  1. Dear all. My tenant are asking me to repair the rear fence. However, because of the different configuration of the garden behind us, our rear fence is actually the neighbour’s left hand fence. If this is the case, then are we still definitely responsible for this fence? The deeds do not say whose fence it is! Does anybody have any ideas please?
  2. Afternoon . Looking to see if anyone has had any success with the HBOS in regards to the ultimate reward packaged bank account . I opened one in 2009 and have noticed that i was paying for a card protection policy that would pay out up to £75000 if there was any fraudulent acitivy on my card after it was reported missing . My question is . as this card proection insurance was of no value (the banks having to already cover such fraud ) would including it in a package of benefits/insurances mean that the entire package was missold . Since the onus is on the banks to check that the products they where selling was suiitable . any replies much appreciated regards
  3. Hi, I am new here, but I have an issue that is cause myself and my family quite a bit of stress and I am hoping and Looking for a bit of advise. We have a Boiler service agreement/Insurance with one of UK energy suppliers for a Vaillant Boiler, and have done so for nearly 3 years. Now we have only had to make use of it once (in August this year they replaced the expansion vessel as pressure was dropping), but around a week ago it brought up an F75 error and would not heat central heating system or hot water. I immediatley called the customer service line, and they said they could not get someone out until after the weekend. So Monday came (after no heating or hot water all weekend), and the engineer turned up (different engineer to the previous 2 that we had - now both left the company). He dismantled the boiler to take a look and said this doesnt look good, and then said that it needed various parts, and that because the amount of parts that it needed he wouldnt be able to order them up without speaking to his field service manager. So he made some notes and looked at the water (took a sample - visual test) and said that the water appeared to not have any inhibitor in and should have in a hard water area. He then went out to his van to make the call to the field service manager who said that they would not be able to carry out the work. The problem I have with this is that I personally put inhibitor in the system (max of 3 years ago - which he said it needed doing every 3 years), our system also has an in line Furnox TF1 filter which I explained to him. This engineer said that there were notes on our account to say that they had seen scale in the boiler when did the first service but I was not advised of this (we have a booklet but most of the notes in the booklet are totally unreadable). The engineer also mentioned that two of the parts that need replacing have been an issue on this particular model of Boiler (which he has seen personally), and Vaillant have updated the parts over the years, but have not admitted there is a problem. So obviously what I am axtremely angry about is that we have been paying for this agreement, and all along they have noted that they have seen scale in the boiler and so could at any point use it to not honour a repair to the boiler if it was water related, but because nobody eveer told us of this we were not to know of the issue. Also the expansion vessel in a boiler obviously carries water and so why was this changed only 2/3 months ago? Should they be testing the water for inhibitor when they do a annual service and then advising if the level is low? I feel now right or wrongly the two previous engineers were the type of guys that just went for the easy life and didnt advise us of anything that may cause a future issue, and should the 2nd engineer have agreed to replace the expansion vessel if there was a water issue. It seems that they may have been doing us a favour short term, but obviously now it feels they may have let us down (conveniently they have now left the company), and then it would seem we have had the complete opposit guy attnd last Monday and he wants to do everything by the book. So if I wish to pursue this - do I stand any chance at all, and if so what should my stance be (as I feel there are several historical errors on there part)?
  4. 3 days ago vandals ran amok in our (quiet) estate. I had stupidly gone to bed without locking the door, leaving my bunch of keys on the table inside. Until 3 weeks ago I had a dog who let no-one in until he'd checked them out - he died suddenly, age 15y. Long story short, thugs came in (about 3am) took my cash and keys, drove my car round the corner and stuffed the petrol inlet with plastic bags and set light to it!!!! First I knew was police at my door in the morning asking where I parked my car....I pointed to my drive...no car!!....3 hours of statements, forensics, CSI etc. They said just to call my insurance. However, during 3 days I've learned a lot. Thankfully the milkman saw the fire, called the fire brigade and police so the fire didn't get out of control. I saw the car damage that didn't look too bad - mangled plastic burnt to a cinder and smoke damage to the body above. Forensics had to take it away for inspection and obviously I couldn't touch it. When I spoke with the insurers they mentioned the dreaded 'your car may be a write off'.....alarm bells. I love my car. It's a Peugeot 206 cc and I've just spent £700 on MOT, service, new brakes etc. Bought it for £2300 last year. I checked Glass's value:- trade-in £700+; Private sale £1600+; Dealer £2300+. Minimum values. So, I thought I'd just pay for the damage myself as the excess is £350. However, when the mechanic (at the garage where the police left my car) checked it he found the petrol tank is a complete unit (not in parts). A new one is approx. £1000. Therefore, with all this info I have a dilemma. Do I leave it with the insurers? Who will likely want to write it off. I know I have the choice to buy it back. But I've heard horror stories of valuations etc! Basically, I want my car back. End of!!! Or, do I buy a second hand tank (I've already had quotes for less than £100), let my garage fit it (they said 1.5 hours labour)? This is the most obvious choice but I've already had to pay for new house locks, hire car (insurers won't give me one until they've assessed the damage and AGREED to repair it). Financially, it seems I could come out 'quids in' if I go through the insurers and they write it off and I buy it back. I think it's classed as Cat C? But are there more pitfalls to doing that????? Apart from the negotiating bit....I'm not too afraid of that! Well.....usually... Thing is I don't want these thugs to win!!!! Any advice would be really helpful. PS. The paintwork is fine - I checked it myself. So, it's only the petrol inlet/pipe/tank. Oh, and the spare key to be reprogrammed and another key to replace the stolen one. I know how that's done.
  5. Hi, I hope somebody on here can steer us in the right direction before we lose our minds. My daughter was involved in a little pile up. A car two in front of her slammed on its brakes for no reason and the car in front of her bumped into it slightly. My daughter stopped and didn't hit anything but the car behind her didn't stop in time and hit her and the car behind that didn't stop in time and hit the car behind my daughter which caused that car to then hit my daughter's car even harder a second time. My daughter called the police because the car at the front and the one behind her quickly got out and checked their cars and drove off - refusing to be involved with the process. It turns out that the car at the front is putting in a PI claim. Police are now investigating them. The car that hit my daughter's from behind was a new car but turns out the driver hadn't insured it. She gave her first name and mobile number only both of which were genuine. She and her passenger were in a hurry to get away from the scene - either because she wasn't insured or there was something illegal in the car?? She then tried to avoid all consequences of the accident and even tried to sue to guy who hit her car even though he was insured but that's between him and her. She gave false addresses to the police when they contacted her and to the insurers when they contacted her. Turns out she's a law student. My daughter tracked her down using google and also found her new Facebook account which she's using under a different surname. She's definitely dodgy but we're not sure how other than her lies. Accident Exchange are watching her street to find out when she's around so they can confront her. My daughter has informed the police of all this info but they are frustrated in that the accident was in Surrey Police area but this woman lives in Met Police area and Surrey Police cannot just go to her house and arrest her. My daughter's problems started when her insurers - Sheilas Wheels - and the guy at the very end's insurers - LV - all started disputing liability. Several engineers called out and all give a ball park figure repairs about the same price. So SW decide to write off the car, and yet it's still ongoing with disputes here and there and claims for this and that and so on. Accident Exchange are involved and have got my daughter a replacement car as the one offered was no good for her needs which involve taking two baby seats in and out on a regular basis using the ISOfix system. SW have not replaced the car seats and have told my daughter to do so and present the receipts - well my daughter doesn't have £300 sitting around to spend on car seats, so the babies are still using the original ones. Her baby son aged one was in the car when she was hit but they don't care because there's no obvious sign of injury. My daughter got whiplash - genuine not just an excuse for a claim. Yet it looks like instead of repairing her car they are going to pay out almost what she would have sold it for, less excesses and so on. The accident was end July and her policy renewed in Sept. No renewal paperwork was received that we are aware of and now they are saying they will take approx. £1000 insurance fee from any pay out as this was the current year's insurance fee. Yet she didn't have a car since July. Does anyone have any advice on how to proceed with this? My daughter has been screaming down the phone to them again today, and is now saying that they must repair it (she can sell it for more than what they are offering to pay). She doesn't have motor legal protection, and I don't think they would have included it in the renewal. I have motor legal protection on my policy as standard but not sure I can use it for her (I'm with Co-Op). Help! please. thank you
  6. My daughter was involved in a "bump" some time ago when she was hit by another car at a roundabout. Their fault not my daughter's. Neither cars nor people were damaged but insurance company details were exchanged. On my advice she notified her company just in case a claim was made, they agreed it was in no way her fault. No claims were made by either side. However, my daughter's company has deemed it to be a "claim", lasting for 2 years instead of just a notification. This is now stopping her getting insurance from any firm for her new car, even though her No-Claims bonus was not affected. Is this normal practice and what can she do about it so she can insure her new car?

  8. My daughters BMW 1 Series car was stolen from outside her house back in March 2015. When it was recovered insurance company sent it for repair, so far so good. When insurance company returned car it was driving dreadful. (Car was fine before theft ) My daughter went back to insurers who were insistent problem was nothing to do with theft. After lots of arguing insurer decided to employ independent engineer who came to conclusion that insurer could not be certain damage was not caused by theft. Car was taken back and sent to a BMW dealer in Stoke to correct damage. When car was once again returned to my daughter she was told repairs had been done but car needed a de-sulpherisation to clear carbon build up which was due to wear and tear. My daughter accepted this and booked car into local BMW dealer (Manchester), when she took car BMW refused to do work because they said there was a fault on the engine and de-sulpherisation process could cause more problems. My daughter once again went back to insurer who again sent car to a BMW dealer in Stoke. It has taken all this time for insurer to come back to us and report that ' there is swarf in the engine caused by POSSIBLE oil starvation' and they are not prepared to pay for repair. We now know Stoke BMW performed de-sulpherisation process back in June. We have been told by various mechanics that swarf in engine could well have been caused by way car was driven when stolen can anybody confirm this. Insurance company have asked us to send evidence to support our argument. Where do we go from here my daughter has been without her car for 7 months. Any help would be greatly appreciated
  9. Colleague's boyfriend took the car and was speeding. (If it at all matters, he took out temp cover with another company). The insurance company Policy Wise has now sent a letter to say they want £250 or they will cancel the insurance policy. Just checking that they are able to charge this amount? Surely they have to have a breakdown of costs otherwise it is seen as a penalty?   10. Hi Folks 1st time up in court regards no insurance on driveing a car. Small print has Cort me out. Have fully comp insurance allowing me to drive any car.... Providing that car has insurance allso!! So have court appearance soon. Would like some advice as to wording my mitigating circumstances so as not to get hit hard with fine i know i will get 6 points. Also as question 2... The prosicution has set there cost at £85. They have worded it as applying for costs. Can this be disputed as to high?? Please advise as i have never attended court before. Thank you
  11. Hello, I am hoping someone could give me an idea as to where I stand, although I think it's probably nowhere... I renewed my car insurance with Adrian Flux in August, £830 for the policy and £200 to pay monthly by direct debit (premium credit). I would now like to cancel my policy as I've been quoted £270 (with the same underwriter!!), a saving of £560, eye watering amounts of money. I rang to see how I go about cancelling. I was told that I would owe the rest of the 12 months remaining balance minus the three I have already paid. However, my insurer would effectively pay a proportion of this... Ultimately, I owe £152. I have paid three £100 instalments, so £452 for two months insurance. Surely this is too much? How do I go about challenging this or am I stuck paying the final £152? Thank you.
  12. Millions of people, including motorists, home owners and pet owners face seeing their insurance costs increase. The standard rate of Insurance Premium Tax - the tax paid each time an insurance policy is purchased in the UK - will increase from 6 per cent to 9.5 per cent from November 1 The ABI said the change will affect 7.3 million car policies, 4.7 million household policies, three million pet policies and three million private medical insurance policies. Any of the affected insurance policies with a start date after October 31 will have IPT charged at the new rate. The ABI warned that the change is likely to add: nearly £13 to the average comprehensive motor insurance policy; more than £10 to the average combined building and contents cover; more than £10 to average pet insurance; more than £40 to average private medical insurance.   13. Hi I feel a bit silly at the moment but need some advice if possible please. I'm 54 and only got my license in April 2014. I have a few problems such as social phobia and other things was advised by people that having my own car would help me get out of the house more etc and be able to lead more of a life i tended to rarely leave the house as i cannot use public transport or walk where there are other people (I know i'm weird ) I did this and was so chuffed when i passed first time. I got a car with comprehensive insurance which allowed me to drive other cars. Around 6 months after that my oldest son bought me a newer car and i got new insurance which was comprehensive. Last week i was out with my teenage son at night in his small car. He's had his license for around a year. We were out taking photographs of various things for a course he's on. He started feeling a bit unwell and so i took over and was going to drive us home. A few minutes later we were stopped by the police as they said i was driving suspiciously. I was simply driving slowly trying to work out the best way home as its not an area i'm familiar with. They saw that the car was insured with my son but asked under which insurance was i driving. I said under my cars comprehensive insurance. They then said that not all comprehensive lets you drive other cars. A fact i didn't know. They let me go with my son driving and asked me to double check my policy and call them when i got home. I found my policy and in the small print was a sentence saying i could not drive other cars. I immediately called them and told them what it said. Also within 10 minutes of getting home and finding this out i took out a policy for the car in my name as my sons was due to run out and as a student he could not afford to pay the nearly £3000 policy to renew anyway and it allows him to keep the car on the drive until he can afford to insure it himself. The next day i got a call asking me to go to the station where forms where filled out and i was issued a traffic offense report ticket. Yesterday i got an offer of a fixed penalty of 6 points and £300. This will mean i lose my license and my life will severely curtailed as its the only way i can leave the house. It says if i don't accept i can go to court and plead guilty or not guilty. It also says at the top 'i refer to the traffic offence report ticket that was issued to you at the roadside' This is not correct. The police simply wrote in a notebook and asked me to phone them later. I was issued nothing official at the roadside and was given this paperwork the following day at the station where it was filled out in front of me. I was also only cautioned at the police station the following day Does this fact have any impact on anything? Also why have they said it was issued at roadside when it was filled in and issued at the station a day later? My point after the long ramble is whether or not i would be wasting my time going to court and if i have any mitigating circumstances at all that could lead a court to not giving me 6 points. A fine, a course, anything else would be ok as i realise the law was broken, even though i'd struggle with a fine it would be better than losing my license. I have 28 days to accept or not. Have looked online and seems to say i can't get legal aid for a motoring offence so have no support in this. Any advice would be gratefully received. I genuinely thought i was covered to drive it. I paid £1100 for my comprehensive policy on the other car. Thanks
  14. Hi folks, I raise a claim via my mobile phone insurer Lifestyle Group. This is underwritten and owned by the same people as #protectyourbubble (Assurant). I go through all the process and log my claim for lost phone. My policy says that it will be dealt within 1 day. After 3 days I'm told it's been passed to the fraud department. This is due to a system that told them to do this!! Eventually get phone call from this guy Sam in fraud. He is are that I have a disability and suffer from depression. He asks challenging and private questions. At all times I am told I can cancel my claim. I start doubting myself and cancel my claim. I make alternative arrangements and get a new phone. After looking on google about protect your bubble, lifestyle group, assurant, (most bank packed accounts) are dealt with by thes people. Anyway 8 weeks later I log a complaint wi them and suggest that the fraud department bullied me, had caused exasperated my mental health issues and brought back bad memories. I also said that I have been at financial loss due to the way I was treated. The company decide my claim was valid and we agree a cash settlement for the claim...Not for my complaint. They have now offered me £100 for my complaint and I am not happy to accept. Having rad the FOS guidelines they may have breached disability discrimination legislation. I have advised the company I require £1,500 compensation and that I have evidence of the way the treated me. All calls recorded, and agents advised at time. They say they have now reviewed there practise and changed. My question is using the FOS takes a long time.m I've advised I will take legal action. Has anyon had xperience with this company and what letter should I send them. The are discussing my request but I suspect they will decline. Any help much appreciated.
  15. Hi I had a call from my car insurer saying that I haven’t paid anything towards my policy for last 6 months, although I have a valid policy. I had a DD setup with them from my last year's policy, but obviously they have done something wrong and cancelled the DD during my renewal and kept my policy valid, only to find out 6 months into this year's policy. Now they are asking for last 6 months payments to be paid in 2 drops (which is their payment plan), on addition to start the monthly DD as of this month. Just to add to the mix, I had 2 accidents last January in which were still under investigation at the time of my renewal (Last April), so they dropped my NCB and gave me a higher premium until the 2 accidents are declared non-Fault then after I could request back a recalculation for the policy and can get some money back accordingly. Now the 2 accidents are declared non-fault and my NCB is 4 years. As this the insurer fault I told them that: I need them to recalculate first the policy again based on NCB for 4 years. I need the last 6 months to be re-planned over a 12 months period so I can afford to pay, and not to be paid on 2 payments as per their payment plan. I confirmed that I am willing to pay the last 6 months. They will get back to me within 2 days, however they assured me they won’t cancel the policy. Can you please advise: am I doing the right thing? I had colleagues advising me that I am not liable to pay the last 6 months as this is their fault, and they can’t come after me for the money, so is that true? I am feeling uncomfortable doing that anyway, but would be good to know as I am negotiating with them. Can I leave them and go for another insurer? Or they won’t give me documentation proving my NCB? Please help. Thanks
  16. Hi. Query regards driving other cars. I am insured to drive a Citroen c3. My policy states that i am allowed to drive other cars with the owners permission. Now how does this work when pulled over by the law if i am driving another car that has tax and mot but not showing any insurance.As the driver(me) is insured to drive it. If the car is sorn as not insured. Would the owner get notification of no insurance?

    received a letter from dvla saying im not insured.....phoned insurance company I am insured sent a copy to dvla recorded post, letter back saying fine stands as they checked with my insurers and im not insured phoned my insurers again im insured and they had no contact from dvla checked myself on MID online and it shows insurance, should I just let it go to court
  18. While insured with Tesco motor insurance, we've had 2 bumps. Both times, within months of the accidents, we've had accident and injury claim companies telephoning us on our unlisted landline number asking if we want to make an injury claim. Both times they knew every detail of the accident and our full names, address and all contact details. Do insurance companies have the right to pass on our private information to other companies, and if not, do we have a claim against them?
  19. I rent a ground floor flat from the Housing Association. There was a leak from the flat above (also circle 33) which poured into my cupboard over a period of weeks. (Just found out today after I noticed a stench which smelt like a gas leak). It has ruined the electrical items stored in the cupboard, but circle 33 has stated that they will make good the leak from above and damp proof my cupboard, but I will have to claim on my own insurance for the items damaged. Is that correct? I thought they took responsibility but I could be wrong......
  20. Hi, I had an accident in the middle of June, not my fault, which has resulted Devitt Insurance demanding £30 as they had to update my policy. I sent the following letter to which they responded by cancelling my policy in 7 days. Rather extreme I think and very unprofessional. I guess I have no option but to pay up. Am I being pig headed, is this now normal practice? Any advice? This does not amount to a change in my policy. It might constitute an update to your records, but you are a broker, it is part of the service that you provide. If it is not you should not be in this business. When, as a result of the accident, I insured my spare motorcycle the insurance company queried my no claims bonus. I replied to the request and you sent me an request for £30 for making a change to my policy. In this case I successfully argued that I had not instigated a change to my policy. In this instance I have also not asked for any changes to be made to my policy. Your policy is not fair and not in the spirit of your terms. I suggest that you contact the agent, recommended by you, who are handling my personal costs and forward a proforma invoice. When my costs are refunded then your very ridiculous charge will be too.   22. I've taken out an insurance policy. a term assurance one over 15 years thinking even if I still live over that we get a payout. I wanted one where I know there would be a definate payout.
  23. I have an insurance issue I haven't been able to resolve to date. The incident occurred just over 3 years ago. My vehicle was sideswiped in England by a Turkish driver / Turkish registered HGV. My vehicle was being driven by a US resident named driver on my policy. At the time the incident was reported to my Irish insurer for information only and an attempt to pursue losses set in motion using my ULR (uninsured loss recovery) insurance. Liability has not been settled. The only offer so far from the TP's UK handling agents is a 50/50. On the other hand, to date, no counter claim has been presented to my insurers. The claim has no personal injury element. The claim amounts to vehicle damage and consequential losses (car hire, taxis, accommodation), total estimate c. £5k Panel solicitor says to move this claim forward it needs court proceedings issued. Ultimate outcome could be anything (0/100, 100/0, 50/50), or TP may fold beforehand on the prospect. My ULR insurer doesn't want to pay for this avenue and suggest taking the 50/50. Panel solicitor says if ULR aren't paying, to take the 50/50. Now my feeling is that this ULR insurance is a waste of time: If the case is easy, then they'll do it. If it's hard, they don't want to know. I've handled two easy cases myself recently, so what is the point this insurance? I don't want to take 50/50 for three reasons: 1) It's not my/my named driver's fault 2) NCD would be affected and steps back 2 years 3) TP has not put in a counter-claim. In short, I think it would leave me more out of pocket than I already am. Doing nothing doesn't appear to be an option, as despite being zero, a claim is still open on my insurance which is affecting my ability to shop around. My NCD however is presently unaffected. What's the best way to conclude this issue? I would like to be put back in a pre-accident position, but accept this might not be possible or practical.
  24. Hi all Hopefully this is the correct place to post my problem.Sorry it is a bit long winded but am at my wits end now!! My current van insurance policy began in Febuary with Commercial Vehicle Direct(CVD) and underwritten by Ageas. In May I received a letter from the motor insurance database(MID) to say my van was not on the database and for me to take action. I immediately phoned CVD who told me the problem would be sorted out in the next few days so I thought nothing of it. I was pulled over by the police in June during the day because my reg plate came up as uninsured on the police computer.I was held in the police car while they phoned through to CVD to confirm that the van was insured. I immediately phoned up CVD and was told once again the problem would be resolved.I thought OK its probably an oversight and will get sorted. I came home on Monday to find a government wheelclamping contractors large yellow sticker on my windscreen warning me to insure my vehicle or be fined/clamped/seized. So I phoned CVD on the Tuesday morning and they tell me it will be sorted in 48 hours. 48 hours were up this morning and still I am not on the database! I phone back again.They tell me it will be sorted at some point in the next few days. I have phoned Ageas the underwriters today and they have told me I will be on the database by Saturday or the will speak to their IT department. I really feel I am being fobbed off everytime. I believe it is a legal obligation for the insurance company to register my details on the database and according to the lady on the MID phoneline are subject to a "subtantial fine" if they dont within a certain time. Meanwhile DVLA have issued me with a £100 fine! If my details aren't on the database by Saturday I dont really know what the next step is for me. CVD and Ageas are not fulfilling their side of the contract as far as I am concerned If anyone can shed any light on where I can go from here I would really appreciate the advice. Sorry for the long post but feeling very stressed by this right now
  25. insurance company have cancelled my policy due to going 10 miles per hour on the speed limit on my black box policy. they are not giving any option to keep the policy and not refunding any money. I am only a student an have nearly paid 1,000 for 4 months on cover. I have not done anything wrong. Please can anyone advise they have charged me £1000 for 4 moths. Please help Mashmallow
