  1. I have, First five years from Barclay's (mistakenly believed that five years was the max in Scotland at the time) then Mint Credit card with contractual interest at 19%. I'm currently waiting on Barclay's statements back to 1996 and my Barclaycard statements but they have decided to flout the DPA so it may take some time. Stick to the plan and you will get your money back.
  2. Where did you get this from? You will get your money back. The banks are swamped at the moment and seem to be imploding slightly. Have a read around at the terrible shambles they are becoming. Have no fear, when court proceedings are issued they will start acknowledging things.

  7. It seems to be sporadic knowledge held by the better CS personnel, the chaff haven't a clue and one actually hung up on me when I asked for my information prior to 2001 I wonder if there will be a cover note in my 'fiche copies when they arrive.

    From conversations I've had with American friends, the law is very different. We get a relatively decent time of it from the banks if my small sampling is anything to go by. Fancy being charged for cheques? Not encashment or processing but the actual cheques themselves. Credit Unions seem much more prevalent though, a good thing from what I gather.

  12. I've been haring round, trying to find the equivalent section of the Prescription and limitation act (Scotland) 1973 (as amended) to S.32 of the Limitation Act 1980 all night. Am I correct in thinking it is Section 11(3) as outlined in this case report? "Prescription" From paragraph 4.

  15. I couldn't say with any certainty but I'd say as each one applies to a different subject then it will have to be two cheques. Oh yes, Mint will cash the cheque too, grabby sorts that they are. Thanks very much Westy, it's strange how this has turned into a weird little hobby. That and all the evangelising about it to anyone who'll listen .

Just start a Hazy v Mint thread. Good luck. The OFT didn't 'recommend' £12 to the CC companies, they said anything over that would result in serious trouble. The CC companies have settled on the maximum they can charge without a serious talking to and are trying to fool us into believing it is in some way mandated by the OFT. Claim all, if they are willing to show you the true costs, pay them.
  17. I've not heard anything about that. I did however, receive an unexpected letter this morning advising me that a further credit has been applied to my account. They've basically coughed the lot Rather happy with that. Keep me posted on your case Milly.

  20. Thanks a lot Jos, it seems like a fair old while to me too . It seemed to accelerate nicely at the end, they seem to cave a little quicker in Scotland.
  21. No, the OFT ruling is widely used by the banks as a smokescreen. You should get back anything that is more than the liquidated damages of the bank. If they refuse to disclose the true figure, they should pay back the whole charge.
  22. Thanks a bunch guys, it is a particularly sneaky tactic but they've at least left a toehold by refusing to refund the latest £12 charge. I wait with bated breath

  24. I'm offshore at the moment but I've received a letter, at home. It seems the sneaky folk at Mint have credited my account with all the charges (except the most recent one for £12 which sparked my decision to chase them) but have left off the interest. I'm a little concerned now that this will make things tricky if I try to pursue things to the court stage. It seems that I will be pursuing them for interest alone. The fact that they've not paid the most recent £12 charge may be my saving grace as I can pursue that (despite their erroneous statement that it 'falls in line with the recent OFT ruling' ) Does anyone have any input on this?
