Really confussed and hoping that someone can give me some advice, every year im getting the same letter then nothing for the rest of the year and no chasing every year im threated court action and it never happens, ive appealled it twice but never get a response apparently overpayment is between Aug 16th 2007 -Sept 15th 2007 because of change in circumstances, however I was unaware this was happening. Partner cant of moved in with me on 15th August as we were on holiday abroad for 2 weeks. Statement of events so far, I am at a lost as to what to do. I can not afford to pay this over the next 12 months. 15th September 2007 - Letter from HMRC saying we are not going to ask you to pay it now no period stated or amount. 19th September 2007 - Single Claiment Amended Tax Credit award received no overpayment mentioned. 4th May 2008 - Annual Review Tax Credits Award received - Joint Names stating joint award started 16/08/2007, no payment breakdown given. Therefore no idea it was wrong. 21st August 2008 - Single Final Tax Credit Award received - overpayment mentioned. 29th September 2008 - Inland Revenue Letter of Notice to Pay to HMRC outstanding amount. 02nd October 2008 - Notice to pay £10.00 a month to HMRC with income and expenditure - no responce received from HMRC 11th November 2008 - Letter demanding full payment, threating legal proceedings. 15th November 2008 - Letter to HMRC notifying them that I had disputed their claims and letter was sent to them on 2nd October by Royal Mail track and trace. Proof sent to them of this, letter also mentions that I asked to speak to a manager at the HMRC which they refused. Letter threatens to send copies to Adjudicators Office and Parliamentary Ombudsman. 19th November 2008 - Letter confirming receipt of my correspondence saying to contact the office to agree payment, when I phoned they refused to let me pay it over more than 12 months which I couldnt afford to I took it to appeal. 20th November 2008 - I wrote to HMRC for appeal on the grounds that no overpayment mentioned at time of overpayment, letter stating no repayment needed, advised them we were on holiday on 15th August 2007 therefore werent living together have proof if required and on the grounds that I had no idea of the overpayment as my payments matched the award notice. 21st May 2009 - Letter received from HMRC to say an overpayment of the single award was made from 16/08/2007-17/09/2007. 10th August 2009 - Notice to Pay from myself to HMRC - I wrote a response to tax credits offering a payment of £20.00 and asking them for a way to pay this due to hardship and not being able to afford anymore, I asked the HMRC to give me the options in how I could pay this, again no response from HMRC. January/February 2012 - HMRC chasing payment again threatening payment. 28th January 2013 - HMRC chasing payment again threatening unless its paid now we will pass it to private debt collection agency. Can anybody help I have got no idea what to do.
  2. I'm going through some 'old' accounts and may have an issue. One of the employees was paid for SMP in the year 2007 - 2008 and yet for the 3 years prior to going on maternity leave they had only ever worked for 11 hours per week and had never qualified / paid any NI. TBH, she took home more SMP then she did wages. This seems strange to me, does anyone know the qualifying rules for 2007 or able to point me in the right direction. Thanks in advance.
  3. Hi Eveyone, I'm sorry in advance as I'm sure you get a lot of posts similar to this one. Im sat here at 1:40am worrying about a Car finance application because of an only halifax default on my credit file. I know my credit history is fantastic except for this one thing. I need advice. Apologies but i am dreadful with approximate dates. The History Around 2005, Halifax gave me a £1000 overdraft, eventually i over a year i filled it up and was just paying the interest of about £15pm. I did this for 2 - 3 years without any issues. Then halifax changes the OD rules meaning I would be charge the £1 per day i was overdrawn and since I was in the full £1000 I knew i was going to be paying £30 per month from then on and that was to much. I went into my local branch and pleaded to an adviser. I asked her if they could freeze my account and I would continue to pay off the OD, she informed me the only time they would freeze the account would be if I went considerably un-agreed OD where it would then be enforced as a debt as such. So i asked if i could apply for a credit card or loan to pay off the overdraft and then just pay the loan. she declined. The lady stated that "halifax have to be seen as responsible lenders, and if I cannot afford to pay £30pm for the overdraft how could I repay a £30pm loan" to which I replied, "I could just afford the repayments on a £1000 loan but at least that £30 would be paying off the debt, with the overdraft I could be paying £30 for the rest of my life and still owe you £1000" The lady told be that she was very sorry but there was nothing she or I could do. being young and strapped for cash I thought "well stuff you, I've told you I have a problem, I have asked for help and you wont so i'm not paying it." i ended up un-agreed OD of £1500 with charges before they froze the account and sold on the debt. then I was contacted by the debt collection company. I explained the situation to them, Obviously they didn't care. I explained that I would be happy to begin paying off the £1000 but would not be paying the £500 charges as those charges could have been avoided, the lady became very rude so I have ignored them since. Which brings me to now...... I know that the ONLY bad thing on my file is that one default from halifax but it is affecting my wife and I massively. I just managed to scrape sub-prime car finance 6 months ago at a rate of 79.65% apr Its killing out income. Is there anything I can do. It seems crazy that I should have plenty of credit with places like littlewoods, vanquis, Landline, ect ect. but for things like a small loan or car is a NO GO, for one small thing that happened years ago. I'm sorry for the huge message, I just needed to get the entire picture accross. Mike.
  4. Hello, I was wondering if I could get some advice. I was contacted out of the blue about 6 months ago from Phoenix Collections regarding a Liability Order dating back to 2007 with Bradford Council. I had no had any notice or contact about this before so I contacted the council and they stated that I owed £236 pounds dating back to a property that I moved out of in 2005. When I left that property everything was fine but I found out that the Rental Agency (Who are now closed) told the council I had left at a later date and it was my fault for not leaving the correct forwarding address, but I had at the time and I move once a year around the country where the work is. My problem now is - The council offered to put the account on hold while I submitting a SAR to find out all the details regarding this case I submitted a SAR following the procedure listed here over 2 months ago The council wrote back stating that I need to provide Identification before they would send any information (is this correct) 2 weeks later I receive a Letter from Phoenix (attached) titled DEFAULT NOTICE and they are coming to collect my goods, and that I don't even need to be there. How can they do this despite not visiting me before and also the amount has jumped to £330.82! Any advice or next steps? I really don't want to let them win this one yet.
  5. Hi, I had a CCJ with Natwest in mid 2007. The CCJ was for approx £15K and I was ordered to pay £10 per month by the Judge. A charger was also unsucessful. I recently SAR'd Natwest for PPI and I have noticed from both my credit files and bank statements that they have been charging me up to £100 per month since the CCJ in Interest up until November 2011 when they finally stopped. I was not aware they were doing this as I have NEVER received a statement since the CCJ for my current account I only receive an annual statement from shoesmiths for the loan. I am furious as my current account now shows as £6.5k in arrears! this has added a whopping £3.5k onto the debt that I knew nothing about. I recently just won my PPI for £3.5K which they are crediting back to the loan so I feel this was a waste of time becasue I am still in exactly the same position as I was when the CCJ was entered in 2007. Is there anything I can do about this? I know judgements over £5K can still attract interest but I tohught they had to tell you and send you statements. My debt will never be paid off at this rate as I only pay £10 per month as it is. I really hoped the PPI win would make the balance go down but it's not. I am so angry. Even more so because they pressured me into the loan which got me in this mess in the first place, The salesman made up fake income to get it passed and made me have PPI. All this was stated in my PPI Fos Q so I wasn't suprised when they coughed up straight away without any arguments. I know it's my responsibilty and I took the debt but I am devastated to see my balance rise so drastically.
  6. Hi all, it’s been a while because nothing as been happeningon the debt front – I have been paying the ones that have to be paid andignoring the ones that couldn’t do their jobs properly. In march 2007 I stopped paying a Lloyds credit card because allthey could supply was a CCA with no reference numbers on it what so ever,although it did have a signature. I SAR’ed at the same time and nothingdifferent came back. I officially complained and was given a reference number.Lloyds wrote each month saying that they were investigating, these stopped andI have heard nothing since. I did post the CCA at the time and it was agreed that it wasunenforceable, it is on here somewhere. So mid next year it is also statute barred. The account as now been sold to 1st credit, whohave sent through the assignment and offered a 5% discount. A couple ofsolicitors have tried to phone but I just refused to answer their securityquestions. But today an interlink currier as tried a number of times to delivera letter, my thoughts are that it is the SD that they have been threatening. Because it as been a few years and having experience of ajudge that was not interested in anything pertaining to 1974. I need to make sure of my rights. I know Iwill have to write to them stating account in dispute but being so close to the6 years I am reluctant. Yes there is PPI but again if I go this root I amadmitting the account is mine. I really need a good letter that says the account is notmine and you cannot prove by CCA that it is but if it was, it is in dispute asof 5.5 years ago! I have got all the paper work! (DN 2006)
  7. Hi I am new to this so please bear with me. I have been trying to find out some information regarding Picture home loans (now Webb Resolutions) and the legality of the loan in the first place. I took out a loan with Picture back in February 2007 and fell into arrears within 6 months. Got back on track for a while but have been struggling for about 3 years now since my husband was made redundant. We have filled in at least 3 income and expenditure requests and have offered to make a nominal payment but they have ignored this and just want the arrears plus the normal monthly payments. I have been a bit slow on the uptake of weather the original credit agreement is legal or not as I did not want to be one of those people who takes out a loan and then tries to get out of it. We are in serious financial hardship at the moment and now have an 8 month old child. We successfully reclaimed our PPI on this loan about 3 years ago which is what we used to pay off the previous arrears. Please could someone give me some advice. Many Thanks

Hi All I had a loan from a bank go bad in 2007, and under the threat of a Statutory Demand from the bank's solicitors, I reluctantly agreed to sign a consent and CH1 form to have the amount registered against my home. In emails with the other parties solicitors, it was agreed that the money owed could be reimbursed on the sale of the property. To make it clear, there was no County Court action back in 2007, and I have heard nothing since. Now it's 2012, and not surprisingly, I guess, because I have not sold my home as quickly as might be expected, the bank want their money back! To that end, I have been issued with a Default Notice direct by the bank. As it stands at the moment, the debt is fixed with no interest added since 2007 and simply a charge on my home. The real threat of this Default Notice of course is that if this does go to County Court, then considerable interest might be added. Here's the plan, I would appreciate some advice: 1) Can I put the account "in dispute" by asking to see a copy of the the Agreement, and so buy time by holding off any proposed county court action? 2)Whilst they are sorting out the Agreement, i need to fire something off to them regarding the proposed county court action breaching our arrangement in 2007, let me explain: back in 2007, when I signed the consent and CH1, I specifically appended emails between me and the bank's solictors which make it clear that the charge attaches to the property until I choose to sell, remortgage or pay-off the settlement balance in full. So I am saying that I only signed the consent and CH1 on that basis. Can someone advise what I need to do for 1), as I must act fast! Any input on 2) would be very helpful.
  9. Hi - I originally posted a thread Help! Asset link taking me to court in forum capital one in 2007-08 and received some really valuable advice which I followed and never heard anything again. I have found out this week that I now have a default next to my name from....Assetlink. Is there anything I can do to get this removed? My last correspondence was 8 Jan 08 from Mrs Roberts Litigation officer at asset Link Capital, saying ...we wrtie futher to your recent defence filed. The contents are noted. In order for us to fully investigate the points you raise, documentation has been requested from archive. Upon receipt of such we will be able to fully respond to your comments and provide copies of the relevant documentation in this matter. In the meantime we weill request this matter be transferred to your local court for action to continue... And that was the very last I heard. I have had absolutly nothing since, so I am really unhappy to find there is a default against my name. Would really appreciate some advice Thanks melanie
