  1. Received court papers from Northampton County Court at weekend. This basically from Carter acting for Global. For weeks they threatened court action but i never replied to their letters as i have had no dealings with them before. However, on receiving these papers now replied back to Carter telling them it will be contested. Also filed a defence on line to the above court. Just waiting now to see what happens.

I recently received court papers from Bryan Carter Solicitors for and old debt with orange which was passed on to Arrow Global. i acknowledged the court papers and sent B.C a CPR 31.14 request. i received a response on 25th August saying they will be in touch in due course. Then today i received some docs that im not too sure about and would like some advice on my next move. i have enclosed all docs and letters received since i sent my CPR request and not sure what to do. PLEASE HELP ME, THANKS

I have received a letter from Bryan Carter Solicitors stating that i must pay an outstanding balance of £99.22 to TMobile and that this "must be paid within the next 14 days or else further costs will be added to my debt if it is necessary to go to court and therefore the outstanding debt will increase." That if I fail to act and they obtain judgment it may prevent me from gaining credit in the future and will remain on the Register of Judgment Debts for a period of 6 years (which I am assuming is like a CCJ). My issue is that I do not owe TMobile £99.22 but in fact £44.40 which I have already spoken to them about and have agreed to clear this as the account was closed and that balance was for the last bill for November 2011. What do I do? I have not contacted Bryan Carter via phone or in writing?

Hi everyone Having received today a letter from Bryan Carter stating that they have started litigation and I will receive a claim form from the County Court within 48 hours, I signed up to Experian and checked my credit report. It does not have the Lloyds TSB debt listed. It does state the following: credit accounts - 4 (2 for my bank, 1 for the mortgage and 1 fro Lowell - I will be asking about this on a different thread!) account overdue - 0 outstanding debt - £0 missed or late payment - 0 Does this mean that the debt is statute barred? Or have I missed it somewhere on the report? Many thanks
  5. Hi there I received the court letter today. It is for Bryan carter and Arrow for an old TSB account. There is nothing of this debt on my cr. So firstly I will send off the acknowledgemant letter saying I am defending all of the claim. Then I will send off CPR 13.14 to Bryan Carter - is that right?? Where do I get the CPR 13.14 from? Thanks ps what is litigation - it is not a ccj is it? What happens if I lose my case?
  6. Hi, I've been using this forum for years and have found it beyond helpful, but until now i've had nothing to add. Its a pretty steep learning curve and I wish I could have helped but it seems I may need some advice myself today. I've recieved a county court claim form (similar to some of the others ive seen on here from the same people) but Im unsure exactly how to set out my defence. There is plenty of info on here for the standard defences and I wouldn't normally ask but In this instance I really dont owe them, and in fact I consider orange (or whoever owns the account now) as owing money to myself. The amount is just a couple of hundred quid, and I could probably afford to pay it but I wont on principle. It relates to a mobile phone contract I had with orange which went bad 5 1/2 years ago (nearly made it lol). I kept eveything and remember all the telephone conversations vividly. The problems came from a phonecall I recieved from one of their indian call centres. I could undertand very little of what the guy was saying but he offered me £5 worth of free international calls for a month. I (stupidly) said yes. While he was in there, unbeknownst to me, he removed all add-ons from my monthly bill. This was around this time in 2006, maybe august (i have records at home). The phone was one of the original smart-phones and one of the bundles was for data. this was back when data cost a lot, maybe £5 per meg, and the phone was similar to a modern phone in how it used data so the bundle was essential. Typically my bills were around £52 if memory serves me. My bills were taken by direct debit and I didnt notice anything was wrong untill months later, perhaps november/december. In the mean time they had been taking £80-90 or more per month from my account. I noticed because my bank had sent me an unpaid direct debit letter. I rang orange and they demanded I pay this ~£80 bill. I refused, found out about the removed bundle and started complaining. They admitted fault and offered to refund one months worth of overcharging (I think it was £20). But still demanded I pay the £80 as the refund would be applied to my next bill. Even though they admitted fault they were unwilling to refund the full amount on the basis that I should have told (caught) them sooner. Its like saying: we know you're a mass murderer, but seeing as we didn't catch you earlier, we will only prosecute you for the last one! I said I was unwilling to pay and that they should disconnect me (I was out of contract). My phone was subsequently disconnected, incoming and outgoing, but they continued to bill me for a futher 2 months ending up with the total bill of around £200. This was for service I did not recieve. And the overcharging amount was well in excess of the £80 demanded from me initially. Hence why I believe they owe me. The question is, Im not sure whether to pusue this line of defence, or just the standard 'I know nothing' defence. I understand it may be more risky, but I see how much hassle the other stlyes of defence have caused people. I doubt they have any real records as its changed hands a few times over the years. I appeiciate any help you can give me, and you will probably see more of me in the coming months as a few deadlines are approaching nicely. But I would hate to have a ccj from the one debt I know for a fact I dont owe.

I have recieved a letter from Bryan Carter solicitors regarding a account that was passed to them from Fredrickson International ltd on behalf of there client Everything Everywhere Limited saying payment must be paid in full within 14 days if not they will advise their client to do court proceedings how do i go on about this as i do not have the amount they are asking for? advise plss
  8. Hi all, I keep getting text messages to my business landline, I checked the number and it appears to be this joker. I've already complained to the solicitor ombudsman. Staff and I have taken calls, long pause and then an automated message, starting off with call before you go to court, to you are now going into court today, to when they text to say they have put a CCG against me today. They have never written to me, neither has anyone else claiming I owe them money, which makes sense as I owe no-one nothing. Who the heck are they causing all this worry across the land, I wish they were just down the road as I would go and stick my foot up his backside and happily be arrested for it. [EDIT] eg those ones on telly that are walking down a flight of stairs and the solicitor lady actor in high heels falls over, saying see we have accidents too, and yes their game would then be to claim off some poor other bugger for their own stupidity, oh I fell over my own feet, who can I make pay for that, it's ridiculous. Back to this Brian character, I read some people say to respond and sort out a payment plan, others say to ignore it, I'm ignoring it and I'll see what turns up from this alleged court case I wasn't even invited to, I summons non payers and I have to obviously let them know throughout what I am doing, why doesn't brian, co's like his should be shut down, and he should be ejected from the UK, I'll help by using my foot and kick him to the continent.   9. To cut a long story short I took a couple of contracts out with Vodaphone during the summer of last year, unfortunately a little while after I lost my job and basically all hope. I have since been ignoring phone calls and letter's demanding payment and so forth. I have just today received a letter from Bryan Carter Solicitors demanding payment in full be made to Fredrickson within the next 14 days or the account will be referred to Bryan Carter to litigate me. The amount they are requesting is actually £100 more than the initial debt and should proceedings be issued I will incur court and solicitor fees. I am in no financial position to clear the whole amount as am in receipt of JSA but I would like to take steps to start paying the debt back. From what I have read I should not contact the DCA via telephone but only in writing. What steps can anyone recommend so I can get this mess sorted.
  10. Hi all, Help would be greatly apprreciated!! I have recieved a claim form from NCC on behalf of Bryan Carter & Arrow global. They claim i made arrangements to pay under a ref number and have defaulted. I have no knowledge of this debt or ever making an agreement with Arrow global. After reading some post on this forum i have completed the response pack stating i will defend the claim. Can someone please help me with what letters i need to send to Bryan Carter to get more info about this and how to proceed. Thanks in advance Graham
  11. Good evening, My wife has this morning received a letter from Bryan Carter Solicitors saying they have issued litigation proceedings in the County Court. She has also received a Claim Form from Northampton County Court Bulk Centre. A couple of years ago, she had a credit card with MBNA which she was unable to pay. She wrote to them explaining the situation and continued to pay £1 per month. All correspondence was ignored by MBNA. Eventually a default notice was issued and the debt was sold to Experto Credite. She wrote requesting the CCA but the £1 cheque was never cashed and in due course she wrote to them stating the account was in dispute. Since then, Arrow Global sent a couple of letters demanding payment which were ignored. A couple of weeks ago, Arrow Global wrote offering a discounted amount in F&F settlement which was also ignored. How should she proceed? The letter from Bryan Carter makes no reference to MBNA apart from the account number. The debt has been assigned to so many companies I have lost track and I was only able to match the account number up after digging through the original CCA letters sent at the time.   12. Hello All, Sorry if this isn't the right place for this, I sincerely apologise. I'm in desperate need of advice regarding a CCJ filed by Bryan Carter against me. I lost my Job in 2009 and life basically came to a stand still. I therefore stopped paying my debts as I didn't have the means to. In 2010 Bryan Carter filed a CCJ against me regarding an Egg loan balance of £3300 which I had defaulted on. As I didn't have the means to pay this and I was so depressed and stressed I ignored all debt collection letters and never bothered to open any including any correspondence I received through the post from other organisations. Three years on and I have signed off Job seekers and found a Job. My CCJ came up during the security checks and the company wants to know what I'm doing to clear it. I'm so confused and scared my company will not hire me beyond the probationary period if I can't prove I'm doing something about this. My question is how do I go about contacting Bryan Carter and offering to pay a set amount monthly without being bullied into paying more than I can afford. I also have other debts which Bryan Carter has written to me about demanding payment and I have ignored. Any advice on how to go about sorting this out will be very much appreciated. Many thanks.
