  1. They failed to pay out on the PPI when you needed it therefore mis-sold. IMO claim back all of the PPI paid plus the 8% statutory interest you are allowed to claim. Cancel the PPI on the agreement and YOU MUST ENSURE YOU HAVE COVER FOR YOUR LOAN VIA A CHEAPER OPTION. There are companies who will cover your mortgage payments at a much cheaper rate but check out all of the small print on the terms and conditions before making a committment.   2. The fact you had the loan written off due to flawed loan agreement with the balance being written off IMO puts you in a strong position to get back the PPI plus the statutory 8% interest. I do not have the full details so do not know how much was written off by welcome the amount written off from the agreement means that you obviously had made some payments on this flawed loan and if it was written off then IMO you should receive back any PPI element of payments made until it was written off plus the 8% statutory interest from the date the payments were made until a settlement is agreed. I would check with the FOS on a reclaim as I believe you would be in a strong position having had the agreement declared void.   3. I cannot help you out here if you make a claim via the Financial Ombudsman Service they will use a formula to calculate what you are due in a refund. You should be able to claim the PPI added to the loan including the interest but you will not be able to claim any compound interest over the loan period only the initial interest added to the PPI at the beginning of the loan. You should however claim the statutory interest at 8% on each and every payment made from the date the payment was made each month until such time as a settlement is agreed via the FOS. I hope this helps. It seems to be a bee in the bonnet but you will not be able to claim the contractual interest rate on any PPI you have paid. good luck aa

  5. It appears that the loan of £999.99 has no PPI attached as the 12 monthly repayment figures of £83.33 add up to the loan figure without PPI being show on the agreement. The insurance product code shown on the document as D 1 1 does not appear to bear any connection to the added payment protection plan which is shown as no figures on the agreement. IMO there is no PPI applied to the agreement shown in the Photobucket agreement. aa
  6. You need to do some research but IMO you would no doubt have a claim on the PPI issue as 90% of PPI policies have according to the Financial Ombudsman Service have been mis-sold. I believe the CCJ issue to be irrelevant the main fight here is the PPI mis-selling. Also see this link as HFC have already been fined over PPI.

  8. The FOS advise against Claim Recovery Companies. Whatever you may think about the FOS (most grumbles are I believe about the time taken to resolve complaints and the fact the FOS will not entertain claims for contractual interest.) The FOS is an easy way to claim your mis-sold PPI money back. Gather the information fill in the form with as much detail as you can and leave it up to them. I believe there has most probably been more PPI claim money returned to consumers by the FOS than going through the Courts. There are good points to both but for the Litigant in person I believe the FOS is a fire and forget solution. The FOS on a recent radio programme stated they were aware that there were probably 2,000,000 people still out there with PPI policies that were mis-sold. Time to get some more money back then aa
  9. You could try an approach to the Financial Services Compensation Scheme. The have managed to recover money from Picture so give them a go you have nothing to lose. If you have sent a SAR with the fee and they have not responded you should complain to the Information Commissioners Office for their failure to supply information under the requirement of the Data Protection Act 1998 link here...   11. YES I believe it is the FOS using questionnaires to keep a tab on their method/s of dealing with complaints my wife received one for one of her complaints. It is most likely a way of providing bench marks to ensure they are up to speed on the massive increase in complaints. They were caught out once with a lack of staff for the mountain of complaints and will most likely not want to be put in the same position again. The way PPI is though there are millions of folks who will still have valid claims. aa
  12. Do not believe all you are told you should chase up whoever signed the Consumer Credit Agreement so if the agreement is on paper with Ocean finance stamped all over it that is who to pursue. Additionally chase whoever is taking the monthly payments including PPI on your Direct Debits. Banks blame brokers and vice versa it is a ploy to try and wear you down. So chase them for 8 weeks then submit a complaint to the FOS it takes a while but there is no worries over more paperwork, fees etc aa

You may wish to consider claiming the PPI was mis-sold and getting the money refunded plus the 8% statutory interest which you can claim back.   14. I would suggest another complaint to the FOS if you do not get a satisfactory response about restructuring. Make it a separate complaint from the original one as it is a complaint not about mis-sold PPI but their failure to restructure the loan and give you the opportunity to carry on making payments. Letters first then complaint. Remember each complaint to the FOS will result in a fee being charged against TFC and it is £500

Want your money back? use these links to help Start with study, gather the information and then claim back your PPI. If you have a valid reason to claim mis-selling (Most people do have a valid reason as it was widely mis-sold) then ask for the PPI to be repaid including the statutory 8% interest if you get no satisfactory response then submit a claim to the Financial Ombudsman Service. It will take a while but 90% of claims are being upheld in favour of the consumer. aa

  18. Have you complained to the FOS yet? PPI is thin on the ground for site team members and I have been absent for personal medical reasons so am unable to be on the site every day or even every week. I would suggest you go to the FOS with your complaint the banks generally sit up and take notice. I had an ongoing claim with barclays and all I got was "we are not in a position to answer your claim at the moment" this went on for weeks so off to the FOS settlement just received a couple of weeks ago over £4.5k by cheque so keep at them and us the FOS as I did. FOS results so far over £23k in PPI refunds aa
