  1. Has anyone seen this: https://www.fca.org.uk/your-fca/documents/requirement-notices/preferred-mortgages-limited-vreq I have a Preferred account and have been in constant battle over fees. I received a letter today to say they are refunding overcharged fees from 2009 - 2012 and they have entered into an agreement with FCA to refund overcharged fees plus 8% interest. The fees in the scheme include: Arrears management fees, Litigation management fees and Repossession Management fees.
  2. Hello, my name is Adrian. Facts: I started a contract for broadband and landline with international free calls, last year September/October, in Wales, with EE. Due to the fact that I had switched jobs, I also had to move the house, therefore, I relocated myself in Crawley, West Sussex, on 20th of June this year. Prior to leaving the house and relocating, I searched online, and phoned EE to make sure they have coverage and that they can provide me with the same service. Everything was fine, they said that they can service it, same price, same package. On the same day, around 1730 hrs, I went on to the local store EE in the Council Mall, in Crawley to get an update on the moving of the service. When I got there, the lady there, said that they cannot cover my postcode with the same package, and that I should take the matters with the Customer Service. She called to the Customer Service, the Moving House department, at which point they again confirmed that the only thing they can provide me with is a lesser bandwidth for the broadband. I told them that I am not OK with it, and on the spot I argued the fact that over the phone, once I planned the moving house, they have stated one thing, so that I find out that that's not true anymore. Another thing is, they told me over the phone, that the landline number should work, and was not. The lady there sent me to close a contract with the competitors, Virgin Media. Since I didn't want to take a decision then, at that time, I postponed this for the next week-end. The next week-end, I went back to EE, and told them that I have signed the same day with Virgin Media, (only for broadband), and that I would like to have my account with them to be closed. The young lady there seemed helpful, and said that she will do that, and I don't need to worry about it. I have also stated that the landline number is not working, though it should have worked, since it appears to be active in their system. Since I had already my DirectDebit with them, and closed that the same day, after they made their final payment withdraw, I thought that everything will run smoothly and that I will receive an update on my email about the last payments, etc, etc, as it happened with my other accounts that I closed in Wales. No brainer, no muss, no fuss. My problem goes like this: I went on today to EE(to a different store, in Crawley), to find out why I have received emails from EE stating that the payments couldn't be made towards them, since: 1. that lady should've closed my account (I was naive back then, I know) 2. I have closed/cancelled my DirectDebit with them. 3. they couldn't provide me with the package I had Just today, I found out that EE, can actually provide those services within the area I live, and can give me the exact same package I had in Wales. I had ring Virgin Media to tell them that I want to finish my subscription with them, since, they cannot provide me with the same deal, at which point I was told that I have to pay them £143.69 for the remaining contract. Honestly, for some reason, I don't think the Customer Service, nor that lady from EE, treated me correctly, and I was mislead to think that things will be sorted out, etc. I was under a lot o stress back then, (and now when I come to think of it, a little bit naive) since I am a software programmer, and needed the broadband, and fast. I don't know how to deal with this, nor what legal actions to take against it. Should I pay, should I make any complaints? I wasn't presented in detail with my options, and I was just passed from one "dealer" to another, when my only need was the broadband. Can you please give me an advice on how to proceed furthermore with this? Thank you. Kind regards, Adrian.
  3. God what a mess!! I will try and explain this as best I can but I have gone so far and don't know if I am doing this right. I have two accounts with Santander which makes matters worse coz I'm not sure if I should now separate them into two claims: 1 account I had a £1000 overdraft on it and I used to pay £20 per month for the privilege, I need to clarify this detail as they have removed the account so I cannot see the statements anymore but I think I forgot to pay the £20 one month. My wages were now with another bank but as long as I paid the £20 Santander were happy with the overdraft just sitting there. As I forgot this is how it escalated in bank charges from £45, £100, £150, £150 & £120 so now the amount owing is £1604.99 of which £565.00 is charges. I have a 123 account which went £9.95 overdrawn and then after a few unpaid charges of £5, £10 they started putting on big charges up to £380 pounds. I recently paid this account £81.23 which is what I felt I owed them and this now leaves the £380 in big bank charges. I phoned Santander in December and they did an income and expenditure with me over the phone and said I needed to speak with Stepchange as I stupidly got mixed up with Payday loans. I wrote in April and they were going to go through my Income & Expenditure but never heard back from them by phone or letter. I wrote a LBA and I have just received a final response saying sod off basically. Do I really have a leg to stand on or should I take it to the Financial Ombudsman or Small Claims Court and see if they are bluffing? I should mention that the £1604.99 amount has been passed to Robinson Way and they have registered a Default. All I wanted them to do was to remove the £565 in unfair bank charges so that I could set up a payment plan for the remaining amount and start repaying my overdraft!! The £380 they are threatening me with a Default at the moment so I expect any day this will appear on my credit file. I explained in my letter that whilst an account was in dispute they can't do that but they said that as far as they were concerned my accounts were not in dispute!!

Hi team, looking for some advice I have beaten a very serious gambling addiction a few years ago for which I received professional help, but, left my Santander mortgage on the brink of repossession, over £6k in arrears for a number of years, have worked 7 days a week, 72 hr weeks on overtime to pay the arrears off, and as of last year it is now up to date I am scared to think of the charges they made on me for my arrears specially as it went to solicitors Aberdein Considine twice, and they charge£££ hundreds if not more. Now that I am up to date do I have any recourse to claim the charges back? I was never offered interest only etc. Any advice would help
  5. Hi Everyone I'm currently trying to get all of my finances sorted out had a few catalogues which resulted in me building up late payment fees. Sorry if I'm really dim but looking at the debts on my credit file I see that I've been charged almost £300.00 in late payment fees alone. I'm not trying to dodge these but trying to understand should I be paying these or should it only be the default balance itself that was passed to debt collection agencies? Thanks Matt
  6. Hi in Sept 2010 I started a p/t degree course. I started the course and then found full time temp job. Jan 2011 found f/t permanent job that meant a lot of study and time away and I could not continue with the Uni course. The course fee was £1920 The Uni gave a grant of £985. I am now being chased by ACT credit for £1920. I haven't contacted them as yet so any suggestions would be helpful. I have the original documents setting out amounts given above.
  7. Husband and I were sold a Platinum joint account in November 2008, having previously had a Classic account. From memory, we had been invited to see our bank manager for a review, and were sold the new account on the basis that the overdraft interest was lower and the package benefits were worth much more than they would cost us. At the time, we already had AA cover (as noted in the paperwork the bank manager signed at the review) and explained that, with two children, 3 and 8 months, we hadn't travelled abroad for over 4 years and had no plans to. We have never registered our mobile phones. Shortly after the account was upgraded, the package fee increased from £12 to £17 a month - I can't find any notification of this (but it's possible it's been lost over the years). My husband has used the AA cover, but bearing in mind we already had cover at a cost of £120, this one benefit equates to a cost of £204 per year - definitely not a saving! Do we have a case for mis-selling, given the benefits were of no use to us - or does the fact we used the AA negate any claim?
  8. Hi - here's hoping!!! I have a current account with Barclays bank (BB) which has an £2000+ overdraft which is always being used to the limit. It only gets reduced for a couple of days when we get paid. What is happening now with their new charges for every day the account is in overdraft is that my monthly fee has more or less doubled. I just used to pay interest on the OD which was about £40 now its around £80/90, which I feel is very unfair. I did contact them to ask about a refund (as you previous helped be get the charges back, saying that I felt it was unfair and did not cost them that much) but now they are saying they cannot. I know the only solution is to not have an OD but unfortunately that is not going to happen for a very very long time or if I win the lottery. Any advice on this. Kind regards Sharon
  9. Are early redemption fees are claimable ? Just we had a secured loan for 18,000 then needed to borrow more so got a 36,000 secured loan and was charged exit fees and it was the same company (ge) this was about 8 years ago . Both loans were through a broker and I have the paperwork .
  10. Hi All, After a very recent successful PPI claim with Aviva I am looking at my other paper work/finances and wondered if you could help me please. Being very young and naïve I took out a mortgage on a low income when I was 18 with Norwich and Peterborough and fell into arrears this was in 1998, the situation escalated and we remortgated firstly with Preferred and then with GMAC who we are still with now. We managed to stave off repossession and I am thankful to say we have worked bloody hard in our employments and are in a much stronger financial position. We did however during the three mortgages gain mortgage arrears charges, administration charges, charges for sending a debt councillor to our homes, solicitors charges and also early redemption charges. Are any of those reclaimable? I have also from a bit of reading seem to think we may have a case of miss-sold mortgage between preferred and GMAC as the broker was well aware we were in arrears however did not properly assess our affordability for when we came out of a fixed rate period and the surveyor actually came in the home asked what we needed to borrow for the mortgage and wrote that down as the valuation without actually looking around our home. Is this true? Also my spare time is little as we have a beautiful severely disabled daughter so I fight battles on a daily basis so despite the fact they take a percentage for something as complicated as this seems would much prefer a cmc and can anyone recommend a good one? Claiming back PPI was easy but I am presuming (may be wrong) this will be much more complex. Also with the PPI Welcome rejected the PPI from 1999 and I have hit a brick wall as they were unregulated in those days - am I right to close the door on that chapter? Thank you so much for your help - the recent PPI claim you lovley people helped me with (2800.00) is paying for some very much needed adaptations for my daughter so you will never know how much this means.   11. Hi there. I've been living in my flat for over a year now, and we recently renewed our tenancy. The letting agent charged us a renewal fee of £132 (£33 more than the initial agency fees). When I asked what this money was for, they claimed it was for a credit check, among other checks (including checking with the bank that I had the income I stated.). I'm curious about their claims. For example, for the past few years, I've been hot on my credit report, and I'm well aware that they didn't carry out a credit check through any of the three main credit organisations. They also didn't check with my bank a second time, (they did the first, but I had to pay an additional £10 for this, so why I paid the fee for this, I don't know..) Are these fees unfair, given that they didn't actually cover what they stated, or is this just something that I have to accept?

  13. Hi, I would really appreciate some advice regarding debt collection fees. I had an original debt with council tax for the amount of £107.80 which got passed on to Jabobs debt collectors. The amount they are now claiming is £417.15 which is made up of the original debt, a £75 compliance stage fee and £235 for attending the premises. Is this all legal? Like I say any advice would really be appreciated. Thank you in advance.

Hii every one, I have a serious problem with Xercise4less gym as i signed up for one year contract by the end of my contract I have had no intention to continue i went to the gym and asked the reception lady to make a cancellation for my membership in November she advised me that i have to cancel my membership by 14th December to avoid extra charges, i came back on 14th of December and made my cancellation, i received a letter from Harland group asking me for £34.99 for a returned payment £25.00 and £9.99 for January monthly installment they asking me for another 9.99 as a fee for cancellation if i want to cancel!!!!! which is very weird as i already cancelled my membership and I have already on my hand a copy of cancellation. please advice me what to do and where to go to complain such fraud/false re question of payment as i really want to take this further. I already read back all terms & conditions and didn't nothing mentioned about that at all. many thanks and all replies are appreciated
  15. Hi, Chanced on a stack of bank statements yesterday and noticed that my account had been upgraded for 3 years to a First additions account, with a monthly fee. Now, I seem to remember that I had to upgrade to the First Additions when I asked about increasing my overdraft. They said I could only do it if I upgraded. Classic mis-selling then. So had a good wade through all the statements, completed a spreadsheet and now sent of with a letter claiming fees plus interest back. Be interesting to see if I have another battle with Barclays. Better dig out all the SAR stuff from my previous encounter. Jedicris
  16. Letting agents’ fees should be banned to protect tenants in the private rental sector, a new Citizens Advice report has urged. New evidence uncovered by the charity reveals tenants are frequently ripped-off by fees often hidden by letting agents – to the tune of £337 on average. These charges come on top of advertised rent prices and deposits and in some cases can force people into debt, the charity says. The Still Let Down report says letting agents have refused to adopt measures that were supposed to bring transparency and competition to the market. Most agents charge for checking references, but costs range from as little as £6 to £300, according to the study. Renters can also be hit by charges ranging from between £15 to £300 for simply renewing their tenancies. Some agents charged £300 for credit checks that are widely available for £25.   17. Hello, I am hoping someone can give me some advice. I have a £10,000 debt with MBNA which resulted in me going to court and a charge being placed against my house. Basically I pay a set amount each month, but if I sell my house they get paid the full amount. The only problem with this is my house is in negative equity to the tune of around £30,000 Due to a serious operation it looks like I may be dismissed on capability ground as Occupation Health feel I am no longer able to do my job and due to cutbacks there is nowhere else to place me. My debt with MBNA is managed by Optima Legal who have said they will only accept offers of 85% of the debt. If I can offer less they have said they will put it through to the 'client'. I have spoke to MBNA who have said that it is Optima who make the decision. Prior to the debt going to Optima MBNA offered me a settlement figure of £2800 which I didn't have at the time. I'm trying to do the right thing by sorting out a settlement figure now - before I lose my job as I am pretty sure once that happens the amount I will be able to pay them will drop to literally a couple of pounds a month. Has anyone any thoughts or experience of what figure MBNA would be likely to accept? Thank you for reading this far. Hx
  18. Hi need some advice please I had a 82.00 parking fine that I didn't pay (stupidly) I was unemployed for over 4 months had letter from marstons with 70 fees on top. Seeked advice from cab and Baines & Ernst , emailed marstons to offer £5 a week repayment ignored! Then got a 2 nd letter from Marstons debt now 397, which I rang and complained as to why they didn't accept my repayment offer to which they replied was withb bailiff!!! And to speak to him which was a waste of time he wants all the money... I'm now working so I paid my original fine of 82.00 via website which I was suprised I could do So now a week later a baliff has been posted a FINAL NOTICE to pay £310 today Do I have to pay these fees?

Hi I hope someone can help on where to start our secured loan has just finished and we made our last payment on 1st April 15, 120 payments later thinking loan was paid off, we had difficulties in the past been made redundant and business venture not working, we got into arrears these have all been paid back within the term of the loan. We claimed our PPi misselling back a few years ago direct with Ge they offered us £8000 but our arrears was £3000 roughly so they took that amount of the payment and sent us the remainder. Now we have received a letter stating that they want £2299.45 by the 9th may for outstanding fees and interest on a sub account this was a secured loan and I have asked if this balance is held on the property to which I got a reply we will have to check with our solicitor. I'm hoping someone can advise on where to start either get the ball rolling on not paying these fees? or will they take me to court over them even though I have kept to the original agreement of 120 x £??? and loan paid of within set timescale do you think I should do an SAR ? and ask them to freeze intrest until I get reply I don't know where to go. the original loan value was £15000 over 120 payments
  20. Hi Guys, I have had ongoing correspondence with opos regarding a loan I took out with MiniCredit almost 2 years ago. After repeated requests for them to provide me with a completed breakdown of the claimed debt including charges/fees/interests I have finally received the below. They are attempting to claim £1,187.50 on an original loan of £150! Would appreciate any advice on how to respond. I am sure the Debt recovery fee and attempt fees are unenforceable. Here is the requested statement : Loan reference: Date issued: 01/09/2012 Due date: 25/09/2012 Loan principal £150.00 Interest £217.50 Overdue charges £80.00 Debt Recovery fee £100.00 Attempt fees (£5 per attempt) £640.00 Total balance £1,187.50 Payments received 31.10.2012 £100.00 05.11.2012 £100.00 Sincerely, Derek Thanks in advance guys.
  21. Just in case anyone is interested - I had an Additions account from the end of 1998. I was told that this was the account I had to have when I finished my studies and was no longer a student. Unluckily for Barclays, I kept ALL my statements! So when I heard about reclaiming charges, I added it all up and sent in a form. No arguments - they paid me back all the fees plus 8% interest per year, even though the account has been closed for a couple of years. I also sent in a claim for the Overdraft PPI that I was charged for many years. Got that back too! Good luck to anyone else reclaiming. Just thought a success story may be useful to hear

  23. Hi im new here so i apoligies if this is in the rong section. Please some one give me some advice. I am privately renting a property. When i first moved in it was me my partner and my son. Due to some difficult circumstances me and my partner have seperated. I informed the estate agent it will just be me and my son living at the property. They called the landlord and he had no problem with this. Now the estate agent want to do a brand new tenancy agreement with new fees. Now im happy to pay fees for a new tenancy agreement However they have said they need to re-refernce check me of a charge of £150, and also re reference check my guarantor of a fee of £100. Now when i first moved in i already payed for these checks and dont they still stand ? nothings changed apart from my partner moving out so why should my guarantor have to be re checked when he was liable for full rent anyway? So they have sent me a section 21 notice to vacate in 2 months saying the landlord wants me out. However the landlord has said its fine they just want me out because i refuse to pay for checks ive already payed for?. In the section 21 it has also said i need to pay for proffesional carpet and curtain cleaning and show them invoices for this . There says nothing of the sort in my tenancy agreement just that it should all be the same as the pictures in the inventory. Now i have 2 months to either pay which i dont see why i should pay for something ive already payed for a year ago. Or be made to move?. Also my deposit is in a deposit scheme so if i find another private rental how does it work with my deposit being transferd? Sorry for such a long thread just need some advice? are the estate agent allowed to do this? when the landlord is happy for me to remain in the property with my son?.
  24. Hello - I made appointments with 4 solicitors for free advice about my divorce, one of them carried on chatting away after the the free alloted time. She didn't mention I was going into paid time, and now I have received a bill for £135. So far I have seen 6 solictors on this basis and all have outlined what they can offer me, and given free advice. But this one solicitor decided to charge me. Is there anything I can do?
