  1. I have today received a letter from income support asking to deduct money for a social fund loan I had six years ago. How do I know if this has already been taken. I remember deductions at the time and I can't see them waiting six years to take back money

Hi Everyone Can anyone provide any advice on how I should complain and attempt to get the original Business Loan Repayment Insurance Cost and subsequent Bank Charges back on the following:- In 2004 we had a Limited Company who banked with Lloyds TSB, when we needed to consolidate the debt of the the Overdrafts with this bank. We took out a loan for £40,000 plus a charge of 7017.00 for Business Loan Repayment Insurance and a £400.00 Arrangement Fee, this was secured by a Guarantee and Charge over our Property. We had many problems during the period up until 2009 when we allowed our company to be struck off by Companies House. We paid all outstanding Creditors off. We had many Bank Returned Fees during the period 2004 - 2009 which added to this Limited Companies demise. We started a Partnership in the same business and Lloyds provided a New Loan ro clear the outstanding Bank Accounts of the old Limited Company. This amounted to a New Loan with the same Guarantors as with the old Limited Company, the loan was for £70,000 with a £1,000.00 Arrangement Fee. This was the amount outstanding plus a small working Overdraft. The outstanding figure would have been £7,000 less if we had not been forced to take out the Business Loan Repayment Insurance in 2004, and I note they never pushed this Insurance for the New Loan with the New Partnership. When they closed the old Limited Companies Accounts they ommitted to open the New Partnership Accounts and as such we where paying continued excessive Interest and Charges on the Old LC Accounts even though it had been closed. One of our old customers paid an outstanding invoice via BAC's to the old LC Account and the Bank transfered this into cyberspace and we have never received into our new account, even though we have complained about it many times. The banks actions over the years have caused the new partnership considerable financial hardship and continue to do so. Please Help!
  3. Advice needed please. I am having difficulty in finding letter template to claim back Vanquis Repayment Option Plan payments. Can anyone give me the correct wording to use. I phoned them to ask for the payment to be refunded and they have written to me to say ROP is not the same as PPI (which I already know) but my point is that I never asked for it in the first place because I would never envisage requesting a payment holiday as I am in full-time employment and even if I was sick I get 6 months full pay. So the upshot being, they froze charges etc and all I pay back is the amount borred plus the initial interest. Regards
  5. Morning all, Went to court a few weeks ago for a reposession hearing on my house, judge granted it at £81203.00. I have been very lucky in sofar as i managed to find a buyer that has agreed to let me stay in the property for a year minimum, providing i agreed to a lower sale price (87500). Based upon the fogures given at court i agreed and am just about to exchange contracts, but the halifax have decided to add on nearly £4000 in early repayment charges, leaving me with nothing. Going on the figures given at court, i have requested these be waived as the origional ammount was misleading and not a true representation of the final ammount owed?? anyone else got an opinion??

I've gotten into the PayDay loan spiral of rolling over loans over the last few months, I've always paid on time but have found that I've been constantly borrowing more and need to put it stop to it. My finances are a mess this month and my bank account will be cleared straight away once my salary goes in on Friday, therefore I only see the option as defaulting on the loans so as I have money to cover rent, expenses etc. for the month and setting up payment plans to get everything paid off and get myself back in the clear over the next 12 months. I owe approximately 1400GBP with Wonga, 1100GBP with SwiftSterling and 388GBP with Quick Quid. I've read on here that the PDL companies can access my account even if I cancel my debit card..is this true? I bank with HSBC and my salary transfer for this month is already in progress so I don't think I can shut my bank account down now at this stage..does anyone have any advice on what to do? I have another bank account at HSBC which is a joint account with another family member who has no idea of the financial mess I have gotten myself into I don't want her finding out. I presume they can't access a joint account, I would ideally prefer to remain banking with HSBC. Am I better to contact the PDL companies before Friday to let them know to expect the payment to default? I am looking at requesting a 12 month repayment plan with Wonga and SwiftSterling starting from August and a 2 month repayment plan with QuickQuid starting this month. Is this achievable do you think? I'm also worried about them calling my work, its the last thing I want my work colleagues finding out about. Thanks Michelle
  8. Hello, I am looking for some advice on a situation that my daughter has found her in recently. She went on maternity leave at the end of Jan 2012 and is still continuing this still. She recently had contact from her Companies New HR manager saying they had no knowledge of this Maternity leave. So the company have been paying her full salary instead of the reduced maternity amount for 3mnths, also and in lieu of 1 month of SMP. As she was on supposed about 90% salary for the 1st 3 months (but got 100%) and now is on SMP which is about 50% salary. The amount owed to date totals about £1200. Now of course the company want to recover this. And my daughter is happy to, but not at the amounts the company want as it would cause her considerable financial hardship This whole situation is now exacerbated by my daughters ex partner losing his job recently and now not being in any position to pay any maintenance She realises she should have been more aware but during the 1st 4 months of my new grandson’s life, she has been fully occupied by him and just not noticed the 10% overpayment. NB she has copies of emails from the previous HR manager thanking her and confirming receipt of all the necessary documentation of this that was sent in at the correct time. All these docs & emails have been resent to HR along with the confirmation email evidence. There was a change of HR Managers with a gap of 1 month with no manager around the time of the start of the maternity leave. Yet HR still insists they have done nothing wrong!? The whole situation is also known by my daughter’s line manager. Who was helping sort this all out? NB As the line manger is being very supportive , HR are now trying to keep her out of the loop, by staying its all a personal matter and they can't discuss it with her . She want to pay it back but the the company is presently insisting on a payment plan of either a lump sum, or £200 per month , off of her current 50% salary. (This equates to about 300 per month income + child and working tax credits.) £300 won’t even pay for her Council housing! She has offered to pay back a lesser mount and we are awaiting a reply. The whole situation has not been very amicable as the new HR manager has strenuously denied that HR has done anything wrong and has always accused my daughter of being at totally at fault, by not noticing the increased amount. HR seems to not care about looking after a new born and the fact my daughter does not drive Hope this all makes sense ? . Any advice here would be greatly appreciated.
  9. I have been paying RBS an agreed amount every month to clear an unsecured loan for the last 2 years, which is reviewed every 6 months. However I have just had a letter now saying that they will not accept the same amount as my 'offer of repayment is unaccepatbale due to your housekeeping and travel expenditure being deemed excessive'. Not sure how it is now excessive when it wasn't 6 months ago! Any advice?
  10. I had sent this email to Wonga asking for a repayment plan Hello, I have tried to contact you via the website but have had no response. My income has dropped recently due to a change in tax credits. I will not have the money in the bank to cover the payment due on 23rd June and I do not want to keep extending my loan as this will ultimately just make it harder to pay it off. I would like to arrange a repayment plan over a period of 10 months via standing order for the loan I have with you as I can not afford to pay it all in one go. I would like to do this rather than defaulting on my loan. Please do not phone me as I am not allowed to take personal calls during working hours.   11. I appealed on 27 March and received decision 25 April and was successful. The letter stated "revised award notices ... will be sent shortly" and I am still waiting and they owe me money too! I called yesterday and was given some waffle about "technical problems". I was told some other people had the same problem. Is this some ploy to not pay people what they are owed. They are quick to demand repayment but stall when they owe us money. I was given an address where I could write to complain but no info on when I can receive a revised entitlement letter or indeed my money!
  12. hi i have with wonga due to be paid at the end of the week i have no way of paying it nor the extension fee. ive heard wonga are very helpful with repayment plans im just wondering do i email them now saying i cant repay or wait till i default?. also who do i email there seems to be alot of addresses flying about? thanks any help appreciated.

Hi there, I left Northern Rock about a year ago, the redemption fee on the mortgage, early repayment fee or whatever it is called totalled £6000, is it possible to claim any / some / all of this back or is it a lost cause? If there is even a chance of claiming any of it back, what would be the best way to go about this? Thanks, James
  14. Hi everyone been looking around this site and think its amazing so thought i would post a thread on situation. I have a loan with Wonga which is due next week at the balance off 1250. I am really struggling to pay this or the rollover charge and really want to enter a repayment plan with them. my question is will i have to default on payment date for them to accept a repayment plan or has there been any success of agreeing before defaulting??? I have red that its best to do this by email instead of phoning is this true? any help appreciated thanks. i will keep updating
  15. Hi guys, Would anybody be able to advise me how to get my tenancy deposit back? My situation is quite complex, but I will try to cut the long story short. I moved out from the property six months ago. I'm dealing with the Agent, not the Landlord. The deposit is with DPS and I'm abroad. When I moved out I left the property in a better condition as it was when I had moved in. I have the Check in and Check out Report and the photodocumentation of everything from the date when I moved in and from the date when I moved out. The Agent tried some tricks on me and claimed £500 for damages. I did not agree and said that all damage was there when I moved in and I noted this on the Check in Report when I moved in and also documented by pictures. After this they agreed to return the deposit in full saying they are only waiting for the written confirmation from the Landlord. Based on this I claimed a full deposit at DPS which they declined saying that the Landlord 'investigated' into this and even though I took pictures, there is no real evidence. They said that the Landlord is proposing £500 deduction from the deposit so I submitted my claim through DPS splitting my deposit in two parts: one to be returned straight to me and another to be 'disputed' amount (£500), whch I agreed to be solved through DPS ADR service. Again declined by the Agent (basically meaning that they do not wish to use the ADR service). In between we had long conversations getting nowhere as they kept getting back to me with the same answer: they are waiting for the Landlord's reply. I asked them for the Landlord's details, but they are very reluctant to this. Clearly they do not want to come to the agreement. I would like to know what can I do. Shall I take them to Small Claims Court? I've heard that before going to court, you must try to resolve your dispute outside court (which I believe I did, after 6-month conversation with them and agreeing to use the ADR service to resolve our dispute). Who shall I take to the Court? Would it be the Agent or the Landlord? The Tenancy Agreement is betweene myself and the Landlord, however I have never dealt with the Landlord and never met him (in fact, I only received a photocopy of the tenancy agreement signed by 'the Landlord') and all my communication ever was with the Agent. And lastly, my biggest problem is that I'm abroad. I left the UK for good so any communication with anyone in the UK is now much more difficult. How can I take someone to court when I'm abroad? I did some research and learned that you can make a claim online using Money Claim Online (MCOL). However when registering, you need a UK adress. I'm getting quite desperate here and any advice or comments will be greatly appreciated.
  16. So basically ive fallen into the trap that over the last couple of days reading on here that many others have also. It seemed so easy...fill in a form..15 mins later have 300 quid to spend.. 2 years later it has spiralled out of control and I have at one point got to the stage where i considered taking my life over it all. I have juggled 9 payday loans for 2 years and now im at my wits end and just want a way out....I have a relatively decent income 35k + and being skint after 10 days on this type of income is quite simply not on. I have the following payday loans pounds2pocket - borrow 1k..pay back 200 quid a month for 12 months wonga -1000 text loans - 300 payday express - 680 peachy 115 wage day advance 300 1 month loan 290 mr lender 390 lending stream - 600 Minicredit - 900 What chances have I got off agreeing repayment plans for all these companies...I have today done what I keep reading which is open a new bank account and get my wage paid into that new account. I can put aside sort of 700-800 to get these paid off within 6-12 month no problem...ive got myself into this mess and im going to pay my way of it. couple of questions. 1) are these companies easy to agree repayment plans? 2) what sort of amounts can be realistically be expecting to pay on these per month. 3) reading alot of bad comments about minicredit - am i going to have to bite the bullet with this one? 4) what is this £1 token gesture mean a month...what is it preventing 5) how will i pay the monthly repayment plan...which account and whats stopping them taking the full amount when i give them my card details. any help at all would be very welcomed and appriciated thanks M

Hello, To cut a long story short i was forced to leave my job on medical grounds last year, at which time i had an o/s loan of £250 with payday express which i had been rollling over for months paying £50 a time. In November i emailed advising of my situation and asked them to consider a repayment plan. I received a message advising they needed proof of illness, benefits, bank statements etc. I sent these but my countless emails got ignored, plus my letter sent by recorded delivery. I just kept getting the same automated message asking for the info again, so was going round in circles. In December they went and swiped £50 out of my bank account, which is a weeks worth of benefit for me - so they left me with nothing to live on despite being fully aware of my situation and state of health. I emailed them to complain and advised that i now consider the £50 to be part payment of the balance of £250 to bring it down to £200 as they were WELL AWARE of my situation but chose to ignore me. I then cancelled my debit card with the bank so they didn't have the opportunity to do this again. I have emailed them twice more, the last email saying i can offer £10 monthly to the balance of £200, this is my final offer and if they do not want to accept then feel free to talke me to court. I am sure any court would see £10 is excessive in my situation. They have finally emailed me today with this: ___________We would like to inform you that we are willing to accept your proposal for a repayment plan arrangement for the amount of £10 per month. This would confirm that you will be making monthly payments of £10 per month to clear your loan of £315. It would be greatly appreciated if you could inform us of the date each month that you would like to make your payments, as well as the payment method in order for us to set this up for you. Once we have confirmed this information we will send you confirmation of your repayment plan. We will stop any further action on your account until 06.03.2012 to allow you the opportunity to reply to this email.______________________________ So finally after 2 months they have responded.. but i am not happy with paying the £315.. as by ignoring me they have simply added charges on. the last thing i want is for more charges to be added but would just like to know where i stand on this and whats the best way to go about it. My options are: 1. Pay £10 monthly until i have paid £200 then send a letter advising i now consider the debt to be settled and to take me to court if they are unhappy with this where i will provide evidence of having contacted them etc, and expose their unfair practices and high APR'S. 2. Advise them now that this is my intention and then risk going roung in circles again and more charges being added. 3. Send a recorded delivery letter with a cheque for the first payment, outlining my above proposal and advising if they cash the cheque they are bound by the terms of the letter (is this legally binding??) and then if i get any further harassment after i've paid the £200 i'll be contacting a solicitor. Am i within my rights to dispute the amount? Any advice would be greatly appreciated, i have a long term illness and this is really not doing me any favours chasing after them all the time. Hayley x
  18. I wonder if somebody could give me some advice, please? Last year I split from my husband and moved overseas to get away from it all. I owe around 10K of money to various lenders - had a payment plan sorted with them (managed DMP) when I was in the UK. But due to the relationship breakdown I had to get away, quickly. I have now got myself sorted and I want to continue paying my creditors but the DMP company say that unless I can pay £50 a month they cannot help me further. Here's the thing.... I am only working part-time and cannot afford to pay anything to my debt (not even a token payment) as the money I earn only just covers my living expenses (rent, food etc). This debt is playing on my mind and I wonder what I can do about it. Should I write to the companies and tell them? I am hoping to find full time work in due course but that is very difficult..... I don't envisage ever returning to the UK and wonder what would happen to the debt if - in time - I was only able to pay a token payment. I am living in an European country. Any help you could give would be much appreciated.
  19. Any advice on this would be very much appreciated. Barclays have frozen my personal and business accounts and are demanding repayment in full. I'm overdrawn £1,765 on my personal account. The overdraft limit is £1,600, with a £150 buffer. The business is no longer in operation. That account has no overdraft limit but somehow I've arrived at £1,700 overdrawn in that as well. I have no other bank account and my credit rating is already dreadful as a result of other, ongoing debt problems. I doubt I'd be able to get another account, unless there's a very willing bank out there somewhere. I'm currently only working in a voluntary capacity. I've had mental health problems and I really don't feel as though I could hold a job down (much as I'm sure the benefits people would disagree). I don't claim any benefits at all. I've been told that I'd be unlikely to get any as my husband is American and I haven't paid national insurance for a few years. We have no income and I'm living off my parents. I really can't see a way out of this. Thanks in advance for any advice you might be able to give.
  20. I'm looking for information regarding repayment of benefits. My mother has been the primary carer of my nephew for the past 6 years, as he was placed with her through social services due to mental illness. This meant she was entitled to certain benefits; (child benefit, child tax credit, foster carers allowance and working family tax credits) or so she was told at the time. She has been receiving these payments no problem what so ever and recently was granted special guardianship. This meant that the case had recently been reviewed, and as a result, has now been informed that she was not entitled to most of these payments and will have to pay them back. She has always declared everything on her tax forms and has never been informed that she was not entitled to these, and when she questioned the various agencies involved as to why they didn't pick up on this before, has been told that "they never checked until now". I was wondering if there was any law or previous case to say that as she never defrauded them or misrepresented any information, that she should not be required to pay the money back. The money was claimed in good faith and went a long way in covering the cost of bringing up my nephew. On a rough calculation, it looks like it will be around £20,000 mark if she is made to repay the money! If anyone knows of a similar case or has any other information it would be REALLY appreciated, thanks.
  21. Hello all I know I should not have got into this mess, but I have so I am looking for some help (advice). I have managed to accumulate 9 payday loans with different companies totalling around £2k due to not being able to work for 3 weeks in September, due to a stress related issue, and was only paid SSP. To date I have managed to scramble together the funds to extend/rollover each loan at the end of every month and it was my intention to repay all of them over the coming months but this is now not feasible. This month however I am unable to afford the rollovers and with other credit card arrears, mobile phone arrears, other loan payment arrangement arrears, I am in a right state. All of my rent/utilities and council tax are up to date and all of the debt is unsecured, I have no mortagage and I live alone. If I rollover again this month my priority debts would not be paid. So with a few days to go (I know I have left it late) I have a load of Payday loan payments due to be coming out of my debit card, none of which I can afford. I have arranged for my salary to be paid into an alternative account so my priority debts can be paid but I need some advise about how I should approach each company and when. I have worked out I have about £235 excess income available to pay creditors and I will probably be approaching CCCS to help administer this. I need some advice on what to do imminantly as I know they will be trying to take payments from the debit card (there is £2.00 in the account), with no overdraft, in the next few days and I will get constant SMS, phone calls, emails etc. I did read in a thread that I should report the debit card stolen, is this neccesary? Thanks in advance of any help/advice.

Young and free spending when I started working within London's financial sector led to the purchase of a house, a new car and eating out in restaurants at least a few times a week Life was good and within no time, I had a mortgage with Northern Rock, a second Mortgage with Northern Rock and a third Mortgage with Firstplus When the bubble burst in Finance, I lost my job and could no longer afford to keep the house. I had to sell the car and move into rented accomodation with my family. Since leaving my house in 2006, I have been chased by letters from Northern Rock, Firstplus and several DCAs for the remainder of the mortgages. I have no assets and have been burying my head in the sand waiting for it to go away. - Northern Rock (£55K Owed) - Recently, one of the DCAs has offered a one off settlement of £15K or repay the full amount at £250 per month. - Firstplus (£20K Owed) - No offers, but chasing letters every couple of months As I have no assets, I am considering Bankruptcy as I would prefer to start fresh rather than paying £250 for about 20 years, (and that is without even taking into account the Firstplus debt) - I have looked into bankruptcy for £450 Has anyone reading this had the same experiences with Northern Rock / Firstplus? I am wondering whether they would prefer a payment arrangement agreed now to cover a small amount of the loan rather than accepting what they are given when I'm declared Bankrupt - Please let me have your view on this Thks ScoobyDooby09 -- Nothing Claimed -- -- Nothing Reduced --
