matter. Anyway, I just wish he would go to court. At least then I would be in a process with an end. I just feel like I am being bullied and harassed by him. Is there anything I can do to sort this out that doesn't involve me paying an outrageously over the top charges. Happy to pay a fair and reasonable amount and have throughout this matter... and still am. All help greatly appreciated.
  8. hey y'all, someone may have already asked..... but...... my car was caught driving in a bus lane 3 times, 2 on the same day, within a minute of each other, i was not driving at the time, when i got the notices i sent them back with details of the driver and received nothing in response, i now have court notices to pay triple the amount £270, when i phoned they said they not received anything, that they sent a notice to owner ( i did not get it) and that it was tough, as the owner of the car ...... i still had to pay whether i was driving or not, is this correct? i am a full time carer to a severely disabled child struggling to pay a mortgage and make ends meet on my meagre "carers allowance" and benefits i absolutely cannot afford 270 pence let alone £270! thanks in advance
