  1. Hi all. I am really hoping I can get some help and advice here. I really don't know where to turn and CAB havnt been that much help. I received a fine back in April for nonpayment of TV License. I was utterly stupid to stop paying it but I can't go back in time now. I was paying off £20 a fortnight but ended up not paying one time due to financial problems and thinking I would pay double the next fortnight. The time came and I couldn't. I received a letter from Swift saying if I didn't pay or make an arrangement, they would send people out. I made the arrangements with them to pay £20 a fortnight again but due to my mental health problems, I defaulted, again stupid. Last Friday, I had a letter pushed through my door at 6:40am saying if I don't pay £412 they would be back with a locksmith. I went to the CAB and they said the only thing I could do was to get a health letter from my doctor but they want to charge £25 for it and I simply do not have that kind of money. I can't even afford to buy a cheap pair of trainers to replace the ones I have now that the sole is practically hanging off of. My heads all over the place, I am scared every time the phone rings or there's a knock on my door. I have been diagnosed with Severe Clinical Depression amd Severe Anxiety even though its bordering more on Bipolar. I have 2 young daughter aged 5 and 2 and I am married. Most of the stuff I have here doesn't belong to me I.e on HP as we couldn't afford to buy our cooker and washing machine outright when our old ones eventually broke. My husband is claiming JSA for us as I got refused ESA even though I have mental health issues, a gap in my spine and other back problems. What do I do? I know not to let them in but I can't physically cope with them knocking on the door and any threatening behavior that I know will happen. I know it will make my suicidal thoughts even worse. Sorry for the long post, just wanted to get everything in. Also, if there are any spelling mistakes, blame my silly phone
  2. Good evening, My auntie used to own a timeshare with Sunny Coast Malta and died over 4 years ago. Since then her sister (my auntie) and my dad have been receiving debt collection letters for the annual maintenance fees for the timeshare. They were not aware that the timeshare would become their responsibility in the event of her death and have not signed anything in respect to the ongoing fees or use of the timeshare. Since her death they have been ignoring the charges. Just recently they have now started to receive letters from Network Credit Services threatening further debt collection. Please could anyone advise what steps they should now be taking? Should they just continue to ignore? Any advice would be fantastic as it is getting to a point where my auntie is starting to feel ill with it all. Many thanks in anticipation

Hi how many times can a £235 liability order fee be charged on the same liability order? is it just the once? what additional fees after the LO fee can be charged? i.e. is there a charge for each visit? is there a link anywhere that refers to all charges a LA can make since the recent changes(?) where collection for council tax debt is 'in house' there is a bit of a row in the family about this, we are all a bit ignorant about the facts. I live in a property that has a prepayment meter, when I moved in the letting agent said that they have written to all my utility companies to let them know about my moving and gave me the prepayment cards (one key for electric for EDF and Gas card for Eon) EDF wrote to me about the electricity and all is fine with that but they then wrote to me to say that I owe them £25 for gas, I advised that it was a prepayment meter and they said they would look into it and get it resolved. Fast forward to today and its still on going but now I owe £200 apparently, I called them up and they assured me there was a lock on the account so no action would be taken while they keep looking into it. I spoke to the national gas grid (xoserve I think) who said the meter wasn't registered with any company. Can EDF still hold me to the debt, no supplier has been registered to this property so how can I be charged for gas I pre-pay for? Also can I go ahead and register with any company for gas without any recourse?

Hi all I am new to this me and my wife about 12 years ago got offered credits cards and loans when we were on benefits which doesn't make good lending sense the loan and credit cards were used up as we were young and had just decided to have a family we were very silly with our money at the time and have now learnt a very valuable lesson and do have good control of money matters now apart from these debts. we had the interest stopped many years ago and have had several debt companies take it on and we have kept up the payments which have been anything from £1 per month to £5 per month which has changed throughout the years. at the moment cabot and Aktiv Kapital. aktiv Kapital have the bank account which was overdrawn due to the payment which was setup to be taken for the loan that came out of that bank account and the amount is around £286.00 at the moment there is 3 other accounts which cabot have which are credit card around £2600 credit card around £1000 loan around £8000 these amounts are estimates as cant remember the exact amounts off the top of my head. all the accounts were with lloyds tsb A few weeks ago I sent requesting the CCA for each account with £1 postal order for the credit cards and loans I didn't do anything for the bank account as I wasn't sure this would qualify under the same thing. I had a letter back from cabot for 2 of the accounts saying they have requested the information (I guess from tsb/Lloyds bank) and that they are fairly certain they will gain the information needed but will reply within 40 days but I clearly stated the 12 days in my cca letter. it has now gone passed the 12 days + 2 days and I haven't had any other contact from them. im really looking for guidance as what to do next do I send anymore letters and is there any templates I can use etc. I was hoping to clear all the debts with f&f offers I have about £1500 to do this with if possible as me and my wife would like to be debt free if we can. Also if I do make f+f offers should these be made in writing and is there any template letters I could use and what 10% offer should I start with. any advise would be greatly appreciated we just want to Be debt free once and for all.
  6. hello. today i recieved a letter from tv licensing.ive missed my last 2 payments,amounting to £11.00. they told me to pay immediatley or they will send my account with them to a debt collection agency. written in red at top of the page. i always pay my licence payments usually.just that over last few weeks i didnt have it spare. was wondering about what happens if i stop paying it etc ? i can probably pay this amount i owe by end of next week. but with them threatening me with debt collection i feel like not paying now who do they think they are ? any help would be appreciated

  8. MMF are trying to collect on 2 accounts, both Payday loans. I have sent several requests to MMF asking for proof of my liability to the alleged debt plus a full breakdown. MMF have continued to ignore my requests and have continued to send emails and letters with their usual threats of court and doorstep collection. I sent a recorded letter on Monday 26th November and was received and signed for by MMF on Tuesday 27th November telling MMF that ALL Communication MUST BE IN WRITTING by post, and no telephone, e-mail or text contact will be tolerated, Furthermore I expressly state that I have no wish to make any appointment for any agent, representative or employee of MMF Ltd to visit my home, should such a visit occur the person will be invited to leave failure to do so and will result in their removal using any necessary means. I have requested a full explanation and proof of my liability for this alleged debt along with a full breakdown of the alleged debt and MMF have failed to provide any data in this regard; therefore I do not acknowledge any debt to MMF Ltd., or any company you may claim to represent. I have also sent an email to Baranby Page & home visits with the same information which has been read... Fast forward to this morning whilst in the shower I heard a knock at the door and Ignored it. Through my letter box was 2x letters from MMF, hand delivered. The leter states "I have now been instructed to visit your property to discuss repayment. I am your local MMF Doorstep Agent and although disappointed that I could not meet you today, I am constantly in your area and a revisit can be booked. Why are these people ignoring me?

  10. Hi all, I received a letter out of the blue requesting repayment of a social fund loan I thought had been paid off. The debt must date back to before 2003 and it was being taken from my benefit at the time I was ill. I am currently at University and have no income other than a bursary which pays off my bus fares and gives me a small income to use for food whilst on placement. That said my partner is working and we have joint claim for tax credits which I am worried they will try take money from. My partner is refusing to pay towards the debt and I have very little money to offer even though I don't believe the debt is as large as they say it is. What can I do.
  11. I have received a letter from a company called Transcom who are a debt collecting agency. Stating I owe £24.15 to ebay. I wasn't aware that I owe ebay anything as they have been sending me emails it states as I owed them selling fees. The problem is I never check emails as I have no reason to and not used ebay in the a long time. I have just checked my emails after receiving this letter and it states I owe £16.15. not a lot of money obviously... Well on the letter it states I owe them £24.15 which is more than I originally owe. I have checked google and it states sometimes [problem] letters are sent out to house holds asking for money, but I am unsure what to make of this at the min. I have checked my ebay balance and it states I can still pay the balance of £16.15 and my accounts (on the selling side of things) has been put on hold until I payup. Lets say I just pay via ebay the normal price of £16.15 and lets the letter is real would they still chase after me for the difference with it stating more on the letter. Can anyone help please. cheers.
  12. Received a letter from debt collection for £150. I apparently ignored previous requests for payments to a company called Excel Parking Services. I cannot recall any dealings with Excel in the past year or so. I did receive a ticket from Excel in 2009 for approx £120 and on advice from members of this forum I ignored it as it was a free car park and I was on the line or perhaps half a wheel was just over I cannot really remember. Reading around I find that a lot of people advise saying to ignore. However, there is a sticky that says we should not ignore. What should I do? Can they chase something 5 years later? If it does not relate to that can they skip straight to Debt Collection without first contacting me? If i contact them can it negatively impact me?
  13. Hi there, Last year in July 2013 I had a procedure done at the Winfield private hospital. I have medical insurance with Bupa, but it has a £100 excess on it for treatment each year. This means that the first £100 of any treatment must be paid to the company carrying out the procedure, in this case the Winfield hospital. I thought that I had paid this £100, so was surprised to receive a letter from Icon Collections saying that I hadn't and that I now owed Icon collections £118, this was sent in January 2014. It stated in the letter that the money was to be paid directly to them and not to the hospital. Does this mean that they have assumed the debt now? Anyhow I ignored this letter and a couple more that I received from them. They also called me on several occasions and left voicemails for me which I also ignored. Eventually an advisor from Icon collections did get through to me and I explained that I thought that I had paid the amount and could she email me a copy of the invoice to look at. I gave her an email address that I rarely check. They did send a copy on 14th May 2014. The invoice was for £100, but in the email they said that a charge of £18 had been applied for late payment. They did send a follow up email on 2nd June 2014, but this said please contact them to arrange payment. Both of these emails I didn't actually see until today, as I rarely check the account and didn't want to give them my regular email address. I have now received another letter from icon collections dated 13th June stating a notice of Legal action. On it they say the amount due is £118. Part of the letter says the following. LEGAL PROCEEDINGS ARE NOW BEING DRAWN UP AGAINST YOU we are preparing legal proceedings against you and therefore you have rendered yourself liable for the following costs along with statutory Interest, which will accrue daily. COURT FEE £15 SOLICITORS COSTS £50 It then goes on to say a court summons will be served upon me shortly which will result in bailiffs attending my property. I then called them today 16th July, to see if they had actually sent me a copy of the invoices (which they had done) and to check if I actually had paid the original £100. It turns out I hadn't paid it, so offered to pay half of the amount now (£60 if you include the late charge fee) and the other half by 1st August to take the total up to £118. She then said the amount was now £189 because it had moved to legal proceedings. I asked what the costs were for and she said it was because it had moved to legal proceedings and that they have records of the multiple times they have called me and the number of letters that they have sent to me. My question is (apart from is the debt now with Icon?). Are these fees legally enforceable? I know that I haven't answered their letters or calls and the debt is now 1 year old with Winfield hospital (7 months that Icon collections have been chasing). But £78 on an original £100 bill seems excessive to me. Can I just pay the original £100? Do do I need to pay the late fee of £18, and do I need to pay these Court fee and solicitors costs of £65? To be fair I don't have a problem paying the additional £18 late fee, as I was in the wrong and I didn't settle the debt and did ignore their calls and emails, but I don't want to pay the additional £65 if I don't have to. Would they take me to court if I just paid £118, or even the £100? I have paid £60 to them today. But the lady wants me to email her to set out what we agreed on the phone, (which was to pay the full amount of £189 by the end of August), however at the end of the call I said I would email her, but I wanted to check the legality of the costs before emailing her to confirm the payment schedule. Any help and advice would be greatly appreciated on what I am legally obliged to pay. Also I'm sorry that this email is so long, the advice on the forum is that you should be as clear and detailed as possible, so that's what I've tried to do.
  14. Recentley ive gotten back into writing a few short stories for fun. Mainly because a few friends of mine saw some very rough drafts and thought i should take it back up. However, i havent found a decent site where i can upload them, people can download, read, and comment/give feedback. Right now, theyre hosted on Google Drive and Dropbox, but im really after somewhere that allows feedback, but maintains the functionality of the above sites. Anyone have any idea if such a site exists? I could write my own site and scripts, but i simply dont have time to do that right now.
  15. Hi all, I owe Lloyds bank an unplanned overdraft of around £2,000. Paid back about half of it over the space of a year in 2012 with a debt collection company acting on behalf of Lloyds but then ran into some job/financial difficulties and had to postpone my repayments. Now a new debt collection company is contacting me asking for repayments, and I have heard nothing in months from the old company. How can I ensure that the new company is now in charge of the Lloyd's debt? They have sent me a letter stating they are acting on behalf of Lloyds but is there any more proof I can ask for? Thanks a lot for your help!
  16. Dear Caggers.... I'm in one of those situations; probably too familiar to a lot of people - but with a "twist". I separated from my wife and moved out of the Marital home a couple of years ago; I've been in regular touch as there are children involved... I am still paying the mortgage plus allowances etc - £2,600/month Incidentally - in the last 2 years I have had a tripe heart bypass and been signed off work with depression/stress. A cople of days ago I recieved a demand for £6,600 for non payment of a credit card bill from a company called Capital Resolve.... The first I had heard of the bill well before I left home. There is no information other than the amount There are instruction as to where to send payments or agree a payment schedule - or to have a visit from one of their representatives by the 15th May - the letter was posted on the 8th. They have now follwoed up the letter with an open card informing me that I wil be visited by one of their representatives in the next week unless I call to make a specific call "Immediately". I have no intention of shirking the responsibility for the debt but I have a couple of questions...... The letters are attatched. 1. What would the significance of the 15th of May be - it seems to be purely arbritary? 2. Are they being intimidating by following it up by this orrible card? I am pretty brassic due to the payments to the estaranged wife etc and don't have acess to anywher that amount of funds - am I allowed to change their date of the 15th to give myself more breathing space ?   17. I own a small business and had ran up a business debt amounting to just over £5,000. Unfortunately the creditor would not be patient with me and so obtained a CCJ. I had made promises to pay futuristically, but yesterday I received a visit from two gentlemen from NCS who are from the North East. They were polite throughout, but it was clear that they were not leaving until they had received a payment and they even clamped my car. I settle half of the debt as a result of that move, paying them the last I had in my business account. I just wondered if it was legal for them to do this?

Hi guys (1st post here) I've read through quite a few posts and I think the advice you guys give is nothing short of amazing, I have a Wonga loan which I have now cancelled all cards and CPA with and I'm setting up a standing order with the details they have given me... My account on Wonga shows... Total amount owed - £1124.79 Capital repayment - £880 Interest repayment - £233.79 Transmission fee - £11 Their reply to me cancelling my CPA and debit cards was to say that 'interest will continue to accrue on the outstanding balance' is that something I just have to accept as I have asked for interest to be frozen whilst I make payments as and when I can afford to, So I guess my question is exactly how much should I be looking to pay back? Thanks in advance guys.
  19. Okay - I'll try and keep this simple to avoid boring people. In 2011 I returned home from a tour of Afghanistan. I was greeted with some letters from O2. I called up the customer service team explaining I didn't have a clue what was going on. I was promised that this would be looked into, and they would get back to me. They never did. I assumed it was over and done with. From that date letters from a load of debt collection agencies came to my mothers address (I lived on an Army camp). I assumed this was spam and never followed it up. Then in 2013 I got a letter from issuing a county court summons. I went online and spoke to O2. They said they were still looking into it. Promised me it was nothing to worry about... And said they would get back to me. Again this never happened, but this time I kept screen shots of the online conversation. When I passed this information on to the debt collection agency they discontinued the claim. Again I thought it was over. Recently me and my partner have applied for a mortgage. All 25% saved. Got rejected... Checked my credit file and found there were 3 defaults from debt collection agencies (namely Lowell, and Cabot financial). I call them and they say that it was with regards to O2 debts. I explain the situation they I never had an O2 phone. I have been with Vodafone for years... Then I called up O2. I spoke to someone from the "fraud department". Possibly the rudest lady I have ever spoken to. Luckily I used my iPhone to record this. She stated it looked like someone I know had opened the accounts. .. Said this was not the type of fraud they were interested in. I offered her a crime reference number, she said she was not interested. I asked what I could do, and was told I should just pay they money even if it was not mine. I have now emailed the CEO of O2. I've also emailed there complaints department. The debt companies say they can't remove the defaults unless O2 agree. From a quick google, is seems like county court action is the only option. I can't not buy a house for another 3 years (before it will drop off). I can't get a mortgage with this information. Any advice?
  20. The reason I ask is that firstly I did not expect to have to deal with a Collection firm arriving at my business premises on a Bank Holiday Weekend. Secondly, they had arrived to remove my haulage truck which I rely on for business and thirdly, when I called the police they had no effect and the two men from NCS dictated the entirety of the proceedings that followed and the police were helpless. I concede that I owed money to the finance company on the truck and as a result they instructed NCS, but I had no idea that a Collection firm could simply remove my property and even less idea that they could dictate proceedings so swiftly and with such power over the local police under a repossession order. Is there no patience anymore?
  21. Hi all, I am new to the forum, probably like many people this is because I have an issue that I am struggling to get resolved with the company concerned. We moved house recently and the incumbent energy provider was Scottish Power, we gave them our readings, then moved to British Gas. As this forum is not for specific topics I'll leave it there but all we want is a bill to pay! The company in question seem more interested in sending debt collection agents after us for a wildly inaccurate amount, than providing us with an accurate bill (in fact, any bill at all would be a start... still not had a single bill from them) that we will be more than happy to pay in full. Any pointers on where best to post this would be much appreciated. Yours hopefully, BBRDave
  22. Hello - My son opened an account with a gym in Bournemouth but has since relocated to China - I believe a years membership was owed which was £72. As no one ever received any letters from the gym (as he had moved) they passed it to a Collection agency (CRS) who have traced his home address (Im his Father) so we have now received 2 letters demanding £172 I am ok paying the £72 but CRS have added £102 fees - do you think this is excessive and / or enforecable?. Of course it was my sons fault for not sorting it out when he relocated - but as he didnt no one knew of the original debt - so it seems a bit much to also pay the £102 fees. Any advice would be appreciated.
  23. A flat that I rent out had Artex on the walls, this contains a very minor amount of Asbestos so needs to be disposed off properly. Spoke with the Local council over the phone and they advised that if I take it down myself and triple bag it, dampen it and label it they will pick it up for free. So did the job myself and called it in they took the order and said someone would contact me. 3 weeks go past and nothing. Call it in again, was told its free and it should be collected within a week. Get a phone call from a very rude person from the council who says its not free and they will not pick it up. The person simply denied that I could have been misinformed on 3 of my phone calls. I asked that if all calls are recorded and he confirmed they are so asked him to listen to them and get back to me. Now they will not return my calls or have they contacted me. What are my options? Can I ask for recordings of the phone calls? Are they liable to collect? I am quite angry as they made me waste 3 days of my time taking it down where as I could have just got a company to take it down and take it away.
  24. On the 19th March this year I had a letter from Rossendales Debt Collection about unpaid fees to HM Revenue & Customs. I was aware of the unpaid fees since I tried earlier to settle the debt with Revenue & Customs themselves without any luck. So they sent it to Rossendales. I was dealing with another debt collector a few years ago regarding a debt to my bank and that went very smooth. They accepted my proposal of payment (monthly installments) and the debt was paid off. So I thought it would be just as easy this time. But I was wrong. I sent them proof of income, my expenditure and a proposal to pay £10 per month. The reply from them came today in the form of a threat of legal proceedings if I don't pay in full now. There was no reply regarding the letter I sent them and they treated my offer like it didn't exist. What do I do? If they ignore my offers should I continue making them or should I contact HM Revenue & Customs about the debt again? I don't understand why HM Revenue & Customs won't accept instalments. They, if anyone, know exactly what my earnings are and must be aware that I can't pay these fees all at once. Thank you in beforehand for any help and advice. C.
