  1. hi Drove into carpark didnt leave car just sat in car and admired the view for 10/15 mins. i didnt buy a ticket as i thought I didnt need one as I wasnt leaving the car, only sitting in it. Received a parking charge through the post, Ignored as friend said too.... Have just received 2nd one, which i ripped up. I am becoming scared and regretting ignoring the letters. Please, any advice?
  2. Hello All, Apologies if this has already been covered, I have tried to read others responses but not sure sure if they apply to my specific case. I wonder if anyone can please help? In August 2017 on my first day at my new hospital where I started work (before hospital induction) I accidentally parked in a patient car park rather than a staff carpark. I received a parking charge of 35.00. The week after i emailed the email address from the ticket (unsure who exactly) defending my case. I never had a response. Subsequently over the last 9 months i have received various letters about this (which have been going to my old address) and the latest is from Civil Enforcement Ltd. stating the outstanding debt is 206.00 and i have 30 days from the date of this letter until they will issue proceedings with the county court. I would like this issue resolved as soon as possible obviously without me having to pay, as I do not think it is a fair penalty. I would very much appreciate if anyone could assist me/advise me in moving forward in terms of responses? Thanks very much, Jay
  3. Where I live now there is a service charge of £4 a week for heating and hot water from the communal boilers, from next week, when they upgrade my heating system I will be having to pay for the heating as we will be provided with individual electric boilers for just the heating! Nothing has been said about reducing the service charge because of this change, I am in the right to ask for a reduction as I will be paying twice for heating?
  4. Hi everyone, Recently I was parking close by Westfield Stratford (London) - The East Village Development. I teach an outdoor class there sometimes. On this day I was in such a rush, by the time I got there I realized I'd forgotten my debit card. The parking uses the online Ringo app, usually I'd pay, but I was unable to. I ran taught my 1 hour class. Came back 'phew' no ticket and went home. ==== This was on the 29/04/2018 A week later I received a letter in the post issued on 04/05/2018. (Nothing was placed on my car) My class was at 11:00, I got there 5 minutes early, the ticket was issued at 10:57. The guy must have seen me get out car, hid (I scanned around) and then taken photo's only minutes after. === The letter is a PARKING CHARGE NOTICE TO KEEPER I am asked to pay £60 within 14 days else it goes up to £100. "Your vehicle was parking in a breach of the terms at East Village Development on (date). As a result we have issued Parking Charge Noticed (PCN) We issued a PCN to the vehicle because it broke the following condition. Not Ticket. By parking on this private land, you agree to the terms and conditions clearly displayed on the signs on-site. You are liable to pay a charge if you breach these conditions. A discounted charge if paid earlier.. (shortened)" On other side of page it mentioned ways to contact and the 1998 Data Protection Act. I'm new to this site so apologies I understand questions like this probably get asked over and over. I've tried to read some of the threads, it's my understanding I should send the cost of 1hour parking to them and challenge them?
  5. Hi all! I received a private parking ticket in a COOP car park from horizon on 26th March 2018. The car park is free to park for three hours and never been patrolled for the years I have lived in the area. My car had a mechanical issue and broke down on the morning of the 19th March, so I left it there for the day to organise AA to come and check it out to keep it off public roads. The repair was expensive and it was non-driveable so I had no choice but to leave it there until i could get the car repaired which was the 26th March. I returned to find a ticket that day for £70, £35 if paid within 14 days. Please note there is only one parking charge and it is only for the 26th March. I have not contacted them and recieved first communication today by post which is attached. Is there any sure-fire way around paying this fine? They have sent the NTK within the 29 - 56 day window that I saw from other threads. I would seriously appreciate advice or an e-mail draft to avoid the fine if possible as the mechanical failure was out of my control . I have the RAC report from the 19th March to show the fault codes and that it was dangerous to drive and didnt have the cash to pay for repair until 26th when the ticket was already issued. Please see attached NTK and RAC report. Thank you in advance lovely people!! PLease see attachments! Merge.pdf
  6. I got myself into a spot of bother with the cops. Easy done it seems. Long story. I'm not here to discuss that. I didn't do anything wrong. Idiots calling the cops over nothing resulting in me getting arrested. Anyway, I've had the first hearing and the next hearing is on Monday. My legal aid has not gone though yet. I haven't heard from my appointed solicitor as promised many times, either by phone or to arrange to meet. I expected a call at least today. Nothing! So as far as I am aware they have still not been presented with witness statements and evidence from the prosecution. And in any case I know nothing about the details of the prosecution's case and there is now exactly zero working days until the hearing. Apart from the fact I am considering going with another solicitor recommended by a friend and not WSA... ... where does my case stand with regards to this? Three charges. I'm looking at potentially resisting arrest and verbal abuse to the police as a worst case scenario. As I understand it it's good practise to have the accused, or their lawyer presented with the evidence 14 days prior to the intermediate hearing, or else how can I be expected to reconsider my plea? Anyone know of any nice little loop holes in the legal system I can throw at the judge on Monday and walk out the building for the last time, and extend my middle finger up to the whole thing? p.s. Scotland
  7. Earlier in January a work colleague of mine who took my vehicle out for a lunch break got me into a bit of a trouble as I found out he had gone to park illegally in a private residence in the city of Edinburgh. The letter from the parking Company, a parking charge notice stated emphatically 'to keeper', they wanted to know the driver and I guess at this point I should have hesitated a bit, I wrote to the parking Company giving them the name of my colleague and asked them to address him with any further issues, I did sign the letter to that effect. I was even more shocked that DVLA could easily give out my private information with such wanton disregard to privacy. Problem is, this guy has moved to Canada and married there and rarely stays in touch, his sister called me up couple of days ago saying there have now been two threatening letters sent to their address but in MY name asking whoever was driving to cough up firstly a 100 GBP parking fine, and suddenly a massive jump to 160 in the second letter, with no breakdown of charges or how they even got to that exhortbitant amount in the first place. Now, was I wrong to name the driver from the beginning, if he refused to play the game by paying, does this then come back to me by default. Where do I stand here if things escalated. I would upload a scanned copy of what the young woman sent me when I get home from work.
  8. Hi everyone The lessee of a vehicle received a parking charge in the post a few weeks ago and ignored it. They have now received another letter saying payment is overdue and they cannot appeal it via SIP as the time to do this has lapsed, but if we feel that there are exceptional circumstances we should write to them and they may consider. Charge is dated the 32/12/17 at Walmer Street in Manchester. The first letter advising of the charge was only recieived a month or so ago and was ignored by the lessee. I’m assuming because the vehicle is a lease vehicle this is why it has taken them so long to get in contact? The lessee was not the driver of the vehicle the date the charge was issued. The driver cannot remember going that far back specifically what happened but the driver remembers the ticket was issued by the manned pay station on entry to the car park, by the time the ticket expired, the manned station was closed and there is only one machine in the car park to pay at. (this machine hardly ever is in working order and may well have been out of service that night) The charge was issued for exceeding stay by approx 10 minutes max There has been no evidence provided of the parking charge being affixed to the vehicles window. The lessee has never disputed a ticket before and was wanting some advice on how to proceed with this matter. Should the lessee write to them and ask for proof of the car being parked and the ticket being expired? Thank you in advance for any advice G
  9. Hello everyone, Yesterday I parked my car near the Camden Underground and paid two hours parking through my mobile. I was planning of taking underground for a short trip which normally takes one hour but due to Camden Town underground station was shut and the roads around the Camden station were shut, I ended up 30 minutes late back to my car and got a penalty charge note. I never had any parking fine in the UK for many years and I always pay for my parking. I was unable to extend my parking time due to the restriction of maximum two hours of parking at once. I do not live in London and came from Milton Keynes. I was unaware of these major closures. Do you think I could appeal due to special circumstances like delays due to public transport delays etc? Any suggestion would be appreciated. Thank you
  10. Hey, Today I received a penalty charge notice from my local authority whilst parked on a marked bay with a single yellow line with a time restriction on it. (30 mins) The Ticket I have been issued causes me some issues and feel that there is key information missing from it. Would be grateful if anyone can assist. The ticket I have offers no details regards my rights to appeal. The only reference to appeal the ticket makes is that it is "not possible to pay the reduced charge and appeal against the Penalty charge notice."... Surely that can't be right? its well documented that upon appeal the 14 day reduced period should be suspended? The ticket also fails to detail the evidence ie the times between which they are claiming that I have been parked in the marked bay that would prove I was there beyond the 30 minutes. No doubt they will have taken timed photographs. the penalty charge notice has been issued under the RTA 1991. Is there any clear guidance that I can access that would state what information has to be on a penalty charge notice? I have a number of other issues with the signage of the road which I was parked on that I will be raising with them however I'm on firmer ground with that information. cheers for any help D
  11. Hi all, I know this has been covered a lot over the years however I couldn't find a thread with a person who was/is in the same position as myself. I received a PCN last year for overstaying 45 mins in a free car park at the Almondvale car park in Livingston last Aug 2017. I am from Northern Ireland and my car is registered in NI but I was working in Scotland at the time. I thought the car park was free and didn't know about the 2 hour time frame. As my work colleague had received the same fine several times for different occasions and ignored it I thought it was ok to do the same. The letters from high view stopped for months but just 2 weeks ago I received my first letter from Debt Recovery Plus. Now I know from the previous threads DRP themselves cannot do anything and I have just received a 2nd letter form them with big angry bold type doing the usual saying they will advise their client to take court action. I have never contacted any of the firms and continue to ignore them. My question is if anyone who lives in Northern Ireland has been in the same position and what have they done about it and what has been done to them? My understanding is that Northern Ireland is similar or the same as Scotland when it comes to private parking charges? The letters were all sent to my parents address in NI while I was working in Scotland. All help gratefully received and thank you in advance.
  12. Hi. I have rec today (17/03) a PCN requesting £100 or £60 within 14 days - the letter states the charge incurred for overstaying time and quotes the duration of my whole time parked with pictures entering and exiting the car park. I paid for 12 hrs to 3.25am approx. and paid again @ 6.09am for 12 hours and left 3hrs.20mins before expiry of the 2nd ticket, so in all i overstayed approx 2hrs 44 mins but let 3hrs 20 mins before expiry. I know I cannot cancel one against the other but is £60 - £100 an excessive charge and should I appeal?. Please help
  13. Hi all, A good friend of mine has received a letter from G24 asking for £100 for stopping at a car park for 199 minutes when the free parking was only for 120 minutes. Please can I ask what he should do? So far, his other half wants to pay it to 'get it out of the way' but, fair play to him, he is holding firm until he gets advice....so here I am Please help if you can.....
  14. Hi guys, I have got home today to a civil parking charge notice from athena ANPR as I overstayed at a LIDL car park. The car park was free for 90 minutes. I stayed 100 minutes and 8 seconds. I have now been charged £90 and told that I will only pay £45 I'd I pay within the next 14 days. I have been sent photos of my vehicle to prove, along with threats of debt collection or further legal proceedings if i don't pay. I did not shop at LIDL on the day, was being 'cheeky' I guess and just using their park for free. LIDL was only open for the first 10 minutes of my stay, after that the shop closed and, up on returning to my car, the car park was empty. I am not used to these kind of situations and have never been in trouble before. I am so tempted to pay just to satisfy my mind and family, who say it would be stupid to ignore it. I have good credit rating and would rather just pay this fine than ruin that. Does anybody have any advice as to what I can do? Thank you, Kelly
  15. Careparking where: Whitefield Metrolink Free carpark , Bury new rd , Whitefield, Manchester. (behind the station) Hi I hope you can all help me with this query on behalf of my father who is 80 years old. Attached are two photographs of my father's car parked clearly in a disabled bay but slightly too far to the right hand side. He had to park this way because on arrival the original car in the left-hand bay was parked at an angle and was impeding into the disabled bay, forcing him to part to the right hand side. He correctly displayed his disabled badge. My mother needs to have a full door opening access as a passenger and she is also 83 years old and is not very mobile. She was the passenger so he had to have space for her to get out. On returning to the car sometime later the original car had been replaced with the one in the photograph and he had a parking ticket for failing to park within the designated bay. He appealed to the parking company on the grounds that he had not impeded any other vehicles or prevented another vehicle parking in another bay and also mentioned that the car adjacent to the left HS has caused him to have to move over and that the car had been replaced since his return. As you can quite clearly see from the photographs there is plenty of room to the right hand side and the parking bay disabled chevrons can clearly be seen. I presume this is to allow access for a door to be opened fully for example, wheelchair access. As typically expected the parking company denied the appeal, ignored his explanation totally and sent him a popla code to start the next process to appeal to Popla. I have used this site previously with great success and really appreciate the knowledge that some of you on here have. However whilst he's not denying parking over the bay line, they're are circumstances that forced him to use this bay as others were available either. I am unsure of the correct argument to use with popla as clearly he is not impeding any other drivers which is the reason I would expect for parking wholly inside a bay. Before we write to appeal again I would appreciate any advice you may have. Thank you 5.pdf 4.pdf
  16. Hello all, long time no post When me and the mrs first signed up to brighthouse the late payment charge was £5. We have missed the last couple of weeks and discovered that the late payment charge has gone from £5 to £12. We've had a lot of phone calls and even a visit from some bloke who said he was from brighthouse. What can i do about the "unfair" late payments etc please. Surely if we signed up for £5 late payments then thats what we should be paying - we'd be happy with that and not £12. Many thanks P
  17. We had a second charge against our home of aapx. £24k about 10 years ago. we have been paying £30 per month since then. So the current balance will be around £20k. My family want to help me remove this charge. Can someone please give me any advice on how to best approach this. A sample letter to write to the debtor maybe asking for a discount to settle and release the charge. Thank you. GH
  18. Hi there, received a parking ticket from Met parking whilst i was unloading my car after doing a massive at Costco. I parked in the small 4 car car park in front of my flat to unload some shopping that i had done earlier in the morning from costco. I live on the 3rd floor with no lift, i tend to take my time as its just me unloading. I have a permit to park on the main road and yes i could have parked on the main road, but i would have taken me ages to unload and didn't want to risk my daughter running across the road, whilst i was doing this. I also have a visitors permit to park in the car park where my flat is, but didn't think it was necessary.. ..maybe naive but i was genuinely unloading my shopping. can i appeal on supremacy of contract. I understand that my landlord is their employer. Ive attached the sign and parking charge met parking signage.pdf met parking pcn.pdf
  19. Hi I also received a PCN from VCS Ltd for stopping for 8 seconds on 28 May 17 to pick up my distraught Sister-In-Law at Liverpool Airport. She didn't go to the pick up point as arranged but thought it better to start walking towards the main road. I received the initial notice from VCS Ltd but ripped it up and binned it (so I don't know if it was within the 14 days timeframe). I then ripped up and threw away their second letter. The first letter from BW Legal came int he same envelope as a letter from VCS saying my account had been passed to their legal team. The second on says its a 'FINAL NOTICE' saying their client has instructed them to commence County Court Proceedings against me for the recovery of the Balance. I'm not quite sure what to do at this stage, I have read through lots of the forum threads and am thinking of sending BW a letter telling them I am not paying and to leave me alone. Any help would be greatly appreciated
  20. Good morning, I looked at my bank statement this morning to see that Harlands have taken £36.99 out of my account. called them and they said it was refused by my bank as "Refer to payer". received an email from them a day after they tried to take the payment(24th January) saying that it was "Refer to Payer" and that there was insufficient funds in my account" called my bank today and they said they can see that Harlands attempted to take the £11.99 on the 23rd January but it was refused. They said I had over £100 in my bank on that day. They then mentioned that it was a merchant problem and that the payment "Is not a fair charge" I then called Harlands back and they flat out told me my bank were lying to me. Harlands also sent me an email also showing the status of the payment as "Refer to Payer" What do I do now? They already have taken the £36.99 out of my account. How would I go about getting the £25 back when I did in fact have sufficient funds as confirmed by my bank? Thanks for your help. Carl
  21. Hi I'm wondering if anyone can help. Received a parking Eye charge and appealed but it's been unsuccessful. I wasn't aware of a time limit, shopped for Christmas and I'm disabled so it took longer because a) I can't walk very well and b) the shop was busy with Christmas checkout queues/busy aisles. I was there 1hr 57 mins apparently. In my online appeal I couldn't find the receipt so uploaded a copy of my bank statement showing a purchase on that day. I've since found the receipt. The error I made from reading these boards now is that I named myself (registered keeper is my husband) as the driver. The email I've received today advises me theyve extended the reduced amount of £40 for 14 days further, or I can appeal to POPLA. Do I continue on with the appeal or just have to pay it as I named myself as the driver? Thank you in advance for any help. 23. I would be grateful for some advice from you guys regarding an on-going matter I have with a company called Park Watch. I was using the car park at the One Stop Shopping Centre in Perry Barr Birmingham and dropped someone off in an area which the company claimed was for busses only. They then wrote to me and issued me with a Parking Charge. I was going to pay it until I decided to Google the company and found that someone else (markavfc) had had the same experience and with your guys help had had the fine rescinded. Following his lead, I wrote to Park Watch saying that I would not be paying the fine along the following lines: With reference to your recent letter reference number ,,,,,,. As the keeper I will not be paying this so called charge as there is no contractual obligation and you have not complied with schedule 4 of the Protection of Freedoms Act 2012. I heard nothing from them for 3 weeks and then I received another letter claiming that I hadn't responded to their first. I think this was due to them changing addresses but with companies like that it might have just been another tactic. Therefore I responded again with the following: Dear Sir or Madam: Parking Charge Notice ..... I received a letter from you dated 28th June 2017 pertaining to the above matter. The address I was given to write back to you was given as: Park Watch, Payments Department Suite 12, The Shippon Church Road Dodleston Chester CH4 9NG I wrote back to this address on the 8th July accordingly. A copy of the letter is attached for your convenience. I received a letter dated 27th July indicating that the parking charge is overdue. However I did not receive a response to my original letter and I await one at your earliest convenience. Please note as stated originally, as the keeper I will not be paying this so called charge as there is no contractual obligation and you have not complied with schedule 4 of the Protection of Freedoms Act 2012. I have today received a very odd response from them which I will attach and would welcome your advice on how best to respond. I look forward to hearing from you
  24. Hi Any advice please. I had a parking charge whilst parking at a hospital (that I work at...). Fine was £50 which was passed to Equita. I received a letter from them dated 09/01/18 stating charge passed to them and recover outstanding sum of £50 in full. No mention of any fees. I rang them and paid automated payment 3d later and thought matter closed. They took that payment. I then received a letter 2w later stating still outstanding, no mention amount. I rang and was told still had £60 to pay for their fees. I mistakenly paid it. Now feel I shouldnt as: their fees were not mentioned in either letter the fees is more than original charge rang them back told to email them any issues
