  1. Hi guys and gals. Sorry to post a new thread but I am extremely confused about the Gladstones Letter of claim. Let me explain. My husband is the registered keeper of the vehicle and I am the main driver. We have just received a Letter before claim from Gladstones, however this is the first I have heard of this PCN. On the day in question i know I was the driver because I found a wallet and handed it in to LLOYDSTSB bank as that's where the cards were from inside it. This is probably the reason i got a ticket as i am aware i was slightly late back but not by much. When I returned to my car I had no notice of charge on it. I have rung Gladstones to tell them to direct the claim to me instead of my husband and they refused to speak to me and asked him to email them. He is doing this shortly so that i can try resolve the issue. I am concerned as to what to do now. I don't want a CCJ on my file. what should I do from here.

As per the msgs before, ive acknowledged the MCOL and sent the CPR 31.14 Request to the solicitors today. When would i need to send the defence to the court?? straight away or wait?, and what to do i need state on it? Any help would be greatly appreciated Thanks

Hi all, I been ignoring few letters (stupidly I searched on googles about ignoring private car park parking charge and believed it ) for a parking charge issued on 03/05/17 at location West Gate Plaza West Bromwich, Moor Street, B70 7AD by Parking and Property Management LTD and recently I received Letter before Claim from Gladstones stating I own a debt of £160. First corresponding letter was from Parking and Property Management LTD dated on 07/06/17 and it was already a 'reminder notice letter', however i was not aware and the person who was driving the car at that time are not aware he was charged before this letter was received. The 'so call edvidences images' first picture was taken at 09:02pm and second picture was at 10:14pm, it also stated the they issued the ticket at 10:11pm. However the second picture show the car was turned on with lights on and the driver told me he had a kid in the car at that time and there were some accident, thats why he exceeded the 1 hour maxium time period. The signage for the car park is next to the shop signage above the car and one more signage is nextdoor shop also next to the shop signage on the right hand side. And it was at night time, it wasn't clear enough to read. 2nd letter was from Gladstones as Final reminder letter dated on 17/07/17, asking for £160, stating if I dont pay they are instructed to issue legal proceeding against me in the county court. And the lastest 3rd letter from Gladstones as Letter before Claim with a deadline of 14 days to respond of pay and the letter was dated on 31/07/17, but I was on holiday so I missed their dealine anyway. Stating they act on behalf the claimant and have now been instructed to commence legal action against me to recover the debts i own. But should I response to them now or no? As I feel it might end up bad if I keep ignoring them and I got confused with all those technical wording. I have not contact any of them or reply them so far. Kindly request helps! Thank you. Hi all! in need of some help bit worried and dont know how to tackle this situation, here are the details below: there was a a very small iceland store that closed down on a side road where they must of had around 7-10 parking bays, this is still closed down and no business is running there. i parked there for literally 5 minutes as i come back i got a PCN from parking and property management, there was a sign on the wall, i just thought 5 minutes as i was looking for a shop wouldnt be a problem! Date and time: 21/02/2017 at 12.38 received a few notice to keepers then a letter before claim i have ignored all of this! from gladstones. and unfortunately they are thrown away as i thought ignoring them would be fine. on the PCN it says issue reason 1: unauthorised parking the vehicle was parked on private property in a manner where the driver agreed to pay a parking charge displayed on the signage at the site. If this makes any difference please do let me know the name of the road one of the letters is mispeld on all of the letters received even on the claim form example being: turner avenue > tarner avenue claim form states: the driver of the vehicle registration xxxxxxx incurred the parking charge on 21/02/2017 for breaching the terms of parking on the land at iceland, xxxxxx the defendant was driving the vehicle and/or is the keeper of the vehicle and the claimant claims £160 for parking charges/damages and indemnity costs if applicable, together with interest of £2.49 pursuant at s69 of the county courts act 1984 at 8% pa, continuing to judgement at £0.04 per day. then accoss the page is says amount claimed: £162.49 court fee £25.00 legal rep costs £50.00 total amount: 237.49 please help and advise as i dont know what to do!   5. Hi all, (COPY OF LETTER ATTACHED) Been ignoring letters after parking in a train station and now received this letter ? How would i handle this, this is a company car and plenty of people have use of it but it's in my name so was going to reply stating i don't know who the driver was?   6. Hi, Went to a wedding last year? I honestly cannot even remember how long ago it was. There was insufficient parking space at the venue and my vehicle was parked in an empty cash and carry car park just down the road. We did not see any signs/ information informing me this was private property/ charges etc. I have attached a google street-view image of the area in question - the signage is very small and I can confirm on the day - a vehicle was parked in front of the sign - big enough that myself and 4 other members of my family walked straight past it and did not notice it. The vehicle was parked approximately where the silver car is in the image. I received a parking charge notice on return to the vehicle and numerous parking charge notices via mail - I followed advise from a basic google search which advised to ignore. I now realise this was a mistake. Received the following letter through the post today. I have stupidly thrown away all previous correspondence and cannot even remember the date of the incident. Am I outside of the period in which to appeal? What action would you advise? Many thanks in advance
  7. Hi Guys, After some advice, around 2 months ago i decided to go travelling. Before doing so i parked my car outside a business which is on a main Road in Manchester City Center. I asked someone that worked at this business if it would be ok to park there which they replied it would be fine. While ive been away, SIP parking must of bought the land the business was situated on and they erected a no parking restricted sign on the wall. Well after coming back from my travels ive came back to a windscreen full of tickets and numerous letters from SIP asking for £100, ive also received a letter from Gladstones solicitors. Ive been away so ive no knowledge that they put the sign up or that i was receiving tickets! just wondering if i have a leg to stand on, ive got 20+ tickets rolled up and i was wondering if i should reply to Gladstones with the reason why the ''parking offence'' has been committed. any help would be greatly appreciated. regards

HI, I had been given a ticket on my car for parking at 4 CHURCH ROAD, ASHFORD - TW16 2UT When I got to the car park I had gone to buy a ticket, because I didn't have the right change I quickly went into a convenient store to get some, roughly in about a minute when I come back to pay for a pay and display ticket I see someone taking pictures of my car I approach him he said that I was being fined for not displaying a valid ticket. I explained that I was on my way to get one and that it had barely been a minute since I parked. (keep in mind this car park is almost empty) He insisted that I go online to make the payment and there was no point in displaying a ticket... With frustration I left the place without buying a pay and display from the advice given I ignored the letters from the debt recovery companies, which spelt my name wrong on the title.. I've now received a letter from Gladstones Solicitors, dated 19th April which i received today (24th April) it states: Re: Our client: Parking Control Management (UK) Limited Amount due: £160.00 Vehicle Registration: XXXXXXX You have previously been written to questioning the settlement of a parking charge. Due to the absence of payment or a valid appeal against the charge, our client has instructed us to recover the total amount due to them as shown above As all other attempts have failed, out client may now instruct us to take legal action against you in the County Court. To prevent such action, we invite you to make a payment immediately or confirm to us in writing your proposals in respect of this debt. In order to avoid any further action you should pay the full amount outstanding within 14 days of this letter. You can make a payment online (Cant insert the link here) or by calling 03330230049 It is important that you understand that if the judgment is registered against you then this could seriously affect your chances of obtaining credit in the future as this information can be made available to any interested parties via the Register of Judgments, Order and Fines, and will remain there for 6 years.   9. Hello I received a Judgment for claimant (in default) from Gladstones and I am unsure what to do. I was advised by a member of the forum to seek help here. An outline of the issue: Around the 10th of October 2015 I received a letter entitled postal notification parking charge from parking management control uk. The charge was for 100.00 but would be reduced to 60.0 if paid within 14 days. I ignored it and not happened after. Now I have received the Judgement of Claim from County court business centre in Northampton, saying that I have defaulted and I owe them 258.21. What do you advice I do now? Since October 2015 I did not get any letters of paper work from Gladstones or PCN, so how can the court send me this judgement. Thank you.
  10. Hello everyone, thank you in advance for any help and guidance you can give, it is very much appreciated. Following receipt of a Letter before claim from Gladstones Solicitors I have responded to them disputing the claim, following a quick back and forth, I have received another letter from them stating that "they are not instructed to enter into any further correpondence...if payment is not made within 14 days - a claim will be issued without further notice" The initial parking charge notice was issued to me by post, although i have no recollection of receiving this as the alleged contravention was in September 2015, I then received the letter before claim in December 2016. 1) Details of the letter before claim are as follows: * Client - Parking Control Management (UK) Ltd. * Charge amount - £150 * Date of charge - 09/2015 * Location - Heath Parade NW9 then the usual comments about paying it 2) My initial reply to this letter is attached as parking letter 1 (after a few days research) 3) I then received the usual threat that they'd take me to court in response, not commenting on any of the points i made in the first reply - i will attach this once i find it as gladstone 1 4) i then sent another reply again making note of my points - this is attached as parking letter 2 5) Today i have received another letter disputing my points made in parking letter 2, stating that they will not discuss it with me anymore and that i should pay within 14 days or a claim will be made - this is attached as gladstone 2 Please could any of you lovely people provide me with some guidance as to how to proceed, My main argument is that the signage is inadequate and that no contract was formed, I have attached photos of the signage (photo 1) and the location of the car in relation to the sign on a wet day (photo 3) [another viewpoint is available] (Sorry for the quality, unfortunately cannot save the evidence as) A massive thank you to all that spend the time to read this, Kind regards, A rather annoyed "keeper" Parking ticket letter 1.pdf Parking ticket letter 2.pdf

  12. Hello all. On August 12th a charge notice has been issued to my car by Ace Security known as Pace Recovery & Storage. Pleasse have a look at the picture (google street map) how the place looks like: Around October 20th I've got this letter from Gladstones Solicitors: In a heat of changing a job and starting a new one, which is quite demanding, I completely forgot to do anything about this letter. Yesterday I've got another correspondence from Gladstones which is a Claim Form, so they taking me to the court now. There are a couple of more papers attached: response pack, ridiculous Admission(specified amount) and defence and counterclaim(specified amount). I do not have a problem with paying fines if it is legal, which I believe is not the case here. If I was there that day or not, or I borrowed the car it is immaterial. I do understand that I should now go online and tick the box of defending my case fully and not pay anything. What would be your advice?
  13. Assistance needed! I've read the multitude of threads re parking tickets on this site and am hoping for the same useful advice from the regulars as I'm a bit confused re the best course of action On 08/06/2016 at Gateway Plaza, Barnsley I received a parking charge notice on my windscreen. The ticket stated it was issued for the reason of: No Ticket Displayed. The enforcement company is SIP Parking Limited I did some brief research online and decided to ignore the ticket. I did not appeal or make any contact with SIP On 14/07/2016 I received a NTK. The NTK did not mention Schedule 4 of the Protection of Freedoms Act 2012 (PoFA) On 15/08/2016 I received a final reminder. This also did not mention PoFA I have today (23/09/2016) received a Letter Before Claim from Gladstones Solicitors which has had the desired effect of finally making me concerned re the charge. The letter requests a payment of £150. The letter refers to the 'Practice Direction for Pre-Action Conduct under the Civil Procedure Rules and in particular paragraph 13-16 of the same which concerns the Court's powers to impose sanctions for any failure to comply.' The letter stipulates I have 14 days to pay or reply. Please advise! May be worth noting that on this occasion, I simply forgot to pay. I used the car park on dozens of occasions previously and paid using one of the mobile phone apps but on this occasion when I was called in to work early, I forgot. Thanks in anticipation for your advice
  14. Hi, Hope everyone had a good bank holiday. I (and three others!) missed crap signage and got a Contractual Breach Charge from Ethical Parking on my windscreen over the weekend. Just double checking that it is currently still best to do nothing until a notice to keeper arrives (between 28 and 56 days) before I take any action on one of these? Then if it (NTK) arrives on time post photos of it and signage on here for assistance? Just don't want to get it wrong! Thanks!
  15. Good afternoon First of all I thank everyone for any advice you may be able to offer. On the 24th March 2016 at 19:14 I was parked at the rear of some shops on Slough High Street. I visited a Supermarket (one of those shops) and was in there no longer than 20min. On my return I discovered a parking ticket from Parking and Property Management Ltd with the issue reason 'Not displaying a valid permit'. It was dark so I obviously didn't see the sign post which outlined the conditions of parking there. The following day I went away for work and totally forgot about the ticket. Almost 3 months later I have recieved a 'LETTER BEFORE CLAIM' from Gladstones Solicitors. This letter is dated 7th June, was sent 2nd class and I recieved it a week later?? Having done extensive Googling online I read there should have been a NTK before this? I cannot recall having received one of these. I will be trawling through all my post again just to make sure. They are asking for a payment of £150 or they will take legal action? The easy option would be to pay the fine, however the bay I had parked in was for a Carpet Shop, which was way past closing time at the time I got the ticket! Where do I stand with contesting the ticket? Looking forward to the advice and I appreciate it!
  16. hi all, I have received a fine from pcm ( parking control management(uk) Ltd. SL1 2XF. a pcn was not issued , but a person was taking photos of my car. this happened at hayes and Harlington station. They send me a letter by post with photographic evidence. saying a pcn was issued : (date) my question is are pcm taking people to court now? or should I ask them to issue the popla code.
  17. I have now received a letter from Gladstones on behalf of MET Parking asking for £162.50 for unpaid Parking charge. I received a letter MET Parking asking for £100 stating that I had ignored the first request. I have not ignored any ticket on my car, and never received the first letter, I wrote to them (Stupidly I did not do a recorded letter) received no reply, I have ignored Roxburghe's Threatograms but today have received this letter (Sent from Cornwall) To be honest I have had 3 tickets from MET Parking, one I appealed against and was successful I had displayed but not clearly, I produced to them Ticket and receipt and they allowed the appeal, but said that this would not be accepted anymore. I then picked up a ticket under the same circumstances and paid the Charge, I then received a ticket because I displayed an old ticket in the window my fault I paid (This I think goes someway to prove my honesty) I can prove via Bank statements that I have paid, I buy weekly tickets for The Car park at my local railway station, my first feeling is to carry on ignoring, just wanted to make sure, sorry so long winded
