  1. sent for cca did get back an application form which is signed then few weeks later newly printed terms and conditions with a letter saying these t&c were at time of account do these t&c not have to be signed by me is this right
  2. Hi all Just need a clarification around the statutory time limit for responding to a S77/78 CCA Request. Halifax have been chasing for a couple of years on an alleged credit card debt. In the last 2 years this has bounced backwards and forwards between them and Blair Oliver and Scott and is now with our old friends Moorcroft. Moorcroft have sent a fair few of their automated threatograms, from their "Pre-Court Division" and now from their "Home Collections Division". I have responded to that with a "you do not have my permission to send anybody round" plus a S78 CCA request. The CCA request was dated Monday (4th January) and posted by SD the same day. Due to the weather it was not delivered until this morning. (I am getting my money back from the Post Office!). my question is when does the clock start ticking and for how long? Is it 12 calendar or 12 working days? And from when? Monday when it was posted or today when they got it? Thanks
  3. Hi there everyone,.. I have found many threads on this DCA group and thought someone could possibly point me in the right direction? I have debts. .. Im currently using DMP by Gregory Pennington to pay off. .. thats all fine and dandy.. . have been using for 6 months but apparently they have to review every few months or so.. . so they have to re-negociate with creditors and so forth.. . fair enough... However, Halifax have recently sent one of my accounts to their in house team B.O.S, they have gone the whole way so far.. . text messages asking me to call them, 08456 numbers, which are obviously halifax, I am aware that B.O.S are just a subsidary of HBOS... Sorry im waffling now.. my issue is with a letter i recently received... "NOTICE OF INTENDED COURT ACTION" ... HFX vs.. ******me****** ... formal notice is hereby given that our client instructs us to commence court proceedings against u without delay... papers are now being PREPARED for commencment... -that old chesnut basically my issue is since i had their first letter last month, they have gone straight to this sort of letter.. . and I already have re-payment arrangements in place via DMP Gregory Pennington - so they are accepting payments... im just a bit confuzzled, i know not to ring them, as regardless of what I tell them IF i actually did ring them, they would only seek more money that I dont actually have... Im sorry If i have waffled on too much, but there must be someone out there who mite be in the same predicament as me?? BOTTOM LINE: i have arrangements already in place, all my other creditors are continuing and are acepting minimal payments which is great.. . AND the amazing thing, HAlifax have already accepted repayment plan for another account no problem.. .. but for some reason they have transferred this particular account (debit acount i believe) to B.O.S where they have jumped to this letter, even though payments are still being made.   4. I took out a Halifax credit card online pre 2007. It was £3 in credit in Nov 2007. In dec 2007 they sent me a new card attached to a credit card agreement unsigned by myself or them. What I did not realise then was that they had transfered the acc to a new acc along with the £3 credit. This has come to my attention as I was going to send them a CCA request in regard to my pre 2007 CCA. Has anyone any ideas as to what I should do ?
  5. After almost a year of requesting a CCA from Halifax credit card services' I received T & C's. Today I received what Blair Oliver Scott call an agreement as it has my signature. It's headed "Our Priority Reservation Form"consists of my details but there is a paragraph headed 'The Agreement" which states; CREDIT AGREEMENT REGULATED BY THE CONSUMER CREDIT ACT 1974 The parties to this agreement are Halifax plc and the applicant named above.I request that Halifax plc issue a card,PIN and cheque book to me and to any person named as an authorised user. I understand that Halifax plc may use credit scoring techniques to assess my application. You are authorised to share information about me and my account with other lenders through credit reference agencies and fraud prevention agencies in order to make credit decisions, trace debtors and prevent fraud. I have received a copy of and agree to be bound by the Conditions of Use. All information provided by me is true and complete. Then there is a signature box (signed) which states 'This is a Credit Agreement regulated by the Consumer Credit Act 1974. Sign it only if you want to be legally bound by its terms. I am not very proficient with the internet and am unable to post the form. Is this just an application form or an agreement as BOS are becoming very nasty. With Thanks
  6. HI ! ADVICE PLEASE I have a secured loan with the Halifax, currently owing approx £15k Until approx 9months ago, I had no problems with my repayments, which were £176.00 per month. Due to the current economic climate, I found I could not make these payments as I should on a regular basis. I wrote to them explaining my circumstances, using the letter templates on this website and enclosing a budget sheet. I offered them £41.00 per month; to which they refused to accept and told me that they would accept £160.00 per month. I asked them to reconsider and in the meantime, I`m paying them £10.25 per week, I`m still awaiting their response. I have just had an "agent" of theirs at my door - so I told him that I do not discuss such private and confidential matters on the doorstep and that I would only communicate in writing. I then reminded him that since he was on private property uninvited, he should close the gate on his way out. :???::???:What should I do......more to the point, what can the Halifax do:-?:-?:-?:-?
  7. Hi Im new to the site and am looking for some advice so apologies if this is posted in the wrong section. A few years ago I had a unsecured loan and overdraft from Halifax. I became ill and unable to work, did not have insurance and was unable to pay the outstanding money. Stupidly at the time I ignored the letters of demand and eventually they stopped. I obtained my credit file from experian about 15 months later and noticed that two defaults had been registered against me for each debt { the date of defaults was Aug 2002}. As far as I am aware this should remain on my credit file for six years from the date that the default notices were issued, can somebody just confirm that for me please? Also will it automatically be removed from my file or do I have to make an application to have it removed?? My main problem seems to be that since the deault was issued in 2002 that I have had no correspondence from Halifax at all, in fact I was not notified of the actual default notice, had the threatening letters which I ignored but never a letter to say they had gone ahead and filed one. The debt now appears to have been sold onto debt collection agencies, since 2002 I ve had various companies write and threaten home visits, bailiffs court action etc if I dont repay the debt, normally I write back 3 or 4 times explaining my position, inability to pay and request that they cancel the debt, I never normally hear back from them after about my 4th letter then normally 9 or 10 months down the line a different collection agency contacts me about the same debt and the cycle starts all over again. The latest debt collection company wrote to me this week and I have replied to them explaining the above, just out of couriosity I obtained a copy of my credit file and it shows the debt still listed as to the Halifax, same default date but says that is settled with a part payment, now I havent made ANY repayments so I presume this part payment is the payment received once my debt was sold on?? I can handle the debt agencies but my query is this, once the six years is up although the Halifax arent the ones chasing me will these debt agencies continue to keep passing my debt around?? None of these agencies are listed ANYWHERE on my credit file / report? Hope this all makes sense, thanks to anyone who can help me Thanks Jem x
  8. hi all.. i have defaulted on my halifax credit card . .they have been accepting 1.00 per mth for 3 mths.. they wouldnt freeze intrest or stop late payment fees. .im on benefits.. no assets in rented accomadation,no savings,absoulutly nothing,!! can i claim back the charges for intrest and late fees knowing they knew my situation ?? also im still paying 1.00 per mth ..when i hear from them again is it a good idea to ask for a CCA? cheers guys i love this site

  10. Sent off SAR request 29 January. They must be overworked 'cos I haven't heard anything. This is my problem? Sending off non-disclosure letter tomorrow giving them 7 days till I complain to the courts. Can't wait to see how much they owe me. It's a shame I have to use 2 envelopes 'cos my Sainsbury's data hasn't turned up either and the address is the shame. Hey ho

Hey Everybody I've been lurking on this wonderful forum for a couple of months now reading up on as much as possible whilst familiarising myself with knowledge through the conversatoins being carried out here - phew. I'm kinda stuck now but here's where I'm at: I sent my SAR's letter mid December and received all my statements first week in January. I'm now in the middle of completing Mindzai's easy-to-follow spreadsheet and looking to claim contractual compound interest at 29.84%. I have a Royalties Premier account. I selected Minzai's contractual daily rate sheet as the correct spreadsheet for this but after having completed all cells, the calculations are telling me for the period from May 2004 until present charged at an interest daily rate of 0.07% (29.84% annually): Total Penalty Amount Total Compound Interest £1917 £719 Total Combined charge and interest £2,636 Is this right as it seems a little low in comparision to other people's calculations for contractual compound interest even though I'm only claiming for just over 2 and a half years. Could one of you lovely maestros of Mind's spreadsheet let me know if i'm on the right track!!! Also, the column that says Date Of Interest, do I insert the date the Interest charge was Withdrawn or do I insert the period of the date the Interest relates to: ie. INT TO 21 APR A/C £10.94 7 May 2004 (do I insert the date as 21 April OR 7 May???) Finally, the cell that says SCHEDULE OF CLAIM FOR CHARGES: FROM: is this supposed to be blank as I thought it would have automatically put the date of my very first charge or does it only do this if you complete the Charges & Interest spreadsheet? Sorry to ask such spastic questions but I promise, I have read through the FAQ's and pretty much all threads under RBOS for more info on filling out these spreadsheets but couldn't see anything relating.
