Thanks Steven, The cheques have been cashed but we had a letter from Natwest (not Cobbetts) offering us monies after the court date and they said that they had written to the court, this is why I think that the court made the decision that they did. So not only are Cobbetts making offer's Natwest are too. How come they do not know what each other is doing? Don’t answers I already know the answer!!!!!!. Thanks Steven.
  2. Just some advice and help with a letter please. I eventually got through to the court today and I have been informed to write a letter to the judge of explanation (to say we did everything right) Any advice please. I think this may be an appeal? Thanks all Smiffie

  4. Thanks Sreven, I needed this to satisfy my own mind but I will also ring the courts and explain to them. I thought Cobbetts were pulling a fast one on me as the letter from court said they received a letter from the Defendants and we only got there letter on the Monday due to a postal strike here. PLEASE ADVISE I have reciveda letter from my court today saying "Before District Judge xxxxx sitting at xxxxxx County Court then the address, Upon neither party attending and upon reading a letter from the defendant IT IS ORDERED THAT CLAIM STRUCK OUT. I agreed with Cobbetts the evening before our court date (time of hearing was 10.15am the next morning) a settlement figure so my husband took the form N279 (Notice of Discontinuance) to discontinue to the court the morning of our court date and due to no one being in the office he was told to post the discontinuance form in a post box. I have banked the cheque, can Cobbetts now take the monies back of us? We have a letter from Cobbetts saying that they agree as a goodwill gesture. Please advise as soon as possible.   7. Hi Tony, Thank you for that. Cobbetts sent one of these forms to me with typing on and this is crossed out. Our Court case is at 10.15 this morning but we settled about 6.30pm last night. awaiting another email from Cobbetts to confirm one condition. I will look at this form now and add all my conditions onto it and I will make sure I will put PART SETTLEMENT, is this the right word to use? Kind Regards Smiffie

  10. THANKS STEVE. No but thank you for your help. I think I am able to give our 3 daughters some money now for passing there exams. I will spend wisely might even open an account with Natwest as I have heard that they are quite a good bank "NOT". lol. Good Luck all luv Smiffie

"WE WON":p Hi everyone, Spoken to Cobbetts and we have agreed on total amount which we are really happy with, we also got them to email us (which they did in seconds) to change conditions and add on more money yipppppeeeeeeeee. We will be banking the cheque tomorrow and we will be receiving another cheque. What a polava (I know I cant spell properly but who cares when we have just beaten NATWEST. Thanks to everybody that has given advice I would have not done this without your help. Good luck to the rest of you who are still claiming I will be keeping a good eye on you all.   12. Steven, Is there anyway I can email you the CAG spreedsheets for you to have a look at? Not sure if this can be done from this website. I am still worried about tomorrow though, I am not sure if I just read from the Statement of Evidence or what!!!! I do not know how to start the conversation with the judge.   13. Sorry Steven about this, The charges are £5352.69 and Interest is £2775.31 with Martins calculator but with the CAG spreedsheet the charges are £4183.88 and the charges are £965.16. The difference is the original spreedsheet I added Interest for Unarranged borrowing. I have left this out of the CAG spreedsheet. The difference being £2978.96.   14. Hi Steven, I have just done the spreedsheet and the Interest is £965.16. Natwest said what I gather they are not disputing the charges, am I right from the letter below? The charges are £5352.69 plus the spreedsheet interest calculator of £965.16 = £6317.85 Can you confirm that this is right please? Would you also read what Cobbetts put in the letter as my husband and I are reading it differently. Your help is really needed. Many Thanks Smiffie
  15. Hi Steven, Thank you for your reply. I calculated all the charges then I put the total in Martin Lewis Calculator and this added all the interest. I am just re-calculating now with the spreedsheet on CAG. I have court tomorrow so what should I do? Many Thanks Smiffie
