  1. Hello, I apologize for the dumb question but I need a clarification about a cheque that I will receive. A few months ago I asked the HMRC for a tax refund (PAYE) for the last fiscal year. They usually pay into a cheque but I asked for the money to be paid into my account. In the meantime I made the decision of moving abroad, so I called the HMRC and left a "care of" address at a friend's of mine. Now he has received a letter from the HMRC confirming that they owe me money and the amount will sent by cheque. Good news, apart from the fact I am already abroad and not planning to come back any soon. Would my friend be able to visit a local branch of my bank and deposit the cheque onto my account or can it only be done by me in person? Thanks

Can anyone tell me have they got the bank details for the Cheque Centre?I want to start paying back a payday loan I currently have with them.I am trying to get a repayment plan in place but I am getting numerous calls daily from them after defaulting. What is the best way to deal with them?they have me worried sick and I am feeling very low because of this daily harassment.
  3. After 2 years with a Barclaycard PPI claim through the FOS I finally received a cheque for £1,925.00. I banked it immediately. On receipt of my October Barclaycard statement the amount outstanding was £1,399.00 - this led me to believe that they had deducted extra PPI reimbursement from my outstanding balance. I assumed they had refunded far more. On the back of this, thinking I was much better off than I actually was, I had a mild spending spree and probably spent about an extra £250. Just received my November statement and I am horrified to see that they have applied £1,925.00 to my outstanding balance with no explanation as to what this figure means at all. In the "description" against this figure is just "199199". They have led me to believe that they had not only refunded me an amount in the form of a cheque but that they had also reduced my outstanding balance. Is there anything I can do? I am a Pensioner and have a very meagre income. Many thanks for any advice.
  4. Hello all, I am new too all of this so please accept my apologies.. My wife has a £ 900 payday loan with The Cheque Centre, it is costing over £ 200 per month in interest alone and we can ill afford this, month after month we are milked and simply rolling it over... What are the consequences of not paying it ?? What are they allowed to charge for Non payment ?? I want to get her to cancel the Debit Card, and then arrange to pay them off, she is unwilling to do this as they will call her mum and whomever else they have as a contact on her initial application.. If she was too agree a £ 100 per month repayment of the original loan where does she stand with additional charges ????????????? regards Mark
  5. Hello, really hope someone could help me in this matter. Car insurance issued me with a cheque for cancelling policy, but I never got the cheque. After many calls to get my cheque, I was being told it will be reissued. Still nothing. Then 6 months later they tell me it was cashed long time ago. They claim I cashed it, which I didn't. They refuse to help any further and will not be issuing further cheque. They gave details of bank account where it was cashed (Lloyds account). The account is not mine. Upon calling Lloyds, they don't have such account (the account number appears one digit too long). Again, my insurer, don't even want to give proper bank account. They suggest there is nothing more they can do for me and that I should contact Ombudsman. How do I go about it? Any help greatly appreciated P.S. I only have 2 suggestion where my cheque is. It either got stolen in post or some at the insurer. . It definitely never arrived at my address.
  6. I'm a vicar of a small rural church which has an account with Santander (previously A+L, Previously Girobank) for our 'Restorationn Fund". In April I received a letter that said that unless we used the account it would be classed as DORMANT. (Its got about 5K in it) I telephoned them and told them not to make it dormant as we need to use it from time to time when we have work to do on the church. The person on the phone said she would email the team dealing with it to tell them this. (This was noted on the file). I heard nothing more so assumed that this was done. At the beginning of this month I issued two cheques for around £600 and £700 which we returned with the big stamp "PAYMENT STOPPED". The inference from this, was that I stopped it. When I telephoned again, they told me that the account was dormant and that I had to apply for it to be made LIVE (which I've done) I believe that bouncing someones cheque, especially when there are funds available could lead to an action for damages to our reputation, stress etc etc. It's particularly bad in that I STILL have had no letter saying that they had bounced the cheque nor did I get a telephone call to ask why a dormant account had become live - which I consider negligent. Obviously our reputation is important because churches are other charities are expected to have the highest levels of probity, How can I start an action for damages? Are there any standard bits of forms, paperwork etc that someone can point me towards? Thanks for your help

My partner received a £70 invoice on 16th Jan 2013 with regard to an alleged parking contravention on private land. The event allegedly happened in Asda, and we had never been issued with a PCN and parking is free with a maximum stay of 3 hours. Will file drop all correspondence in order.....ENJOY..... 21 January 2013 Town and City Parking 5 South Inch Business Centre Shore Road Perth PH28BW To Whom It May Concern: parking charge Notice Number: ******** I refer to the invoice for £70 that you sent to me on 16th January 2013 with regard to an alleged parking contravention on Private Land. I note that you do not state what the alleged contravention is. I have complained to Rob Tippett, Store Manager of Asda Canterbury who stated,"He is more than willing to intervene if I hit a brick wall with you." I believe this matter falls under English Contractual Law because the matter does not relate to Public Highway or Council. My first point to you is this ... I have never received a parking charge notice at Asda in Canterbury although, I do shop there at least three times per week, but on the day in question, I was elsewhere. Therefore, your charge is rejected and the debt is disputed. I now require you to provide me with all of the following evidence. • Photographic Evidence clearly showing the charge attached to my vehicle at the time of the event in question. • A Copy of the charge notice. • Photographic Evidence of myself either in or standing next to my vehicle at the time of the event in question. • A Copy of the contract allegedly entered into. • A Copy of your Lease Agreement with Asda. Even if by some remote chance, you manage to persuade any Court that I am liable; my third point to you is the charge ... The Charge is a Penalty by virtue of the value of the charge. Indeed that particular car park at Asda is free of charge for customers with a maximum stay of three hours. In view of the fact that the Landowner suffered no loss of revenue, to suddenly ask me to pay £70 is a penalty charge and thus not recoverable in law. I would also point out to you that the signage at that particular site is inadequate and therefore contrary to the Unfair Contract Terms Act 1997. Now then ... Should you wish to escalate proceedings against me, I must inform you that I will consider this harassment to which I will seek remedy under Part V (40)Administration of Justice Act 1970. I will also be obliged to report your behaviour to the Office of Fair Trading. I trust that this concludes our business and it is the end of the matter, for which I would like confirmation by reply.   8. summer holidays about to start, expecting children over for the first week of the holidays. vodafone decided yet again to overcharge me this month and bar my phone, nothing new there, however went to shops to get credit for my pay-as-u-go and first time ever my bank card doesn't work, 4 times, so needing money and phone credit to contact the x i go to my bank who i've been with for 15 years plus, and they all know me there, however on inserting my card in the atm for a mini statement the atm grabs my card, i go to the counter and join the proverbial long cue, this is when i find out all my accounts have been barred because according to the bank i've received a fraudulent cheque, on verifying the details i go home to retrieve the receipt for the cheque paid in which transpires to be one paid to me by a friend who did an end of term school disco and had hired disco equipment from me to do so. not the first time for this school either, on producing a receipt and details to the counter staff, they call the head office who inform them that i have to produce an invoice for the transaction, i explained that the transaction was done third party and the school wont know me also as this was the first day of the holidays my friend had left for his holidays and the school was now closed for six weeks, and i needed to get cash that day but they insisted my accounts were barred and all dd and so would also not be paid from any account, i insisted on talking to head office to escalate a complaint and get an explanation, and on many calls from the branch being cut when put on hold i finally spoke to a lady who informed me that she didn't believe the cheque was fraudulent but they will continue account barring till i produce an invoice Fraudulent,cheque,really, even though i reiterated the details of being a long term client, highlighting why id be stupid enough to pay a fraudulent cheque in my account, and also the cheque had the primary school details printed on it as it was paid from their bursary, and the need for cash at the holiday start, this sis when they said i could still make withdrawal over the counter but couldn't use my debit cads???? i asked for the details to be confirmed by letter to me and left it at that. off i go knowing i've no card facility for six weeks, and £70 down in my account, as i wouldn't be able to contact the school till then or contact my friend for two weeks to see if he could get any contact with them prior. six weeks went by as myself or my friend were unable to do anything till the school opened again, and by per chance i went to the bank again prior to the school term recommending to make a withdrawal but the counter assistant said i was unable to due to my account being blocked, on reiterating the details over the counter albeit humiliating, she looked at my account details and said that all bars had been lifted as the cheque was fraudulent, i was dumbstruck being that my friend would now have gone to the school to chase up details and subsequently look like an idiot or accusing, and i would have to explain to him now that it was a bank fault ?? i escalated complaints with the manager and after going over details i received an apology from her, despite the fact it was nothing to do with her or the counter staff, and then came that question and the reason i've written all this on this forum......what would you like??? oh dear, initially i though of all the humiliation and hassle, agro with two children having to waste time in bank ques to get withdrawals and only at my local branch because my accounts just showed up as barred anywhere else, the worry having to carry around cash enough to facilitate the childrens needs whilst out, mostly the loss of £70 for a six week period, then i remembered that id not received any letter of confirmation about the details id requested that i would have needed had i been able to contact the school, which also highlighted the fact to me that id not even been informed that the bars had been lifted on my account/s and had found that out by chance. the question of how much compensation, i am not a complaining type of person and don't get time to do what i've had to here, i have complaints with now almost all of my domestic suppliers due to incompetence on billing and am currently waiting to get time to chase up another two banks and two network providers that have promised compensation due to failure in services but have subsequently disappeared. what does one ask and what will compensate such an experience, who knows, as this may have ended or been resolved in the banks minds but for me the escalation of complaints and e-mails shall go on and on as that is the only port of call for complaints available nowadays. i am awaiting a call from the bank manager with proposals but whether it is satisfactory or whether i take it further to watchdog and /or the fso will yet to be seen. i better get used to this sounding off i suppose as i still have all the other complaints to tackle yet....... .....just let them go, not on your nelly having been a loyal paying customer for years with most of them i should expect and receive at least a generic customer service level yet i'm abused, ripped off and played about along with the rest of the decent general public and it should stop. i guess the figure i may ask for is the figure that such a hopeless company as vodaphone just sold themselves for, 82 billion pounds, and good luck to the new owners, energy suppliers i think ill leave till another time, but the elderly i feel sorry for, i'm 50 and i find all this stuff quite overwhelming, especially when they don't put there hands up, tho subsequently its now no better when they do.... .hmmmmm.... .End Of Constructive Unpunctuated Rant any replies or ideas welcomed.
  9. Hi all - relatively inexperienced poster here, so I apolgise in advance if I have lumped this thread in the wrong section, anyhow feedback is welcomed on the following situation........ In May of this year I raised a cheque for just over £1000.00 as payment for services carried out to my home following a recent move. I sent the cheque in the post via a third party whom they were an associate of, to be forwarded on to the relevant payee as I did not have their current address details, but the third party did (an established local business who have carried out excellent work for me in the past). Anyway, I sent the cheque on its way (via regular mail) and thought nothing else of it. I had already budgeted for the debiting of the monies when reconciling my personal accounts (I have a list of unpresented cheques) and so did not pay much attention to the fact that the cheque remained uncashed for a number of weeks. To bring the story forward, I received a phone call from my bank (Lloyds) last week asking me to verify the details of a cheque drawn on my account. The cheque in question was that described above, and it soon become apparent from the details I was being given that the cheque had been altered. I informed them that the payee was indeed different to the original and correct one and was duly informed that they would reject the cheque and log it as stolen. Needless to say this was quite a surprise, I had up until that point forgotten about the cheque entirely and so was caught a little off guard to say the least. The lady from Lloyds briefly explained that the cheque would be returned unpaid, and that I would incur no charge for this given the nature of the situation. She also mentioned that collecting bank's fraud team would open an investigation into the transaction and that a copy of the cheque would be sent out to me, but my brain was that frazzled at the time I didn't push things much further. So the gist of my posting is that I am seeking advice from anybody who has experienced a similar scenario to mine, and what the due process is? Given that the bank have told me that an investigation has been opened by them, I assume that I am not required to inform the police etc?? Do I need to do anymore or should I just await the banks response?? Many thanks Matt

I have been paid for goods and services by cheque which has subsequently bounced .This was a regular client who had in the past paid in cash.They have left the area and paid their last bill with this cheque(should have smelled a rat !) which I suspect now may be from a closed account. What should be my next move ,the amount is over £500.? thanks for any and all advice

Hi, Currently I am in the situation of having a loan of £1000 with the Cheque Centre, as I cannot afford to pay this off they debit my account for £1275 per month interest and I go back to them each time for a loan of a £1000. This has been going on for a while now. The situation has me depressed and there is no way out of this situation I can see. I plan to bite the bullet this month before they take the money of me and cancel my card and email them to see if they will agree to a repayment proposal. I am not too confident however as I have read horror stores concerning this company issuing arrest of earnings, ccj's and not to mention multiple calls to work which I am terrified about. Can anyone assist please? any advice would be appreciated. Thank you
  12. My child was sent a cheque for Christmas for £100. Sent it to the Building Society where she has her Child Trust Fund (her only account). I received a letter to say it was received and would be credited to her account. This week I have received a letter stating that the cheque has been returned by our bankers as 'Refer to Drawer'. This amount has now been debited to your account and returning the cheque for your reference. Then to add insult to injury...... The letter continues that there will also be a charge for this returned cheque of £30, please forward this remittance to the society in due course. Can anyone please advise what I should do about this? I do not see why my six year old should lose funds from her account because of someone else's actions. Can they do this? Thanks

I have already submitted a ppi claim to Natwest which I believe is with the calculations dept! 2 questions really. 1) They have just requested authority from my husband as the main policy holder which has really bugged me as this is the first time since the claim was submitted so surely they should have requested this before. Delay tactics? 2) We are on a DMP with cccs atm and the company I am claiming against are 1 of our creditors. The claims are for 4 closed loan accounts. The remaining loan account has already been ccj'd and has a court order to pay a set amount each month. My quextion is, can they or are they likely to offset any claim award against this account with a court ordered payment in place already. I could really do with the payment to fix a few house problems and fix my car which I need for work. any remaining would go to our credittors but I think it should go pro rata not just to natwest. Have any of you guys had the cheque straight to you? I don't intend to waste the money but think it should be my decision who get what! I am also considering a self managed dmp as I don't think cccs have helped that much and were useless when natwest took us to court.
  15. Hi all, have just recently had 4 loan ppi reclaims upheld and sent off acceptances. Its only been 2 weeks for me and the blurb they (Rbs) sent says 28 working days but I am just curious if you guys have had to wait the full time, longer or shorter amounts of time. I am kind of expecting an offset but keeping my fingers crossed anyway. I believe they would still be sending me the interest anyway if they do offset, read that on here somewhere. So, what were your timescales and did you have to jolly them along at all?
  16. I have a medical condition, memory problem and as such I ended banking my cashback cheque after more than 6 months. The cheque has now been returned to me as out-of-date. Do I have any rights to have the cheque issued again? Thanks for any help

Hi, I gave a cheque to my landlord from my Yorkshire Bank account, I had expected funds in on the Wednesday to my account but the funds turned out to be paid into a different account, I had asked for them to be paid into my Yorkshire. My landlord contacted me informing me that the cheque had been bounced, I then checked my Yorkshire account to find no money then checked the old account and the funds were in there. I then arranged to make a Faster Payment to my landlord to settle the amount and thought no more of it. I have been into the branch to see if they will waive the £35 charge, scandalous... anyway, she said she would wave ONE of the charges. It appeared that they had REPRESENTED the cheque, my landlord certainly hasn't!!! What I am asking is, can I fight them on the second charge anyway as I hadn't been informed they intend to represent the cheque. I have looked at the terms and conditions of my account and I see no mention of them representing cheques, I assumed that if it was declined then the the Payee would need to take up the matter with me or re deposit the cheque!!! I'm fuming, ripped my cheque book up and threw over the branch! Any ideas??? Thanks in advance Stopthethieves

In September a cheque payable to me drawn on Santander, was paid into Barclays, some days later the cheque Barclays wrote the cheque was dishonoured by non-payment, Barclays have not however forwarded the document and now in December have given the lam explanation that it had been sent to Santander. Of course that is course correct, it was sent via clearing, but when (for whatever reason payment was not made) it should have been returned to the clearing bank and so to me, the customer. Under normal conditions on suing on a Bill of Exchange, one would exhibit the document to the application for Summary Judgment, its therefore critical to have. How can I get a conditions of the procedure banks use when the paying bank dishonours payment of a cheque, what should happen to the original, and if the Bank has lost it, can I sue for damages, in addition to losing the cheque they have not dealt with the query within the 8 weeks mentioned in BCOBS, and in fact have given a evasive explanation.   19. Ok this ones a bit weird Bank sent Me a letter for an old account a couple of months ago saying I owed them money on it and were now sending it to a DCA to collect it for them. Today came home found a letter from bank with a cheque for over 3 times what they claimed I had originally owed them. the letter seams to be from the same dept of the RBS credit management services even has the same name at the bottom Sue B Letter says My name account number(same as the one they claim I owe money on) sort code Balance £*.***.** Fowlling balance reductions there remains a credit balance of £*.***.** which has been returned to you via the attached cheque. This just doesn't seem right my luck is never that good is this legit or has somebody got a hold of my old account and trying to pull a fast one on me. I did pay my old mortgage from this could it be some sort of PPI payment I had forgot all about.
  20. On Tuesday I wrote a cheque for just under £500 to a painter decorator. At the time I wrote it, I did not have funds to pay it in my account but it is a joint account and my husband had agreed to pay some money in. Long story short, he didn't pay it in. On Friday I noticed the cheque debiting the account and taking it £200 overdrawn. We have no overdraft facility and I would expect such a cheque to therefore be returned unpaid. I went into my branch to see if they could tell me if it would be returned. They said they couldn't but they could stop the cheque. I asked them to do this for me (so that I could avoid charges and explain to the decorator and pay in two instalments) and they said they had stopped the cheque and it would re-credit my account later that day. By 8pm it had not re-credited so I phoned the bank. They said the cheque was being paid. I queried why when there were no funds and we do not have a good credit rating. I said I had been told the cheque had been stopped. They put me through to a customer care department where they said they would recredit the cheque and 'ask the payee to pay the money back'. At the time I was so relieved to not be £200 overdrawn (with no money then accessible to me at all, from any account) that I just said thank you. They even offered me £25 as a sorry for telling me they had stopped it when they hadn't. My bank statement still shows the cheque having gone out but a credit for the value of the cheque from 'customer care'. Now in the cold light of day I am wondering what they actually meant. Presumably the money would normally credit the payee's a/c on Monday. Will it not arrive? Or will it arrive then disappear the next day? Will they actually phone up the payee and say pay it back and if so, why on earth would they? I want to pay this bill as soon as I can but if my husband does not help I cannot pay it in full till 21st of this month. If the cheque recredits I fully expect the bank to take back their credit and I will then pay what I can to the decorator and pay the balance on 21st. But what happens if my bank can't get the funds back? Is that their loss or will they redebit and put me overdrawn again? Very confused - and also very confused as to why on earth they would let me go £200 overdrawn when they won't give me a planned overdraft of £50!!!!
  21. I received PPi refund from Halifax for £180. On the cheque it wrote: Pay: Insolvency Exchange Ref: My name. When I took the cheque to the cheque exchange I was told I can’t cash it and that it will have to go to Insolvency exchange. The bank says they will take it if I have account but I don’t-----------HELP

  23. Apologies if in the wrong section, but i really could not see where else to post this. Long story short....last year i was hit by a car (i was a pedestrian) it went through their insurance company on a no win no fee basis. The third party insurers wanted to settle full and final payment for £5265 to which i agreed. The firm dealing with the claim said a cheque would be sent out. Ten days later i had not heard anything so rang them back. The solicitor who was dealing with it had left, but the notes had said the cheque was sent out on the 14th (last month) and to give it a few more days and if it had not arrived then to contact them again and it would be sent again signed for.....i asked how it had been sent and was told second class...........second class for a cheque with that amount i asked....yes it was standard for firms to do this i was told. When i finally got hold of someone again at the office and said this cheque needs to be stopped and another issued, the solicitor i spoke to (as the person who would now be dealing with my claim was away on leave) said it can take two weeks to cancel and order another cheque........surely this cant be right.....second class post and then in total another 5 weeks after the first cheque was allegedly originally sent. Has anyone any advice on this as i feel i am well and truly being given the run around.
  24. I have an on going issue that is driving me mad. I got a some PPI back on a BOS loan and credit card (2 separate claims) got two cheques cashed them both in and one got returned saying there was no account! I had many phone calls and letters sent (with evidence that this happened) over a period of 4 months with them refusing to accept it was not cashed and finally they sent another cheque......4 days later this cheque returned saying the payment was stopped!!!! I phoned them losing my temper a bit and it was all apologies and that they will investigate...one week later chasing it up they are back to saying the original was cashed 5 months ago. I'm at the end of my tether what shall I do next letters don't get answered no matter who i send them too. Shall I take them to court...how do I do that if that is necessary?...HELP

Help, I paid a cheque into my bank account on the 31st August and paid £15 for special clearance, (it was for a car i bought which had to be returned since it did not match the description Sale of goods act etc..) I was informed by staff at branch that i would hear whether the payment would be ok in 1 working day. Since i paid the cheque on friday had to wait until monday, Didnt hear anything from bank untill wednesday when i was told that the cheque had been sent to the wrong place and had not be processed. Since then they cannot find the cheque and have as a gesture of goodwill (according to them) given my back my £15, but have said hard luck get another cheque its not our problem and that now a stage 2 manager is stating that they did do things correctly and that it was sent to the right place, however the person from a processing centre that called me on wednesday said they had sent it to the right place. I had to get trading standards involved for getting my cheque in the 1st place how can the bank just say sorry and sort it out yourself. I have made myself very ill over this and have had to borrow money from my son to pay for things. The bank have said when i get another cheque, they will process it, other than that hard luck What do i do? Kind Rgds
