  1. Hi, thank you for your reaponse. I can't believe they can get away with this. Fair enough take my home which is nothing more than bricks and mortar. However I do take exception to 2 adults 38 years worth of possessions and everything a 2 year old child has or needs can be just smashed up and thrown on the tip when all they had to do was call me and say. Hi Mr Carter if you do not remove your items by this date we will be disposing of them. I also find it funny that all the electricals of value were the first things to go to the 'tip'. Flat screen tvs and dab radios etc were one of teh first to go. I'm now wondering if they are panicing somewhat as they oddly brought as much stuff as possible back to teh house albeit smashed to pieces.They clearly have not displyed their chattels notice properly and they were also stringing me along by sending out a means form to see about negotiating moving back in upon clearing of arrears and 3 months up front. I could never go back there now. Passport gone, driving licence, bank books, cheque books. They have totally screwed up my life to the max. Just adding things up roughly I estimate £65000 worth of goods destroyed.(that may sound alot but you try adding up every single item in your home) It is not like they have gone in and there is a stale matress on the floor and a pedal bin which would indicate the house was empty or abandoned. It was exactly as if a family lived there. Which we did. Our family home. To top it off we had over 40% equity in the home and they'll probably sell it for peanuts and send us a bill. Regarding the disposal of goods how do I sue them for breach as the eveiction was clearly not carried out properly. Can county court deal with this at all amount to such a high amount of damages sought?

  3. I lost my home due to repossession on the 17th February 2011. As the judge ordered the eviction for the same day I had no time to remove our furniture etc. I called the estate agent who was keeping the keys to say that I have been able to arrange a van to remove the families things. They told me I better hurry up and get round there as they were in the process of throwing it out. I immediately rang the mortgage company to get this stopped and they claimed that there was a notice on the door saying there was a time bound notice requiring me to remove things or they could remove them as they saw fit. I arrived at the home to find all there was left was a bookcase, rack of CDs, dishwasher and washing machine. Everything that we have worked for was gone or smashed up on the back of a tipper truck. Childs nursery and toys, GONE, other two bedrooms emtied, living room furniture , every pot, pan, knife fork. My driving licence, passport, family photos. EVERYTHING. i informed the mortgage company that there was definately no notice on doors or windows until the house clearer showed my a notice stuck to door with a metal shutter put over it giving me not a cat in hells chance of seeing it. We are tyruly devastated that we have not only lost our home but everything it including jewllery and ireplaceable things such as war madals etc. Can I and how can I take action against Redstone Mortgages. We have nothing but the clothes we stand in and a couple of kind neighbours have bought the little one clothes and toys. Please help.
  4. Hi, My family and I lost our home last Thursday. We are in negoiation to try and move back in to the property upn clearing of arrears and 3 months paymets up front. However when the judge granted the eviction to go ahead (3 hours before the bailiffs arrived) he informed me that the goods inside the home would be kept safe. Bear in mind this is all the possessions of 2 adults and a 2 year old cjild. All I had time to do was grab medication and a few clothes. Sure enough the bailiffs and locksmiths arrived on cue.. They removed all of the windows to put these metal shutters up and left teh exterior doors open too so the shutters can be bolted to walls inside the property. These shutters have thousands of little holes drilled into them. They let me in to the property the next day to collect my debit card. The house was freezing and you could feel the dampness as the cold wind sweeps through the gouse. My question is does the property management company have a duty of care to our goods which may be further damaged with teh cold damp conditions? The property management owner told me we have 14 days to move the stuff out but if we can negpiate moving back in it is pointless. If they had just changed the locks and kept the windows in it wouldn't have been a problem but I'm worried about damiage to our electricals. Please advice???
  5. To be a brief as possible my partner and I have a serious financial problem. My partner took out a wonga loan and sucessfully paid it back in June 2010. Fast forward to this morning and Wonga have charged our debit card over £1000 leaving £40 the last the next month. The bank (barclays) will not help us as they say we must have given them the card details and wonga say they will investigate the issue. The investigation could take up to 6 WEEKS and there is a Mortgage, council tax etc about to bounce. Please tell us what we can do about this? Wonga had no right to charge our card and they certainly have no right to hold our money while they look into it.
  6. Hi thanks for response. Yes he has the car but I've been to his house and I'm meeting him for cash tomorrow. He even handed back spare key until then. And yes both me and my Mum both bank with Coop bank so transfer was instant. My Mum is really upset that they took the money without even calling to tell her. She got a shock this morning when she saw her state pension had gone in but was still overdrawn.
  7. I know that I am writing in the barclay thread and not the Coop but the coop thread is so rarely used that I hoped I would get an answer here. I sold my car last week for £4000 to pay my elderly Mum back for helping us out of debt. The guy who bought the car paid by cheque so I told him that I would give him the car once the cheque cleared. I paid the cheque in on Tuesday 13th July. Immediately my balance showed the £4000 in account but NOT available balance. My account showed the same until Friday 16th which then said available balance. Using the internet banking service I transferred £3700 into my Mum's account. Obviously Mum was happy to have saving put on an even keel and went and spent £1200 on a holidayautolinker.com autolinking image for her and Dad. This morning the cheque has been returned and the bank have taken the liberty of taking the £3700 from my Mum's account which will have put her £1200 overdrawn straight away. Surely I'm liable for that money until I sort it out with the guy who bought the car and not my Mum. How dare they access her account without her permission. She has been with the bank almost 30 years and never been so much as a penny overdrawn. What with my daily radio therapy and my Mum's weak heart this has caused all matter of problems.

  9. Yes it is for Council Tax. I did ring Gateshead Council and explained i was ill but they said it was too late as it is in the bailiffs hands. However I didn't explain to them that I was being treated for cancer. thank you ; )
  10. Last year I foolishly allowed Rossendales to enter my property for a walking possesion order. I fell behind with their unrealistic demands and on December 23rd 2009 the bailiff arrived to empty the property. My Mum wasn't going to allow them to empty our home at Christmas so she paid them off thus closing the case. I haven't worked for over a year due to cancer in the jaw and my partner lost her job in March of this year. We subsequently fell behind again with our council again. Rossendales have quickly picked up the case this time and a bailiff arrived on Friday saying if I paid £250 and signed a walk in agreement he would enter a payment plan. I informed him that due to having my fingers burned by them last year that I would not allow him in to the property. He said he could force entry as he has been in the house before. Of course this was for a totally seperate case which was settled. He has said he is returning this afternoon thus giving me the weekend to stop being silly and think about how much more it would cost if he forces entry. Can he break in? I'm worried sick, i have my radio therapy at 3pm this afternoon but i'm terrifieed to leave the house.

Maybe I am too late but i just can't get over the fact that my car is gone forever and personal property within the car too. I foolishly took out a loan from the Gateshead branch last July 2009. I was making the payments on time up until November when I lost my job, drastically reducing the amount of income into the family home. I asked if I could make token payments until I found work. I was asking if I could pay about £50 per month instead of almost £200. Basically the manager refused that amount and the threats of repssession started. Anyhow, on January 21st of thsi year 2 big lads came to my door and said they had come for the car. I had friends round at the time and not wanting to cause a scene in front of them I handed over the keys. He told me to contact the office about getting the car back. I rang them up and they told me that they would keep the car for a month before selling it. They wouldn't allow me to bring the account up to date they only wanted full and final settlement. After about 3and a half weeks I managed to raise the cash to get the car back so I started calling them to arrange pick up. Everytime I called I would be put to voicemail after a couple of rings. I left a message saying I had the cash and when could I pick it up. The next day I recieved a text of all things saying sorry but the car is sold we tried toi contact you on numerous occasions without suscess so we had to sell the car. A cheque for the difernece is in the post. I was absolutley devastated that my car had gone forever which then made me think well at least I need my personal possessions back. Desigener £200 long distance glasses and a copy of fifa 10 for PS3 and some CDs. Once again the voice mail tactics started so I sent a text. Within a minute I recieved a text back saying there was nothing in the car except rubbish. The next day I recieved a cheque for £700. The total repayable was £2000 and the car was worth at least £4400 (Parkers Glass Trade Guide). A week later I recieved a letter from DVLA saying that they received notification that I ha dsold the car. Well I certainly didn't sell it nor did I sign the log book so I suspect that they forged my signature. Is there anything I can do to hopefully (a) Get some personal recompense or (b) get the buggers closed down for theft,fraud whatever? Please help!!!

  13. I suppose that I should've also included that I haven't even got a new job description. Obviously I must be doing okay as I've either found my feet and took to the role well or blagged my way through.
  14. In our local press there was a story of a youngle married couple who bought a car in good faith. It turns out that LBL stilled owned the car and the couple lost out on the money paid and the car. My experience of them is terrible, I know it's all well and good saying don't give them the car as they don't have this and that but when 2 bailiffs that look like UFC fighters snatch the keys from your ignition, you call the police and police back the bailiffs, what can you really do about it except try and get the money together.
  15. Hi, I have worked for the same company now for 4 years but in two different roles. The first 2 years and 10 months I was a community worker but then moved in to a role which was more strategic and operational. My first role as a Community Worker I had a contarct within 3 weeks of my probationary period ending so when my probationary period ended on my current role I asked for my new contarct. They told me they'd sort it out. For the past 8 months in every line management session I have asked about my contract and they are saying 'its pretty similar to my old role so just adopt from that'. The job is TOTALLY different to what I did and I'm worried thay could just drop me like a bad penny without a formal contract. Is there anything I can do without P***ing my manager off too much. At the end of the day it aint much to ask for. Any advice appreciated... Cheers Neil
  16. As you may have read in an earlier post I had a problem with a cheque vouncing which sent me overdrawn. I also have another account wwith The Co-op which my regular wages goes into. What I'd like to know is, Can the bank take that money from another account to compensate the overdrawn account? Th ewages went in yesterday and they haven't as yet. I wish to propose paying back £50 per month. Will they normally settle for this? Thank you
  17. AAAARRRRGGGHHH! I think I'm going to explode. I fit kitchens and bathrooms locally and a few weeks ago a customer who I know personally whom I did a job for paid me by cheque to the sum of 1400 pounds (Cant get pound sign on keyboard). The agreement was that she would pay me 1400 last month and the remaining 1000 this month. As it happened the cheque bounced due to a genuine error with her employer messing up her wages. This lady is due an amunt of money from her divorve and she showed me the solicitors letter showing she would receive 32000 today 9th July. So on Monday gone I paid the cheque to the full amount of 2400quid in to my account. In the mean time I've had to borrow a couple of thousand from my Mam to buy supplies for jobs etc. I'll get to the point then, this morning my account has been credited with 2400 and I have transferred 2000 straight into my Mam's account through internet banking. The account now shows that the money has left my account and as she is a co-op bank customer the transfer is immediate. Ten minutes ago the lady that paid me the cheque has informed me that due to solicitors delays the cheque will bounce. I wouldn't have done it but I did read the solicitors letter saying how and when it would be transferred. This is going to put me 1600 in the red. What I want to know is, what will the co-op bank do about this? Will they take the money from my Mam's account or will they chase me or the lady with the cheque for the money? What tactics will they use in a scenario like this? Please help, cheers. Neil
  18. My God I feel sick to the pit of my stomach. I have just checked my balance over the phone to see if my wages have gone in yet and found that they have taken back an unpaid cheque for £1469 putting me £1399 overdrawn. I paid the cheque in last friday for a job I did for someone and the funds cleared on Tuesday which I withdrew £1400 yesterday (Wednesday 11th). Surely if the bank have cleared the funds they can't just take them back? Now my wages are due in any minute now and thats going to put me about £40 in credit. I have my mortgage, council tax and all these other bills and living for a full month. What can I do, please help as I feel ill. Thank you

That day it was extremely windy, in fact it usually is as it cuts between 2 exposed farmers fields. I specifically remember because a roadworks sign blew out in front of me just 400 yards past the van.
  20. It was definatley the same van that clocked me. It's a little half mile stretch of road between a 60 mph and a 50mph road. The location and everything matches even right down to the time the journey would've taken. I'm worried that its my speedo as the first time i knew I was clocked the speedo read 38ish yet I was clocked doing 43mph. How can I prove this. I hoping a right minded magistrate would believe that nobody is stupid enough to get done twice. I was of the belief that speedos read 10% over so when I sat the speed counter at 30 I thought I would be doing 27mph. The car is a 2005 Ford Focus. Does anyone know of common faults on these?
  21. Last Tuesday i recieved a phone from my daughters school saying she needed collecting as she wasn't well. I drove round a corner in to the sights of a mobile camera unit. I knew I'd been clocked speeding as my speedo suggested 38ish. I applied the brakes but hoped that the copper was having his flask of tea or something but sighed and resigned myself to the fact that I'd probably get done for it. I picked my daughter up from school and headed back home knowing fine well that the camera van would be there on the return route. I sat the car at exactly between 30 and sometimes went just under on the air of caution. Today I received 2 notices of intended prosecution from Northumbria Police. he first claims to have clocked me at 43mph in a 30 zone and the 2nd claims to have clocked me 20 minutes later doing 35mph. Now I aint saying the police are wrong on the first as I knew I was speeding but as for the 2nd why the hell would I speed when I knew the van was there? Its not just the £120 that sticks in my throat its the 6 points. My job dictates that I can have no more than 3 points so I can see this causing problems. Please advise
  22. Sorry, to add to Zak3737's comment I was the very first person in the queue at check in we got a taxi to the airport to beat the coaches and ensure that the cabin crews promise was honoured. Had I of been last i wouldn't have expected any other as they probably would've been allocated.
  23. You are an unsympathetic lot. Yes I could pay for extra leg room like jam pot does but why should you have to pay to not feel crippled with pain. Also some of these seat are not pre-bookable And someone is going to get these seats free. Thats my point why should I pay when others will get them free. In my experience easy jet are best because as long as you get there early enough you can sit where the hell you like without additional charges. Come on tall people of the world unite! We pay extras all of our lives with clothing, king size beds etc but to having to pay for summit that others get free sticks in my throat.
