  1. I have a question on my application form related to indefinite leave to remain. Do you or any dependants who are applying with you have any criminal convictions in the UK or any other country (including traffic offences) or any civil judgments made against you? Here is my situation: My wife got a parking charge notice from Brent Council, the PCN and all the letter mentioned below were sent to my old address as we moved home and didn't know anything about the pcn. The PCN turned into a charge certificate, then an "order of recovery" was issued and then a "warrant of execution" was issued from Northampton County Court. When we came to know about it after an year and bailiffs took £500 from us, we filed an "out of time" statutory declaration and that was successful, the letter mentions that "charge certificate", "order of recovery" and "warrant of execution" are cancelled by the country court and a letter from council mentions that. All the money was returned except for the pcn £65. Now in terms of credit history, we checked with registry limited and experian before the successful application for "out of time" and there is no judgement showing against my wife. Question: Is this a county court judgement or civil judgement, what is civil judgement? Should i put this as ccj or civil judgement, both no clear? regards, Raj
  2. Hi there hoping you can help me? We moved into our current property in Dec 11 and duly registered with the water company as new customer over the phone, they asked us basic details of names/address etc and then told us that everything was set-up and we would receive out bills in due course as they were due( monthly payments), since then however we have never received a bill or any other paperwork from them other than just advertising flyers and then today we receive A Claim form from CBCC at Northampton for £469.74. We have never received ANY paperwork from them regarding our account and admittedly we have not contacted them since as there have been a lot of personal and family problems/bereavements which caused their entire existence to completely slip our minds where they have never sent us any bills or paperwork to remind us they need paying. Where do I stand with this and what would be the best way to proceed? Thanks in advance, Saerimmner. I received a letter out of the blue from NCC 26/09/12 this year re arrow global guernsey limited with bryan carter solicitors acting on their behalf with the particulars of claim being " the claimants claim is for the balance due under an agreement which is now all due and payable" " The defendant agreed to pay monthly instalments under account number xxxxxx but has failed to do so" and the claimant claims the sum of ?? The claimant also claims interest thereon pursuant to S.69 county court act 1984 limited to one year to the date hereof at the rate of 8% per annum amounting to 0.00 I sent a defence to northampton using a template either off here or another site cant recall correctly and cant find the letter i sent (aaaarrrggghhh) saying i didnt recognise the debt to arrow at all and that if the debt had been bought by arrow i did not agree to any purchase. I also stated that at no time have I entered into any agreement with arrow either in writing or verbally to pay any so called debt and that if arrow has purchased the debt then i believe the original debt has been settled. I then received a letter off bryan carter dated 29/10/12 saying that the where no longer instructed in connection with this matter I then received a letter off arrow with a notice of change of solicitors and was now being dealt with by their litigation team also it says We notice from your defence dated 28/09 that i state that i have no knowledge of the outstanding balance and that they confirm this matter relates to a CapOne CC opened 10/07 and that copy documentation regarding said account has been requested from the originating creditor and will be forwarded to you on reciept. The account was assigned to AGGL on or around 11/02/11 and notice of assignment was served on myself at this time. i do not have any letters from arrow from this date i have checked my credit file with equifax today it says ive had a Credit Card from Arrow Global Ltd (I) / XXX Start Date 19/10/2007 Date Updated 15/03/2011 Date Last Delinquent Date Satisfied Default Date 10/10/2009 My credit file does not have any record of original lender just arrow and that record is linked to a old address from 3 years ago I hope all this make sense to anyone because im confusing myself I have now received a notice of defence from northampton along with a allocation questionaire This is where i could do with a helping hand because i havent got a clue how to fill this in
  4. Hello all Hoping for a little advice. Have received a claim from Northampton from Bryan Carter on behalf of Arrow Global. The original debt was from MBNA and the claim is for this plus costs totalling £579. The particulars of claim mention an arrangement that I can only assume refers to the original credit agreement with MBNA but does not mention them by name on the claim form at all. Just wondering whether I should have had a letter advising the debt had been sold(I assume again) to Arrow as they are the ones taking the action when they are not the original creditor? I am not disputing the debt and probably don't have much of a case to dispute the costs either apart from I only get the letter advising of legal action from Bryan Carter today the same as the claim The letter ask to call him to discuss the matter so should I do this first before I answer the claim to try and resolve it? Any thoughts/past experience with this company and how they operate would be useful so I can decide what to do would be useful. Thank you
  5. hi, thanx for reading, just need a bit of advice , i hve received court papers from county court, claimant is a arrowe global guernsey ltd, there solicitor is a bryan carter.. particulars of claim arefor the balance due under an agreement which is now due .that the defendant agreed to pay monthly instalments under account number xxxxxxxxxxxxxxxx but has failed to do so. the claimant claims £4999.00 and also interest. i think arrowe global is a dca. .ive had letters of them in last twelve months. .but i havnt taken any agreement out withthem? any ideas on how to defend this ? all feedback much appreciated guys .

I got a ticket somewhere in Worthing and clearly someone pulled it off the windscreen (or the wind got it, I've no idea) this was a while ago and I've since moved and changed my car, the first I knew about this was a bailiffs letter appearing at my new address! no NTO beforehand, nothing. . so I appealed using the directions on the government site with an out of time witness statement and declaration explaining clearly what happened and apologising for causing a problem, I thought this would be pretty straightforward and I had no problems with paying the original ticket amount, just not the £450 the bailiffs were now asking for!! sadly today I recieved a letter from the HM court and tribunals service telling me my application has been refused! so, now I HAVE to pay the bailiffs £450 for a ticket I didn't even know I had up till now it all seems a bit unfair.. and the bailiffs are giving me the old 'well sunshine, them's the rules' line. . I haven't actually had any contact since recieving the rejection from the court but I know its coming.. so I was wondering what my best option was! I could appeal but that's £45 before you even start and I'd probably still have to pay the bloody £450 even after all that! any help would be appreciated!

Looking for some guidance as I have received today a court claim as below, After reading up on here about Acknowledging Service and CPR procedures, I have acknowledged service online and requested the following from Hegarty under CPR 31.14, 1 the agreement relating to Personal Loan Account number AAAAAAA. You will appreciate that in an ordinary case and by reason of the provisions of CPR PD 16 para 7.3, where a claim is based upon a written agreement, a copy of the contract or documents constituting the agreement should be attached to or served with the particulars of claim and the original(s) should be available at the hearing. Further, that any general conditions incorporated in the contract should also be attached. 2 the assignment from Secure Trust Bank plc to your client 3 the Notice of Assignment sent to the defendant by your client 4 documentation showing compliance by your client with Section III and IV and Annnex B of the PD Pre-Action Conduct I have also sent a SAR to Secure Trust. Can anyone advise what the next thing(s) I should do are?

  9. I have sent all the paperwork off to Salford for a small claims action. When I filled in the paperwork I specified my local court as a preference. Today I have recieved the notice of issue back and it states that it is in the Northampton Court (some 200 miles from where I live). What would be the reason for this ? I have also had communication from the defendant that they will be defending the claim and seeking for it to be heard in their local court - again some fair distance from me. Do I have a say in this matter at all - would there be a reason that it cant be held in my local court ?? I will post the claim details seperately as I have a few questions and dont want to complicate this thread. Thanks in advance.
  10. Hi all, I have been issued with 2 separate PCN's (for being an idiot and parking where I'm not supposed to) both for contravention code 16. I don't deny either of them, and all details - reg, road, etc are correct, but one (which I have paid) says my car is Grey, the other that my car is Silver. My car is metallic dark grey/blue. Does this qualify as incorrect information? Thanks G
