Hi Please can you help me with regards to the above messages whether I need to start a new court claim with lloyds because I calculated the interest wrongly by £600 or can I just amend my claim as per 'amend your claim' thread , and can I make the amendment at the same time I ask them to restore my case. Also with another claim which I had going on with natwest at the same time before the oft case, and which I had only got to the 'letter before action ' stage, should I send another letter starting all over again, including interest ???? Sorry to sound so vague but having not even looked at any of this since the oft case I have lost my way a bit and need a bit of a kick start. Your help would be much appreciated as I am wondering is it worth all the bother after all the fuss with the oft and them possibly not winning after all cheers maggie
  2. aaaargh with reference to the case above that is stayed , I have just realised that I didnt calculate the correct amount of interest and I have a shortfall of about £600 of the interest on my claim, is there anything I can do about this or is it too late now
  3. Ok thank you for that . Just a couple more questions : My name ( reverted back to my maiden name) and my address have changed since then, would I still be able to go ahead with requesting they restore my case, if I also explain my new details of name and address in the same letter? Is there anyone in particular that I should address the letter to at the court in Cardiff. I was also in the middle of a claim with another bank and had got as far as the letter before action stage, what should I do about that situation ? Should I wait for the resulting oft case or go ahead and write another letter requesting a refund of charges ?

Hi I havent visited the forums since the oft test case and have been awaiting the outcome, but due to a phonecall I recieved the other day telling me to go ahead with my claim I thought I had better get some advice about it all. Basically I had a court date set for my reclaim and three days before my case was in court they put a stop to all claims pending the oft result. My case was stayed and has now obviously been cancelled due to the amount of time gone by. Firstly can I go ahead with my claim? Secondly I would like to know where I go from here to re start my claim. Do I start all over again and write to the bank asking them to repay all my charges? I would also like to know if its worth pursueing the hardship route that I have recently read about? cheers Maggie
  5. hello everyone i havent been on the forums for a long while now,pretty much since the oft case took effect back in august ,three days before my hearing was due to take place. I lost all my enthusiasm and believed the banks will always have the upper hand.But i realise i spent a lot of time and hard work getting my case to a hearing and now im thinking it would be a shame to let all that hard work go to waste. my case was stayed like everyone elses so where do i go from here? is it too late to request removal of the stay? please can i have some advice on this as im a bit out of touch with it all now:confused:
  6. My claim was one of the cases stayed in Cardiff court on Aug 14th. After learning about this I pretty much gave up on the claim with the feeling of whats the point as we dont stand a chance when this sort of thing happens anyway.But with charges going onto my account daily and quicker than i can pay them off I feel ready to fight again. Can anyone advise me on where I go from here ,is there anymore I can do or do I now have to wait for the result of the OFT case? Ive looked on the appropriate thread and Cardiff claims thread and cant make heads or tails as to what action if any I can actually take at this stage. Basically is there much more anyone can do AFTER a case has been stayed?
  7. hello all having been offline for a while after the stayed aug 14th cases i pretty much threw in the towel and gave up on my claim. now i feel ready to go for it again and i was wondering what steps to take from here. the last thing ive had was the letter from ccc telling me my case was stayed. what steps should i take now,do i oppose the stay at this stage or is it all a waste of time until the result of the oft case
  8. hello all having been offline for a while after totally losing heart over the stayed cardiff cases,im now wondering whats been happening and what i should i now do myself. i had the letter from the ccc telling me the case aug 14th was stayed at which point i threw in the towel,and gave up. now i feel ready to go for it again so can anyone please tell me what i should do first. do i oppose the stay at this stage and is there any other letter recommended i should send ? or is it all a waste of time until the result of the oft case
  9. cardiff court are no longer holding the hearing regaurding bank charges. i was told that whether i apply for the stay to be lifted or not ,there isnt a hearing at all,and none of it will make any difference. this is some justice system we live under
  10. cardiff court told me that as there will no longer be a hearing tomorrow any opposition of stays will not make any difference,and that everything will be determined by the oft case result
  11. ive just spoken to the court and they have informed me that as there is to be no hearings at all tomorrow and that it wont make any difference whether i oppose the stay today tomorrow or last week. the bottom line is that until the result of the oft case has been resolved ,nothing will be done with any of the bank charges cases

  13. and thanks saintly,im almost on the point of giving up on this whole mess. i have been on this case since last november and to be treated so unfairly at the very last minute making it impossible to fight my cause makes my blood boil . i really truly feel like theres no hope for me now and the only thing driving me on is the absolute determination not to let the banks keep getting away with this total injustice:mad: is this the only thing i can do is to write to my mp. surely the fact the court took so long to send my order for stay gives me some leeway
