  1. Hey Guys, about 4 months ago had £80 refunded, i kept fighting and got today £445 more refunded including Please do not stop..Please keep fighting;)
  2. HeY Hell, I am sooooo happy..Pamela is more than just brilliant...I was..reading..and reading and reading...everything she wrote is so important... I was printing the pages of the thread and reading at work, on the train, back home...Pamela managed to involve so many people, i would never get so much help on my own: Such a great team...   3. Hello Guys, Hope you are all well.. Just a quick update: Pamela and others finished my Reply to Defence which looks sssssssssooooooo good. Pamela is very intelligent and knowledgeable, and without her my initial claim would be a total falier. It was such a hard work, but i am very greatfull to Pamela and team for completing it.   5. J, she has to phone tomorrow and discuss with the person that sold her the loan. I am more than sure the agreement is not properly executed...Tell the seller that it would be reported...and phone head office Ian Orill and discuss it with him, as it's legally incorrect!!!
  6. Hey Hell, I am reading some info that Ink have posted. Very intresting and soooo new to me...WF admitted that the agreement is not properly executed in their defence...but as i am claiming whole amount of loan back, loads of work has to be done... It's hard for me because of being foreigh...using merriam webster site alot now:))))))))))))))) Pamela knows soo much!!! Once again i can't believe my luck to meet so many intelligent and knowledgeable people like Pamela, yourself, Ian, Dave...and many others...May...Carina...( how is Ian BTW????) xxx
  7. Hey Guys, No, i am still here:))) Spent some time doing nothing as feel had enough of those replys from banks....moving slowly but still moving... Now, i have received amended defence from Welcome...Good, but not good enough:))) AQ has to be submited by 28th of Augest. Now, going to have that cup of tea( took me some time to read the defence) Hope you are all fine. Mich, Vamp is not helping anybody anymore and closed her chambers so, only one person can help with spready is Bill-K... Regards, Maria
  8. Dear May, Well, N 244 is a request for the amendments, you do not need to be very specific. If Judge accepts the request than you will amend your POC and than you have to be very specific. Michael Brown some time ago advised me to send 3 copies of N244,amended POC and spready to save some time. I did it in other ways, as Pamela advised: sent N244 first explaining why you want to amend you case( just points) and than i had sent POC when N244 was accepted. Depends if you are sending your amended POC with N244. Good luck:) xx

  10. Hello May, You do need to demonstrate your point as you want to show that your claim needs a reopening on other grounds. Just relevant parts of the ACT. As your claim based on same agreement you should put in N244 that ''at the time you file your initial POC you wasn't aware about some extra points( list them) and you were aware only about one course of action( unfair charges and default)'' Since than you have discovered and can show now that the relevant credit agreement was improperly executed due to the ommision of ''prescribed terms'' as defined by CCA and wish now to seek a declaration from the court ( put extra point you have found and want to focus on them and reffer to the ACT) Include that you have discovered that you have a statutory rights that the court consideres reopening the agreement( again add those points ....I had extortionate credit bargian.) and you can show several grounds on which agreement can be considered......add your points in last section add: Having regards to the overiding ojective of the Civil Procedure Rules, you respectully request that the court permits the inclusion of these issues in revised claim form and POC and than the court permits the defendant to amend the defence accordingly. In my N244 i had only 5 main sections( Pam helped me with them).I had listed 3 of them above that are suitable for your N244. I hope you are using extortionate credit bargian point. What i didn't know that i have to pay for the amendments and new AQ:))) But i am happy i had amended it:))) The decision is yours:) x
  11. hello, Just received an other reply from Vodafone: Buzby and guys, To pay that amount i had to take a loan with 44.50% Apr as noone else would had given me with lower rate. I still do not have a breakdown of that charge. I do not have a copy of the agreement and the only one i have monthly charge is for £33 only. In his previouse letter(A Chandler's manager) So this is it. Plus i had received a standart letter saying that thay will take 14 days to come back to me. So far: - still no breakdown of charge - default was recorded for wrong amount and i HAD suffered from it as i couldn't get any financial help with a better APR. Can i ask for a compensation???? - it doesn't seem like they will send me a copy of the contract or a copy of the one after it with monthly charge of £58. - I do not remember taking a protection insurance.   13. Dear Hell, you made me laugh:)))))))))) Well in my case i had sent a letter claiming contractual with all those neil biting costs and they refused to pay a penny. So this is me thinking to get a copy of the agreement and file a simple N1. When i spoke to them Ms Smith said that to get contractual i had to go to court:)) I wanted to say to her -i had just been there and didn't like it at all:))) My Creation claim is still going....going to the court stage....   14. Just an update, I had received a letter from halifax credit. They are not prepared to refund me anything at all. I will send a CCA request. Question is: did anybody claim through court fees for time spent on the preparation, postage etc. I am claiming contractual as well. Thank you. Kind reagrds, Itsme

  16. Hello Tanz, Iitially i had filed an N1 with 20 sections: very large and detailed but it was only about claiming PPI back. I had received very basic defence and a conterclaim for £500. Than i found Consumer agreement or aplication form thread and met Ink, DaveFireworker, Zubo and BIll-k. Ink straight away pointed that my agreement is not properly executed as it doesn't have a total amount of loan and Dave pointed that the APR- is an extortionate credit bargian( CCA). Ink took over and created N244 with updated POC. Initial speady that i got from Vamp is amended by Ink and Bill-K as i have now 3 points of claim: PPI or PPI and extortionate APR applied to the account or PPI, ext APR and not properly executed agreement...BIll is kindly finishing spreadsheet that includes these 3 ways of claim. You can ask Ink, in the thread( not in this one))) she can explan you more clearly, as my written english is not very good on the paper:rolleyes: .... As Ian, said in his thread, that CAG is watched by banks...etc and i am not going to give more info that WF already knows, but you are more than welcome to PM or use privite facilities on the OTHER thread:)) xx

  19. Hello you, I think you are giving them more than enough. Give tham only 7 days to reply...I do not think this letter would make a big difference. I always advise to call tham and discuss the court route rather than send other SAME LBA... It seems ok. Good luck. Itsme

  22. Hi Fuzzi, I totaly agree with you and think same way that Ms C is very unprofessional. Therefor i had sent a letter to CEO of Vodafone. I have not time for the timewastes. She was wasting my time and i am going to speak to her manager about it.... She did remove my default, but the statements u had received didn't have what i requested and as you said it's hard to itemize what those charges are from and how they were culculated. She took 2 month to get me almost nothing and i am very annoed... My contract life line charge is £33, but i never had been charge this ammount( half of year £28.92), THAN THEY HAVE INCREASED THIS AMMOUNT AND THAN THAY ADDED 1/2 EXTRA LINE+insurance and itemised bill charges.... You can post your statements only if you uploaded it in a photobucket, and than post a link here. Human, thank you for the info, they have removed default, she confirmed, she also admitted thay do not know why default was recorded for the wrong amount. I am trying to understand if Vod is resposible for all the mistakes and overcharges that Singlepoint put on the account? Thank you regards, Itsme
