  1. Hi Guys, I parked in a hotel car park on business at the Ramada, Glasgow Airport, for (so I am told) 1 hour 38 minutes. I parked in a disabled bay with disabled badge showing, although that wouldn't appear to be the issue. I was aware that there was a meter, but as I normally do, I assumed they didn't apply to the disabled! Now having been asked for the princely sum of £100 (reduced to £60 if I cough up sooner) am I right in assuming that the normal ignore rules apply....this is private land etc and I should just ignore the letter for now and the what I assume to be follow up threats etc?   2. As a newby not sure if this is the right place to post this but here goes. I am about to move out of my rented flat and I have to have a property inspection. Not a problem with that except that the lettings agent wants to charge me £35 for the inspection! There is nothing in his T&Cs about a charge for this, but as he is holding a £500 deposit, if he decides to take it out of that there isn't much I can do about it. Does anyone know if he can legally just take this money without my consent.
  3. i think this will be an ignore one but i will ask anyway (you are friendly arent you ) went to preston railway on my motorcycle over this weekend found out previously that bicycles and bikes could be parked in the cycle bay which is on a platform this was confirmed by the helpful chappie at the taxi rank with a rail jacket guiding people about bike was parked end on to the bike bay as there was a concrete plinth at the end of the bay stopping me putting the bike in parallel with the others (it was fairly full also) so it was parked in front of the plinth and chained up came back this morning to find an ncp parking contravention charge notice on the bike- says on the back (7) causing obstruction bike was clear of the entrance and there wasnt anything immediately around it to cause access issues as it was on the station and not in the car park can they enforce it? thanks mark
  4. Hi all, We've been living in the same rented house for 5 years now. We are never late with the rent, and have never missed a payment. We now have to sign a new contract, and for the priveledge of signing, we have to pay the landlord £50. The rent is high enough as it is. Is this standard procedure? Can they do that?   5. Hi guys, I recently admitted a debt to a creditor and had a decree granted. I arranged direct with the creditor a monthly payment plan of £85 and informed them that i would set this up as a standing order through my online bank. I have not done this properly and it turns out payments have not been getting sent. I only found this out after receiving an e-mail from my employer saying that someone called Amanda called looking for me with a number to call. Turns out it was a Sheriff Officers in Glasgow saying they have a "Charge for payment" to deliver to me from the creditor. Will i be able to pay my arrears from the payment plan and set up a DD direct with the creditor or will i have to do something else? I can not afford to have an earnings arrestment, it wouldn't be worth me working if i did in my situation. Thanks
  6. Hi, Back in 2002 I applied and got accepted for a mortgage. I have been scanning through my paperwork and have noticed that the mortgage company, Northern Rock, charged me a fee £1306. The fee is listed next to a statement saying: - "We would only normally lend you £**,*** on the security of the property but are prepared to lend £**,*** subject to the payment of a risk charge fee of £1,306. This non-refundable fee will be added to your mortgage account on completion of the loan." I was wondering if this is a fee which would be able to be claimed back???
  7. I went through a light on a traffic light controlled roundabout. I was stopped by the traffic police and told that I had ran a red light because *their* light was green. They were waiting at the lights of the next junction of the roundabout. As far as I'm concerned that's an inference based on an assumption. If I'd been charged with a speeding offence they'd need to produce a calibration certificate for any equipment used to prove that charge. As far as I'm aware, traffic lights do not come with calibration certificates. Is this worth defending in court? At the moment I'm looking at 3 points & 60 pounds. I have no points on my licence.   8. I recently received a parking charge for an expired parking ticket from LDK in a private car park. The parking charge is for £60 in 14 days or £90 thereafter i sent a letter off to appeal but received an unsuccessful letter back. What should i do, should i pay the £60 or offer a £5 payment as their loss would of been £1 for the over stay time.
  9. I recently got a parking eye ticket for overstaying at an aldi car park. I was there for 2 hours 15 mins and the time limit was 1 hour 30 mins. In the pictures my licence plate was not visible on one of the pics due to glare. I emailed them sand told them I would not be paying said charge but if they had further picture evidence I would be happy to pay £0 due to the financial losses suffered due to this apparent overstay. I did not state I was the driver. I told them not to contact me again unless they were sending me a popla appeals reference number, They have now sent me two follow up letters. One saying I need to provide evidence I was in Aldi. I don't know what this has to do with anything. But they have also sent another letter stating they are entitled to take enforcement action against me if I do not pay and that under schedule 4 of the protection of freedoms act 2012 that the driver is required to pay this fine. They say they have the right to recover this charge under paragraph 9 of this protection of freedoms act, they have kindly put it on hold for 14 days while I provide further evidence. I know people say its best to just ignore them, I wish I had now. But what do people think my next course of action should be. I have no intention of paying them but i have not heard of anyone recieving a letter of this kind before . thanks in advance
  10. Hello Folks, Wonder if those in the know about private parking company PCNs - namely ParkingEye can jump in with some constructive feedback here. I received a PCN from ParkingEye today (dated 5 days ago) parking in Tunbridge Wells whilst in a closing down Comet store. They asking for £60 by 22/12 or it will become £100. I Was in there for 2h 24m (time allowance is 2 hours) but was in the shop genuinely buying some products (albeit discounted as they were shutting down , that i lost track of the time i had been in there. I have been doing lots of research about appealing the PCN with PE directly, complaining to the retailer (not possible as they are now gone bust), ignoring letters, etc but am worried that they may escalate this matter to higher authorities - bailiffs, Courts, credit agency etc. I take pride in maintaining a good record with all concerned, but this matter has got me puzzled. They offer an email address to appeal to - if so is it safe to email an appeal or safer by post? Not sure what to do, would appreciate any feedback you can generously provide. Best regards, Ryan
  11. Hello my partner and I have a direct debit with Comet for a fixed term loan we have received a statement today and it has something called a Sal Fin Int Charge. We have read through the contract/information and it does not mention anything about this charge we have not missed any payments and they have all been paid on time so what is this extra charge and why are they adding it to the existing balance every time that there is a transaction can someone please explain what this Sal Fin Int Charge is any information would be appreciated as we are confused to what it is and why it has been added. Thank You
  12. Like so many others i have received a "Charge Notice" from one of the many private parking companies. Interestingly enough the picture on the notice is indeed my car and I did indeed park where they say I parked. However, the picture is date stamped 15/11/2012 and they say I over stayed on that day. I actually have the parking ticket and it is dated 16/11/2012 which was the true date I parked there and I certainly did not overstay on that day. Obviously I have no intention of paying their £75, reduced to £40 if paid quickly, but it does raise the question of how I would prove that their picture was incorrectly dated. The fact that the ticket I got from the machine clearly states 16th but their picture states 15th.
  13. recieved a bus lane penalty charge notice. stating i recieved a letter last month but i did not recieve one. do i have any chance of appealling and winning. the fine was origionally £60 now it says because i did not pay within 14 days i need to pay £90 i did not recieve origional first charge notice. what should i do ? pay or fight for my rights.? advice please . i have uploaded the letter recieved.. http://postimage.org/image/51deut0bd/
  14. I have been doing some research but wouldn't mind some feedback. I parked my car at my student halls car park without a permit(haven't bothered to buy one just park my car on the road), I don't usually park there but was unloading shopping and left it there for a while, i forgot about it being parked there, and yes ended up receiving a parking charge from county parking who enforce the car park on behalf of the UNI. The charge is £50 if paid within 14 days. Since no one else parks there hardly and I am a student that lives there, i think £50 is a disproportionate amount to charge, since they have not lost any revenue and I do live in the building. Plus in their charge letter they say i've entered into contractual terms and conditions which is drawn to the attention of the user by the sign at the entry to the car park. Now then there is a sign but it doesn't display the terms and conditions, it just says you need to get a permit to park here, failure to do so may result in a parking charge, it doesn't say anything about agreeing to enter a contract once you enter the car park. I want to send a letter asking them to justify the £50 and stating there is no clear sign displaying the contract, and don't contact me again! Good idea or shall i just ignore/pay etc?
  15. Hi, Could someone please advise me the process I need to take to get the catalogue company off by back. I have looked at other posts in the site, and what I understand is that you can reclaim late penalty charges, is this still the case for 2012 as some posts are old My position is that I have not paid the current penalty charges I only made 1 a year ago and Very Catalogue keep adding £24.00 a month. Initially I was late with my payment by 2 days, and they charged me £12.00 penalty. I have paid all the lawful debt only the charges are outstanding. I requested Very to provide me proof that it actually cost them £12.00 due to my payment reaching them 2 days late, however i only received further demands for payment. The charges have now accumulated to £72.00 and it has been passed on to NDR (Nationwide Debt Recovery). If I don't pay the full balance in 7 days a default will be added on the credit register. I need advise as to how do I proceed in clearing these charges. If I keep ignoring them they are just going to keep adding the charges. Please advise whether I need to use the same procedure for reclaiming the penalty charges. Many thanks

  17. Hi everybody, my business has recently failed and I had signed a personal guarantee on the company overdraft plus used personal credit cards to keep the company going. The credit card companies have both agreed to freeze interest and accept an affordable montly payment based on my income. I've offered the same deal to the bank but they are asking for a voluntary charge on a second property I own and are charging interest at 3%. They have said that if I don't agree they will go through the courts and I will have to pay the statutory 8% interest if they win. Part of the charging order is an agreement not to force a sale as long as the agreed payments are maintained. I'm inclined to reluctantly accept their terms but does anyone have any experience or advice they can pass on? I'm concerned that I will be giving preferetntial treatment to a creditor and that I'm turning an unsecured loan into a secured loan. The amounts we are talking are aprox. £10k for the overdraft and £30K for the cards and the property is in my sole name and not the one I live in. Any advice appreciated. Thanks.
  18. I recently received a text from 84433 which is a company called Mediaburst. They seem to be real and respond to emails. The text was marketing some financial service. I googled 84433 and it took me to Mediaburst's website where it said that I could unsubscribe by sending "stop" to the number. I did this and then emailed the company to find out where they got my number from. Unsurprisingly I was told that another company had used their service to send the text. I asked for and was given their details and again, unsurprisingly, this turned out to be a marketing company. I have yet to pursue them to find out who they were acting on behalf of but I intend to do so as I'm fed up with spam texts. What has really annoyed me about this is that I now find that I was charged for the stop message. O2 treat it as a premium text. I don't see why I should have to pay to unsubscribe to a service that I never subscribed to in the first place. The charge was only 10p but if 10,000 recipients of the spam sent a stop message, someone is making £1,000 out of this. I have a couple of questions: 1) Does anyone know who is likely to have profited from this i.e. will Mediaburst receive any revenue from the stop message? 2) Is there a legal basis for the charge? I don't see where there is a contract between me and anyone other than O2. Of course O2 has offered to refund the charge but I would rather pursue Mediaburst or their client (or their client's client) if possible. I think there is a real point of principle here and I'm spoiling for a fight.
  19. Last June I paid for a year's storage in advance with a well know self-storage company. At the time I took the opportunity to negotiate down the charges they initally quoted for renewal (I've been using them for several years now). The negotiation was all done over the phone and no mention was made of VAT at the time. I am now being asked by them to pay VAT on the charges relating to October onwards. They claim that they had not known the storage charges were liable for VAT until recently when their lawyers confirmed that it was. I've looked on the government web site and see that it was made quite clear when the announcement of future VAT liability was announced in the budget, it was also announced that "anti-forestalling measures" would apply from 21 March, therefore the Self Storage company should have known that there would be a VAT liability. As a concession, the company is only asking for half of the VAT, but this is still a significant sum. So my question is: Am I liable for the VAT or should the company have known about it and included it in the agreed sum that I paid in June? Thanks for any help.

Hi All alid ticket and a Staff NHS I parked on a roadside within the local hospital in a row with around 12 other cars, no yellows, no emegency traffic flow, not able to find a space for 1 hour 15 mins. The above notice put on my windcreen even though my vehicle clearly shows a valid ticket and also a staff NHS permit, albeit for part of the hospital that has yet to relocate to the new super hub (lol) £40 fine or £15 if paid now, on principle of their pettiness and given the amount of parking spaces that are occupied by hundrens of construction vehicles and skips rubble etc due to the rebuilding, l do not want to pay these people. Anyone with any advice for me ? Cheers AG

This is a slightly unusual problem i have . i just finsihed replacing the gus of a computer for a friend of mine who is from the old school like me , however he will not accept me doing it as a favour but expects to pay for it , my problem is i feel uncomtable accepting payment because i did it as a favour but he would be upset if i didnt charge him . Any one got any ideas pls
  22. Hi there I've only just come across this forum in the past week, I had my savings account arrested & have had £872.38 taken from me for council tax arrears. I missed the Charge For Payment as I wasn't around at the time. I've been served another Charge For Payment for £1073.40 & was wondering what I can do to stop another arrestment being made. I've read about various methods of applying for time to pay, but it's all new to me and I'm starting to panic! The original arrestment was a pain, but I had the money to cover it, now I don't have much! I am in full time employment so I could pay in instalments. The Charge is from Walker Love, acting on behalf of West Dunbartonshire Council. Thanks & please help!
  23. Hi guys, just a quick query. Over the last year i was stupid enough to have severaql payday loans to which i was not able to pay. First was with MiniCredit which is being dealt with, and sure most people that use this site are aware of the issues with this company. The Second loan is with CFO Lending. Both have issued me with several charges to my account, including missed payment charges and interest charged per day. On this site and others I have seen stated that the amount that people have to pay is "amount borrowed plus one month's interest" I've informed both companies of this to which they say this is not the case, i have tried to do some research on this matter online and have failed to find any other reference to this on any other sites other than forums, this does not appear (from what i can see) within Consumer Credit Act 1974 or any amendments and does not seem to appear under any OFT guidelines. I don't doubt in the slightest that this information is correct but i can find any law that would back up this. Where would i find these laws or guidelines which states this amount of charges applied to accounts? Dont get me wrong I know I am liable to these debts and will pay these back, but I think i should only be paying what is lawful.
  24. Hi I parked in a Parking Eye car park whilst going to the cinema opposite. The maximum stay was 3 hours (although I didn't know this until receiving my parking fine). It was a Friday night at 20:42 when I left my car there. The car park closed at 22:00 (although, again, I didn't know until later). When I returned to my car, the car park was locked and I could not remove my car until the next morning. I returned at 08:42 the next morning. The car park opened at 5am (I noticed on my return in the morning) but the shops did not open until 9am. My car was not using up any parking space during opening hours and no one else could enter the car park / require my space in that time. I didn't see the signs saying that the car park would be locked, nor that the maximum stay was 3 hours. They are now trying to charge me £85. Help! What do I need to do?
  25. Hi This is my first post and was hoping someone could respond with some information to help me decide on my plan of action. I recieved a £30 fixed penalty notice in relation to not displaying a current excise licence (section 33 (1) of the vehicle excise and registraion act 1994) The penalty notice was issued by a police officer on 06-11-12 at 10.30pm in the car park outside my flat. The car park is owned by the housing association, not the local council of which I have a share (being an owner occupier). The vehicle did have a current excise licence issued on 07-10-12 and had this in the vehicle. Although it had slipped out of its holder and was lying between the windscreen and the dashboard. I had not noticed this, as the vehicle had not been moved for over a week. The vehicle is a registered disabled car used mainly to transport my disabled daughter about and was parked in her disabled parking bay and showing a current blue badge. I must say that I was disappointed to find a ticket on my windscreen when I was putting my child on to her school bus in the morning of 07-11-12 and that the issuing officer did not check that a current excise licence was actulally issued and investigate matter a bit further. I was thinking of appealing but need to go to court to do this. I am anxious that if I go to court I will end up with a much bigger fine for challenging it. I was hoping to get information to allow me to assess what my options are.
