  1. hiya so far first direct and nationwide have both refunded before court all my charges in full. Barclays are a bit tougher. Am waiting for a court date - have just returned the allocation questionnaire. Can someone tell me if I need to copy every section of the relevant acts for my court bundles - don't want to waste the ink if not necessary though have a funny feeling it might be. thanks sm4423
  2. hi - am at the same stage myself - doing the MCOL now. Feels scary but great to do it! First Direct paid in full after just two letters - so Barclays are holding out, like the nationwide - but the fact that Barlcays have offered something makes me feel like they know they're wrong! Anyway - to court we go. Can I ask - did you file their address as the Leicester head office - or the Swansea customer relations address?
  3. We're going to accept the offer. Thank you all for your help. Mad Nick - thanks, I agree that £1000 is worth asking about - hence this thread! But I don't want to risk going to court and the banks winning - couldn't bear to lose the money twice to them (thats what it would feel like). Hey - had no idea we could claim back this money til 6 weeks ago - am chuffed to get the charges back. Thanks - shall donate - and raise awareness and tell everyone I know that they can do it too!   4. Just a quick note to say that First Direct have just offered us all our charges back - just under £3000, and didn't have to file court claim. Missed out on the interest -but am happy! When rec'd - will donate to this site - has been so helpful / informative - THANKS
  5. Thank you - that answers my question! In which case we shall consider this a win for us! Does this mean that banks are getting wise to letting it get as far as maing a court claim? Seems a bit unfair that they get away with not paying back the interest they must've made on our money! Still at least we're getting out charges back. In this case, I'm happy!   6. Sorry if I'm not explaining myself very well -or just being really thick! :? The 'full amount' I have requested in all but my first letter is the charges plus interest. In which case I shall go to court for the whole amount. But in my very first letter I didn't request the interest back - just the charges. So would this be regarded as the 'full amount' in law? If so, does this mean that I have no claim on the interest as I didn't include it in my initial letter, even though I have included it in all my subsequent letters? Basically, I mean have a blown it by not including the 8% interest in my repliminary letter?
  7. Oh, I haven't got as far as court yet - their offers have come after my intial letter, my reply to that, and then my LBA! I have given them until 13 Jan before I start a court claim. Are you saying then, that I do not have to accept this offer - I can carry on and take them to court as my subsequent letters included a demand for interest (at 8% as per spreadsheet)?
  8. One of my banks has made another offer - for the return of all the charges from the two accounts - but not including the interest. Great, except as the interest is nearly £1000 it matters to me - but in my very first initial letter I hadn't worked out the interest and just asked for the charges back. Does this mean I have to accept their latest offer? I have written several letters since and enclosed schedules of charges which included the interest, but the banks replies do not mention the interest. I need to know whether I have to accept the offer - don't want to go to court and find out that I can't claim the interest because my very first letter didn't include it. Anyone help?
  9. Hi everyone, Me and my OH are taking on Nationwide, first direct and barclays who have all at one time or another charged one or both of us over the past six years. Am just about ready to take FD and B to court (I think!) but a little behind with nationwide - as they took the longest to send us our statements, made the biggest fuss about doing it - and their reply to my initial payment request letter has so far been the rudest, most patronising, even threatening in nature. Woah! They really don't like all this do they . Still won't put me off - Am about to send LBA to nationwide and relish taking this as far as needs be Am waiting for the small claims pack to come with info about filing court claim - but any tips about this next step gratefully rec'd. So good to read others' successes!
  10. Hi everyone, I have banked with Barclays since I was 14 and always thought they were fair - yeah right! This has really opened my eyes to how unfair the whole system is. . and to how much they owe me! Initially requested my charges back and got a letter within a week offering half back. Um!. . must think I've got a case then. . So have set an LBA. Will see what happens . .
  11. Hi everyone. We have been charged over £3000 by First Direct over the past few years, despite only just going over the overdraft. Of course each month on go their charges taking us right back over it again. Sick and tired of patronising lectures and telling off's whenever we contact them about it, no practical help and ridiculous charges. Have sent them initial request letter and received a fob off for a reply - so sent them LBA. Have now downloaded N1 form and am waiting for small claims pack for info about going to court as the 14 days will be up soon. I am so goin to take this all the way! (might have to borrow the court costs from my dad though! lol:) Think the interest spreadsheet is brilliant. Have only just discovered it - should I send another letter including another schecdule of charges with the interest or just leave this until I go to court now? Fingers crossed.
