  1. oh, ok, I didn't think of the fact that their defence might be that they'd paid - I guess I always tend to think the worst! How did they pay you? My Flexaccount has not been used since they stopped all activity on it two years ago - I really hope that if they do pay me they don't simply dump the money into an account I can't access...
  2. I went onto MCOL on Thursday and it now says: Defence You are unable to take any further action online on this claim. The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly. So, what happens now? Do I receive paperwork by post?
  3. Hi Caroline, my court claim for the FlexAccont charges is already in progress with MCOL and the deadline for them to pay or defend is Tuesday, so hopefully I should get that money pretty soon. When they finally get their backsides into gear and send me the Classic Visa statements I'll start the whole process again with them. It matters not to me if I get my money back in one, two or even ten installments - as long as I get it back!
  4. ok, but if they do enter a defence won't it show up on my MCOL page? I also feel that they've had plenty of time and that if the boot were on the other foot they wouldn't be giving anyone a few days grace...

Update to my message above: I got a response from the ICO who said they would be contacting Nationwide about their non-compliance and have now received a letter from Nationwide saying that the ICO has informed them that I have made a complaint and asking me to confirm that I still haven't had the info that I requested in my S A R. Their letter then goes on to say that if the request is still outstanding they will send the info asap. I've waited 5 months already so I won't be holding my breath!
  6. I'm back from my holiday and Nationwide's 28 days are up on Tuesday. I haven't heard anything more from them or the court since the claim was acknowledged and they said they would defend, so is there anything I should be doing now or should I sit tight, do nothing and then work my way through the 'Judgement' section of MCOL on Tuesday?
  7. In response to my LBA, RBS have made me an offer of approximately 25% of the amount I am claiming. They have said that they will repay this to the account (which is closed so that would be pointless anyway) and if I accept it will be full and final settlement. Of course, I have no intention of accepting but do I need to write to them and decline or do I simply go ahead and start my MCOL claim?
  8. Does anyone know anything about this lot? I've making debt repayments to Logic for quite a long time when suddenly the direct debit started being paid to EOS S (but with the same account reference number) and their tactics changed - i.e. from being quite polite and reasonable in accepting my repayment ofers, they rang me out of the blue to demand an increase to the payments I am making. Needless to say, I refused to deal with them on the phone, wrote (to Logic) and complained about bully-boy tactics and told them not to phone me again or it would be deemed harassment and reported as such. I can't seem to find much out about them though and was hoping someone else might have had some dealings with them.
  9. Hi NailPost I reported them to all of the above as well as Ofcom at the same time as I complained to TS. I've had acknowldgements of the the complaints from Ofcom, OFT and ICO and will update as and when more info is available.
  10. I'm also having a bit of a battle with Nationwide over my credit card charges in that they are refusing to send me anything at all relating to that account. They say that the credit card account was closed in 1999 and is therefore too old to reclaim on but I was using that card right up to being made redundant in 2004 (when my finances fell apart and put me in the situation of having all these charges to reclaim) and despite me writing to them about non-compliance of my S A R three times as well as reporting them for non-compliance to the Information Commissioner, they still haven't sent anything relating to my Visa card! They did, however, send me a full 6 years worth of statements and charges for my flexaccount. I'm reclaiming on that one and have filed and been acknowledged via MCOL.

Further update: I spoke to Peter Skevington and he asked me to send him the transcript of the phone message so that he could take that plus the copies of my letters that my local TS office had forwarded on to him along with him when he went to visit Meritfarce on my behalf. While on the phone he said that the Newcastle TS office had really not had very many complaints about Meritfarce and that given the nature of their business they seem to be fairly well regarded. However, he was most interested when I told him that I seemed to recall reading somewhere (here!) that they'd recently been taken over by Mackenzie Hall and commented that he'd had cause to look at them on occasion and that he very much hoped that Meritfarce were not going to adopt MH's less than desirable practices! I've now had a letter from him saying that he had discussed the situation with one of Meritfarce's directors who had requested copies of my letters and the mesage transcript and would investigate. I have been asked to let Mr Skevington know if Meritfarce contact me again and he'll let me know when they get back to him.

On Saturday I got the notice that they'd acknowledged the claim on the 1st of May and am a bit confused because I thought from reading other Nationwide related threads that their solicitor was Charles Bacon but my Acknowledgement of Service states that they intend to defend all of the claim and that documentation relating to this claim should go to catherineprice@eversheds.com of Eversheds LLP, 1 Callaghan Sq, Cardiff CF10 5BT. After reading so many of the 'success threads' that mention e-mailing Mr Bacon a day or two before the 28 day deadline seemed to be the catalyst for repayments to happen will the fact that it's Eversheds make any difference and should I still e-mail Mr Bacon or Catherine Price or not bother? Also, I've not used my Nationwide Flexaccount for well over 2 years, which was when things went badly belly up for me and they simply stopped all activity, although they never told me they were actually closing the account. Anyway, I have no idea if the account is still open and how to access it if it is! So, my question is this - how do I make sure that they pay my refund by cheque so that I can put it into the account I choose (namely an ISA) rather than it going into a possibly defunct Nationwide Account and me having to fight on to get to it? Any advice would be most welcome.

  14. I got this e-mail from them today: Dear Thank you for your enquiry. We are aware that the online system had a 'glitch' for a period of time and has incorrectly dated a number of claims, those submitted on 26th and 27th April were dated 13th April. The online and court systems have been corrected and a corrected claim form will be sent to the defendant so that they are aware of the correct response times.   15. ok, so I filed with MCOL and Nationwide have acknowledged the claim so I guess it's 28 days and counting. Any advice on what to do next would be greatly appreciated.
  16. I finally managed to get through to them this morning. Apparently the whole system had a bit of a hiccup last Thursday and Friday and logged everything under the wrong dates. I was told they'd sorted it out and re-issued the cliam and that a new Notice of Issue would be sent.
  17. I submitted and paid for my claim against Nationwide using MCOL on Thursday night (26th April) and yesterday I got my Notice of Issue letter. However, the letter states: Your claim was issued on the 13th April 2007. The court sent it by first class post on the 13th April 2007 and it will be deemed to be served on the 18th April 2007. The defendant has until the 2nd May to reply. I'm really confused by this - how could it be issued and deemed served before I submitted it?
  18. Yup, they certainly did - but for only one of the two RBS cards they were dealing with. As for the other one, they immediately wrote a letter saying 'we're no longer dealing with this account, it is back with our client' so obviously there was no CCA to be found for it... I have to say that, on the whole, my experience with Moorcroft has been a polite and positive one - unlike some other DCAs (Meritfarce for instance) they've never been heavy handed or over the top with their demands.

Update time - Moorcroft actually came up with the CCA for one of the cards they were collecting on so I'm still paying them for that one but, for the other one, I just got a letter that said 'We are no longer dealing with this account'. Needless to say, I cancelled my standing order for the payments to it immediately.   20. Time to revisit this one. I managed to get them off my back for the original reason for this post, but they've resurfaced having taken on one of my RBS cards from Moorcroft http://www.consumeractiongroup.co.uk/forum/general-debt/56411-endofmy-tether-moorcroft.html I immediatey hit them with a CCA request (if Moorcroft couldn't supply it neither will they!) and they've acknowledged it and told me the account is on hold while they refer back to their client.
  21. My LBA is going off to them tomorrow, it's not a huge claim but it's MY money and I want it back! Watch this space...
  22. Update: the nice helpful person at my local Trading Standards office has given me the contact details for Peter Skevington at Newcastle TS. She spoke to him about my complaint and told me that he's said he'll talk to Meritfarce on my behalf or may even visit them. I just have to ring him to give him the go ahead. I left him a voicemail today and hope to speak to him tomorrow. Thanks also to DJDave - I have got the answerphone message on my laptop now as an MP3 so can either e-mail the file to Mr Skevington if he wants me to or can post CDs with it on to him, the Information Commissioners Office and the FSO Meritfarce have sent yet another letter since all this threatening me with a home visit if I don't pay up. They are lucky that Newcastle is a long way away or I might have been tempted to pay them a little visit

  24. ok, I sent in my LBA and I have had a second bog off letter that says it's all my own fault and that if I am having difficulty managing my account they may be able to agree to give me a bigger overdraft! This is a bit rich considering that they froze all activity on my account 2 years ago! Anyway, I'm about to file with MCOL and have some of questions about the Particulars of Claim. 1. I can't recall when I opened this account (it was probably nearly 20 years ago!) so can I leave that bit out? 2. Do I need to list the cost of filing the claim or will this be added onto the settlement and repaid automatically? 3. Do I list the £10 fee that I paid for the Data Protection Act S.A.R - (Subject Access Request) info (which they still haven't fully supplied after 4 months!) or will it be repaid automatically or can I not get this back? 4. I know I can't claim for my time spent on sorting this out but can I reclaim my (multiple) recorded delivery and postal order fees (I have receipts) and if so, where do I put these amounts? 5. As the account is dormant (possibly closed by Nationwide - I have no idea) can I stipulate that any payments are to be made by cheque?
  25. Hi Nailpost, I am still going to make a complaint to the FSO as advised by my local Trading Standards this week because it's for a breach of the DPA and I was told that this is now under their jurisdiction.
