Thanks Steven, The cheques have been cashed but we had a letter from Natwest (not Cobbetts) offering us monies after the court date and they said that they had written to the court, this is why I think that the court made the decision that they did. So not only are Cobbetts making offer's Natwest are too. How come they do not know what each other is doing? Don’t answers I already know the answer!!!!!!. Thanks Steven.

Thanks Sreven, I needed this to satisfy my own mind but I will also ring the courts and explain to them. I thought Cobbetts were pulling a fast one on me as the letter from court said they received a letter from the Defendants and we only got there letter on the Monday due to a postal strike here. PLEASE ADVISE I have reciveda letter from my court today saying "Before District Judge xxxxx sitting at xxxxxx County Court then the address, Upon neither party attending and upon reading a letter from the defendant IT IS ORDERED THAT CLAIM STRUCK OUT. I agreed with Cobbetts the evening before our court date (time of hearing was 10.15am the next morning) a settlement figure so my husband took the form N279 (Notice of Discontinuance) to discontinue to the court the morning of our court date and due to no one being in the office he was told to post the discontinuance form in a post box. I have banked the cheque, can Cobbetts now take the monies back of us? We have a letter from Cobbetts saying that they agree as a goodwill gesture. Please advise as soon as possible. Hi Tony, Thank you for that. Cobbetts sent one of these forms to me with typing on and this is crossed out. Our Court case is at 10.15 this morning but we settled about 6.30pm last night. awaiting another email from Cobbetts to confirm one condition. I will look at this form now and add all my conditions onto it and I will make sure I will put PART SETTLEMENT, is this the right word to use? Kind Regards Smiffie

"WE WON":p Hi everyone, Spoken to Cobbetts and we have agreed on total amount which we are really happy with, we also got them to email us (which they did in seconds) to change conditions and add on more money yipppppeeeeeeeee. We will be banking the cheque tomorrow and we will be receiving another cheque. What a polava (I know I cant spell properly but who cares when we have just beaten NATWEST. Sorry Steven about this, The charges are £5352.69 and Interest is £2775.31 with Martins calculator but with the CAG spreedsheet the charges are £4183.88 and the charges are £965.16. The difference is the original spreedsheet I added Interest for Unarranged borrowing. I have left this out of the CAG spreedsheet. The difference being £2978.96. Hi Steven, I have just done the spreedsheet and the Interest is £965.16. Natwest said what I gather they are not disputing the charges, am I right from the letter below? The charges are £5352.69 plus the spreedsheet interest calculator of £965.16 = £6317.85 Can you confirm that this is right please? Would you also read what Cobbetts put in the letter as my husband and I are reading it differently. Your help is really needed. Many Thanks Smiffie

HELP URGENTLY REQUIRED I have today received a cheque from Royal Bank of Scotland but not for the full amount. I have also received a letter from Cobbetts today stating that: As a gesture of goodwill, our client is prepared to settle the element of your claim which relates to Overdraft Charges on a non-admission as to liability basis and offer you the amount of £x,xxx.xx in full and final settlement of part of your claim. The statutory interest that you have calculated does not appear to have been calculated in the correct manner. The statutory rate of interest is calculated on a charge by charge basis, and accures from the date at which each charge was incurred. Therefore we have re-calculated the statutory interest inccrued on your charges. Our client, National Westminster Bank PLC, has forwarded a cheque to you directly in the sum of £x,xxx.xx. Acceptance by you of this goodwill payment will be strictly on the basis that: You agree not to disclose to any third party the fact of, or any details relating to, this payment; you write to the court withdrawing your claim. Please note that any Overdraft Charges that properly accure int the future will be applied to your account in line with our client's published tariff and in accordance with your agreement with our client. In light of the fact there is a hearing listed for 31st July 2007, we would ask that you now write to the Court and discontinue proceedings, requesting that the hearing on 31st July 2007 be vacated. We have attached two copies of the Notice of Discontinuance, and we should be grateful if you would complete the copies, forwarding one to the Courts aan the duplicate to us. LOL. Typed letter up and will take it (Hand Delivered) to court on Monday and I will also send a copy to Cobbetts (only if I have to). I have written to Cobbetts with the court bundle and asked them to send me the t&c going back from 2000 up to date and they have not sent them to me. Thank you Micheal, Thank you for your reply, I got onto the website after creating an account and loging in, then I had to open the link up again. I really do not want to give Natwest any more time as this is not the first time for Cobbetts to get the paperwork in on time. I would just like to file for the defence to be struck out and I will send a copy to Cobbetts. Has anyone drawn up a letter to write to the courts to ask for the defence to be struck out? I have just gone onto my online bank account and Natwest have cancelled all my Direct Debit's and they have used the money I put in to pay off the Natwest Personal Loan and overdraft without my consent . I have just telephoned the branch vbmenu_register("postmenu_1018915", true); and they said we need to speak to the Lending department, they say they have not but all looks odd from were I am sitting. Just a further update: I have contacted our local court to see if they had received the court bundle from Cobbetts (Court should have received it by 4th July), the courts informed me that they have not got the court bundle from cobbetts and adviced me to write a letter to the judge to ask for the case to be struck out for none compliance of court order against Natwest. Would someone please be kind enough to reply. Natwest have just taken off our overdraft without letting us know, can they do this? I though they had to give us notice before they could do this? Please would someone reply URGENTLY. I put a substancial amount of money in our account to pay of bills and they have used this to pay the overdraft. We have court with them on 31st July.
