  1. I had an incident where I got banned for life from sainsbury. Nothing was stolen from sainsbury. I had paid for all the items. I had an item from different retailer and I couldn't provide the receipt for that. I have recieved DWF letter now. I have been reading other posts regarding same kind of experience where people have been advised not to pay them. Just wondering if anyone had recent experience and what was the outcome. I don't want anything going on credit file if I don't pay. Any advise would be much appreciated
  2. Hi, I have been caught shoplifting food under the value of £50 by a store detective operating for DWF. They took my details, banned from all stores, took my photo and advised a letter will be sent to my address. Does anyone know whether there will be a fine along with the letter? Thank you

I received them l12 months ago I have received some recently, I have seen some people being taken to court over this. What has happened to the cases that went to small claims?   5. Hi, I received a letter regarding an adidas return back in May, I sent them an email with my confirmation from adidas saying they received my return. But I have received a 2nd letter from DWF saying that the tracking says it was rejected at whatehouse and returned to sender(order was returned in october and tracking says rejected in january). These items weren't returned to me and dwf have said they will seek instruction from adidas to proceed with court action. I'm not really sure what to do, should I email dwf with the confirmation email from adidas like previously? Hi, i got a letter from dwf requesting money for a adidas order i returned back in october 2021. they sent me the letter 3 days ago. i have all the proof of sending the items back to them, and all the emails they sent me saying weve received the items and processed the refund. i rang up adidas and they checked the order and told me it looks fine, and said to ring dwf and tell them to close it. yesterday i rang dwf, and told them the order has been returned and refunded by adidas themselves. i have all the proof. they then tell me they are going to contact royal mail and see what was sent back. she then said theyve put my case on hold, and they will be in contact with me. any advice on what to do next, do i email dwf with all the evidence i have. i have seen similar cases like this on the internet and this website. a lot of people are saying to ignore the letters as they are a powerless company. what can dwf actually do with these letters or are they just trying to squeeze out money from you. any help would be appreciated. thank you
  7. Hi, this is the 4th letter I have now had from dwf regarding a debt I apparently owe adidas from October 2021. I have sent a screenshot to dwf from adidas saying to ignore dwf but they do not give up. All items were returned on October 2021 and after checking tracking , returned to sender January 2022 which is not the case as I have not had anything back. This is why adidas are chasing me . Is there a way I can report or anything? 4th letter is different heading to 1st 3 .

Hi i had a few letters early last year regarding a return I made to adidas which I received a refund and they claim a year later they hadn’t actually received it despite email confirmation saying they had and I received a refund. There have been numerous threads on this. These were returned to adidas around September 2021 and then I started to get a few letters towards the end of 2022 which I ignored as directed. today, I have received this letter. It appears as though they’re trying to issue a CCJ against me and have sent me a moneyclaim letter from northampton courts im really worried, what do I do? We’re just about to have a baby and a CCJ would ruin us

Hi, I just received a second letter from DWF stating that I have a balance of £4kish to pay and "should you fail to contact us and come to a suitable arrangement for payment of the arrears within the next 10 days our client may consider further action to recover the monies owing to them. This may include issuing of Court Proceedings which will incur additional costs which you may be liable for". I am wondering how true this statement is and if I should contact them to sort it out because the sentiment on this website is that I should just ignore and they can not take me to court. Looking forward to your replies.
  10. its a corporate sign up to dwf and the services they provide. don't be mistaken here, adidas might not know, the extent, or actually what dwf are doing, but they most certainly CANNOT, as the claims here witness, be the claimant on a court case, adidas are . it could well be an exercise in seeing what mugs cough up with simple threat-o-grams and give them free money when there is not legal reason too, and the court claims could just be testers to see how they go. sadly most people wrongly wet themselves when they get a court claim, just like the ones from dca's on debts they bought, and cough up blindly. but i very much doubt with evidence of returns adidas will win. sadly people go quiet and dont tell us they won or the claim was discontinued. rather selfish really. its a numbers game but i bet it profitable and 99% of the money dwf get from people that ring them up goes straight in their pocket and straight down the pub. just like the retail loss scam letter dwf and RLP send out. dx

  12. I'm completely confused and worried as these solicitors have sent me a letter for an Adidas order which was £900 and it was mostly returned, 5/7 items were returned due to sizing issues. They have stated I have 14 days to pay and that my items were not actually returned to the retails. This does not make any sense, I had done various orders and returns with them before and never had this. I have confirmed with adidas themselves that the items had reached their warehouse and have confirmation emails stating this too. The figure of 1600 is out of the blue, they must have taken my previous returns into account or something? What really worries me is that people have stated in other areas of the web that they have sent bailiffs or threatened this multiple times, I'm young and live with my parents so that wouldn't be good for something I didn't do any wrong with. My idea is to gather everything I have as evidence and send this directly to dwf, Is this the right thing to do?
  13. I have received a second letter from DWF regarding an order I made at a clothing store in august 2021. It says: “Whilst our Client processed the refund they never, in fact, received the products. The refund was, therefore, made as a result of a mistake.” They also said this: ”Ignoring this letter will lead to us seeking our Client's instructions to start court proceedings against you - making a claim for the recovery of a payment made under mistake - without further notice to you, and may increase your liability for costs. Further our Client would be entitled to claim interest on the amount refunded.” This order was from August 2021. They said the tracking information shows it was refused by the recipient who was not their client. I am told it was returned to me but I never received anything. This is from so long ago. Do I carry on ignoring the letters?

  15. I returned two pairs of shoes that I bought from Adidas over a year ago. One of the shoes was £250, the other was £180 (yes I know, I was young and wasting the money I was earning at my part time teenage job). I thought the shoes were too expensive for the poor quality that I received so I decided to return them. I returned the £250 pair of shoes and it was perfectly fine, got refunded, no issues. For the pair which cost £180, I thought I had returned it, but I had mistakenly sent the wrong parcel, thinking it was the shoes. Adidas therefore informed me that I had sent the wrong parcel and didn't refund me for it, which I had no issue with in the end, because it was my mistake. I missed the 14-day returns window for the shoe and decided to keep it. Fast forward a year later, I have moved house and gone back to the old house to discover that DWF have been sending me letters for the last 8 weeks saying that I owe Adidas £430 (£250 + £180, I presume). They're saying that I have to pay or that they will take further action and all this stuff. Whats confusing me is that, one of the pairs of shoes, I was never even refunded for (as I said, I sent the wrong parcel), so why would I owe money to anybody? The £250 pair I sent back and was refunded for accordingly. I have a few questions about this situation: I presume everyone on here will tell me to ignore but I was slightly more worried because £430 is a lot more than the amounts I have seen on here, so I was wondering what I should do in this scenario for such a large amount? Can they take me to court? Is it true that these kinds of things can eventually affect my credit rating? DWF have said on their letters that they can affect my credit score? And lastly, if I do continue to ignore them as people frequently say, are they just going to send me letters forever and ever and ever? Forgot to also mention that as I said I have moved house, so I don't actually see any of their letters. I only saw these as I had to collect my credit card which got sent to my old house. Do I need to get the mail forwarded to this house or do I continue to ignore it and leave the letters? I just don't want a bad credit score or to go to court for the love of God.
  16. Hello, I did a adidas order around November 2021, returned it. Today I got a letter from DWF saying that I owe Adidas a lot of money for the returned goods, which I believe was either lost in transit or something. I am worried because I am only 19 and i’m not aware of all of this type of stuff. After I got the letter I rung them and asked about payments plans but haven’t set anything up I apparently owe them £400 Any advice on what to do what be greatly appreciated, do i pay? do i ignore them? I am only 19 and really worried about this Thank you.
  17. Hi dx100uk! Many Thanks for your soothing message, made me feel better! I am terribly sorry for my late response!!! Reason of what’s happening in Turkey! Helped my tension to drop down a bit.Many many big thank you!!! From now on I hope I do not receive any letters. However, if I do get a letter from DWF I will post here first for advice rather than making immediate payment as I originally planned. After reading some threads about these types of claims I feel a more reassured that I don't "HAVE" to pay and can put up a fight. Although I am still worried about any repercussions if I do that. I already paid for two box of blueberries and left the other stuff. But I did not get the paper receipt, because I never get the paper receipt in the self-check out. Can they now insult me to steal everything although, I gave unpaid items back. And they are all saleable condition. All I have now is proof of bank statement for Waitrose nothing else.Because, I did not printout the receipt on the self-check out. Can I ask about RLP and DWF, for those people that do make the requested payment, who actually gets the money? It is the supermarket ultimately? Is that why they pursue Civil Recovery via these types of companies? Or does the retailer and RLP/DWF split any money that people pay? And If I refuse to pay money to RLP/DWF, can they take legal action towards me? Also what are the chances of me being pursued by DWF? Is it a bit hit and miss/luck of the draw as to they come after or is it pretty much guaranteed that places like Waitrose / John Lewis and all retailers pass on my details as standard policy? Also, Now I am very scared to go into Westfield Stratford city shopping centre and the Stratford underground station because of what’s happened in Waitrose. Because, Waitrose in the Stratford shopping centre if they informed and shared the incident CCTV images with the shopping centre security guards, now I cannot go into any shops in the shopping centre!!!   18. Hi, I'm sorry if this is in the section I'm new here, this may be more appropriate for the "legal" section but I'm not too sure. I received this letter and didn't know how to respond as the order in question was returned and I think I may even still have the postage receipt somewhere. But it was months and months ago now and they are telling me it hasn't been returned, has anyone else dealt with these issues in the past? If anyone has any guidance on how to respond and if I should respond to baseless claims like these please let me know! DWF.pdf

Adidas (paperwork to be sent to DWF) Date of issue – . 24/01/2023 Particulars of Claim What is the claim for – 1. the claimant sold and delivered goods to the defendant. 2. The defendant subsequently invoked the claimants returns and withdrawal policy. Whilst the claimant processed a refund to the defendant in the sum of £3,996.17, it discovered the goods were never received back. 3.The claimant had therefore made the payment to the defendant as a result of a mistake. 4. It then demanded the sun on 24/07/2022z the defendant has failed to pay all or part of that sum. i.the claimant is entitled to repayment of said sum and further claims Interest pursuant of s.69 of the county courts act 1984 at the rate of 8% from the date the claimant demanded payment totalling £612.28 and continue using at a daily rate of £1.04. AND the claimant claims against the defendant 1) the sum of 3996.17 2) damages in the alternative 3) interest as aforesaid 4) costs What is the total value of the claim? 4768.45 Have you received prior notice of a claim being issued pursuant to paragraph 3 of the PAPDC (Pre Action Protocol) ? Original creditor is adidas but paperwork to be sent to DWF so I assume the debt has been assigned to them Were you aware the account had been assigned – did you receive a Notice of Assignment? No Did you receive a Default Notice from the original creditor? No Have you been receiving statutory notices headed “Notice of Sums in Arrears” or " Notice of Arrears "– at least once a year ? N/a Was there a dispute with the original creditor that remains unresolved? No contact from the original creditor, DWF popped up out of nowhere. Provided evidence of me returning the items to them such as tracking and confirmation from adidas about receiving the items but they claim it was automatically generated and goods not received Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? No, was advised to ignore DWF letters
  21. Thanks for your response cjcregg, I understand that FOS won't & can't do anything now there's a consent order in place thank you. I didn't receive any sort of draft order, other than what was attached in the OP (redacted - compressed). "You can settle your outstanding finance balance in full – as a reminder, the amount you would need to pay is £12747.98 by 26/05/2021 OR We can see if we can agree a Consent Order with you, which is a way of agreeing an affordable, sustainable payment plan with us so you can pay back what you owe gradually over time." I agreed to move forward on clearing the arrears via a CO in May 21 and provided payslips at the time. I then received confirmation that the payslips would be sufficient from Moneybarn on 28th May 21. "I can confirm that in relation to our correspondence earlier today that these payslips are sufficient to meet the criteria that we need when applying for a Consent Order. I have now passed these payslips over to the department that will review your circumstances and issue a letter out to confirm what your repayment amounts will be moving forward to clear the arrears. No further action is required from yourself until this letter has been received." Didn't hear anything back until I received documents stating a court date in February 22 (received Nov 21). I then frantically tried contacting Moneybarn for a week and couldn't get through to them via multiple emails and phone calls. Ended up emailing the CEO 15th Nov and received a response the following day from his secretary stating the case had been passed to DWF solicitors. Contacted DWF who said they were now in charge or arranging the CO, and asked for an updated I&E document, which I promptly provided. I also queried the amount they had as outstanding owed: "Can I also note that the amount DWF have noted that I owe Moneybarn is £16,485.00. But on my online portal that I have been making my monthly payments on, it states that I owe £15,243.00 which includes any arrears. That’s a £1,240 difference which is 3 months' worth of payments of £414 that I have made that haven’t been included. Can you confirm what the next steps are please? Do I make an offer, or do you calculate one based on the attached I&E?" To which their response was: "Thank you for sending over your income and expenditure form. We have reviewed the details, however before we are able to consider a payment arrangement, please can you confirm when the last payment of £414.00 was made to Moneybarn? We will request an up to date Statement of Account from them so we have the most accurate agreement balance." I then provided evidence of all payments made since the £803 made in May 21 to clear some of the arrears before they'd consider the CO. Heard nothing for a while then was hit with: "Please can you confirm if the payment of £414.00 was made to Moneybarn in December as this would decrease our outstanding balance. The current balance we hold is £15,835.00. To clear this within the 27 months remaining on the agreement, you would be required to pay £586.48 a month at least. If you are happy with this, please let us know the start date for the arrangement and we can see if Moneybarn will accept it." I clarified December's payment was made and offered £550 per month. They accepted the offer: "We have been advised by Moneybarn that we are in a position to accept your repayment offer. Could you please advise as to what date you would like to start payments so we can set this up for your file?" I then set up a DD of £550 per month to DWF. Until the CO was approved. I then continued to make payment to DWF as instructed in the CO. Received an email stating I hadn't made a payment, from Moneybarn and that I was in breach of the CO (due to the delay between DWF sending over the payment to Moneybarn - I had definitely made the payment on time and had evidence). Some back and forth between me and Moneybarn and they eventually agreed for future payments to go directly to Moneybarn and I haven't missed a payment since. In relation to your question - I never had an official draft CO offer. I just made an offer of repayment to clear the arrears, which was accepted. I was told I didn't need to attend court, it would all be sorted out for me. "If the terms were different to what was agreed with you then you should, in the first instance, query it with the other side and suggest they apply for a new consent order accordingly and at their expense. If they refuse you can then apply to the court to vary the order to the originally agreed terms and request that the costs of the application be met by the other party." - I appreciate this information, thank you - I will approach Moneybarn and highlight that the CO was originally agreed to clear the arrears - not for the full remainder of the agreement and see what happens.   22. Hi, I received a letter today from a debt collection law firm threatening CCJ action on behalf of Volvo/Santander for a voluntary termination of a vehicle. (I did request Volvo/Santander that a complaints procedure be started as I think the terms of the contract were miss sold but alas, they ignored me and went straight to CCJ action via a debt collection law firm!). I digress, the letter was addressed to me, it included my original signed contract, but, there was another document inside. This document was another hire contract with some other person details on it! It includes: Their full name Their address and postcode Their handwritten signature Their email address Their mobile telephone number Their debt amount Their vehicle registration Is this a breach of the data protection act? On the flip side, my details could be in the hands of someone else, who knows? What should I do now, is this a trump card that I could use if this matter does actually go to court? I did intend to argue against this debt in the first place. Any advice on this would be most grateful! TIA
  23. From reading various posts on here its looking real bad for DWF. Adidas themselves haven't even attempted to make any contact, this has been escalated to DWF directly for whatever reason. The order was so long ago i had to look back through emails to find proof of the return just in case. They haven't even mentioned any items just a figure and the letter even says "do not contact our client" which is laughable. But i saw 2 money claims on here which was shocking, how they think they can win any case is ridiculous. But thanks for the confirmation, I will just wait
  24. My 14 year old son shoplifted sweets from Sainsbury's to the value of £8.25 and was caught, questioned in a back room, banned and then sent on his way. All without any parent contact or an independent adult there when he was questioned. Never been in trouble before. Police not contacted. A week later, a letter was sent addressed to my 14-year old son from DWF Law LLP (see attachment - names deleted), acting on behalf of Sainsbury's, demanding £158.25 - £150 for security costs and £8.25 for value of goods stolen (which were returned undamaged at the time of being caught). Still we were not informed - no communication at all with us, the parents. Suffice to say we will not be paying this as I believe DWF Law LLP have made unlawful threats to a minor and acted with complete disregard to the welfare of a minor. From my understanding of threads here, they don't have a legal leg to stand on. I have contacted the Legal Ombudsman to raise my deep concern at this cynical and unlawful behaviour, which seems to be quite widespread (Citizen's Advice Bureau raised Boots doing the same thing). I wonder what my son may have done if he had opened that letter alone and we remained none the wiser? Another real concern is that this practice is very likely being dealt out to vulnerable children. It's truly shocking. The threads say to ignore any letters/communication from DWF, which I am happy to do. However, while acknowledging my son's behaviour was completely unacceptable, I want to challenge Sainsbury's as I am horrified that all this can happen without the knowledge or communication with parents. Would you recommend having dialogue with DWF, as mediator suggested, or just leave it Not sure what dialogue he expects me to have, although I did say to him that the figures DWF had quoted as my refunds don't match my info from Adidas. Worth clearing that up with them i.e. how they have come to that figure ?
