  1. Have done the same though the barclaycall number 08457 345345 and Barclays sent me T&C's from 1995. I think I have binned them now but will try and get them again.
  2. Dont be suprised if they file a day or so late and the court lets them get away with it - this happens time and again and is incredibly frustrating. I doubt they would dare tell the Court that their letter got lost in the post - that is arrogant even for them!
  3. Kev - not much to say that hasnt already been said mate, other than if/when you file an appeal they better build a grandstand outside with a TV feed for the public gallery 'cos a hell of a lot of us will be there to see you get your money! Keep the faith

  5. Hopefully the judge will change for the new date - also, Kev's appeal will be done by then and the amount of flack this judge is getting may well have made her reconsider the case. I wouldnt worry - I am sure Barclays will settle anyway - the case yesterday does NOT set a precedent (either generally of for Ms Cooke). Barclays will not rely on lighting striking twice.
  6. You can write back to the Court and explain why you cannot attend and ask them for another date (you should copy Barclays) or you can ask somebody to attend in your place. I think you could also call Barclays and explain and ask if they would consider settling as this is so close to the court date anyway (it worked for me, in slightly different circumstances). Say that you will request the court for a date before your holiday which may, of course, be too soon to give Barclays time to settle..... Whatever you do dont just not turn up!
  7. Here we go then - last bank/credit card claim (other than the Barclays "over 6 year old" stuff....... SAR sent some time in Feb Prelim sent some time in March (never acknowledged by Abbey) LBA sent 14 days ago Called Abbey last week to give them a kick - the customer service person who spoke to me claimed to have "a diploma in law" (is that like a mother in law?) and lectured me for a few minutes about why I was wrong and they were right. She told me I would not get any money - I told her to look up my/Mrs C's 2 sucessful claims - she did and then said they were "exceptions". She asked why I really wanted to go through all the hassle of filing in court, and if I waited for 8 weeks then the complaints procedure would surely resolve something amicably. Told her I was filing 14 days after my LBA was dated, through the HMC online site. She then admitted that she hadn't heard of MCOL! MCOL submitted today Will let you know how it goes

  10. Would call the person dealing with your case - they will transfer you if not but that may just delay things (they arent that good at ringing back!)

  14. Without seeing how you have worked the spreadsheets its hard to tell, but normally the "overdraft" interest is at least as much as s69 in my experience (unless your o/d rate is very low!) One thing I would recommend is to rename "overdraft interest" to "interest applied on charges"

PPPP - I hope, like everybody here, that the Lloyds TSB case today was a one off (and wouldnt mind betting that the guy wins on appeal) - that makes 4 (i think) court wins to the banks out of tens of thousands of claims - not a bad hit rate. Keep the faith - if you dont have a court date I doubt Barclays will pay, and I would let the dust settle on yesterday before you do call, as I am sure a lot of people have been unnecessarily panicked and started calling to settle. I am carrying on with my pre 6 years claim against Barclays and dont see any reason to be concerned that one case, in a court that cannot set a precedent, should affect me. Dont forget that there have been many more cases where these have gone to court and the judge has ruled, usually in absentia, for the claimant
  17. Once you are into MCOL you just have to wait, I'm afraid - a phone call after you have a court date may work, but unlikely to change anything before then...
  18. It looks like a clear typo to me - call the court and ask them what teh date should have been and ask them to reissue

  20. PK - I wouldnt be shy about calling Barclays now - you have a court date next month and I am sure you told me you had a holiday coming up in early June so if that is still on it will be awfully difficult for them to get in touch with you...............
