  1. Hello newbie here, My Husband & I have been dealing with a Debt Collection Agency SMD Credit Solutions Ltd since April to collect a Debt owed to our Company since November last year. A little background: We were owed £38k and the debt was in dispute by the company who owed us. This was construction industry dispute where we worked for contractor (2) who was working for main contractor (1). Main Contractor (1) refused to pay contractor (2) citing poor workmanship therefore contractor refused to pay us. So it was quite in depth but it was being dragged out and being a small company we needed to get a resolution. SMD cold called us but it just so happened we were in the process of looking for an agency after them phoning us everyday for weeks trying to persuade us to agree for them to take the debt on we agreed. We had lengthy discussions about the whole case and we were upfront about everything before we even agreed for them to take on the debt. We knew it wouldn't be straight forward so wanted someone who knew what they were doing. They wanted to charge £2000 + VAT for a reg fee but we simply couldn't afford that so they dropped it to £1000 + VAT payable in 2 instalments. After we agreed we sent them all documentation regarding the debt including invoices owed, purchase orders we received, emails and a report from the main contractor (1). Needless to say SMD were useless, they never answered or return our phone calls, they never returned or answered my emails. In their initial 'guarantee email' they claimed to keep you updated every step of the way and give you a full refund of the reg fee if they don't at least recover the cost of the reg fee. Eventually after quite a few weeks I was emailed and told that SMD had had to obtain legal advice on our behalf and had to pay out in excess of £3000 in order to do so. After weeks of getting nowhere and no answers SMD finally advised us in mid June to set up a meeting with Contractor 2 and main contractor 1 and thrash out what we could get paid. We advised them that we would look for an alternative agency who was specialised in Construction industry disputes and we would like our reg fee returned to which we received no reply and no refund. We then received the official In Administration letter from contractor (2), and I left a negative review on SMD company facebook page. Nothing defamatory or untrue just stating our disappointing experience and that I would not recommend them. Oh and I hope they don't keep telling people about their 100% success rate which is what they said to us. Today I get an email from them saying that unless I remove the comment they will charge us £10,000 (10 x the reg fee) plus the £4000 costs as per their T&C's. They claim we mispresented the debt by not telling about the report Can they do that? Sorry for the long post
  2. Hello, any help would be appreciated. In brief: I used the Dartford crossing in August. I tried to pay the £2.50 but their system was down for hours and I was unable to do so until the following day. I received a £35 fine. I made a representation and they have rejected it and said "our investigations show that thre were no known problems with our website at the time you stated you attempted to pay". The fine has gone up to £72.50 now. I am wondering what the best option is (a) just pay the charge and forget about it; or (b) appeal it. I am worried that I will have bailiffs at the door and cost hundreds all for a £2.50 charge and their system being down. Thanks

Hey I recently parked in my university car park and then a week or two later i received an 'important notice to registered keeper, parking charge of £40' ive parked here without paying a few times so far so i will probably receive 2 more letters. Also last year i parked here all the time but did not receive parking charges, looks like the cameras have started working now. Should i pay them or not Received parking charge by F1RST PARKING.
  4. Hi all, VW dealer charged almost £700 first time when took the car to them for Engine management sign. This was after 70% discount . Invoice had EGR & particulate filters work done. It was on 17th Sep. A week after, same sign came on dash and took it back to the dealer. Now they saying that they need to replace rear EGR valve and wants £600 . Decided not to go ahead and requested to get the car back. Will be asking for printouts for diagnostics and quotation. Don't know what are our rights on this matter but shouldn't the dealer try to fix for free for the same fault that was charged but not fully fixed? At the moment, we're trying to write to parent company and to VW UK. But if goes nowhere, where and how can we proceed further? Car is VW Sharon diesel 2015 reg and not in the list for recall. Ive received a letter before action from Gladstones re an alleged parking violation on private land there aren't any signs at the entrance barrier stating the land is private and subject to a fine for illegal parking. Although there are some within the car park, these are placed in such a way that tree branches etc obscure them. Is the alleged violation enforceable if there weren't any noticed placed at the barrier entrance to the car park? Thank you.

Smart Parking 8. Where exactly [carpark name and town] Exeter, Haven's Bank retail park My case is a bit weirder than the usual. I got back from work around 19:30 and in my street they were having a BBQ party so cars parked and no where for me to park. Good natured I asked them when will they finish and they said about 15 mins I went in the nearest retail park in our place about 30 sec drive and parked there, no other cars where parked (not knowing it was private). I then left the car park after 13 mins to go back in our street and the cars are still parked I gave them another leeway of 10 mins in which i proceeded to go back to the empty retail park (2nd time now) from 20:00 to 20:13 Got back and saw the party over and proceeded to park in my own street. Now 1 month later i received 2 parking charge notice from a private company called Smart Parking asking for 90 quid or 54 if paid within 14 days. I made an appeal stating what I said here but I haven't gotten a reply yet. I was going to contact them through the phone but they are not opened on weekends. Having revealed that I was the one driving the car, have I still got a leg to stand on? I can possibly survive the £54 parking charge but having to pay £108 for not even 30 mins max of parking on an empty car park is a bit too much I think. It also doesn't help that I didn't even see the sign that night stating it was privately owned I thought it was a bit misleading. The letters too small especially not visible when dark. Where exactly [Whitlingham Country Park, Norwich, Norfolk ] For either option, does it say which appeals body they operate under. IPC A member of my family who is foreign, drove into Whitlingham Country Park in Norfolk stopped for 20 minutes to see what boating facilities there were then left, my family member drove out through the entrance by mistake, we are now incurring charges and threatening court letters. Any advice would be gratefully received
  8. Hi everyone, I am a single parent of 2 children (2 years and 2 months old) which I take to the park every week. I don't have a lot of money but still I go to and pay for parking every week in the same place (Willen lake in Milton Keynes). What happened on this occasion is that after I placed the ticket on the dashboard, I then had to get both my children out as well as the push chairs and so on out of the boot. Whilst doing that the ticket must have been blown over on to the seat as it was a windy day. When I got back I found the ticket upright on my seat after returning to the vehicle. The company is an IPC company called Napier Parking Ltd and I was issued with a Fixed Charge Notice. I contacted them immediately and showed them photos of my ticket and explained my case to them. They replied by rejecting my claim and showed me pictures of my car (obviously not my car seat) and said I could try contesting this by contacting the IAS. I appealed for this case through the IAS and was absolutely dumbfounded by the "independant" services response: " In all Appeals the Adjudicator is bound by the law of contract and is only able to consider legal challenges and not factual mistakes nor extenuating circumstances. Once liability has been established only the Parking Operator has the discretion to vary or cancel the parking charge based on mitigating circumstances. In this case the parking charge was issued because the Appellant parked his car on private land without displaying a valid P&D ticket in the front windscreen or on the dashboard as is required. The Appellant maintains that he bought a ticket which allowed him to park there that day prior to the issue of this parking charge at 13.53. The ticket provided by the Appellant does not show the time when it was issued but the cost of £2.40 should be able to confirm whether it was before or after 13.53 which would have an impact on his mitigation. The responsibility for making sure that a P&D ticket was properly secured in place so as to be able to be read is the motorist's and even in windy conditions that is still the position as well as with the difficulties of coping with young children. However much sympathy one may have for the Appellant this is not a matter of law which is the extent of an Adjudicator's remit as set out above and as a result this Appeal must be dismissed. " I am now in a position where I can no longer appeal anywhere nor can I pay the reduced fee. It really makes me angry why I must still pay the fine even though I have a valid ticket and also why I am at fault in the adjudicator's eyes for not having a ticket which shows the start time . .. I mean, the company who prints the tickets should be at fault there right? As for the parking company, these are simple reasons why I feel their actions are simply to make money off of fines: 1) Why am I not allowed to show you them my valid parking ticket which should still be proof of payment after being accused of not paying? 2) Why is there no start time (ticket issued time) on their tickets? 3) Why don't they have a system which makes you enter your registration number? 4) Why don't they have the sticky backs on their tickets? Does anyone have any suggestions? My fine needs to be settled by 02/08/16 and is £80 Thanks in advance!
  9. Hi all, Just after some advise as this may be a bit different to other people cases. Today I received a Parking Eye "Parking Charge Notice". It's my car which my wife drove to take me to hospital, she paid using the Pay By Phone app, however she entered her cars registration by mistake. I worry she done this again the following day also! I've appealed and sent a copy of our proof (screenshot with incorrect registration on it) but now I'm wondering should I of come here first before quickly rushing into an appeal? 1 Date of the infringement - 13/09/2018 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] - 27/09/2018 3 Date received - 01/10/2018 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? YES 6 Have you appealed? {y/n?] YES APPEAL - I have received a Parking Charge Notice for my car, which my wife was driving at the time taking me to hospital. We made payment using the Pay By Phone app, and once I received this letter have only realised that payment was made however it was made for our other car (*OTHER REG*) as my wife has often used her car to make payments as she has been to the hospital a lot recently (as I’m sure you can check by her registration). Unfortunately this has been a simple error and I attach proof that the payment was made and you'll be able to confirm this as her car *OTHER REG* did not enter the hospital car park on this day.   10. A teacher who drove into an airport worker following a row over a new £3 drop-off charge has been spared jail after a judge said he agreed the levy was an "absolute disgrace". Graham Benbow, 55, flew into a rage at Manchester Airport when he was told he would have to pay a fee for dropping off a passenger at a departure terminal. An airport official tried to stop Benbow from driving his Mazda through an open barrier but ended up on the car's bonnet before he was carried along a road for several hundred yards, Manchester's Minshull Street Crown Court heard. Benbow, a psychology teacher at Altrincham Grammar School, went over a roundabout before he stopped for police. Hi All, Any help would be greatly appreciated on how I appeal this parking Charge, I paid for the days parking via the PayByPhone app but selected my previous vehicle in error (same make and colour in list with similar number plate!). As per the sticky post here are my answers to the questions; 1) Date of infringement: 17/05/18 13:24 2) Appeal lodged: No (I have however opened the web page to do so!) I also have not received an NTK. 3) NTK Mention Schedule 4 PoFA: N/A NTK not received 4) Appeal after receiving NTK: N/A NTK Not received 5) Parking Company: SIP Parking Limited (SIPcarparks.com) 6) Car park: Tariff Street, Manchester. (Code 88841) I was parked legally in a marked bay and paid for the parking upon arrival, unfortunately I used my previous vehicles registration number. I have a history of using the car park on a monthly basis with receipts / records of each parking transaction and Reg number they are against. If paid within 24 hours: £35 7 days: £50 14 days: £60 Any help would be greatly appreciated! Thanks
  12. hello i hope this is in the right place, firstly i`ve been paying my council tax since: december - paid january - paid february - paid march - missed it april - paid may - paid was recently sent a letter saying they are taking me to court and adding 92£ court summon cost to my bill! because i missed the march payment, this is crazy! they should of at least sent me a warning letter or somthing, i missed march but kept paying april and may etc so they know i didnt stop paying i just missed 1 month and got it mixed up. i rang the number on the letter and they told me theres nothing they can do and i must pay in full etc lady on the phone didnt really care much. i tried to go to the manchester city council building today but by the time i arrived it was already closed. will try again tommorow. the reason i missed march payment was because my mothers younger brother passed away in early march and it was a hard time for us, we didnt think about much and the bill was at the back of our minds we still started paying april may etc so shouldnt they have sent us a letter saying hello we see you have paid recently but you missed a month, even tho you are continuing to pay us can you please finish the march payment etc, not just suddenly summon us to court i always keep receipts and i checked on them and they are right we missed march, but continued to pay april may etc. any advice guys? appreciate it again i hope this is the right forum im posting sorry if not
  13. Hi all - as per thread title, either my better half (car owner) or I stopped at LJA whilst dropping someone off. Didn't stop on a road edge, instead turned into a side road/parking area, spun around, and let them out. Reason for this - never been to LJA before and didn't have a clue what was going on parking wise! IAS I've added a copy of the letter. Suffice to say it was utterly unclear that there was a contract being entered into, and that dropping someone off, whilst lost in a confusing car park, would somehow result in a harge Also suffice to say no money is being sent their way!   14. Hi Just after a bit of advice really. My wife had two fixed penalty notices came through today for an offence on 8th August. She was in Brockworth, Gloucester with my daughter who was house hunting. They had gotten confused and a bit lost and whilst they did not notice at the time managed to go a short distance up a bus only link road then turn around to come back. The two tickets seem to show this but are one minute apart. Literally one at 13:54 then the other at 13:55. Yes ok but really two penalty charges within one minute surely not. Each charge shows two images both on the left show the number plate. The 13:54 on the second image shows a car approaching but a fair distance away from the camera. On the return run which is the same camera then yes the number plate and the car. At £60 each that’s £120 in one minute, (ok £60 if paid within 14 days) but really can they be that harsh? Any advice please would be grateful.
  15. Heathrow airport drop off though this could apply to any airport I expect.. Heathrow airport is private land and I have a response from the Met police stating that and that they are paid to police the land by Heathrow airport.. Now I accept a need to police it for security reasons and because in motoring terms a lot of traffic uses the area daily. However on occasions the Met police decide they will clamp down on people picking up from the drop off areas which by the signs posted is an offence some signs state its an urban clearway no stopping allowed except for dropping off so its fine to stop and unload but if you stop and load up thats an offence. I had a friend (taxi driver) dropping off and loading up at the same time 1 in and 1 out and he was threatened with a ticket as according to the officer its an offence to pick up.. Its clear this is all about money for for the car park.. Would the police issuing you a ticket in this case be classed in the same way as private company ticket or would it be classed as a criminal offence given that its on private land and would the matter differ if the ticket was issued by an airport employed operative such as the parking wardens they employ. I havent had a ticket but in some ways Id like to test the case in court as in my eyes its a private land parking matter and one the Police should not be involved in.
  16. Wondering if one of the experienced users on here can help here with this one? Yesterday afternoon I found my car clamped by Marstons Bailiffs - no paperwork whatsoever only a scribble and phone number so I phoned them to find out that apparently I failed to pay the congestion charge in November last year but know nothing about it as they send all paperwork to a previous address even though I updated my address with the DVLA in 2017!!! Then the bailiff stopped answering any of calls when I tried to ask her about PCN information etc and the TEC phonelines were not being answered yesterday so in a panic I phoned TfL got my PCN details, filled out the PE2/PE3 forms and headed into central London to the local magistrates court to get it signed for £25 (yes I now realise I could have gone to county court and got it for free but never mind)- was in major panic as bailiff was threatening to tow car in 2 hours- filed everything with TEC at yesterday and just had confirmation of filing today. So now TfL have it the question is how long will it take to halt recovery and will they remove the clamp? Also who can I phone for advice? TfL say they have not received the filing from tec yet and the bailiffs wont answer my calls. I need the car as I am the named driver for my disabled father who needs to be taken back and forth to hospital. This has caused me an undue amount of distress and i genuinely dont feel i have done anything wrong - had I known id have to pay a congestion charge on the day in question i would have done. as it happens i have no recollection of that day whatsoever was it was a year ago and i have no access to any paperwork (bailiff has refused to give me anything ive asked for).
  17. Hello all, I've received a PCN through the post from Excel Parking, here's a brief explanation. My car parked in an area it had not parked in before and was not familiar with any of the parking. This was simply to pick up a takeaway. My car was advised by the takeaway that there was parking behind that is free after 6pm. So my car went after 6pm, only saw one car park behind and parked there for just over 20 mins. I (the keeper) have received a PCN from Excel Parking. Once this was received I had a look online and it seems they have been rather sneaky in this area. It looks like there's another car park behind the one I parked in that is not very noticable, and according to their website this is the one free after 6pm. So, my car being a newbie here and not knowing the area assumed the car park immediately behind the takeaway was the one free after 6. I bet this has caught a lot of people out. I appealed online, but have had a letter of rejection. They state in the letter about the signs at the car park being clear, and say they issued the charge correctly. Is it worth pursuing? as it was a case of mistaken car park and the car parked in the wrong one.. would my car have a leg to stand on? Also notice the letter says if I appeal again through IAS the reduced charge offered will no longer apply. Should I pay the £60 (reduced) now, or appeal.. is there ANY chance I would get a successful appeal? Has anyone ever won against Excel parking?
  18. am a newbie to this wonder if someone can help me ive been fighting a PCN with harrow council since last year, had my informal appeal rejected and then was sent a NTO ages ago where I restated the appeal and didn't hear back, until a few days ago when I received a rejection letter dated in june which meant I was already out of time to appeal in 28 days. the reason for the lateness seems to be that they thought my company name was my surname and spelt it wrong, so the address was a generic campus/site address and therefore must have gone into a pool before it was redirected to my specific pigeon hole (please note the address is correct with the dvla - its just the council that have made the error). so in a massive panic, I lodged an appeal online with the reference number given and stated that the reason I was appealing late is that I didn't receive the rejection paperwork until now due to this error in address. However, ive looked up the pcn online and it looks like it may have already progressed to charge certificate (just because of the price) but I ahvent received this either -maybe this will also come late if they have made the same mistake with the address as with the NoR. the question is was it the right think to do to lodge an appeal late (the website says you can appeal late if u state a valid reason and I thought not receiving the NoR was a valid reason but I may be wrong) but now im thinking maybe I shouldn't have done that and should have just waited for the next stage to file a witness statement from what I read on here? however the problem I have now is not that I never received the NoR but I received it too late because of the councils mistake in my name/address. So if this does progress what box can I tick and also ho long will the tribunal take to get a result - am worried that the council will continue to progress the charge while im waiting for the appeal result. help please!!!!!

The letter dated 16/07/2018 is the first I have received regarding the case. (...) Have you had a response? [Y/N?] post it up Y (...) The PCN was issued and the signage is displayed in compliance with The British Parking Association’s Approved Operator Scheme Code of Practice and all relevant laws and regulations. Hi everyone I'm new to these posts but hoping you can help, I received a civil parking charge through the post as I parked in Lidl car park for 1 hour 38 mins when the allowed time was 1 hour 30. They sent me photo evidence of me entering and leaving. They applied to DVLA for my details. The charge is for £90 but £45 if I pay before 14 days. What can I do thanks in advance Athena Lidl.pdf

  22. We have just received a parking charge notice from ParkingEye for using a carpark that we don't normally use. We went to Asda and Farm Foods and I looked up parking details prior to going on the Farm Foods website and it said parking was free. We parked for 2 hours and 1 minute on 12 July 2018 and have received parking charge of £100 dated 18 July 2018 - do we have to pay this? I was not aware of any time limit but have subsequently found out that there is a limit of 11/2hours - noted on the back of the parking charge notice. They have sent photo evidence of car going in and car leaving. The car park was Glynn Square Wolverton Milton Keynes Has anyone else had similar and what did you do and what was the outcome? Vicki
  23. This NTK came to someone I know and quite frankly it's a joke! Date of parking: 08/07/2018 NTK date: 13/07/2018 NTK received (last week, I'll check the exact date) The vehicle was parked from 15:43 to 16:02, the driver went into the pub, spoke to the pub owner while drinking a coke and left. The car park is for the pub only, not shared iwth shops or anything, post code is RM6 6QT Google nosey neighbour link: https://goo.gl/maps/3bb2EhXYUJN2 The reason for the charge being issued is 'Your vehicle was not authorised to park' As the car was there for less than 20 minutes it's not an over stay, so I'm guessing the driver forgot to get a free ticket or register the reg number at the till. Until I see a photo of the car park signs I won't know. Anyway, any thoughts on this one? One thing I need to add is that the registered keeper moved house a week ago so the NTK was sent to the old address, I think they need to send at least one response to Euro CP to advise of the change of address and I guess at the same time deny any responsibility for the keeper as the vehicle was parked correctly (dependant on photo of sign)?

I moved from Amsterdam to UK I did not have bank account here my friend started paying my DD of 9.99 per month from March 2018 I started gymicon with him now in june some how he missed the DD. he received a call and letter stating that you missed a DD you need to pay 25 pounds plus your monthly fee for X4Less. he cancel the direct debiticon I only went to gym for a month because now I was little far from gym I was paying my friend to pay the DD. now I am receiving the text msg from X4L saying your account is default call on this number to solve the default when i rang on this number it says you have to pay all 9 months fee plus 25 admin fee Ii told him I was paying monthly and I want to continue gym again and I will pay month by month, he said you sell your membership to us with total fee and you can go to gym till march 2019 which is end date of contract. I also rang the gym and tell them I received msg from you but I want to pay monthly m/ship fee but I will not pay extra they said your account is default now you call on 0144444 ... number to clear your matter then you can start gym again. please advice me what should I do i want to continue my gym but I do not want to pay extra fee.   25. So 2 days ago my misses got a letter from Fedex saying she owes £40.69 £12 of it is a charge from fedex themselves the rest they claim is customs duty. Her sister who lives in the USA sent her a book from a company over there the book cost $14.99 which is around £11 our money. From reading it would seem that my misses can received a gift from outside the EU and not pay any duty on it so long as the item is less than £34.99. Yet fedex insist its worth higher value $27.99 and claiming an individual didn't send it the documents show the importers name as her sisters name. Fedex will not back down on this By my calculation even if duty was due on this which it shouldn't be it would only come to around £2. It seems fedex is trying to get away with daylight robbery and charging 4 times what the book cost. She has the book the invoice arrived after it was delivered.
